My nerves are now skyrocketed. >> I understand that has nothing to do with the fact >> I also observed you swerving >> up >> around 6:01 p.m. on June 28th, 2025. Officer Valentino Salgado with the Hoboken Police Department was on patrol in the area of Second Street and he heard a loud bang consistent with a motor vehicle crash. He then observed a black vehicle with heavy damage to its right rear fender. After making contact with the driver of the black 2014 Tesla Model X, the driver pointed towards a white 2014 GMC SUV and told officer Salgado that the GMC was probably the vehicle that had struck his car >> because I got a text. I apologize. Yeah. >> So, do me a favor. Go ahead. >> Can you We can also track my record on my text. >> Are you okay? Are you impacted >> a little bit? The driver of the GMC, later identified as Bailey Zimmerman, told officer Salgado that she looked down as she received a text message and then struck the other person's car when she was distracted. As he was speaking with her, he observed indicators of impairment and asked her if she had anything to drink. While she initially denied consuming any alcohol, she would later admit to consuming a can of ginger mule 8% in Guttenberg earlier that afternoon. >> To I just have a traffic built up here. I'm just going to try to clear some of this out. I just need an extra unit to come down uh in the area first in Willow to just stay with the female before I move. >> Okay. So legally, can I ask your officer name? >> Officer, are you hurt? >> No. >> Okay. >> She will also send me 34. >> No. >> All right. Put this down. >> I got a a text that alarmed me. >> I was very present and I apologize. >> Okay. >> But I did get a text that was alarming. >> Your car has to stay there. >> Yeah. I'll be in my car. There you go. JR, I'm just going to move my car. Can you just stay with her? Yeah. >> Give me a second, buddy. Right. So, if we can have another unit a second and we'll block off traffic there, please. And then just so we're clear, I got an emergency text. Like, that's why my phone is down here. I would like everything if anything is being recorded. I got an emergency text. >> Okay. >> And I'm not I'm not validating. >> What? >> And here's my license or registration. But I am ob whatever you guys need. >> Okay. >> But also >> No, I'm just saying it's out as it should be. Whatever you guys need accident, so it's kind of extra. >> I should never And this is why you never look at a text. >> Was he involved? Sir, was your vehicle hit? >> Yeah. Okay. Um, >> where did she start the vehicle? >> No, no, my car is back there, though. >> Oh, it's on the way down there. >> Yeah, >> she she was wrong. >> 14 on the floor. >> She ran away. >> Okay. >> Rose, just watch out. Okay. >> This is just I'm allowed to drink, right? >> Water? >> Yeah. And coffee. >> Okay. Did you have anything to drink like alcohol wise at all today? >> No, not in the past like hour, 2 hours, 3 hours. When was the last time that you did drink >> this morning? >> What time? >> Sergeant Francis McCort and officers John Rodriguez, Rose Kanan, Alexander Miller, and Kyle Seer arrived on scene shortly afterwards to assist. As the officers were speaking with her, they detected the odor of alcohol and observed other indicators of impairment. Officer Miller asked Bailey to perform field sobriety exercises. Uh, when I arrived, I did a drink concept for my sponsor, but I didn't drink the full drink. >> What was it? What' you drink? What' you have? >> It was a mule canned cocktail. >> Okay. >> By drink, and it was one cocktail. >> Okay. >> So, how many how many in total did you have? >> This one. >> One. So, what's going to happen is that this officer is going to perform a field of body test on you. Is that okay? >> To make sure you're safe to drive. Okay. >> Well, yes. But also, can for insurance purposes, can can everything get recorded? >> Yeah. When my body cam's on, it's activated. Everyone's body cam on activated. Of course, no problem. MCL injury. >> I will make sure. >> So by limp or any incapacity. >> Do you also um >> Officer Miller strided with the horizontal gaze nestagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Billy did not touch heel to toe on each step and turned improperly. The final exercise was the one leg stand test. During the one leg stand test, Billy failed to raise her foot in the proper fashion and did not count in the correct sequence. >> Do you wear contacts glasses as well? >> I need glasses into a certain regard, but I'm not wearing them right now currently. >> Okay, I will make note of that. Okay. The bigger note is if I limp in a certain regard, >> I have a full partial ACL chair and MCL chair that I'm currently recovering from. >> Okay, no problem. I will definitely note that if uh it comes to that. Okay. >> Thank you, Mr. Miller. >> No problem at all. Here's >> Do you prefer me to call you officer Miller or Mr. Miller? >> Whatever your preference is. >> No, it's your preference. It's to your discretion. >> So, I'm just going to have you stand right here. You're going to face me on this line. Okay. You're going to stand with your feet together