Defendants are considered innocent until proven guilty. Thank you all for the support. How are you guys? I'm watch police. You have your license insurance? >> Yes, of course. Around 1:56 a.m. on October 26, 2024, patrolman Preston Malachi with the Red Pink Police Department observed the driver of a 2019 Jeep driving in the wrong direction in the vicinity of Maple Avenue. As he followed the vehicle, the driver continued driving erratically. He activated his emergency lights to initiate a traffic stop and the driver pulled over on W Front Street near Morford Place. He made contact with the driver who was identified as Cara. >> Thank you. >> You're welcome. >> Where are you guys coming from? >> We're just coming from uh out to dinner. Tentrada. >> Okay. >> And then uh we're just I'm just dropping him off and then we're >> dropping off. >> Where you dropping him off at? >> Bankrupt. >> Okay. >> All right. Cara, how's your license? Everything's good. >> As far as I know, no police. Everything's good. Yeah. >> Okay. All right. Listen, the reason I'm stopping you is because you were driving on the opposite side of the road when you were coming up White Street. >> Oh, yeah. >> Okay. Cuz >> sorry, I was I was [ __ ] around a little bit. That might have been my >> I've never drove him home before. He said keep left and I'm like I can't keep left yet because >> I told her to keep left. Keep left. >> I know. And I thought that it was illegal to turn left and then switch lanes as we were turning and then so I had to keep left as right after and then I had to switch over the lanes. >> Okay. >> Sorry about that. >> All righty. How's your license? Everything's good. >> Everything is good. >> Okay. All right. And you're the registered owner of the vehicle? >> Yes, I am. >> All right. Just give me one second. I'll be right back with you. All right. Yes, sir. >> Real quick, do you have an updated uh insurance card? This one's expired. >> Oh, yes. I'm sorry. >> Wait, what do you have in here? Register aggressive. >> That one looks like the same date. >> No, that one expired. >> This one? That one expired as well. It's the same one. >> Oh my gosh. Wait, I have the app on my phone. >> Okay. >> Just found Do you have that? >> You have a phone? I need a >> Oh, it's right here. >> How do you guys know each other? >> Where is that? Eden Town. What? My bad. What is that? >> Oh, it's >> it's like a steakhouse. >> All right. >> I'm sorry. I thought I had the app. >> You're good. >> Wait, it should be good until April, though. >> Uh, it says October is the beginning of this month. >> No, I know, but it's like 6 months. >> Yep. So, it expired October 4th, 2024. Today is October 26th. This is >> 2024. >> Oh my gosh. It says 2023 though. Hold on. I'm sorry. Oh my gosh. I don't have the app. Hold on just a moment. Oh my gosh. I am so sorry. >> You're good. Just pull it up for me. All right. >> Okay. I'll pull it up for you. >> All right. Sorry. You >> Oh, yeah. Yeah. You just check my R5 voice. Let me know 340 as well. Do you want me to f that? >> I would just need you to do htn. I'll be >> Yeah. 340 red 340 license. Okay. Car Cara told patrolman Malachi that she had went out to dinner with her coworker and she was driving him home to Linkraftoft before heading home. As he was speaking with Cara, he detected the odor of alcohol. Cara was able to provide her driver's license, but she was unable to show valid registration or insurance. Her license was also suspended. >> Carrie, you mind just step out of the car for me real quick? Want to talk to you outside? >> Sorry, I actually had a guy call out. >> We're just going to move right over here on the curve. >> You mind if I uh just download the progressive app? >> Yeah, you're good. I just want to move out of the roadway so we don't get hit by any cars or anything. How are you tonight? >> I'm good. How are you? >> I'm really well, thank you so much. >> I'm so sorry. I did switch over my car insurance and I didn't realize that I downloaded the app. >> When did you uh end up switching over? >> Can I look at my email? >> Yeah, you're good. >> Okay. I'm so sorry. >> When did you end up switching over? >> I switched over honestly it was probably like August. >> Okay. And because I didn't realize that I had to like switch and update Hold on. Scheduled payment October 5th. Reminder. >> Did you miss a payment? >> No. It should be on auto auto pay for months now. >> Does it say something on your end? So listen, what I'm getting back on my end is that your license is suspended as well. >> Your license? >> Yep. Correct. As well as your registration. >> Your registration. >> My registration. >> So hold on. >> I'm so sorry. >> Your registration is normally suspended because