Gary borbit of the IAM Police Department observed a 2018 BMW driving erratically on Tuckerton Road he stopped the vehicle after it turned onto Longer Road as he approached the vehicle he detected the odor of an alcoholic beverage and observed a six-pack of smof under the passenger seat with two bottles missing officer isai harose later responded to the scene of a possibly intoxicated driver in the area of Longhurst Road and an umw Road and the investigation was turned over to him the driver 26-year-old angelik papis told officer rose that she was coming from a nearby bar and admitted to having consumed alcohol earlier since her speech was slurred and the officer detected the odor of an alcoholic beverage he afforded her an opportunity to perform field sobriety exercises you can come up here right in front of my car okay we're going to do two two exercises all right um like I said you know just two exercises follow state test just make sure uh front camera's off right now turn open I'm G to demonstrate the test for you okay um when I tell you to begin you're going to begin so first we're going to do the walk and turn all right I'm going to put you in a starting position you're going to stay in that position until you're told to do so okay starting position you're going to put both hands down by your side all right you're going to put your right heel in front of your left foot all right and you're going to stay inside of this position so you're going to take your right heel and you're going to place in front of your left foot all right and you're going to stay in that position and how you do so I'm going to demonstrate can I can I ask because you guys have like not you personally but I've been given this before can I take my like pop song yeah you can take them off yeah if walk and turn test she was unable to maintain her starting position or take Heel To Toe steps while counting out loud the second exercise involved the one leg stand test during this test Angelique was unable keep her foot 6 in off the ground as instructed and she kept swinging her arms to balance the final exercise was the horizontal Gay's nagus hgn test during this test Sergeant gorbage observed a lack of smooth Pursuit distinct and sustained nystagmus at maximum deviation and the onset of nystagmus prior to 45° in both eyes not don't start walking yet you're going to stay in that position until I tell you to do so okay Sor so just take that right foot and place in front of your left all right stay in that position I'll demonstrate it for you right so what you're going to do is and that starting from that position M you're going to start keep your hands down by your side and you're going to take nine steps you're going to count them out one 2 3 four all the way up till 9 when you get up to your ninth step you're going to take a serious small turn a series small steps from your left foot to turn all right and then you're going to take nine more steps back one 2 3 4 all the way up to nine do you understand that do you have any injuries that's going to affect you from doing this test I'm going to demonstrate it you're going to I'm going to demonstrate it first then you'll be able to do it okay so you're going to take your right either leg of you're choosing I'm going to choose my right all right you're going to lift it up 6 in off the ground all right you're going to look down at your foot keep your foot parallel to the ground you're going to keep your hands down by your side all right and you're going to count out uh one Mississippi 2 Mississippi 3 Mississippi 4 Mississippi and so on until you're told to stop all right do you understand that all right you can begin whenever you're ready you're fine you can go right back to doing it just start off where you uh Angelique under arrest for driving under te influence she was transported to the Ean Police Headquarters where she was read her Miranda rights afterwards Sergeant gorbage read her the standard statement from motor vehicle operators and she initially agreed to provide breath samples but later refused when she he attempted to escort her to the alcoas machine all right I [Music] mean just turn literally told him I could pull it up but he didn't want to accept that so that's fine that's fine MH um and then the last one was for the refusal for the breath test all right um if you have any the bottom okay after Angelique was processed she was released to her mother after she signed the potential Shar ID warning form on her behalf she was issued the following summonses operating Under the Influence refusal to submit to chemical breath testing reckless driving and failure to provide proof of insurance court records indicate that on October 27th 2022 Angelique pleaded guilty to operating Under the Influence and she was fined $1,390 along with a sentence of two days in jail 30 days of community service 2 years of ignition interlock device usage and 48 hours at an intoxicated driver Resource Center the citations for refusal to submit to chemical breath testing reckless driving and failure to provide proof of insurance were dismissed as part of the plea agreement I'm just
