intoxicated driver as officer G's own approached the vehicle he could detect the odor of an alcoholic beverage from the vehicle the driver later identified as 26-year-old Alyssa Divine insisted that she was not intoxicated and that it was her younger brother in the passenger seat of the car who was impaired she told the officer that they were about to head home from the Rangers game after the New York Rangers lost 3 to2 to the San Jose Sharks hey Miss Hi how are you go Poli on my cameras on okay yeah you're good you all right tonight yeah where you guys coming from going the Ranger game yeah investigation officer Gars own offered Divine an opportunity to perform field sobriety exercises officer Gars own initially performed the horizontal gaze nystagmus hgn test and the results indicated potential impairment as she walked Divine seemed to have a lack of balance and fine motor coordination subsequently Divine failed to adequately perform the walk and turn and one leg stand test all driving while intoxicated 39 4-50 the all requires you to submit samples of your breast for the purpose of testing to determine alcohol content a record of the taking of breast samples including the test results will be made on your request a copy of that record will be made available to you after youve provided samples of your breath for testing you have the right at your own expense to have a person or phys of your own selection take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you'll be issued a separate summons for the refusal the court may find you guilty of both refusal and driving while intoxicated the court finds you guilty of the refusal you'll be subject to various penalties including right uh license revocation of up to 20 years fine of up to $2,000 installation of an an ignition in a lock in referral to an intoxicated driver Resource Center these penalties may be in addition to the penalties imposed by the court for any other offense of which you are found guilty you have no legal right to have an attorney physici or anyone else present for the purpose of taking the breath samples you have no legal right to refuse to give delay giving or or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing even if you agree to take the test but then do not follow my instructions do not properly perform the test or do not provide sufficient breath samples I will charge you with refusal to submit the testing I repeat will requires you to submit samples of your breath for testing will you submit samples of your breath yes sure I need was brought to the station Divine agreed to take a breathalizer test after Divine was processed she was subsequently released to her sister after she signed the potential Sherl warning form on her