you either don't have insurance on your car or the insurance lapsed or you ended up switching insuranceances and the DMV didn't get a hold of it and they don't think that you have insurance. So, I don't know what the aspect might be as to why it is suspended. I'm having my dispatcher check right now. >> Thank you. >> But did you know that your license was suspended? >> No, I didn't. I had no idea cuz I don't even have any points or anything on my license. >> Reesei, thank you. So, you it's saying that you you haven't had insurance since August. No, that's not true because I just called and I had like a No, no, no, no, no, no, no, no. >> Okay. All right. Just give me one second. All right. Listen, Cara. It was it >> Cara? Yeah. >> Okay. Did you have anything to drink tonight? >> No, I didn't. >> Nothing at all? >> No. >> Okay. Because I smelled some alcohol on your breath. >> My breath? >> Yes. >> No. >> No. >> I just came off from a double and then we went out to eat. >> Okay. >> Yeah. >> All right. I got you. Listen, um I'm just going to run some tests on you just to make sure that you're fine to drive and everything. Okay. Um >> I can pull this up, too, if you need. Yeah, we we'll just wait for that. First, we just want to run the test just make sure that you're good and everything and then if you're good, we'll put you back in the car and then uh you could pull it up. Okay. >> Can you just uh reiterate how my license is suspended? >> Uh it's because you are not insured. Your motor vehicle is not insured. So, your registration got suspended in August and then your license got suspended because you don't have insurance on your car in September. >> Okay. Sorry about that. So, if I do have insurance, which I'm sure I have insurance because I just called them recently about uh a thing that I had to dispute or whatever. So, what would I have to do with my license moving forward? >> You'd have to go to DMV and get it re reinstated. >> Reinstated. >> Yeah. Restored. >> Do it online. I'm not 100% though. >> Um >> yeah, you you'd have to go to DMV and and ask them. But um so >> what about my registration? >> Same thing. DMV. >> Yep. >> So, listen. We're just going to move over here. It's a little bit flatter in this parking lot. Okay. >> You want to run that real quick? >> You have to go to my to my insurance company and say anything about >> um Yeah. So, if you just want to put your phone away for right now and I'll explain everything for for you a little bit later. Okay. >> So, listen. The first test uh >> based on his suspicion of impairment, Cara was asked to perform field sobriety exercises. The first exercise was the horizontal gaze nestagmas HGN test and it was administered by Sergeant Ashen Lavik. During the HGN test, the Sergeant Lavik told patrolman Milachi that he observed 66 indicators of impairment. The second exercise was the walk and turn test. During the walk and turn test, Cara failed to touch heel to toe on each step, counted incorrectly, and turned improperly. The final exercise was the one leg stand test, and Cara failed to raise her foot in the proper fashion. I got you. >> I'm so sorry. >> So, the first test. >> Here you go. >> You can just put that in your pocket. Um, my sergeant is going to run on you. Is HGN horizontal gay gaze nestagmas. Okay. He's just going to check your eyes. All right. So, if you just stand with your feet together, arms at your side, just like that. Yep. >> And then he'll explain the further. Look straight ahead. >> Hello. >> How are you? >> Good. How are you? >> All right. Do you have any like head injuries? Any Are you wearing contacts? You have any problems with your eyes or anything? >> No contacts. No problems with my eyes. >> You feel dizzy or anything? >> No dizziness. >> Okay. All right. You see the top of the pen? >> Yes, I do. >> All right. I want you to follow the top of the pen. Your eyes only. Don't move your head at all. Do you understand the instructions? >> Just move my eyes, not my head. >> Okay. >> Don't move your head. Just your eyes. >> I'm not moving my head. Am I? You did. >> Don't look at your right. I saw I saw my eyes. It's just I didn't see the pen. >> You see it, TJ? >> Yeah. Mhm. >> It's It was just in the dark spot. Not that I didn't stay still. Stay there. You keep your head still. Okay. six. >> Okay. All right. Listen. So, the next test >> I don't know if you want to line. >> Yeah, we'll use this. All right. So, if you just want to walk over here real quick. If you want to stand right here and just face me. >> All right. Right on the line. >> So, like the last test, just put your feet together, arms at your side. All right. >> Yep. So, the first test that we're going to do is a walk and