You available for that license, registration, insurance. Just so you know everything's audio and video recorded. >> That's fine. Okay. [Music] Around 11:19 a.m. on November 27th, 2024, officer Simon Scherer with the Woodcliff Lake Police Department observed a 2019 Hyundai with an expired inspection sticker and the driver was not wearing her seat belts as she was approaching the on-ramp to the Garden State Parkway. Officer Scher instructed the driver to pull over and made contact with the driver. The driver was identified as Marquia and he detected the odor of a substance that can cause impairment if it is smoked before operating a vehicle. License [Music] [Music] So yeah, the reason I stopped you, your inspections expired and you didn't have a seat belt on. So I'm just going to run everything. We can have a conversation about it. >> All right. I appreciate you having handsree, but for the future, don't drive and have somebody on the phone video wise because it's going to be it's could end up being an issue for you. I like that you didn't have it in your hand. That's important. All right, just your time for me. >> Do your thing, but you you got it, too, right? >> Yeah. Oh, there's the console. Hi. They're going to check your license. Um, I can smell the odor of marijuana coming from the vehicle. And from when I was here a second ago, you took a bunch of stuff and moved it all around. So, I'm gonna give you an opportunity to level with me on what you have and show me what's going on and what because you had wraps in there. You had >> Hey, I can clean my car. All right. I could straighten my car. I didn't get to do that. So, what's the issue? >> Okay. Look, I'm I'm going to give you an opportunity to come front with me because I can smell the order marijuana and I'm working with marijuana. >> Okay, perfect. When's the last time you smoked marijuana? >> Before I got on the highway. >> Before you got on the highway. >> Yes. >> Okay. So, you're just getting on the highway now. So, you just smoked >> like 20 minutes ago. And then I waited and I I had to go to work at >> 20 minutes. >> Yeah. >> Okay. >> Is it an issue? >> Yeah, it very well could be. >> What's the issue? >> All right. Where's that rat that you just had in the console? >> I just bought it from the store. It's right here. No, actually, there's nothing in here. It's right here. That's what I like. >> All right. There was more than just these two. Where was the rest? >> It's nothing in here. So, >> okay. What is this? >> Marijuana. It's a bag of marijuana. It's a bag of marijuana. Okay. >> It's not nothing in there. So, >> all right. Where is it? >> Is that what you just smoked? >> Yeah, but the blunt wasn't even around. You seen this right here? This is what I put the blunt out cuz I was not smoking before I got I didn't drive in the highway. I knew that. >> Okay. So, you said you just smoked before you got on the highway. >> Do you mind if I do two tests just to make sure you're not impaired? >> I'm fine. Do I look >> natural blunt? Central alarm. >> This is not This is not from a dispensary. It's not a prescription. It has to be >> from This is what I got it from. Yes, it is >> from the Usually Dispens got markings on it. That's not from dispensary. Don't lie to us. >> Why do I need to lie to you? I'm just trying to figure out. >> So, a dispensary item has a sticker on it with the percentage of where it came from and everything. >> Yeah, that's different than >> dispensary. Yeah. Okay, >> drop the blind here for me. >> So, do you mind if I just do some quick quick test to make sure you're not embarrassed to drive? >> All right, I'm just going to have you step out of the car right now. Okay, >> we're going to stand behind the car. Any problems with your eyes? Do you wear contacts? So, I'm just going to have you stand up, not lead to the car. And you see the tip of my finger? I'm going to have you do is I'm going to have you follow the tip of my finger with your eyes and your eyes only. You're not going to move your head. Okay. >> I'm sorry. I'm just really angry. Listen, I'm just having >> We just have to make sure you're not >> all these cars. Why y'all didn't stop then? >> That's my question. >> We did. She had a vehicle stopped right when you pulled up. I had a vehicle go. She had a vehicle stop. So, >> you're going to follow the tip of my finger with your eyes and your eyes only. Okay. There's nothing wrong with me, man. >> All right. Like I