on April 25th 2022 Monroe County
deputies were dispatched to a crash
involving a rear-ended school bus in the
town of Lyon
Wisconsin when they arrived at the scene
they found a white car that had struck
the school bus however the driver was
not there two people at the scene said
the driver left on foot heading
south eventually deputies discovered the
Man 2 miles from the crash carrying a
backpack the man was identified as
32-year-old Timothy lson Timothy
initially told deputies his brakes went
out in his car and said his buddy was
coming to get it what's going on man the
[ __ ] went out man H the back in the
bus okay how come you're take it off
my buddy supposed to come and he's going
to close the car car for me
like dud that's all it is gotcha I was
on my way to court to be honest with you
okay um in price County um D I tried to
slam on the brakes like the fluid you
can see it all the way back okay there's
no break at all well anytime you're
involved in a crash you got to stay on
scene okay do you mind just set setting
the stuff here and we'll I'll talk to
you here then okay so can you tell me
what exactly happened um yeah I was just
going and like school bus is you know
making periodic stops okay you know
they've been doing it all the way down
here Y and I mean my brakes have been
kind of squishy you know but the line
must have busted is my assumption I
don't know but there is like fluid going
up to it I mean I slammed on them okay
like I me doing like 30 got I had enough
time to hit you know get 30 you then put
the white lights and yellow lights and
[ __ ] damn dude okay um so don't take
this the wrong way but have you been
using anything this morning any
okay I go to for Price County
okay that um well the reason I asked you
looks like you got some like dry lips
and stuff like that what's that from u i
mean being off theide I don't I don't
know I just got up maybe an hour or two
ago my hair's still wet from my
shower did you uh talk to the bus driver
or anything I talk to the lady that was
right across the street she said she was
going to see if the neighbor called it
in or something like that okay I don't
have service on the phone so I trying to
get Wi-Fi and I was told a bar had Wi-Fi
or a house had Wi-Fi or something like
that okay do you got ID on you man um
yeah yep I have a remot license okay all
right I appreciate the honesty do you
mind keeping hands out I tell you what I
know it's cold out do you mind if I uh
patch you down real quick or search you
U make sure that you don't

right is uh so I know it says you got a
point out your restriction haven't been
drinking anything using any substances
at all okay all right
gotcha well uh what were you uh what
were you revoked for um exactly that
they think I was drinking
so okay long story short I used to have
a hair problem I did long time anything
that's supposed to be impairing driving
or possibly impairing driving no
search no that's fine I know the brakes
been kind of [ __ ] lately I know they
have but I I didn't expec them to
[ __ ] blow out on you okay like
well does does say mod were you
distracted in any way at all I mean I
tried hitting the
brakes there was just nothing gotcha um
and did it seemed like it like skid it
at all or it just it didn't just a
slight second and then nothing like
fluid and I didn't like trace the fluid
back so like I'm okay we can uh we can
take a look there um
so all right the only thing is um I'm
trying to think of the best way to do
this here
um I can give you ride the only issue is
if we do a ride that I have to do a a
search on you so I I can follow you I
tell you what um I'll just grab your bag
I'll throw that in the car and
then what's
that y I'm not going to search anything
it's just safety wise you mind just um
we'll throw that in the back if you
don't want me to search you and you want
to walk I'm okay with that and we'll go
back towards the vehicle

ass end of you
here while they were talking to Timothy
they noticed he had dry lips droopy
eyelids and slurred
speech all right we'll stay on this side
here just cuz we got cars coming

like a line from hitting on your brakes
at all so that's from the
impact right qu I had to pull them out
of the street I P up over there okay but
there's also some right here majority of
the okay tell you what man do you mind
uh setting the um soda here and then
we'll just do some couple quick tests
and we'll just go right over to the
concrete piece right over here um so
what I'm going to have you do put your
feet together heels and Toes touching
side to side hands down to your side
just like I'm doing here you can face
towards me here right well see that's
not an angle for me it's going to [ __ ]
me out show this is pretty straight here
man if anything we can is it better
right here okay so facing me feet
together heels and Toes touching hands
down to the side what I want you to do
is follow the tip of my finger with your
eyes and your eyes only not moving your
head do you understand yes I do okay
next phone here what I'll do is we'll
just go kind of near where this crack is
on uh sure I've had issues with the
phone L I do have balance issues or
whatever but I'm pretty sure I can do
you know the heel the toe thing okay
what me to do right uh yes but I'll have
you step kind of just where this line is
then we'll face back towards my car you
believe this is a flat surface right
here I'm not going to have you step on
this line I'm just going to have you go
in between yep okay so I'm going to
demonstrate how I want you so basically
we're just going to imagine a line then
kind of along this one but straight down
the path towards kind of the passenger
side Tire of my squad yep so what I want
you to do is uh put your left foot on
the line your right foot in front of it
touching heel to toe and your hands on
to your side just like I'm doing here I
want you to get in that position go go
from my right foot in front of my left
left foot on the line and your right
foot in front of it just like I'm doing
here right foot in front of it yep and
then I want you to stay in that position
wait till I tell you to do um otherwise
I'll demonstrate the test for you what I
want you to do is to take nine Heel To
Toe steps looking down at your feet
counting out loud touching Heel To Toe
each step so I'll demonstrate it here
three once you get to your ninth step
then you can stop do you understand the
test um double check forward nine steps
heal the to slowly turn around forward
nine steps heal the toe touch and heel
the toe each time looking down at your
feet and your hands down to your side
yep all right you may be getting the
test

