Hello. My name is Officer Estrada with the Palm Beach Gardens Police Department. The reason I pulled you over is because when I observed the rear, you were unable to maintain your lane and I'm getting calls about your driving. Oh, I'm sorry. I was texting my husband. Okay, so you were on your phone? Do you have your license, registration, proof of insurance? Is that what you're telling me you're on your phone while you're driving? I was you didn't ask me if I was being truthful. Cuz I was coming back from Publix. Okay, and do you have insurance on this vehicle? Yes. Okay, do you have it on you? I can pull it up. It's on your phone, what's the company? Uh Progressive. All right, I think you should pull that up, yeah. All right, ma'am, would you please step out of the vehicle so I can explain some things? Okay. All righty, so like I said, the reason why I pulled you over is because I was behind you and I observed you were like taking up two lanes, so you were failing to maintain lane. And also I received a 911 call on how you were driving. And they specifically gave out your tag. So I'm issuing you a a warning just for that, failing to maintain lane. But because of the fact when I came up to you on the driver's side, you did say that you were texting your husband, so I'm issuing you a citation for driving while texting, okay? So you have within 30 days to figure out what you want to do with the citation. You can either pay it and the instructions are in the bag. You can either pay it, you can fight it in court, or you can So is that a a ticket? Yeah, it's a ticket. Okay. Okay, and I got to ask, where are you coming from? I'm from Port St. Lucie. Port St. Lucie. Okay. All righty. And did you show me your insurance? Not a one of them. I just need one second. When you find it, just show it to this officer right now. Okay. So, what were you doing from there to here? Okay. Is that where you work? Okay. No, it's just a guy I work with sometimes. Gotcha. Gotcha. When he cuts trees, I help him. And you showed him the uh insurance? Yeah, I did. Okay, then. Cool. Cool. All righty. So, I like even showed him the text message from my husband. Yeah. Whoa, no worries. I mean, you got to realize, this is a very, you know, busy road, Northlake. And especially when it's 65 mph. Tell him the name of the uh Ayala. Ayala? Ayala? Yeah, I know him. That's my one of my best friends and his all his sons. Oh, yeah. They play for Gardens PD. Oh, okay. All righty. My son's in uh Palm Beach Gardens soccer. Okay. That's cool. That's cool. Do you want me to like call him? Okay. No, you don't need to Tell him who I am. No, you don't need to make phone calls. No, that's fine. Okay. Yeah, like at the end of the day, like I just showed him the text message from my husband. He's upset that I'm coming home late. Gotcha. Okay. Well, so I'm just going to keep it real with you, okay? I have an officer who does DUI investigations. He's en route here. So, right now, from this distance, I can smell the odor of alcohol emitting from your breath. I have not drank anything. I have iced coffee Okay. purchased from McDonald's. Okay. Well, I mean, I can smell it from this distance right here. I swear I haven't drank anything today. You don't have to prove your points to me. I have an officer that's going to conduct an investigation. He's going to handle it from there and then, you know, if he deems you're not under the influence, you're good to go. Okay. All right. Just stand by. Since you said you didn't have anything to drink, are you diabetic at all? No. No. I can show you my ice coffee in the car. No, I saw the ice coffee. I mean, that's that's not my concern. It's just the odor of alcohol coming from your breath. I haven't had any alcohol. Driving pattern and the call I received, you know, just out of concern of your driving. Are you saying me doing like getting the DUI officer involved? Is that what you're asking or like why I pulled you over? No, why you have a DUI officer. Oh, no, because I can smell the odor of alcohol. That's why. So, I smelled that and then your driving pattern as well. I definitely haven't had anything to drink. Well, it's just an investigation. Like I even just tried tied my shoes in front of you. I didn't fall or anything. Okay. I mean, that's just one task. I mean, your driving patterns, too. Yeah, but I just showed you. in here. So, if you could just put your phone down so you can just follow the instructions here. Okay. I don't understand what why it's it's difficult to use your mouth. No, cuz I told you Okay, look look, here's the thing though. If you're not If you're not husband. Okay. But if you're not under the influence, if you Can I Can I explain? If you're not under the influence and you dispel my fears, then you're good to go. There's no need, you know. I know, but I'm already in trouble, so that's okay. All righty. I have been a verbal abusive husband. I can prove it