said, we just have to make sure you're not impaired, okay? Cuz if we let you go and something happens back on us. >> I'm sorry. It probably is not you guys. It's just what I'm going through and I just I literally smoked my blunt before I got here. I got to go to work. I just got awful. >> Okay, let's finish this so that we can get you to work. >> I don't understand why. >> All right, for this next one, I'm going to have you stand feet together, hands at your side. Okay. When I tell you to, you're going to close your your eyes. You're going to tilt your head back. And when you think 30, you're going to count 30 seconds in your head. And when you think that's passed, then you're going to open your eyes. Okay. >> You have stopwatch. [Music] >> Wait, I didn't say start yet. >> Okay. When I say start, you're going to close your eyes. Head back. And when you think 30 seconds faster, okay, you may be good. Okay. We're just going to have you sit back in your car real quick and just give us one minute. Okay. So, I saw the both eyes did uh converge. Yeah. >> Um and she did get the she did you see the flutters? fast. >> Yeah, she had the flutter. She said 23 seconds fast and 30 usually with um marijuana stuff um slowed down. Um but I I did see the flutters. >> The flutters converged. >> Both eyes did converge. >> Sometimes you have lack of convergence, but both eyes did converge. >> Okay. So you're looking for lack of convergence in >> Yeah, she the both eyes did converge. Um I did see the flutters though. >> Okay. So ultimately it's up to you if you want to take her back and we'll go through the whole Dr. thing. But I did see flutters. >> We have odor. We have 20 minutes. I mean >> that's enough. You understand? >> Yeah. Everything's out of call. Let them know where we got when we get back and we'll do the whole thing. >> Okay. [Music] [Music] Central. [Music] >> I'll be at 11 over. [Music] >> All right, man. Step out for me. >> 27. >> Step down for me. Come to the rear vehicle for me. You have anything in your pockets to be concerned about? >> I'm going to jail. >> No. Right now, you're going out of headquarters. >> Why? >> You're driving under the influence. Turn around for me. Turn around for me. >> Y >> Turn around for me, please. >> So what? So So what we're I'm going to tell you, >> we're going to explain everything. We're going to explain everything. >> So since you you >> So you going to take my car, everything? >> Let me finish. All right. What we're going to do is we're going to take you to headquarters and just like those tests I did, we're going to do it's not safe to be doing all these tests on the road. I'm just going to test to make sure you're not impaired. Okay. >> I have to go to work. Y'all don't understand. I just got this new job. I just I bust my ass. I do everything. Why? Why? What the [ __ ] did I do? I didn't do nothing to smoke to smoke weed and drive a car. >> I did not smoke and drive. I was only hitting my vape. I smoked before I got here. I live in my phone. >> What do you mean? I didn't even I smoked the blunt before I pulled off. I smoked the blunt. I went to the gas station and then I pulled >> Probably by the time you got on the >> Yo, I didn't even say something. All right, I'm going to turn around. That's no problem. >> Listen, if we do the test and everything is fine, then you're fine. >> It's the point. This This is wasting my I don't So, I'm about to get like a mud shot and everything. >> Officer Terara Tambbor arrived on scene shortly afterwards and she also detected the odor of the same substance. The driver also appeared to be in possession of items that were not purchased at a designated dispensary. Based on the officer's suspicion of impairment, officer Tambbero performed the lack of convergence test and the modified Romberg balance test. Since she observed indicators of impairment, officer Sher placed Marquia under arrest and brought her to the Wood Cliff Lake Police Department for further processing. All right. Can I ask you your back for me? We'll answer. >> I'm not going to have my car. I don't have I'm working to work to make sure I have these things. Are you going to take my car? I don't have the money to do all >> If you're not impaired, you can get back in your car and drive. You just have to make sure you're not impaired. >> It never has happened to me. And you you're just happy to do that. That's That's the vibe I'm getting from you, sir. That's the vibe I'm getting