Are you okay? >> Are you okay? >> Yeah, I am. >> Um, but I noticed you were kind of parked weird and stuff. >> Oh, my brother. >> Who is it? >> My brother. >> Nice. Um, >> that's why I never left. >> Yeah. >> Yeah. Okay. Well, don't call anyone yet. Do you have your license on you? >> Hold on. They stopped me, so give me a second. Around a 21 a.m. on August 31st, 2024, Deputy Sheriff Joe Peterson with the Semino County Sheriff's Office observed a white 2018 Nissan Sentra with its reverse lights illuminated in the parking lot behind 144 to SR436 in Castleberry. He made contact with the driver who was later identified as Kelly. Upon making contact, he immediately observed indicators of impairment and noticed that both passenger side tires were flat. He also noticed that both passenger side rims were dented and he asked her if she had hit anything, but she denied hitting anything. He radioed for additional officers to respond to the scene and began his DUI investigation. You >> hear me? Okay. Thank you. >> You're welcome. >> And do you have uh is it your car? >> Yep. >> Do you have a registration insurance? >> All right. >> Well, first off, it's my mom's. It's your mom's car. >> Yeah. >> You said it was yours. >> So your mom [ __ ] is the same. Yeah. >> I see. >> Mhm. >> Is your current address still? Do you have a good phone number? >> Same thing. >> What's your phone number? What? Say it again. I think that's one too many numbers. >> Can you say it slower? >> And then what? >> Okay. One too many numbers, but that's all right. Um, do you have any weapons in the car? >> No. >> Okay. Now, um, did you hit something? We noticed some damage up here. Oh, no. >> Tired spot. >> Oh, I see. There's some grass. Did you go off the road somewhere? >> Nope. >> Deputy Peterson asked Kelly for her phone number, but she was incoherent and unable to provide it. As he was speaking with her, he observed indicators of impairment and detected the odor of alcohol. Kelly told the officer that she was coming from a club called Room 22 in Orlando and admitted to consuming alcohol earlier that evening. Based on his suspicion of impairment, Deputy Peterson asked Kelly to exit the vehicle and perform field sobriety exercises. >> How did the tires get flat and you have grass? >> Because I've been here. >> Cuz you've been here. Where were you coming from before here? Time for >> I've been working in a minute. So yeah. >> Say again. You said what? >> I've been working here since since last minute. >> Since a minute. Where? Okay. So where were you going to? >> So I I used to work at dancers. I used to work at Now I Then who I am. >> Yeah. Okay. So, so where were you coming from and where were you going to? >> Home. >> You were going home. So, where were you coming from? >> Home. >> Coming from home. So, where were you going to? >> To my brothers. He told me to go home. >> So, you coming from I see >> to my brothers and he didn't understand that cuz he's on the phone right now. >> I see. >> Yeah. My brothers. >> All right. Well, here's what I'll have you do. Um, is it Kelly? Is that the name? >> Mhm. Kelly, can you step out of the car for a minute and just come right back here? >> You can have it. >> Okay, here. Come. All right. So, I have a red pen. >> You have red pants? >> No. >> That's all right. >> I already know it. Like, you're not trying to come understand like the whole I can't do the whole >> Okay. Well, we'll >> I can't do that cuz you're not tell me [ __ ] Well, >> how much have you had to drink tonight? cuz I smell the alcohol coming from. >> So, I'm going to I'm I'm be honest with you. >> Be honest. That's all I ask. >> I am. >> Please. >> I'm going a heartbreak right now. >> I understand that. That's hard. >> Let me ask. >> So, how much did you drink then to get over the heartbreak? >> 2%. >> Two how much? >> 2%. >> 2%. >> Yeah. End of the day, I'm home. >> Okay. So, did you have beer or liquor or vodka or >> No, beer. >> Wine? >> Yeah. >> Beers? What kind of beers? >> Like beer I was drinking was more so like the hard liquor, the beer. It was more so >> Mhm. >> I used to work there. >> It's where you work? Where you used to? >> No, I do. >> Where is that? Downtown. >> Downtown where? What's the place? What's the name of >> Room 22? >> Room 22. Yeah. >> Oh, that's what you were saying. 