to you on text messages. I don't know if I should tell you. All righty. So, Bridget, do you understand English? The English language? Just got to confirm. Okay. What's your highest level of education that you completed? Uh 12th grade. Okay, and graduation. So, a high school diploma? Yes. Okay. And what do you do for work? Um I'm actually on disability right now because I got bilateral pneumonia in February and I had a 15-year culinary degree. Mhm. Uh I was an executive chef for J. Alexanders and I've been on disability for bilateral pneumonia since February. Got you. And I've been doing this as extra money. Got you. And do you have any medical conditions? Just the bilateral pneumonia and a heart uh condition. Okay. So, that's just Just educate me a bit more. I mean, I know the heart condition, but the pneumonia, is that just affecting your breathing? bilateral pneumonia, um all of my organs started to fail. I was in ICU. I was put on a ventilator. My heart started to fail. My lungs started to fail. Everything. Okay, but that doesn't affect the way you can drive and walk and fine motor skills, correct? No, I've been getting better over time, but my pulmonologist has not cleared me to go back to my the environment that I'm in. Okay, but does that affect the way you drive? I can drive. Okay. All right. Um do you have any injuries currently? No. No? I got my knee scraped today by working. And I have I cut my finger today. So, you just cut your finger, you scraped. How did you scrape your knee? Yep. How did you do that? Uh by I was doing landscaping. Okay, okay. All right. And are you comfortable in the shoes you're wearing cuz I know you were driving barefoot. I was cuz I don't like the boots but I didn't want to Okay, well I'm going to conduct an investigation so it's up to you. You can either have your shoes on or off. So you're comfortable with the shoes you have on? Okay. All righty. All righty, so like I stated before, I can smell the odor of an unknown alcoholic beverage. Okay, okay. All right, so You you haven't even been near me so that's it's coming right off. It's I'm telling you. so Bridget, here's the thing. I'm going to explain everything again. Reason why I pulled you over is cuz I saw you failing to maintain lane. I received 911 calls on your driving and immediately it's a bit odd as soon as Can I Can I talk? Can I talk? Okay. Texting and driving is still not okay though. No, I understand that and that's why I admitted it to you. And then another concernment of mine which is a bit odd. As soon as I pulled you over you quickly smoke take a smoke break. Okay, I don't know if you're trying to I don't know if you're trying to hide the odor of alcohol and then you're trying to sip your iced coffee. If you saw my cigarette was already halfway done. I was smoking way before All righty, so So now that I haven't smoked since. Is there Is there any reason why we would be getting odor of alcohol? There's no reason. I haven't drank in I just That still has still has ice. So there's there's absolutely zero chance you had alcohol. No. When was the last time you had alcohol? Probably like a month ago. That long ago? Yeah. Okay. Do you have any condition with your eyes? No. Why are they glassy? Why are they Why are they red? My eyes are red? Yeah, they look they're slightly bloodshot and why are they red? They're not red. Okay. Were you crying today? No. Okay, why are they watery? My eyes are not watery, sir. I know Robert Aiello. I will call him right now. Yes. That is my son's best friend. It doesn't change anything, but I promise you I have not been drinking. You guys I'm not I'm not going to do this. Just put the test on me cuz I know I haven't been drinking. Okay. That's all that there is. All right. So, with that being said, do you agree to to participate in a field sobriety test? But I have not been drinking. Okay. I promise you I haven't been drinking. Okay. All right. Bridget, I'm going to say this again. Bridget, Bridget, Bridget, I'm going to say this again. You don't need to be argumentative right now. Like I said, if you dispel my fears, this is nothing. You're good to go. to worry about. Okay, then why are you acting like this? Because he's trying to say my eyes are bloodshot and they're not. They're glossy. They are and they are slightly red. Okay. So, we're going to Just stand over here, please. This is ridiculous. Sit right here. All right. So, I'm just going to We're going to have your feet together. We're going to do the horizontal gaze nystagmus, all right? I don't know what that is. I'm going to explain it to you. All right. Just stand with your feet together, just like this, hands by your side. All right. Stay just like this and follow my instructions and just listen, okay? All right. So, I'm going to check your eyes. Yes. I take buspirone and trazodone and paroxetine and uh Xanax. Okay. When did you take all of those? I take them I take