from you. I can't even talk. in my room. >> I'm trying to explain to you. Give me a second. I'm going to put your handcuffs for my safety and yours. And then we're going to answer all you. We're going to answer. I don't know you. I don't know you. I need to keep myself partner safe. Like my partner said, we're going to take you back for testing. Okay. If you come back un unimpaired, you're going to get back in your vehicle and have a good day. If you are impaired from the testing from the DR, then yes, your vehicle is going to get towed because you're driving under the influence. So, yes, it could get it. Okay. But we can't complete our test here because we're on the highway. It's unlevel and it's unsafe because I'm out of vehicles here. >> How am I going to be able to call my manager or anything? Can y'all give me a chance to get all Yes, absolutely. Where's your phone right now? >> Please. I'm not going to do anything. >> Where's your phone right now right now? Please stop touching me. I didn't No, you're not. You're going in the car doing all of that. I'm asking you can use I'm telling you Listen to me. Stop talking. >> I'm not being rude. I'm >> You're going in the car. Talk in the car. >> You're going No, I'm going to hold you. You're going to go in the vehicle. We'll get your phone. physics. You can't I can walk myself cuz I don't like the way you talk to me. >> It's our policy that I've got. I'm not >> being rude to you. >> Yes, you're you're talking over me. You're yelling and you're pulling away from me. That's fine. I understand you're upset and I watch Watch this puddle. We're going to step over together. Okay. I will work with you, but just follow my directions. When you yell at me and pull away from me, that makes me feel like you're being aggressive. Okay? Then I'm concerned for you and for me. I will work with you. Okay? I'm a nice guy. I'm not trying to be give you a hard time. my best in life and that shit's been making me bad. >> Well, grab your phone. I got to take your hat off. Is there anything else in your vehicle that you want? Is there a wallet? Is there a >> All my stuff Wait, you doing? >> I'm going to unhook it cuz I think it's stuck to your hair. >> All right. I'm going to put your phone and your hat in the front. >> Two phones. >> You going to put them in the hat? We're going to put them in the front. What else do you need? [Music] >> What else do you want us to get? I can't get all my things. >> Tell me. Give me like you say I want this. >> I'm sorry. I just need I just need a couple minutes. Absolutely. That's it. I just need a couple. >> Take a minute. I'll go I'll go look. If I see a person wallet, I'll grab it. Everything's video recorded. I'll bring it over to you. [Music] >> It was left on FaceTime. it off. He has two. >> Okay. >> Did you grab the stuff the uh >> the blunt? >> Did you put it back in the car? >> Did you put it back in the car? >> No, I think I threw it in the car, actually. Take take the key. Take that bag for her. I can't reach [Music] this keys. Put this in there. Put this in there. Put this in there. This I'm gonna >> what? >> I'm going to copy you and just go down this. Get all my stuff ready. >> Uh, go the other way. Yeah, go the other way. I'll give you a minute to, too. >> Okay. >> All right. I got you. You got a clear bag. We got the whole clear bag. Uh, I got your key, car key, and the other keys. Anything else you need? >> Yeah. >> Everything in the car is also audio and video recorded. >> Central one female in custody. Going back to headquarters mileage 550 411 [Music] >> for me and get me a case number. Anyway, [Music] number [Music] 43. >> Hey 48 central rising headquarters. Bottom mileage 55 416 Table. [Music] Um, >> I'll start observation. >> Yeah. >> I'll go get I'll get all my stuff ready and then >> you turn your general guideline all that stuff. >> Uh, yeah. >> Okay. >> Cuz otherwise it becomes a refusal. >> Yeah. Got it. >> All right. Step out for me. When we get to the steps, I'm going to hold your arm just because it's our policy. We don't want you to fall. All right? But otherwise, if you want to walk freely on your own, you're more than welcome to. [Music] We're going to go right into this room. We're going to take off one handcuff. We're going to connect it to the bar because that's our policy. See, I'm right in front of the chair. And then we're going to take you through some more exams and explain everything. >> As soon as you're