22. >> All right. How many beers did you have? >> Only one. >> Just one beer. How many liquors did you have? >> One. >> One liquor. >> Only shots. They tell me take a shot. I take a shot. >> So, how many times they tell you to take a shot tonight? Do you remember? >> One. >> Just one? >> Yeah. >> So, okay. >> I told I want to go home. Okay. And you told me when to go home. Okay. >> Oh, thank you. >> Deputy Peterson started with the horizontal gaze nice HGN test. The second exercise was the walk and turn test. During the walk and turn test, Kelly failed to touch heel to toe on each step and took an incorrect number of steps. The final exercise was the one leg stand test. During the one leg stand test, Kelly failed to raise her foot in the proper fashion and did not keep her arms at her sides. >> All right. Are you able to see that red light? Okay. So, here's what I want you to do. Step away from the car a little bit. Stand with your feet together. Arms at your side like this. All right. Then keep them at your side. So, you can you can see this. >> Mhm. >> All right. Now, um, do you wear glasses or contacts? >> I do. Yeah. >> Do you are you do you have contacts? >> Yeah. Keep your feet together. Um, do you are you wearing your contacts right now? >> No. >> Okay. And then, uh, are you on any medications? >> No. >> Okay. Um, do you have any other physical or mental diagnosis, anything like that? >> No. >> All right. So, you can see this? Yeah. >> Okay. So, again, feet together, arms to your side, your arms to your side. Okay. There you go. All right. Try to hold that. Now, focus on this. I'm going to follow it with your eyes only. Okay? So, keep your head still. Follow it with your eyes only. Okay? You watching? Try to keep your arms at your side. Okay, I'm going to go up. Go up one more time. >> Okay. Thank you very much. All right. So, I'm going to have you do um I might need my little paper, though. Go ahead. >> Okay. Be right back. I got a little >> I got this one here. All right. So, let's see. This All right. So, Kelly, I'm going to have you come to this line right here facing this way. >> Can you see that line? >> Yeah. >> Here, come back. Come back. right here. Just go near the start of the line. Right. And up. So >> before you start, would you like shoes on? Do you feel more comfortable with shoes? >> No. And do you feel like this ground is pretty level? >> Okay. >> Um, so can you stand with place one foot on the line and then >> Yep. And then your other foot in front touching heel to toe with your arms to your side. Can you try that real quick? >> Yeah. >> Here, try it right now and try to maintain that position. No, don't start the exercise. So, >> Connie just said it. >> No, no, no. I want you to stand like this first. >> Just exactly what she's doing. >> One foot in front of the other. >> Left foot. Yeah. >> Your two feet are touching. The heels are touching. So, how >> I am trying to Okay. >> All right. So, you want to have your right foot and your left foot touching just like that. do that. >> Can you do that? >> You put heel to toe. Can you touch heel to toe and hold it? >> Can you not do that? Can you put >> No, I can't. >> You going to try it? Take your time. >> Just like this. Put your hands to your side. Just like this. >> Can you do that? Yeah. >> All right. >> All right. So, stand like that. Hands to your side. She's going to explain the directions. >> All right. >> Put your hands on down by your side. Stay by yourself. >> You understand what we're saying, right? >> Okay. All right. So, just hold that position and then I'll tell you I'll don't start until I finish the instructions. Okay. Don't start the exercise till I finish. All right. So, when I tell you to start, you're going to take nine heel to toe steps down the line. Turn. Take nine heel to toe steps back. Okay? So, it's going to look like this. One, two, three, all the way to nine. Okay? Okay. When you reach your ninth step, you're going to take a you're going to keep your lead foot on the line and you're going to turn by taking a series of small steps like this to the outside. See, series of small steps. >> Yeah. >> Then you come back >> to my left though, right? >> Um, whatever your lead foot is is on, wherever your lead foot is, you go around, you go around your lead foot. Okay. Okay. And then while you're walking, you're going to keep your arms to your side. Okay? You're going to you're going to watch your feet at all times. And you're going to count your steps out loud just like I was doing. 