turn. >> Okay. So, you're going to put your left foot in front of your right just like this with your front. Yep. >> Left or right, doesn't matter. I'm going to do it with my left. All right. So, put your left foot out in front of you. Arms are your sides. Just like this. All right. While your feet are on the line. All right. You're going to take nine steps forward. Real quick before we start that, do you have any injuries with your legs? Your legs are all good. There's nothing wrong. >> My a little iffy, but legs are good. >> All right. All right. So, you're going to start at this position. Just like this. Okay. Okay. Left foot forward. Got it. >> Yep. Right in front. You're going to start heel to toe. Okay. So that means your back of the whatever heel is in front right at the other foot the toe. All right. You're going to take nine steps forward. I'm going to demonstrate for you. >> Okay. >> Counting out loud. One 2 3. >> Okay. >> Four. Five. All heel to toe steps. And then you're going to turn around on one foot. Face the other direction. >> Nine steps back >> while counting out loud. Okay. Do you understand the instructions? >> 18 steps total. Nine steps one way, nine steps the other way. Correct. And you want me to just go and you want me to walk? >> Yep. And then hit the toe to the heel. >> Yep. >> Like specifically hit the shoes. >> Yep. That would be perfect. Just like this. Heel to toe. >> Heel to toe. >> Nine steps forward while counting out loud. Nine steps back. >> I'm counting. I'm counting. >> Okay. You understand? Let me know when you're ready. >> You understand the instructions? >> Yes. Sound like I sound like I know the instructions. >> Yep. You can start now. >> Okay. One. >> While keeping your hands at your side. >> Oh, I'm so sorry. Three. Four. Five. 6. 7. 8. 9. Go ahead. >> 1 2 3 4 5 6 7 8 9. Okay, you can turn around and face me. >> Yes. >> While we're doing this test, I just ask you to keep your arms at your sides, feet together. All right. >> So, the next test is going to be the one leg stand. >> All right. So, >> okay. So, my balance has always been off and my physical therapist can tell you. >> Okay. >> On my right foot, especially. >> All righty. So, the next one that I'm going to have you do, next test is going to be arms at your sides, feet together. When I tell you to start, you're going to raise one leg, whichever one of your choosing, approximately 6 in off the ground. While you raise the leg 6 in off the ground, you're going to look at your toe. All right. >> Look at my toe. >> Yep. While keeping your hands at your sides, and you're going to count out loud. One Mississippi, 2 Mississippi, 3 Mississippi. Correction. 1 2 100 3 100. So on and so forth until I tell you to stop. Okay. >> Okay. >> You understand the instructions? Um, I'm just going to repeat it back to make sure that I understand them if it's okay. >> I'm just going to hold my foot out anyone of my choosing and then I'm just going to count 1 1 2 1 and then you're just going to tell me to stop whenever. >> Yep. >> Okay. >> So, keep your arms at your sides. >> My right is a little unbalanced compared. >> Listen. So, whatever foot of your choosing, whatever one you're more comfortable with. I'm raising my left for demonstration. Okay. But you can do whatever foot that you choose. Okay. So, as soon as you start, you're going to look at your toe while it's raised approximately 6 in off the ground. >> 1 1000 2 100 3 100 so on and so forth until I tell you to stop. All right. Yep. >> Out loud. >> Yes. >> Sure. You just want to know when >> you can start when? >> Yep. >> Okay. >> Hands down. Okay. Looking at my tails. 1 1 2 100 3 100 4 100 5 1 6 100 Sorry, 6 in 700 8 100 9 100 11 100 12 100 13 100 14 100 15 100 16 100 17 100 18 100 19 100 21,000 >> All right, you're good. All righty. Just give me one second. >> Okay. And then I I also um I'm so sorry to interrupt, but I can also download the app. I'm so sorry about that that I had one picked it up. It's been from October. It October 4th it looked like it said from But I can download the app and I can prove that I've been paying. >> Okay. She's obviously >> Yeah. >> 606. The tests were bad though. >> Yeah. >> Turn was a little off. >> Oh no. She uh stepped off the line, held her arms off. >> So, you definitely you have enough. >> Yeah. >> All right. >> Based on her erratic driving, the odor of alcohol, and her inability to adequately complete the field sobriety exercises, patrolman Malachi placed Carara under arrest for driving under the influence. The vehicle that she had been driving was impounded for a mandatory 12-hour hold under J's law. She was transported to the Red Bank Police Department for further processing. >> All right, for right