done. >> Yeah. Give me a minute. Give me a minute. Okay. >> Cut his hand. >> Where do you work? >> During the day? >> Okay. All right, just have a seat for me for a second. We'll get things moving for you. >> Yeah, I'm going grab my stuff first. [Music] Let me bring my stuff in. Then we'll do the SSDs. After the SSDs, then I'll do the paperwork for the blow. And then we'll do 20 observation in the box. Hey, we didn't um so Tara just did some uh DR stuff out there. She found uh her reason suspicion. We're going to do the SFSTs here because we couldn't do it on the highway, right? >> Then we'll do 20 observation. They'll put on the box and then if she blows zeros as we're expecting, the entire will complete the process. >> We just tell Bridget let her know what we're doing. >> Just remember to use it. >> So we're going to be doing um >> it's a DR. So, we're going to let our SFSTs in the hallway right here because we couldn't do it on the Parkway on ramp. >> Okay. So, just giving you a heads up. >> SFST's here. >> The box is back. Otherwise, we're going to go somewhere else. Oh, it is. >> Okay. So, we'll do SSTs in the hall. >> Uh, no seat belt and inspection from February. >> Um, so we'll do SFSTs observation box. Um, and then Terra's going to run her DR for uh suspicion for cannabis. [Music] All right. Put them in here. [Music] Just show everything. [Music] [Music] [Music] You've not smoking dry. Okay. So, when we do the test when we do the test, we'll see that then >> the plan is we'll get you in and out of here. But with and with with the weed, it has to be if you have it in your car, it has to be from a dispensary with the proper label on it. Not a smoke shop. It has to be a state dispensary. >> Okay. So, you can't weed from a smoke shop. You have to just get it from a dispensary. >> Technically, it's illegal to buy it from a smoke shop. You have to buy it from a dispensary. >> Is it a smoke shop? I mean, it's not the same, right? It's not it's not what's what's the word I'm thinking of? It's not uh like with a dispensary they know exactly what's in it. You're being told it's not monitored properly. >> Yeah. By the government. >> So I need the labeling like THC that that that's what you're talking about. >> That's what you have at a dispensary. So you're allowed you're allowed to have up to six ounces. If those all packages all had labels on them from a dispensary fine. >> Um All right. So I'm going to cough. You good here for the tests? >> Yep. >> Perfect. >> Um you know what? Let's uh hold on one second. I just I do them again with my email. >> So, yeah, let's you know, I'm gonna have you run you run your SFSTs and then I'll do mine with on my iPad. >> Okay. All right. What's your first name? >> Maria. >> Maria. Can I call you Maria? >> All right. So, I'm going to I'm going to uncuff you. We're going to go in the hallway. I'm going to run you through three exams that we do in a situation like this. some extra cops in general. >> It's just >> you the man >> you the man that put me in the back [Music] about it. I'm really going through a lot. My dad died, my mom. I'm just going through a lot and sometimes I'm not going to lie, read makes me calm and I'm like all right, let me take two calls. I already knew because I'm living my the other day I went to all I did was go to the gas station and then doing the same thing you did and the lady was just like she didn't take it and then she was just like you can't she didn't see the blunt she was just like I smell it and she was like I just want to let you know you can't smoke and I knew that already. That's why I left out a decent time so I can smoke let it go and go to the gas station and then I don't that's why I'm saying I get it. Additional field sobriety exercises were administered at the station and it was determined that Marquia was impaired and that she should not be driving. The officers then decided that Marquia would be transported to the hospital for a blood draw that they could determine what may be causing impairment. Marquia was later issued the following citations. Operating under the influence, open container or unsealed cannabis. failure to wear seat belt and failure to have inspection. >> Come on. Come with me. >> I I appreciate it. Like, like I said, I I don't mean to be a lot. Sometimes it's just with working, we we come off as a lot, but I'm a nice guy. I will work with you. Whatever we can do, just, you know, like when you were yelling