1 2 3. But you're going to go all the way to nine. Series of small steps. >> Nine and turn. >> And then come back. Okay. >> Nine. Turn. Right. >> Yes. And then once you start going, don't stop until you finish the whole thing. >> Okay. >> Okay. Do you understand all that? >> Yeah. >> Okay. You ready? This is the starting position, right? Left foot on the line with your right foot in front to touching heel to toe. >> Okay. Are you ready? Okay. When you're ready, complete the exercise. When you're ready, go ahead. That's why it's in reverse. >> Yeah. Okay. All right. Done. [Music] All right. Okay. So, we're going to do another exercise. which is called the one leg stand. Okay. So on this one, >> wait. I can't I trying to understand where I'm coming from, but like my brother has to understand where I'm coming from. >> I'm sure he does. >> No, he doesn't. >> No. >> No. >> I'm going tell you right now, like he thinks I'm innocent right now. So like right now I need he understand it. >> Well, he's family. He'll he'll forgive you. He'll forgive you. >> No, he's not. >> Okay. >> No, me dad. He's not. >> Okay. But he'll forgive you if he cares about you, right? >> Okay. >> Our we'll worry about that. We'll worry about that's in the future. >> That's in the future. We'll worry about the present real quick. >> We'll get through this together. Okay. >> There's nothing else in the future cuz I don't remember [ __ ] >> Okay. So So here's this one. It's called the one leg stand. You're going to stand with your feet together and your arms to your sides once again. Okay? Just like this. Okay? Um, don't start this exercise until I tell you to. Okay? Do you understand? >> Right. Right. But let me let me get through the instructions. Don't start till I finish. Okay? Do you understand that? All right. So, when I tell you to start, you're going to raise either leg with your foot approximately 6 in off the ground. keeping your foot parallel to the ground. So, >> okay, but listen to me. >> It's like, >> how [ __ ] is my six inches? >> It's like this. See how my foot's parallel to the ground? About 6 in high. One leg. Whichever leg is more comfortable for you. >> Yeah, but I can't hold the whole same thing. >> Okay. Well, this it's it's not pass or fail. Okay. >> Just do your best. >> Okay. I'm saying that it is though. >> No, no, it's it's just an assessment. Okay. So, so with that being said, okay, you're going to lift your leg like I showed you. You're going to keep both legs straight. Keep your arms at your sides. While holding the position, you're going to count out loud in the following manner. Okay? >> 1,001 1,002 1,003. Okay? So on and so forth until I tell you to stop. >> Okay? You're going to keep your arms at your side the whole time. You're going to keep watching your raised foot. You're going to keep your eyes on your foot. Okay? So again, I'll I'll demonstrate one more time. It's going to be like this. 100,00 1,002 1,003 1004. And you just keep counting and I'll tell you when to stop. Okay. If you happen to put your foot down like this, just pick it back up and continue counting where you left off. >> Okay. >> Okay. Do you understand all that? >> Mhm. >> All right. So, let's get in the starting position. >> Feet together, arms to your side. It can't be in the car. >> Oh, we'll leave your car alone for now cuz it has flat tires. >> Barely. >> That's all right. We'll get to it. >> I'm saying like barely can't face my car next to it. >> No, not not right now. Let's finish this and we'll get to that. Okay. >> Okay. >> You ready? >> That looks kind of uneven. Why don't you come back over here? >> Cuz it is >> cuz it's got extra >> got extra paving going on there. M. >> Okay. >> Does that feel better? >> No. >> Okay. You ready? >> Mhm. >> All right. When you're ready, raise your foot and start counting like I instructed. >> No. >> Where you going? Where you going? Just