buspirone three times a day. I take trazodone at night and I take paroxetine during the day. Okay. And Xanax you take as needed? As needed. Okay. When did you last take Uh probably like three days ago. Okay. And are for those other medications when did you last take Uh Xanax um like uh No, no, no. Um, like anxiety. But, I have right now and I also take, um uh I'm blanking on it. Like, uh Adderall. And I have the prescription in my car. Okay. And when did you take the Adderall? Um, I've taken Adderall two times today. Since 6:00, two times today. So, like breakfast, lunch Dinner. So, you've already taken your nighttime prescription? Yes. Okay. All right. I have that prescription in my car with my name on it and everything. Okay. All right. So, just keep your feet together and your hands by your side. Okay? So, I'm going to check your eyes. You're going to keep your head still and you're going to follow the stimulus slowly. Do you see this light? Yes. Okay. Just keep your hands by your side. Okay, you just turn that off. All right. So, I'm going to move the light, okay? And you're going to follow with your eyes and your eyes only. You're not going to move your head. Do you understand? Yes. Do you understand the instructions? Yes. All right. Let me begin. You said you understood the instructions and you're moving your head. I'm sorry. Can you Are you able to get your hair out of your uh face out of your eye? Let me put it up. So, go up there. Just look at There you go. Oh, she's fine. She's fine so far. You're just following her eyes. I just want to just check one thing out, okay? Both turn into pin holes out of that car. Yeah. Just look right there. We did it again. I'm fine by your side. Just look Just look at my nose here. At your nose? Don't look at the light. Just look at my nose, okay? I'm just looking at your eyes reaction to light. Her pupils are dilated, too. Well, they should be. Okay, thank you. Okay, so her eyes are normal or reacting normally to light, okay? So, listen. I know I know that you don't understand what on and I know that you may not agree with our assessment or anything like that. And but I'm telling you professionally that your eyes are not reacting as they're supposed to be for someone who claims that they they haven't been drinking, okay? For someone who claims they have not ingested any alcohol. The medications that you're on, I'm not familiar with what those medications are, but some of those medications may have labels on there that tell you not to be driving and uh uh uh uh uh uh Okay? Because they mimic the indicators of impairment. Now, let me let me just explain this to you. You can still be placed under arrest under your prescription medications for impairment. Okay? I can tell you right now that your eyes are not doing what they're supposed to be doing. What are they supposed to be doing? There's There's significant nystagmus in your eyes. Involuntary jerking of your eyes, okay? So, your eyes are not reacting as they're supposed to be. Your eyes are supposed to be nice and smooth. They're supposed to be able to to move and gaze and everything else normally. Your eyes are bouncing around the entire time. That's an indication of alcohol impairment or some type of other uh drug in your system and potentially something already on board. Okay? So, that's that. Now, I know that you're claiming that there's no alcohol or anything like that, okay? I don't know why we're we're at right here. There shouldn't be any alcohol, okay? I don't I'm not noticing any alcohol. I promise you, like there's no alcohol. But I'm getting some some wafting some odors of alcohol, okay? Now, you're saying that you haven't drank in the last 10 minutes. Right? I It doesn't It doesn't make sense. with my medication. It doesn't I I I would agree. Don't Don't take it with your medication. I can't. Okay? But it doesn't make sense as to why I'm getting these wafting odors of it here, okay? We're not like at a bar or anything like that with people walking by where you would detect it, okay? So, I think we would have We can agree that there shouldn't be that odor here. There shouldn't. Here. Okay? But I told you I'm not I'm telling you that that's something that I'm picking up and I think that this officer here as well is also picking that up. But I'm not showing any signs of it. Well, your eyes are. Your eyes are showing signs of of of intoxication. Like I promise I haven't We've got other assessments to do, okay? There's there's a few more steps that we have to go through before there's there's a determination, okay? So again, I just want to be up front and honest with you based off of what you did and everything else. I'm I'm being up front and honest and I don't want you to be surprised. Your eyes are not doing what they should be doing, okay? And I also take medication if you say so. I don't know what they are doing to my eyes, but I understand that. I'm not