and your hands at your side. Okay. You're going to follow the tip of my finger. >> Which tip? Which finger? >> You're going to follow this finger. Okay. >> Gotcha. All right. >> Um I'm sorry. With your eyes and your eyes only. You're going to keep your head still. >> You want my jaw still? >> Uh yeah. You're going to keep your face looking at me, but you're going to follow with your eyes and your eyes only. Okay. >> Yes, sir. [Music] Do I have no head? [Music] >> Sorry. [Music] [Music] Oh, so long. [Music] I'm not sure. I'm not sure. [Music] >> That's from a bar. Okay, you can relax for a moment. Uh, the next test we're going to be doing is going to be called the walk and turn test. Okay. >> Um, >> this is the one I'm blurry about cuz of my ACL injury. >> No problem. I'll I'll definitely make note of that if anything >> like is this everything you make note of right now? I feel like I'm being under a deep surveillance. >> No, I'm deeply worried because I don't want >> I understand. So, I am just I'm here to determine if you're able to operate a motor vehicle. Okay. >> Oh, yeah. That's fine. >> That's all my purposes here. So, if you pass these test, you're free to go, >> right? >> Um, >> I'm going to have you stand there with your feet together and your hands at your side. Okay. >> You're not going to begin this test until I tell you to. >> For demonstration purposes, I'm going to be taking three steps. >> When you conduct the test, you're going to be doing nine. Okay. >> Okay. >> 34. We're taking I'm really worried about my but you've already considered >> correct. So what you're going to do is on your line. >> Yes, sir. >> You're going to have your left foot on the line. You're going to have your right foot in front of it. Okay. >> You're going to stay in that position until I tell you to begin the test. Do not start the test until I begin. Okay. You're going to stay in this position though, just like this until I tell you to begin the test. >> Okay. When I tell you to, you're going to be taking nine steps. Okay. For de again, for demonstration purposes, I'm just going to be taking three. One, >> two, >> three. >> Once you get to your ninth step, you're going to take a series of small steps. >> I've never turned. >> No problem. Do you understand? You're going to take a >> I think I do. >> Without stepping off the line, you're going to take a series of small steps. >> A small swift turn. >> Don't Don't move from the starting position that I started you from. Okay. >> I know. I'm just doing my best because of my ACL tear. >> I understand. All I'm asking you to do >> this is my first time without a brace. So, all I'm asking you to do is to stay in the starting position as so. >> Oh, of course. Do not move until you tell me to move. >> Yes. So, you're going to take a series of small steps. >> You're going to take nine steps back. Okay. >> One, two, three, and so on until you conclude the test. >> Mhm. >> Throughout the duration of the test, you're going to keep your hands at your side and you're going to keep your eyes, you're going to be watching your feet while you walk. Okay. >> Hurting my hamstring. >> I understand. Okay. >> Cuz just because of my ACL tear. >> All right. Do you understand the directions for the test? >> A little bit, but do you understand that? >> Yes, I understand you have an injury. I'm I'm I'm taking that into consideration. Okay. >> But I'm fighting beyond. >> Okay. No problem. You may begin the test now. Okay. >> The beyond the test is me stepping. >> You nine steps forward, a series of small steps, and nine steps back. And you're going to keep your hands at your side. Okay. Are you refusing to take the test? >> No. I mean, no. >> Okay. So then I need >> I don't want there to be a miscommunication ACL. >> There's no miscommunication. I'm going to make note of this while you're doing this. Okay. >> I just want to make sure that >> Okay. You may begin the test. Thank you. >> I have an ACL tear. >> I understand. one MC3. >> Thank you. Uh just stand at this line for me. >> You're good. The that test is complete. Okay. No problem. >> Okay. Yes, sir. >> I'm going to be demonstrating this test. Okay. For this test, you can choose your leg, a leg of your choosing, six inches off the ground with your foot horizontal to the ground, and you're going to be take counting out loud. One, Mississippi, 2, Mississippi, 3, Mississippi, 4, Mississippi, 5, and so on and so forth until I tell you to stop. During this test, you're going to keep your hands down at your side, and you're going to be watching your foot while you count. Do you understand the directions? >> I I think I do. Can I repeat them to you just so I'm clear because I'm being tested in a way that's >> No problem. You would like me to put one foot and elevate it in front of the other. Correct. And hold it >> for a period of time. >> You're going to count out loud until I tell you to stop. >> And that is 6 seconds. >> I'm going to I'm going to count You're going to count to count. >> You're going to count until I tell you to stop. >> Okay. >> I'm going to count one Mississippi or just one. >> One Mississippi. >> Yes, sir.