at me and pulling away from me, it gets me nervous. Not because I think you're going to hurt me. Like you said, you're not going to hurt me, but like you're pulling from me. There's cars going everywhere. Anything happens to you, that's my fault, >> right? I'm not trying in my life. I'm working on trying to control my emotions and I never been through this situation and I'm literally just minding my business. Like I told, like I told the other cop, it took a lot for me to get up out of the bed this morning and just pull it together. So then I just run to y'all and just was like, why can't I get a break? That's how I felt. So I apologize for you and the other officer. I'm not competitive. I'm not like that. I just appreciate that. >> And I feel like, like I said, if the things I had to think about it, if the things that I'm saying is true, it'll prove that. >> Yes. 100%. That's all that matters. >> All right. All right, just stand right here in front of me. Do one more step forward. >> Perfect. Leave your arms at your side. I'm just going to check your eyes. >> Yeah. >> So, what I want you to do is you're just going to follow my finger. Okay. Move only your eyes, not your head. >> Both your You don't have a glass eye. Nothing wrong with your eyes. No injuries, no trauma to the eyes. >> No. >> Perfect. You know, I'm going to use this. All right. So, just follow this only moving your eyes. >> I feel Is that okay? >> What's that? >> I feel like cross-sided cuz I got to watch. You think you like the finger better? >> So, yeah. So, just follow my finger. You're doing great. Just keep on going. Just like that. Good. Last one. You got to follow me up. Same thing. Only eyes, no head. Good. Good job. All right. So, next task is to walk and turn. So, what I want you to do is I want you to imagine you have a line in front of you. So, you're going to put your left foot on the line and put your right foot in front of it. Heel the toe. Perfect. Arms out of your pockets. >> I'm not so my my legs is not all the way like, you know, I'm like together. Okay. >> You see what I'm saying? So, my legs don't work like everybody else, but I'm fine though. >> Any surgeries to your knees? Any traumas? >> Hip. It's just the way I was born. The way my legs, that's the way to go. So, >> Okay. >> All right. Perfect. Hands out of your pocket for this one. I told you don't start until I tell you to. I'm going to give you I'm going to give you all the instructions. >> Um, >> left foot. >> So, left foot on the line, right foot in front. Just like that. Perfect. All right. So, when I tell you to, you'll begin. You'll take nine steps walking heel to toe on the line in front of you. You're going to count out li count out loud staring down at your feet. When you get to a ninth step, you'll turn around keeping one foot on the line and you'll do nine steps back. It's going to look something like this. I'm going to demonstrate for you. One, two, three, four. I did four. You're going to do nine. When you get to nine, >> heels half. >> Yeah. Heel to toe. When you get to nine, you'll keep one foot on the line. The other foot you're going to turn back around and you'll do nine back. One, two, three, four. Arms out at your side, counting out loud, taking uh those steps and watching. While you're walking, you're going to watch your feet at all times. Any questions? >> No. >> Do you want to show what I ask you to do? >> Yeah. >> Okay. Begin whenever you're ready. Four, five, six, seven, eight, nine. Up to nine. Turn. Good. Good. Last one. Stand heels together, arms at your side. Don't be I tell you to. When I tell you to, you're going to raise one leg. Either one. Doesn't matter which one you want. It's approximately six inches off the floor. You're going to point your toe. You're going to keep your eyes on your foot while you do it. Uh, and you're going to hold that position. And you're going to count out loud. 1 1000 2 100 3 100 4 100 until I tell you to stop. You understand? Perfect. I would go arms on your side. It's probably going to help you balance anyway. Do you can I borrow your timer on your uh on your watch? >> Hey, Sean. >> Yeah. I just had a quick DR question. You mind if I give you a call back in two minutes? >> Which going to use right or left? >> You pick. You pick either leg you want. Try to keep your arms at your side. Six inch off the floor. Point your toe. Look at it. And count out loud. >> Yeah. Whenever you feel more comfortable. When you're ready, we're going to start a timer and you should keep going till we tell you stop. >> Count out loud. >> 100 2 100 3 100 4 100 5 100 6 100 700 8 100 9 100 Sorry, I my breath. 