now, just put your hands behind your back. All right. >> Okay. >> Listen, you're placed under arrest for driving while they're under the influence. >> Yep. You just release your hands. >> You're good. >> And who is that to? That's your boyfriend. >> That's not my boyfriend. coworker. >> No, we're just going to secondary and very nice. You have anything in your pockets beside your phone? >> Yes, I do. >> Okay. All right. We're just going to walk over. >> I have a key. >> All righty. Your keys for your car. >> My keys for my car. >> Headquarters one. What do you want? >> All righty. It's just uh the keys in this pocket >> and then the wallet's in this one. >> The keys are in this one. >> No, no, they should be in this one. Okay. >> I took them out already. >> Yeah, I didn't feel them. >> Okay. They're probably either in the com. >> Just give me one second. I'll be right back with you. All right. Okay. All right. >> No. Yeah. All right. Do you have a ride home? I can get an Uber. >> Yeah, that would be uh probably preferred. You want me to call an Uber? >> Yes, if you can, please. She >> all right. She's running. Yes. All right. Listen, Cara, I grabbed your wallet and keys. Are there anything else that you want me to grab from the car? >> Uh, is there anything else that you can get? >> Not I don't know what's in the car. So, >> am I going somewhere for the whole night? Anyway, >> um if you get somebody to pick you up, you would be released. But uh I mean if not, then you would have to wait with us. >> The only test that [snorts] I have for >> the only one? >> Yep. >> The only one. >> The only one? >> Yep. >> There's three that were just administered to you or your three tests. >> Which ones? The Okay. I only got two though. >> Three. >> What's the second? >> I I'll speak to you later. All right. But is there anything else I need to grab from the car that you need? >> Um, [snorts] do I have my cell phone? Cuz I need contacts. Yep. Okay. >> So, we're all good. Wallet, keys. >> The keys. >> Making sure my car is out of the way. >> Yep. So, your car is going to be getting uh towed to our impound yard. All right. >> Oh my goodness. Are you kidding? >> Yes. That's the law. >> There's no way. >> No, I'm I'm sorry. That's the law. So, >> what's your name? Patrolman Milachi. >> Malachi. >> Yep. So, just give me one second. All right. I'll be right back with you. >> Yeah. This is really embarrassing. >> So if I say you're going to fall at me. >> Okay. >> Does it matter? So if I'm going to embarrass myself, like does it matter? >> Does it what >> matter? >> If you're what to embarrass myself, does it matter by >> I mean that's up to you. >> Okay. >> So who does she is she able to call somebody to pick her up or does she want to sign for somebody? >> It's up to Do you want I don't know if you want him to sign for you. You need a ride home in an Uber or >> cuz obviously >> that that's that's up to you cuz the car is going to be impounded for 12 hours. >> 12 hours. >> So he said he's going to call an Uber. But if you're willing I'm willing to let him sign you out and take an Uber home. >> All right. All right. Just give me a couple minutes. All right. >> Yeah. >> Are you staying here with the car or is Todd? All right. Here are the keys. Heat. Heat. Yeah. Yeah. Don't worry. He can. >> You want to sign her up? >> You don't want them. >> There was nothing in the bag. >> What bag did you check? >> I checked the bag that was on that side. I'll look it. I took the black one. The black one. Okay. on a date. >> Yeah. All right. >> Yeah. >> You stay in here. Yeah. All right. 18 correction 20 headquarters. We'll be in route 103. Headquarters, can you close the west, please? >> I'm sorry. I didn't notice a minute. >> Negative. It's just open a little bit. Try putting it up all the way and then down. >> Yeah. So, your registration got suspended. Because >> at the Red Bank Police Department, Cara was read the standard statement for motor vehicle operators and agreed to submit breath samples for testing. Her alco test results indicated a back of 0.099% which was above the legal limit of 0.08%. Cara was issued the following summones operating under the influence. Reckless driving. Careless driving. Failure to keep right. Failure to possess driver registration and failure to possess driver insurance card. >> Didn't have insurance on the car. Okay. So, that's what we'll look at when we get inside. >> Okay. >> You can close it now, please. Um, so your registration got suspended because of the insurance and then your license got suspended because of the insurance as well a month later. So, the insurance, correct? I think I know why. Cuz I had to dispute something. Salvador. Um, dispute what I had to dispute.
