not warm out here yeah shortly past midnight on February 4th 2023 Deputy Christopher Olen of the Whitman county sheriff's office observed a 23 Honda CRV turned into the wrong lane when turning from Valley Road to any Stadium Way in pulman Washington when he proceeded to initiate a traffic stop the vehicle turned into the driveway at 715 any Stadium Way the driver 21-year-old Mia Murphy seemed incoherent when she was asked if she knew why she was being stopped Mia admitted to having consumed one shot and one truly about 1 hour prior but insisted that she felt safe operating her vehicle hello hey good evening my name is Deputy ol and I'm with the Sheriff's Office this is being recorded you have your life license registration and insurance with you I do um I'm going to have to turn off my car and open the glove box totally okay any weapons in the vehicle I need to know about yeah was it because I turned before um the person walked over not here to talk to you about that the issue is you turn into the wrong lane at the intersection there you're turning into the nearest Lane second lane yep you got to go to the nearest Lane always at an intersection okay I'm so sorry okay okay uh are you guys going here is this where you're we just getting Taco Bell we so why' you pull in here yes no why did you pull in here oh oh well I don't know it's was the first place for need to turn over so which way are you supposed to pull over when the lights I'm going to pull towards um Taco Bell but I because okay sorry that's not my question when which direction you're supposed to pull eat food too food has nothing to do with it do you know you need to wait about 2 hours per drink before you can drive oh okay so you waited about 30 minutes per drink and here's the deal in this situation I'd ask if you'd be willing to do some voluntary field sobriety tests is that okay yes okay hop on out for we can get we can do that right here let me turn off my lights so they're not can be stopped at any time based on her admission to consuming alcohol Deputy Olen afforded me an opportunity to perform voluntary field sobriety tasks he observed me as ice to be bloodshot and watery and he detected the odor of an alcoholic beverage on her person the first test involved the horizontal gaze nystagmus hgn where the deputy observed the lack of smooth Pursuit distinct and sustained nagus at maximum deviation and the onset of nagus prior to 45° during the walk and turn test Mia counted the first step on the wrong foot and was unable to maintain her balance or walk a straight line for the final one leg stand test Mia started to soon and counted contrary to the depuy's instructions yes uh first thing I'd ask you do you have anything to keep you from walking or balancing um no do you have any injuries one leg shorter than the other nothing like that okay are you on any medications that you should be driving with no any marijuana no any other drugs you're not supposed to be taken okay just to two one shot and one CA from over an hour ago totally understand so can you stand with your feet just like there hands right at your side can you see the tip my pen right here yep okay in trouble cuz it's been an hour since I last drink so what this does it it basically tells me that you're being honest with me and everything's happened like you said it has this will just tell me how much you had to drink if you've had okay if you waited an hour and you're under the legal limit that's fine one shot and the 5% s it okay yeah I just want to get in trouble I I to well I don't want people to get in trouble either okay big breath in whenever you're ready go ahead blow blow blow blow blow keep blow keep going keep going keep going keep going stop okay so how old are you I'm 21 you're 21 you know the legal limit for someone who's 21 years old um I think it's 007 well close it's 008 do you think you'd be over or under 08 I should be like under you think you're under okay following the voluntary field sobriety test M was offered the opportunity to voluntarily take a PBT test the PB PT reading was 0.102 which is over the legal limit of 0.08 based on her admission to consuming alcohol her inability to perform the field sobriety tests and the PBT result Deputy Olen placed Mia under arrest for driving Under the Influence Mia was subsequently transported to the WSU Police Department for further processing and as soon as this clicks over I'm going to show you the result and we'll know okay my concern is I can SM smell the odor intoxicants coming off your breath so it's obvious you've been drinking yeah that's normal the the problem is so here's the that says you're a 102 so 8 is the legal limit for someone your age okay so the problem is you are under arrest right now for DUI so I need you turn around put your hands behind your back and me I'm going to tell you everything we're doing along the way okay so nothing's a surprise you are under arrest right now you do have the right to remain silent anything you say can be held against you in the court of law you have the right to the presence of an attorney if you cannot afford an attorney one will be appointed you prior to questioning if you so desire you can decide at any time to exercise these rights not make any statements or answer any questions do you understand the rights I've read to you and we are still recording I saw you noding your head up and down and you said mm is that a yes or a no yes okay I'm just making double sure well I'm glad nothing bad happened like you didn't get in a sure your car gets home and a sober driver and everything I would put I would put for to drive I mean not drive um I would prefer you didn't drive I would prefer my roommate to drive then right I I don't want her to drive but can she get a hold of your roommate and everything for you yes if I uh give her my phone which is somewhere in the front seat can we give her the phone number for your consists of two separate samples of your breath taken independently to determine alcohol concentration One You're Now advised you have the right to refuse this test if and that if you refuse this test your driver's license permit or privileged to drive will be revoked or denied by the Department of Licensing for at least one year and your refusal to submit to this test may be used in a criminal trial two your further advised that if you submit to this breath test and the test is administered your driver's license permit or privilege to drive will be suspended revoked or denied by the Department of Licensing for at least 90 days if your age 21 or over and the test indicates the alcohol concentration of your breath is 0.08 or more or you're in violation of RCW 46 6152 driving Under the Influence or RCW 46 6154 physical control of a vehicle Under the Influence or under the age of 21 and the test indicates the alcohol concentration of your breath is 0.02 or more or you're in violation of RCW 46 6152 driving Under the Influence or RCW 4661 504 physical control of a vehicle Under the Influence number three if your driver's license permit or privileged to drive is suspended revoked or denied you may be eligible to imately apply for an ignition interlock driver's license what does that mean uh do you know what a blow and go is have you heard your friends talking about a blow and go it's where you have it installed in your car and you have to blow in it prove that you're sober so you can drive and then you have to get the license to correspond so you have to get the privilege to drive on that ignition in lock you have the right to additional tests administered by any qualified person of your own choosing for those not driving a commercial vehicle at the time of arrest if your driver's license is suspended or revoked your commercial driver's license if any will be disqualified for those driving a commercial motor vehicle at the time of arrest if either a refuse this test or B submit to this test and the test indicates an alcohol concentration of 0.04 or more you will be disqualified by the Department of Licensing from driving a commercial motor vehicle you don't have a commercial driver's license correct yeah okay just check it what kind of driver's license a commercial driver's license is it for like driving a biger nope you don't drive a request a DUI hearing to appeal the suspension of your driver's license you're going to need to use this form there's a fee it's nonrefundable and you have to request it within 7 Days of today's date okay after 7 days you can't request an appeal for your suspension so keep we're going to make sure this stays with you uh and then you can decide if this is a good option for you're not in the it is I waved her constitutional rights and answered the depuy's questions she agreed to submit to a breathalizer test her Alco test results indicated a BAC of 0.094 per which was over the legal limit of 0.08% following the results of her breathalizer test M was transported to the Whitman County Jail in kfax Washington with the bail amount of $500 she was cited under RCW 46.6 5002 for driving Under the Influence DUI on March 16th 2023 the ultimately pleed guilty to negligent driving in the first degree 46.6 1 50 to 49 and she was sentenced to serve 12 months of Probation and one day in jail total fines were $732 25 which included a $250 fine for negligent driving a $139 125 DUI cost recovery fee a $43 criminal conviction fee and a $300 supervisor probation fee I forgive you no hard