intoxicated. But but that's the thing is even your medications, people can be placed under arrest for DUI just with their medications. But none of my medications says I can't drive. Okay. And then I I don't know. But something's definitely Might be Buspirone is something I take three times a day. I take my Trazodone at night, which Trazodone I'm not allowed to drive on. And did you take that one yet? No, I said you took your your nighttime medication. You haven't taken that one yet. I took my Buspirone and my Adderall. All right. Well, we've got a couple more assessments here that this officer is going to do, okay? It is imperative that you follow No, I understand that, but I promise you I haven't drank. Like I feel like you guys are just trying to say something. No, but I promise you I haven't been intoxicated today. to the instructions. If you don't understand something, you need to you need to say you don't understand. You get clarification, okay? Do everything to the team, right? I know. I understand. Just so you all know, I've had ankle surgery three times. I actually got in the beginning. No, I have. Here. When did you have that? Um uh a year ago. I've had one 2 years ago and one 1 year ago. You want to do this barefoot or you want to do this with your shoes on? I just want you to see the surgery. Okay, so what would you be comfortable doing, barefoot or with shoes on? Um probably with shoes. Okay. But I just want you to know How does that affect your ability to to walk and Um if I go into a divot or anything like that, I roll my ankle. Okay. Okay. Yeah. All right, we don't need to see it. It's fine. I'm I'm taking your word for it. You know No, it's right there. Okay. Okay. And I've had knee surgery as well. But based on your occupation, does it affect you at all? No, I rolled my ankle today. No. No, your your knee surgery right now. Well, what for what you do as of right now? Right now, I just, like I said, I work for a friend every once in a while, but I get disability checks. Okay, so you're assisting them, but you that doesn't affect you or your knee. No, everything does. Like I said, I rolled my ankle today. And it affects you in your driving as well? No. Okay, so it doesn't affect your driving. walking. And it doesn't affect like land in a divot that's uneven, it'll roll. Okay. Okay, that's fine. That's all good. So, you're going to put your You're going to put your left foot on the line, and then you're going to put your right foot in front of it with your right heel touching your left toe. And now you're going to keep your hands by your side. All right, stay in that position and just listen to the rest of my directions here. All right, well, I can tell you I can already don't have good balance as it is cuz I have knee and ankle surgery. Okay, how You You told me that affects you because of walking, but how does that affect your balance? walking. But we're not walking right now, you're just standing in position. All right. Like I have knee injuries and I have a bunch of gear on, but I can stand I'm going to search. I had surgery before. All right, well, okay. Okay, but we're not going to go into that. All right, so you're going to stay in that position with your hands by your side. Put it by your side. All right, stay in that position. Can we have your hands by your side? You're like having it forward. There we go. All right, you're not going to start the test until I you are instructed to do so. When you begin, you're going to take nine heel-to-toe steps in a straight line, and you're going to turn around keeping one foot on the line. I will demonstrate, okay? And then you're going to return nine heel-to-toe steps in a straight line. So I have to go nine steps back? So let me explain. Nine forward and nine steps back? Let me explain and show you, and then you can save the questions at the end. Okay. I didn't say get out of position. Your hands by your side. Okay. So you're going to have your left foot on the line, right foot in front, okay? So you're going to do nine heel-to-toe steps in front, so indicating I'm almost at nine, so this is seven, eight, and this is my ninth step, okay? You're going to take a small series of steps here, keep your foot on the line, and then return with nine steps back. One, two, three, all the way until you get to nine, okay? So So I have to do one All right, I didn't say begin. Just go back to the starting position. Okay, so on the ninth step, you're going to keep your front foot on the line. I'm going to wait till the train passes by so I can explain. But, please go back to the position. Can I relax? All right, you can relax then. Can you relax? Okay. So, on the ninth step, you're going to keep your front foot on the line and turn around by taking several small steps with the other foot like I demonstrated. What are we doing, Bridget? I didn't say begin. Okay, can we have your hands by your side? Okay. Do you understand