stay over there. >> Stay there with her. >> Try it again. You want to try it again? >> Over here, ma'am. Back on this line. >> No. I don't know what line. >> This line right here. This yellow line. Yeah. >> There you go. Right there. >> Yeah. Don't go over here cuz it's like kind of bumpy over there. You want to try it again? One second. There we go. >> Okay. You want to try it again? You ready? >> No. >> Okay. Remember the instructions. You are here and not over there. >> Right. But you're going to keep your arms to your side. Raise one foot approximately six off the ground. >> You're going to tell me something? >> No. >> Oh, then what are you doing? >> I'm trying to be adjusted. >> Okay. So, you're going to do it this way? >> Yeah. >> All right. You ready? >> Cuz right here, I can't do it. >> Okay. You can do it there. >> Okay. >> All right. Try it. Wait, like how long from my feet? >> You're going to keep counting out loud. 1,00 1,0023. >> It'll be approximately 30 seconds. So, just do your best. >> Ready? >> Ready? >> You started. >> Mhm. >> Okay, go. >> Bouncing. Two. Three. four five six n do [ __ ] because I [ __ ] with my man. So yeah, it's not >> Okay, that was 30 seconds. Okay, >> I can't do it. >> It's all right. You did your best. >> I tried to cuz I [ __ ] with my man. Yeah. >> The most. So, yeah. I can't do it. >> That's okay. >> Mhm. >> All right. Okay. That's okay. Ryan and my brother died. Based on the damages to her vehicle, her admission to consuming alcohol, and her inability to adequately perform the field sobriety exercises, Deputy Peterson placed Kelly under arrest for driving under the influence. >> Say it. [ __ ] My brother. >> All right, Kelly. >> I'm going to take you under arrest for suspicion of driving. Do you have some shoes in the vehicle you can put on? >> Nothing. There's shoes in the front seat if you want. Just grab them. >> Hang. Can you go on my brother though? >> Can we call my brother for a second? >> Oh, we'll get to that. Yeah. Let me get these on first so they're not too tight. >> Okay. >> We'll grab your palm out. Can put your palm outward like that. probably doing it now though. >> Hang on. We'll explain everything in a minute. >> Mhm. >> Hang on. Hang on. >> Okay, >> hang on. We'll get those on in a second. >> I know. I know. >> All right. You can get your shoes on now. 524 seminal has one. We'll also do the toi you needed to do. >> Sorry. No. Go to my property, buddy. [Applause] Let's see what these You know everything we need for the Toshi, right? >> Never done one, but I know. >> Oh, really? >> Never done one here, but >> it's basically I'm sure the same everywhere, but basically you just need high high value items. >> So, like obviously the heels are expensive. >> I'm kind of looking for like open containers in the seats, too. >> Yeah. I mean, all that's good to not report, but for the tow sheet itself, you just need mileage for the car if you can get it. >> 73 680. >> Yeah, that's cool. >> Keys. We're gonna keep here. >> The tow driver will need the keys obviously right there. So, that's good. >> And then just any high value items you're going to need to notate in the uh in the actual toshi in your purse. This looks old. What are these other keys here? They look like maybe to a different [Applause] um trunk. Sorry. She's got brake lights in here. >> Did anybody go and get a 1070 on support yet? >> I don't think so. >> So, did you put the tag on the screen? Right. >> Yes. So go on support ask 1070 reference your 1015 seminal. Did I have a 1070 reference my 108? 5247 and I have a 107 in reference my 1028 event 256. That's the signal with one 1015. >> All right. So, so you got inventory of books here. >> Yeah. So, you need to do an inventory of the car cuz it's going to ask you what's in the car. >> Um, you're going to need to get her phone number cuz we're going to need to put that in the tow sheet and then an inventory of the outside what's damaged. So, walk around and see what's cuz it's going to ask you where's damage on there. You got the mileage. >> Yeah. >> Okay. Um, and then we should be good at this point. And then >> So, the only thing I see is like her pepper spray, her keys. >> So, she's got a bunch of pairs of shoes. >> Yeah. One, two, three, four. Four pairs of shoes. Heels. 