My phone has been acting up all day, so that's why. I'm sorry. I just moved to Winnetka, and I don't know my directions around here. >> Okay. All right, see if you can get it pulled up. Just give me a sec. >> Okay. >> On September 13th, 2024, at approximately 12:23 a.m., Deputy Serzenski with the Lake County Sheriff's Office observed a Nissan Rogue swerving across the solid white line while driving. He initiated a traffic stop and made contact with the driver, who was later identified as Hillary. Hillary told Deputy Serzenski that she was headed home after attending a work event in Wilmette earlier that evening. He asked Hillary if she had anything to drink and she admitted to consuming two drinks before operating a motor vehicle. >> 33-10 >> 10-4 >> Can you pull it up? >> No, I I don't know why this keeps happening. That's why I couldn't like figure out my directions. It's >> Yeah, that happened to me before. It's like if you keep trying to swipe and it doesn't recognize your face. Yeah. All right, do you live here in the subdivision? >> I live in I don't live here, so I don't >> What Why are you turning into here for? >> Oh. I just was turning in. That's um okay. >> Have you been drinking at all tonight? >> Um I had a couple drinks. >> Okay. How many drinks did you say you had? >> I I'd say like two. >> Two? >> Mhm. >> Okay. >> Can I Can I please just I I just need to go home. I'm I'm sorry. I'm >> Okay. You mind stepping out? And then >> No. >> Well, uh just check you out real quick, all right? >> Okay. >> 33 from 31. Can you uh come over here? >> 10-4 176 Fairfield >> 10-4 >> 31, I'll be doing fields. >> Doing fields. >> What happened to your leg? >> I broke my foot. >> Oh, wow. Um, you mind just stepping over here out of the street? You want to sit? >> 43, 10-4. >> 10-4. >> [laughter] >> Based on his suspicion of impairment, Deputy Serzynski called for backup and asked Hillary to exit the vehicle to perform field sobriety exercises. Deputy Serzynski started with the horizontal gaze nystagmus HGN test. Afterwards, he decided to not administer the walk and turn or the one-leg stand test because of Hillary's apparent foot injury. >> I'm sorry. >> What happened? >> I just I I I I'm sorry. I don't know the the roads here. Like I just moved here. I just >> That's fine. So, I want you to just stand over here and face me. I'm just going to read uh some directions for you here. All right, do you have any eye problems or abnormalities with your eyes? >> I got floaters, sicknesses, or something like that, but that's >> Okay. Uh how's your general health? >> Good. >> All right, are you wearing any contacts? >> No. >> You are? >> Mhm. >> Okay, are they just normal They're not colored or anything? >> No. >> All right. Um all right, so I want you to put your feet together with your hands at your side. So, just stand like this. All right, you you can step out of the up in. Push down. So, what you just saw, so feet together, arms at your side, all right? All right, good. Uh don't do anything else until I tell you to do so. Do you understand? All right. I want you to follow the stimulus with your eyes and your eyes only. It's going to be it's in my finger, right? Don't move your head. I'm going to move the stimulus in a couple I'm sorry. I'm going to read the directions. Uh put your feet together with your hands at your sides. Focus on the tip of the stimulus again, it'll be my finger. Follow the tip of the stimulus with your eyes only. Do not move your head. Keep looking at the stimulus until told the test is over. Do you understand? All right. Don't move your head. Keep your head straight. All right, I'm going to do a couple of All right. Ready? >> 119766119766 >> What are you looking at? I'm going to go up this time. All right, one more time. You're looking up at it. All right. Go ahead and blink your eyes a A of and reset your eyes. All right, so obviously I can't have you do some of these other tests because of your injury. Um that wouldn't be fair. Um do you want to provide a breath sample? >> After the HGN test was complete, Deputy Serzinsky offered Hillary an opportunity to take a preliminary breath test PBT, and she agreed to do so. He attempted to have her blow into the breathalyzer multiple times, but she failed to provide adequate breath samples in order to get of her back level. >> Um >> Sure. Yes. >> I'm going to stop the breathalyzer. Yes, sir. I just uh >> 50153 10-8 >> 10-4 >> You got to put it in the night mode. Hold it down for a sec. Like All right. One second with this uh warm up. So, the way you're going to do this is I want you to take a deep breath in, hold it for a sec, and then just keep blowing into the machine until I tell you to stop, okay? All right, you ready? So, deep breath in. All right, so when you do this, put your lips around it and just keep blowing until I tell you to stop, all right? Don't take like pauses. >> Sorry, my mouth is dry. I'm nervous. >> That's fine. All right, so take a deep breath in. Blow. All right, so again, put your lips around the tube and then just keep blowing and don't don't like pause, okay? >> All right. Does that make sense? You want to do like a practice one? >> No, my mouth is dry. I have to sneeze. >> All right, so again, take a deep breath in. Again. >> Okay. >> So I need you to provide an actual sample here. >> I'm sorry. I'm trying. >> Is that I've given you multiple chances here, so All right, so let's do it right this time. So let's let's let's do a practice one, all right? So deep breath in. All right. Don't bite down on the tube. >> Okay. >> your lips around it, okay? >> Okay. >> Does that make sense? >> Yes. >> All right, so deep breath in. Keep going. Keep going. >> It's not accurate. >> No, it has to be continuous. >> [sighs] >> All right. >> I'm sorry. I'm not trying to be sarcastic. >> I I understand. It's It's a little tricky at first, so It It just don't focus on more of a longer breath instead of blowing as hard as you can. Does that make sense? All right, so let's take another deep breath in. No. Again. I need you to How do I describe this? So >> I Can I take a drink of water? I don't feel like >> No. >> Okay. >> Because that it might mess up the results, so >> All right. I'm sorry. >> All right. So, again, let's do another practice one. So, deep breath in. All right. >> Mhm. >> And let's All right. You ready? >> Yep. >> All right. Deep breath in. Keep going. Keep going. Keep going. Keep going. Keep going. Let me try yours, ma'am, cuz this one Yeah. Trying to give you the benefit of the doubt here, okay? >> I I think it. I think it. I'm trying. I think I drank a lot and I'm going to vomit. >> How many drinks did you have? Did >> Two. >> And how long How long ago? >> I I was just going to be after the little breath, but >> How long ago was it? At what time do you think? >> I I Like 30 minutes ago. >> Like 30 minutes ago? >> Mhm. >> Do you know what time it is now? >> I would No, I don't, but >> Okay. You build ACs? Furnaces? >> I said I I can have drink water and I feel like >> So, the thing is, though, if you drink some water, it may it may mess up the result here. >> That's fine. >> All right. So, when you blow into this, you got to put your lips around it. It has to be a pretty decent like you you you know, blowing out pretty decently. It's not like a weak blow out and it just has to be consistent for like 3 seconds. All right, can you do that? >> Yeah. >> All right. Deep breath in. Again, you're biting down on it. >> Okay. >> Stop biting down on it. >> Okay. >> All right. Deep breath in. All right. I'm going to give you one more opportunity. >> I'm sorry. I'm I'm doing something wrong. >> Listen. Listen, I can't keep doing this all day. I'm going to give you one more opportunity. Now, I'm going to have to place you in handcuffs based on my observations, okay? Do you understand? All right, so let's let's make it a good one, all right?