the instructions I've explained to you? Sure? What did she have you do? She wants me to do nine steps and then turn around and do nine steps. One consecutively after another. What? You have to do toe steps? Mhm. Nine heel-to-toe steps? So, I have to put one, two, three, four, five, six, seven, eight, nine. Turn. turn with what? One, two, three, four, five, six, seven, eight, nine. Okay. Where are you looking when you're doing this? I'm looking at the uh yellow line. Where are your arms? By my side. Okay. Are you counting as you're counting or are you going to make a mistake? so I don't lose count. Yeah, just count as you're as you're doing it. Okay. All right, so we'll go back to the starting position. This is the foot that test. So, while you're performing this test, watch your feet at all times, keep your arms by your side, count steps out loud, and don't stop until you completed the test. Do you understand? Yes. You may begin. Turn. Turn. I'm going to do it again. You said you understood the instructions. Yes. Why weren't you counting out loud? I didn't hear you count out loud. I was counting in my head. I said out loud. Okay. And then, you didn't have your arms by your side. You were kind of using it to balance, and I did not count nine steps. I counted eight steps. I counted nine. Is this count as one? That's your starting position. So, that's one. Go back to your starting position. I'm going to explain the instructions again cuz I don't think you were listening. Go back to your starting position. the starting position? That's not your starting position. You weren't listening. Your starting position, your left foot on the line with the right foot with your heel touching Yes. So, that's two. And your hands by your side. So, that's your starting position. So, this is your starting. So, that's just two. Can I explain first? That's not two. That's nothing. That's starting. So, technically, this would be one. Okay. All right. So, let's go back to your starting position. I'm giving you another opportunity here. Just have your hands by your side. Okay? When you're told to begin, you're going to take nine heel-to-toe steps in a straight line. Okay. You're going to turn around keeping one foot on the line All right. once you get to the ninth step. All right. While you're performing this, watch your feet at all times. Keep your arms by your side. Count your steps out loud and don't stop until you've completed the test. Okay. Do you understand? Yes. Okay, you may begin. 1 2 3 4 5 6 7 8 9 Should I do this one? Just Just continue. 1 2 3 4 5 6 7 8 9 This leg hurts. I don't know if I can do that. All right. Now you can just stand over here. All right, feet together, hands by your side. All right. Stay just like that. All right, now we're going to do the one-leg stand. You're going to stand with your feet together and arms by your side, just like that. Do not begin until I tell you to do so. When I tell you to do so, you're going to raise one leg, whichever one you want. I suggest not the one where you have a My surgery on. Yeah, okay. And you're going to raise it approximately 6 in off the ground with your foot pointed out. You're going to keep both legs Let me With your foot pointed out, you're going to keep both legs straight and don't bend your knees. And you're going to keep your eyes on the foot that is raised. While you're holding that position, you're going to count out loud, such as the following: 1,001, 1,002, 1,003, and so on until I tell you to stop. I'll demonstrate. Okay, so with your feet together, whichever foot you want, you're just going to raise it approximately 6 in, foot pointed out. Just watch me, don't do it. I didn't tell you to do it. Okay, foot pointed out, you're looking at it, you're counting 1,001, 1,002, 1,003. This is about 30 lb of gear and I'm able to do it, okay? So Do you understand the instructions? Do Do have any questions? Okay, you may begin. 1,001, 1,002, 1,003, 1,004, 1,005, 1,006, 1,007, 1,008, 1,009, Do you want me to keep going? 1,010, 11, 12, 13, 14, 15, 16, 17, 18, All right, you can stop counting. So, we have one last task, okay? So, the last one is where facing with the light, you're facing the trunk of your vehicle. Okay, you're going to have your hands out like an airplane, but your feet together, okay? You're going to stay like that as if you're balancing a position, okay? And you're going to count from 1 to 30, okay? Out loud with your eyes closed. Do you understand that? All right, so have your hands out like an airplane, eyes closed, and count from 1 to 30 out loud. You may begin. 1,001, seven, Relax, relax. No, what are you doing? No, stop, stop. You're under arrest. Why? Stop, stop. No, stop. I can't believe you're doing this right now. Are you being serious right now? That's literally entrapment. You're getting charged with resisting. Stop. Don't be forceful. That's literally entrapment. No, it's called arrest.
