She was asked where her boyfriend lives and she initially responded by saying that he lived at the Verona Tavern before stating that he lived at the Verona Inn. The Verona Inn is actually a bar in Verona, New Jersey. Ashley admitted to consuming one shot at the Verona Inn before driving, but she would later admit to having two shots at the bar. I mean, it's >> I know. >> Yeah, I'll say. >> How you doing? >> I'm officer Clark. >> I'm Officer Clark. I'm just waiting for Officer Sub. How are you? Good. Thank you. Can you do me a favor? Can you just shut the car off for me really quick? >> Thank you. I appreciate that. >> How you doing tonight? >> I'm good. How are you? >> Good, thank you. Yeah. Heat. I don't want to heat. Heat. Heat. I'll be right back. Okay, >> I just had to shut the car off. She trying to call someone. I mean, I don't know what she's trying to talk to, but what is that? >> No. That's why I grabbed the jacket. I'm going to go put my phone in there. I don't need this thing, gang. So, cuz I'm going to be >> [singing] >> um realistically like in front of the car is probably going to be fine. Sure, it's wet, but Got it. Thank you. I got the lights. See you then. All right, man. So, just because of what I observed when you were driving and the effect you had, consume some alcohol today, we're just going to do some tests real quick to make sure you're okay to drive. Okay. All right. So, you might you can put your window up to keep your uh your car dry. We're going to step out. Oh, is the car off? Okay. Do you want to put your phone in there so it stays dry? Okay. We're just going to step to the sidewalk over here. You can talk to her. >> She's right here. You want to stand on the sidewalk? Okay. Based on the officer's suspicion of impairment, Ashley was asked to exit the vehicle and perform field sobriety exercises after Lieutenant Sheeper arrived on scene. The first exercise was the horizontal gaze nistagmus HGN test. During the HGN test, officer Subert observed the lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation, and the onset of nestagmas prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Ashley failed to touch heel to toe on each step, took an incorrect number of steps, and failed to turn. The final exercise was the one leg stand test. And Ashley failed to raise her foot in the proper fashion while displaying a lack of balance. >> So it was just the one shot, right? Just the one shot. Okay. Do you uh What's your highest level of education? Your highest level of education? Did you go to high school or college? >> College like one semester. >> Okay. Did you finish high school? >> Yes. Do >> you have a high school diploma? >> Yes. >> Okay. You going to understand the English language? >> Yes. >> Okay. Okay. Do you have any problems with your eyes? >> No. >> Any ongoing medical conditions I should be aware of? >> Okay. Do you wear glasses or contacts? >> No. Um Okay. Are you diabetic? >> No. >> No. Okay. All right. So, um just take one more step forward. So, we're off the crack. So, I want you to stand there with your feet together, your hands by your side. Okay. Do you see the tip of my pen right in front of you? Okay. You touch the tip of my pen with the tip of your finger. Perfect. So, what we're going to do, I want you to follow the pen with your eyes or eyes only. Okay? Don't move your head. Just going to go side to side. Ready? Okay. Oh, it's my pen. Don't move your head. >> See, it's in my pen. >> Yes. >> Okay. See some of the pan. >> Yes. Sorry. One more time. Follow tip of my pen. Try and keep your eyes open. Okay. >> My eyes are open. >> I know. They're squinting. I know. Keep your hands by your side. >> Sorry. My eyes are just I'm sorry. >> I understand. >> I'm following it. Okay. Same thing. We're just going to go up and down. Okay. >> [screaming] >> Okay. Um, no, I understand. I I feel you. I think that's why I put the jacket on. >> I'm just very cold. >> Do you have a jack in the car you want to throw on? >> Do you want to throw it on? >> No, I'm sorry. >> Okay. So, all right. Step in the road right here. So stand here close to the curb. >> Okay. >> Okay. Um next is going to be a walk and turn test. Okay. Do you have any issues uh with your back? Any injuries with your legs? Your back? Back is but it's okay. >> What kind of issues >> does that affect your ability to walk? >> It should be fine. >> I'm just asking. I didn't want to take everything into consideration. >> Be fine. >> Okay. But does that affect your ability to walk in any way, shape, or form? >> It should be fine. I I understand. >> But I should be fine. [snorts] >> I understand you should be fine. It's If you haven't and you can walk, that's great. I just want to know will it affect even if it's a small way, will it affect your ability to walk at all? >> I hope not. I don't know, honestly. I hope not. >> Okay. >> I don't have to do this. So, I hope not. >> Okay. So, take one step to your left right here [snorts] towards me. One step to your left. Okay. Okay. So, I'm going to get you in the starting position and I want you to stay in the starting position while I explain the instructions of the test. Okay. >> Yeah, sure. >> So, the starting position, I want you to imagine a line going straight out from your feet to straight out in front of you. >> I'm going to walk like my feet to my feet, >> right? I'll explain to you. Okay. So, imagine there's an imaginary line starting from your feet going straight out in front of you. I would like you to put your left foot on the imaginary line and then put your right foot in front of your left foot on the line touching hold to toe. Okay? And I want you to keep your hands by your side. All right? This is by your side. This is the starting position. I want you to stay in that position while I explain the instructions. Okay? Okay. So from the starting position, you're going to take nine heel totoe steps forward. It's going to look like this. One, two, three. Do you mind getting back in the starting position for me? >> Yeah. I I could do this if I didn't take a shot to be honest. >> Okay. Well, this is the this is the uh >> I'd be better off taking the line over here. >> Do you want to do this line? >> Yes. >> Okay. >> That's fine. >> Usually it's a little slippery when you touch water. I can't even hear this to be honest. >> Okay. So, >> put your left foot on the white line and put your right foot in front of your left foot on the line touching. Hold the toe. So, let's go back with your left foot. Put your left foot