were dispatched to the site of a motor vehicle accident involving multiple vehicles and possible injuries at 618 Bloomfield Street in Hoboken the driver was identified as Risa ging restivo a 34-year-old resident of baton Florida an officer approaching restivo detected the odor of an alcoholic beverage emanating from her breath as well as watery eyes and sared speech REO had already horizontal Gaye nystagmus hgn test the officer noted that R Evo exhibited lack of smooth Pursuit distinct and sustain nystagmus at maximum deviation and onset of nystagmus prior to 45° in both eyes the officer also did not observe a vertical nagus and restivo continuously moved her head and failed to follow instructions the second test involved the walk and turn m test upon beginning the instructional portion of the test rivo was placed in a heel to toe position while the officer demonstrated the test rivo proceeded to take nine steps forward and could not maintain a heel to toe position throughout the course of the test rivo continuously failed to follow instructions that were explained to her before the watt test the final test was the one leg stand ol after the test was demonstrated for rivo she did not have any questions restivo began the test but could not maintain her foot 6 in off the ground also restivo dropped her foot down to the ground and could not maintain her balance okay do you normally wear glasses no do you have contacts in your hand um do you have any medical elements like you ever br your kneecap broken legs nothing no no I I do have a bad knee uh foro after she was transported to Hoboken police HQ reso consented to providing breath samples restivo was subsequently transported to the Jersey City police department at 365 Summit Avenue new to restivo's breath test revealed a back of 0.17% which was more than double the legal limit at approximately 8:37 p.m. restivo was transported back to Hoboken police HQ at this time Lieutenant Gonzalez informed officer aroyo regarding the particulars in regards to the series of events that took place at the scene according to Witnesses restivo was driving at a high rate of speed which resulted in her colliding into a blue colored Chevy Malibu that was partially parked near a fire hydrant the impact of the crash to the parked vle shifted the parked vehicle which then struck the victim maroon Hardy valon as she was standing on the passenger side of the vehicle also due to the impact of the crash rivo who was driving a black Chevy Cruise elevated the vehicle into the air and turned over subsequently crashing into a properly parked graycolor Toyota Highlander on the other side of the road is that you6 to wash yes 14 uh we'll be done here in a couple minutes uh then you can come and block uh Bloomfield I take my car down I'd rather you leave it here atfield an ambulance arrived on scene to medically assess Hardy and she was transported to Jersey City Medical Center jcmc for treatment officers Bates and Lup traveled to jcmc to obtain an update regarding Hardy's injuries officers were informed that Hardy had sustained a fractured upper femur to her right leg and that her hip would need to be reset based on the injuries resulting from the crash at approximately 10:21 p.m. Sergeant Rory Miller contacted Sergeant Ragland of the Hudson County prosecutor's office crash degree crime of serious bodily injury SBI if it was appropriate restiva was fingerprinted by Officer Fitz jibbin and subsequently issued a summons for violating assault by Auto third degree along with citations for driving while intoxicated and reckless driving after she was processed restiva was released to a family member after she signed the potential shil form how you want