10 100,000 11,000 1200 13 100 14 100 15 100 16 100 17 100 18 100 1900 21,000 21 100 22 100 23 100 Good [Music] [Music] in here. Have a seat for [Music] grab the form there. [Music] We're going to take you over to the hospital real quick. Okay. >> He's going to have to put the handcuffs back on. Bring in the car. Hospital is like 8 minutes away. >> Because you still you're still in our custody. >> But why? Okay. Okay. Wait. My question. Why do I have to wait to get my car tomorrow? I have things to do that I cannot wait. I have to go to work tonight. I will lose my job. >> There's something called John's law. If there's suspicion of people many years ago, they got released from the released from the police department. They got back in the car. I'm not >> You're under the influence. You're under the influence. Yeah. >> But I'm not. >> You are. Yeah. from all the from all the tests that we found is that we believe you already >> because I just hit the blunt before y'all. But here's the thing. With alcohol, you could have a certain amount and drive with with marijuana. >> I'm gonna lose my job. >> With marijuana, whether you have one hit or 10 hits, it doesn't matter. You're still under lose my jobs. >> But listen, >> nobody nobody takes care of me. That's what y'all don't understand. >> I know, but you you just you just told us you're telling us I hit the blunt before you stop. >> Yes, but I hit it twice. That's not that's not nothing to me. Is it? It's in your system. >> Yeah. You can't you can't say it's nothing to you. But you're saying you hit the blunt right before you got in the car. You're saying >> for like 3 hours and by the time I go to work tonight to my real job that pays my bills, I would not be high. That's what I'm trying to tell y'all. Why do I have to wait tomorrow? Who's going to pay my bills? I'm going to get in trouble. Y'all don't care. >> How many hours is it? >> It's 24 hours. It's got to be tomorrow. >> And I have to pay for it, right? >> Yes. >> That is not okay. That's not right. I don't >> I don't want to go nowhere. I don't want to go I don't think it's fair. It's not. Let me talk to somebody else cuz that's not right. Why do I have to pay for stuff that I did? Y'all took my car and y'all told me word for word that I was going to go back to my car. That's what y'all told me. >> We said >> that's not right. I don't have the money to get out. >> We said if you weren't under the influence, which you are. >> I'm Yo, >> you can't smoke marijuana and say I'm not under the influence. You admitting you smoked marijuana right before you got in the car. >> Nobody does a lot of you. >> So you're you're impaired whether took one hit or 20 hits. There's >> So, so here's the deal. We can either go the two of us >> or call the judge and it's done. I >> You will be able to pick it out. I don't care. I'm not I'm ready. Just come on. I don't care about [ __ ] My life is over. >> It's not It's not over. >> It is over. I'm going to get fired. I can't work with y'all. That's y'all realize. Y'all told me I was gonna get my car back. I just don't understand. I don't get paid for no no time. Oh, >> can I have your other hand, please? [Music] >> This is not I'm not going to do anything. I'm just twist it and let you know that. Can you do it a different way? >> Yeah. And twist it. Don't pull out. >> I didn't mean to. I was just twisting it. >> That's okay. I'll do it for you. [Music] Turn for me. Come back. Come back to me. >> Why would you lie to me? >> We didn't lie to you. You're under the influence. That's what we said. We said if you weren't under the influence, we we ran all our tests. >> Who's going to pick my [Music] turn around for me? [Music] Can I have his hand? >> Can you stop walking, please? Just turn for me. That's it. Just stand just like that. [Music] Can I really? [Music] >> I'm going to lose my job. You don't understand. Y'all don't understand. I would not be I was calm. I'm a calm person. I'm dead ass serious. Y'all don't understand. And the fact that it just look like y'all don't care. You want to know why? Cuz y'all have a job. Cuz y'all are working. I'm going to lose my job. >> I know. Listen, we we got your frustrations. You don't y'all don't have a phone. >> When we get back from the hospital. Yeah.