to stop I don't want you to put your
foot down at any time but if you do
bring it right back up and continue
counting where you left off no it's
probably going to come down um I do have
issues with that but you do have what I
do have balance issues like I was tell
my my site has three okay okay um I can
do it gotcha so again uh approximately 6
inches off the ground keep your toe
pointed forward while looking down at
your foot and your hands down to your
side just like I demonstrated County

count to 30 in your head when you think
that time is up lift your head forward
and open your eyes so just backwards I
go count to 30 count to 30 in your head
at normal Pace normal 30 seconds and
when you count to 30 in your head then
put your head up and open all right tell
me when you're ready do you understand

driver revoked trying to make it to

been uh ever uh cited or arrested before
for operating after uh revocation yes
okay how how many times was that twice
gotcha anything illegal um in your bag
in the car at all no no okay do you mind

so I just thought want to ask before I
do search it any needles on cuz I don't
want to get fed at all years good okay
um so I tell you what if you want to
take a seat warm up a bit in my car
you're not under arrest if you just want
to sit there um like I said you're fine
there a witness also stated they were
traveling behind Timothy and observed
him crossing the center line several
times and nearly hitting a semi headon
According to some witnesses that were
following you they said that you were
swerving all over and in in two lanes
the whole time and behind the bus
I mean I did the balance test I mean I
know I've been awake and coherent like
my brakes went out yep and and so here's
the thing the thing that I'm worried
about isn't so much like the alcohol
test kind of like what we're doing the
things that's worrying me is stuff like
the kind of more of the stuff that leans
more towards the drug test like how
you're County longer than 30 seconds One
Mississippi is why it is like I get that
I mean that would add like around 8 to n
seconds I would think so when was the
last time you used
anything um not within the last like 48
hours I know that okay so what was the
last thing you used uh marijuana okay
marijuana nothing else no type of opioid
or heroin at all in anyway op at all not
OPI at all if I did I'd be no out man i'
be passed
out
okay and I when I looked at your eyes it
didn't seem very reactive to light now
that we're out of light here I'll do the
same thing just look right at me
man yeah your pupes don't react at all
to light so why why is that I couldn't
I'm nervous I mean I couldn't tell you I
don't know
okay well nervousness doesn't do
anything man to how your pupils react I
can't control it man I don't know what
to tell I don't have the answers I just
I'm out of lost myself this [ __ ]
shouldn't happen

well I think all the clues that I'm
seeing though is I believe you're under
the influence of something
so well here's the deal man like I said
I know you're under the influence of
something what it's telling me is that
it's it's some type of we'll say Downer
or something that that would cause this
type of stuff to happen my assumption is
that if that is the case a lot of times
what happens is that makes people kind
of fall asleep or something and maybe
potentially rear a vehicle yeah no I
understand that okay and then like I
said a witness saying that you're
swerving all over um the whole time all
the way from West you kept looking down
were you monkeying with something like
phone or radio they said you kept
looking down they didn't know what
you're looking for so were you monkeying
with something or were you not you're
nodding off definitely not nodding off
they said you were using both lanes of
traffic like I said man do to the crash
you do to all the signs due to witness
statements um you got synthetic urine in
your car not my car though and that that
was my other question whose car is it
and is there even insurance on it or
anything I have no idea he just he used
to record um so if you want to let your
buddy know that whoever you're borrowing
the vehicle from um but I'm going to be
placing you under arrest then
okay so need you to step out of the
vehicle can you put his backpack in his
car then so he can get it that's that's
his too okay all right you said I can
call him right or try to call him quick
we we'll do that after okay all right

cigarettes just just keep them in your
pocket there

okay justce sanction he said he was
going to court
deputies searched his backpack and
discovered pill bags containing
marijuana Alprazolam Kazaam 9.5 gr of
meth and an unused
syringe man I've done this job long
enough man don't you don't have to BS me
I know so I can look you right in the
eyes and tell you like yo he told me
about his tablet and he said the
backpack was important because he want
his tablet it's that number and and
that's why why you taken away from the
crash with it too I'm
sure

100% I've been nothing but respectful to

uh if you refus all and we got a drga
that's resisting and that's another
whole charge me I definitely refuse def
to religious act for all right
especially since I don't have two
convictions I ongoing cases yep and like
I told you too I'm only getting you up
for uh for second offense not third
offense like my dispat I don't even have
a first offense there they're still
going to court for it that's what I'm
not understanding it shows on your dot
record that you have a guilty conviction
for V
you are revoked due to OWI however it
also says that you have a guilty
conviction of of
ow Timothy was charged with felony
counts of possession with intent to sell
meth and THC second degree recklessly
endangering safety and five counts of
bail jumping misdemeanor counts of
possession of a controlled substance hit
and run resisting OWI third offense and
operating while revoked he also received
several citations totaling over $2,000
and his cash Bond was set at $5,000