9 and five. >> You call for a 1070 yet or no? >> Yeah, I just did. All right. So, the damage we got. >> Oh, do we need to tell them we need like a flat bed or >> they'll they'll know what they need. damage. Looks like bumper damage here. That's all she needs. We'll just leave the car key with them. Okay. >> Okay. Yeah. Yeah. >> A second. If you go to tracks, click on, you know, where it says tow. >> Okay. [Music] It really had to be that tight. I think it was pretty tight. [Music] That wasn't the person that was trying to rescue My dogs taking me in. Why couldn't they take me in? >> Because it's time for me to go home. >> Makes sense. [Music] Are we that far? >> Huh? >> Are we that far? >> 5 10 minutes. >> No, I never did. That's why I only asking. I only been to they told no one. That was it. >> Dayton. >> Yeah. >> I didn't know they had >> not not because of me obviously, you know. >> But yeah, other circumstances. Yeah. [Music] [Music] But you do are you do are you are sure that if I don't have my brother's phone number I could at least get on my phone? >> Yes. >> Okay. So I need to make sure cuz it never happened to me. So I don't know. All I know is I gotta make sure my brother knows that. Yeah, he got me here. [Music] [Music] Is it be my record? >> Huh? >> Is this going to be my record? >> I don't know. >> It is. Since it says you don't know, that means it is. I'm a leasing consultant. I work at the Paramount Lake in downtown Orlando. So if that means that I'm trying to get another job or any circumstances and then run my background, this is going to be it. [Music] Yeah, cuz I'm a wholesome ass [ __ ] but not right now, obviously. They're [Music] [Music] going to see what you [Music] Wow. [Music] I'm telling you, you don't. This is my first time I ever went to jail. [Music] [Music] is the fact like why can't I get it a chance before going to jail? Damn, [Music] it was no opportunity. [Music] Heat up [Music] here. [Music] Does that mean I have to be like taking my whole clothes off and wear their outfits. [Music] >> Feel like they're lying. >> I see the movies. Well, >> if you already know, my guess is >> cuz I already experienced it. But since you work here, so I feel like you know it's different. If you ask me like, "Oh, how is leasing going to be and then how to get apartments?" I will tell you how the process goes. I don't know. I've never been arrested, so I don't know. But >> I feel like you know the process, though, cuz you arrest people. You should know. [Music] That's same way that people tell me. You should know the credit score. I do know the principle and I'm being honest. I'll tell you you're you're supposed to have more than 600. [Music] [Music] I'm supposed to move on Monday and obviously it's not going to happen. And especially Labor weekend, that means I don't have no court case after after Labor Day weekend. [Music] [Music] [Music] That means freaking Good morning. Tell them is right though. Says Labor weekend. I'm not going to see nobody until after Labor weekend. >> I don't know. >> It's facts. You don't have to really lie to me. [Music] Hey, [Music] >> heat. 537 514. Got the watch. [Music] [Music] [Music] At least get water. >> Huh? >> At least get water. >> Once you go in there, >> when am I going to go in there? >> Huh? >> When am I going in there? >> I don't know. >> It's really humid out here. I just don't have any new water bottles to give you. >> I know, but he at least put an air on. >> It's on. >> Barely. Did you put the windows down? >> Yeah. To get you fresh air. >> Barely. It's not fresh air. This is hot air. I'm sorry. I'm a little bit bougie. I've never been in jail. Morning. She's actually on that side. Hello. Are you injured at all? >> No. Homicidal suicidal. >> You take any prescription medication? >> I have asthma. That's it. >> Oh, yeah. She uh I think she started. >> Kelly was transported to the John Epoke Correctional Facility for further processing. She agreed to submit breath samples and the results indicated a back level of 0.25% which was over triple the legal limit of 0.08%. Kelly was charged with a DUI 316.193 and eventually transported to HCA Lake Monroe Hospital for further evaluation in her back level.
