report of a disabled 2011 Ford Fusion on the train tracks near the crossing at Route 33 in Memorial Drive the vehicle had sustained some damages and the driver exited the vehicle as officers approached her they proceeded to make contact with the driver of the Ford who was later identified as Veronica V roll4 County attach and R Romeo 84 Lima Zulu papa how you doing hi what's going on I had been drinking and she admitted to doing so based on his suspicion of impairment Veronica was offered an opportunity perform field sobriety exercises yeah he said they're at least 45 minutes out second field sobriety exercise was the walk and turn test during the walk turn test Veronica did not touch Heel To Toe on each step and took an incorrect number of steps the last field sobriety exercise was the one leg stand test Veronica was unable to perform this test because she could not keep her hands at her side and she kept putting her foot down I'm going to do a couple tests with you buosi placed Veronica under arrest for driving Under the Influence her vehicle was impounded for a mandatory 12-hour hold under John's law and Veronica was transported to the Neptune Township Police anything like that no it's bad I'm sorry it is bad okay so right now you're being placed under arrest of driving while I'm car okay I am not driving while intoxicated you told me you were drinking I smell alcohol on you while we're talking and all the I just give you a a field sobriety test and you did not pass any of it okay so what's going to happen now is I'm going to take you into my headquarters I'm going to wait 20 minutes and I'm going to put you on a I'm going to give you a breath test and we're going to go from there and then I'll give you a phone call and you go home do you breath for testing you have the right at your own expense to have a person or position of your own selection take independent samples of your breath blood or urine for independent um testing if you refuse to provide samples of your breath it will be issued a separate summons for the refusal a court may find you guilty of both refusal and driving while in toxicated if it cour finds you guilty of the refusal you will be subject to various penalties including license ocation up to 20 years a fine of $2,000 installation of an ignition interlock and referral to an intoxicated driver Resource Center these penalties may be in addition to penalties imposed by the court for any other offense of which you were found guilty you have no legal right to have an attorney physician or anyone else present for the purpose of taking the breast samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide breast samples will be treated as a refusal to submit to breath testing even if you take the test but then do not follow my instructions do not properly perform the test or do not provide significant breast samples I will charge you with refusal to submit to breath testing I repeat the law requires you to meit samples of your breath for testing will you
