ma' what's your first and last name around 1:02 a.m. on March 9th 2024 office officers with the Lakewood Police Department were dispatched to report a motor vehicle accident involving three vehicles on Detroit Avenue between Westwood Avenue and Lakeland Avenue as officer McCarthy arrived on scene he observed that there was an accident involving a 2013 Honda CRV driver's car 2018 Volkswagen Atlas and 2015 Kia Optima near Mary Arts Pub and Grill the officer made contact with the driver who was identified as Mary Mary was initially evaluated by First Responders but she declined further medical attention as the officer was speaking with Mary he detected the odor of alcohol and noticed signs of impairment so he asked her to perform field sobriety exercises s what's it last name okay do you test and officer McCarthy observed a lack of smooth Pursuit distinct and sustained nice stmas at maximum deviation and the onset of nice stmas prior to 45° the second exercise was the walk and turn test and Mary did not touch heel two toe on each step turned improperly and took the incorrect number of steps the final exercise was the one leg stand test and Mary put her foot down multiple times and swayed while balancing arms your side all right all right what I want you to do is just focus on the tip of my pen this entire time all right do not turn or move your head all right you understand understand these instructions I have nine heel toe sets and then I turn around and do nine heeld so yes when I tell you to begin you're going to count your steps out loud keep your arms to your side for OVI she was placed placed in the patrol car and transported to the Lakewood jail where patrolman Wilkins booked her in for OVI at the LPD jail Mary refused to submit breath samples so she was advised that her driving privileges were suspended Mary was subsequently released to her mother and charged with the following offenses oie failure to wear a seat belt and failure to control 10 1,000