on the line. And then your right foot, you're going to put in front of your left foot on the line touching heel to toe. Just like that. Okay, that's the starting position. I want you to stay in that position while I explain the instructions. Don't begin until I tell you to. Okay. >> I can't even do this. >> Okay. [snorts] Can you try and get back in the starting position for me? So, when I tell you to begin, not yet. When I tell you to begin, you're going to take nine heel to toe steps along the line like this. One, two, three. I did three. You're going to take nine. On your ninth step, you're going to keep your lead foot planted. And with your back foot, you're going to take a series of short steps to turn around. Once you turn around, you're going to take nine returning steps along the line, heel to toe. One, two, three. I did three. You're going to do nine. Do you understand? >> I'm sorry. Do you understand? >> Yeah. >> Okay. So, while you're doing these, I would like you to keep your uh arms by your side. I would like you to count your steps out loud and if at any point you fall off the line, just pick up back where you left off. Okay. >> All right, you can begin. Okay, you can stop. You come back here. >> [sighs] >> That's okay. We just have one more test. >> We do it over here. >> Okay. >> I'm very sorry. I don't usually drink. I really don't. >> Okay. >> It happens. Do you want to be honest about how much you had to drink? >> About two shots. >> Two shots? >> Yeah. >> Okay. >> I I'm very sorry. >> Okay. I I understand. We just have one more test. Okay. >> Okay. So, just like before, you're going to stand feet together, arms by your side. >> Yep. >> It's going to be a balance test. Again, no issues with your legs or back aside from the chip. >> Okay. >> Right. I'm asking you, do you have any other injuries? >> No, I just have >> just a chip. Okay. Back in. >> So, don't start until I tell you to begin. But when I tell you to begin, you're going to lift one foot up, either one of your choice, approximately 6 in off the ground. And then you're going to count 1 1 2 100 3 100 and so on until I tell you to stop. >> Okay. >> Okay. So, it's going to look like this. When I tell you to begin, you're going to pick one foot up approximately 6 in off the ground. >> You're going to count 1 1 2 100 3 100 and so on until I tell you to stop. >> While you're doing this, I would like you to keep your arms by your side. >> I would like you to count out loud and I would like you to keep your foot straight or your leg straight. Okay? And if at any point you touch the ground, just thick it back up and start from where you left off. >> Does that make sense? You understand? >> Absolutely. >> Okay. All right. Whenever you're ready, you can begin. Can you keep your arms by your side? Put your foot out in front of you like you're instructed. >> So, you want me to explain one more time? Do you want me to explain it one more time? >> Yes. >> Okay. So, when I tell you to begin, you're going to keep your arms by your side. You're going to lift one foot approximately 6 in off the ground in front of you. Okay? You look at me while I'm demonstrating it. Okay? And you're going to count 1,00 2 1 3 100 and so on until I tell you to stop. While you do it, I want you to count out loud. I want you to watch your foot, your raised foot. I want you to keep your raised legs straight. Do you understand the instructions? >> Okay. Not yet. All right. You can begin. You keep [screaming] your arms by your side. You keep your arms down by your side. Can you count out loud for me? Put your foot in front of you. All right, you can stop. >> Based on her erratic driving, the odor of alcohol, her admission to consuming alcohol before driving, and [clears throat] her inability to adequately complete the field sobriety exercises. Officer Sub placed Ashley under arrest for driving under the influence. Her vehicle was impounded for a mandatory 12-hour hold under J's law. She was transported to the Verona Police Department for further processing. >> Your back for sorry. >> No problem. >> Hm. >> I'm very sorry. >> Okay. It's okay. At the end of the day, this is just a traffic violation. >> I got it. I got it. I'm sorry. >> Do you need anything from your car right now? >> No. I'm just >> You want your phone? I got you. Do you want your phone? >> My phone and my phone. >> So, listen. Your keys. Is there anything on your key ring that I need to take off for you? Do you have house keys or anything like that on there? >> No, I think uh my keys are in my car actually. >> Yeah. No, I know they're in your car. Is there anything on your key ring that you need so you can get home? >> Okay, no problem. >> So, unfortunately, part of this you're going to have to tow your car. >> My huskies, I think, are under my passenger seat. >> Okay. Do you have a wallet or anything in there you want us to grab for you? I think my dollar is in my pocket. >> In your pocket? Okay. All right. You can just walk this way to my car. >> And we're going to step off right here where it's flat where the driveway is. >> Just keep going. >> What side do you want? Uh >> this side and take the lighter off real quick. >> Yeah. Stand right here. >> Very sorry. >> It's okay. All right. Stand facing my car. Don't move. >> We'll get you in and out as quick as you can. >> You got someone that can pick you up? Yeah, but I just Oh, very sorry. I'm sorry. >> All right. It is what it is. Um, do you have anything in your pockets that's going to poke me or prick me? >> Oh, sorry. >> No. >> Okay. I'm just going to take the lighter off. Okay. >> Here. Step over to your right. Put all your belongings up here. Okay. Your phone and wallet at least. Nothing in your waistband, right? >> Okay. You have a hood on. Okay. [snorts] You can take a seat. There's a problem. Sniff seat. All right, just lean back as best you can. Face that way. Let's put the seat belt on it. All right. Hazkies are in here. Looks like >> we have your purse. We're going to take a whole purse with you with us. Okay. So, you can have when you get out. >> That's fine. >> Okay. >> Thank you. >> We're going to take the whole purse. That's okay. >> I Yeah. Now I'm just making sure that she doesn't try to hold it like a um yeah go through this. I don't know if that's actually anything. Yeah, it's in there. Heat. Heat. Heat. Heat. Heat. After the officers were finished with their paperwork, Ashley eventually released to a friend, he signed the potential shared lady warning form on Ashley's behalf.
