[Applause] just try to gather yourself all right let me know when you're ready and we'll continue around 12:43 a.m. on April 24th 2023 officers Bonilla and the Jesus of the Hoboken Police Department responded to the scene of a motor vehicle accident involving a 2019 Mercedes and 2011 Honda Civic in the vicinity of Washington Street and 13th Street officer Jesus spoke with Katarina and Sarah who were inside the Honda that had been struck and officer Bonilla made contact with 25-year-old Julia who was the driver of the Mercedes the driver and passenger who were inside the Honda Civic told officer to Jesus that the driver of the Mercedes was probably Under the Influence while the driver of the Mercedes initially denied consuming any alcohol hello hey how's it going good how are you good um very [ __ ] crazy you driving no we wer parked and she just hit us I think I you're this is your car so you parked where like right here and I was going to drop her off so I was in park and then out of nowhere she pushed us like the car pushed us all the way to here but I was in park I wasn't even moving at I think she's drunk has to be drunk you in this spot that's where I was and she pushed the car already here [ __ ] came from nowhere nowhere I didn't even see a car coming I don't even see anything coming she has to she has to be wasted she like threw a cup out she like swung a cup from you have to be drunk after she hit you yes you have to be drunk she opened the door and like flung two cups out on the side to drunk how are you I'm like talk [ __ ] sedated no you have to be drunk do you guys need an ambulance no I'm have check you out yeah we just get checked out look at you to make sure you're okay I'm going to go there two females right here we're in this vehicle uh the one in the brown Coach complaining of chest pain all right right how's it going you want to step out the vehicle for me are you okay no like like physically my armor I'm talking to my Mercedes button for the asked Julia to exit the vehicle and turn off the engine as he began to speak with Julia he detected the odor of alcohol in her vehicle and noticed to empty cups on the driver's side door her her eyes appeared bloodshot and watery while her speech was incoherent based on his suspicion of impairment officer Bonilla asked Julia to perform field sobriety exercises while she had initially denied having consumed alcohol she later admitted to having consumed some alcohol in the hours prior what uh what happened is your car on by the way it is you want to turn no relax calm down calm down I know I'm SC scared calm down just turn your car off for me cuz the girl came and yell at [Applause] me I'm talk at Mercedes and they said that I can't drive my car home I have to tow my car you do have to to the car because of airbags deployed I don't want to my car to be it's it's it's nonnegotiable I know I know it's jul so what [Applause] happened she's going to her her arm hurts and then the other one said her chest hurts so so both please my wind like 5 and I just went this night and then we just crashed I don't even remember what happened which were you coming from were you driving this way was yeah I driving I was on this side on the other side and now I'm on [ __ ] this side okay so obviously it's my fa whatever whatever can I just get you a license registration insurance right now yeah I think so SM over here but I don't smell her smell on her [Music] no I will they're saying that they were literally B where she is and then she moves in at that this one might be a newer one my dad dad exercise was the horizontal gaze nice tyus hgn test during the hgn test officer Bonilla noticed a lack of smooth Pursuit distinct and sustained nagus at maximum deviation and the onset of nagus prior to 45° in both eyes he did not observe any vertical nystagmus the second exercise was the walk and turn test during the walk and turn test Julia displayed a lack of balance turned incorrectly and failed to walk Heel To Toe the third exercise was the one leg stand test during the one leg stand test Julia kept putting her foot down while swaying and using her arms for balance just just try to calm down all right all right for this first do you have any medical history do you wear glasses I do wear glasses are you wearing contacts right now I am wearing okay that's fine do you have anything that's going to prevent you from walking or doing a a series of short tests any knee injury [Applause] now for this one what you're going to do is you're going to follow the tip of the pen with your begin you're going to raise the foot and then you're going to count 1 1,000 2 1,000 3 1,000 4 1,000 it's all right you're just counting up one so 1 1000 2 1,000 until I tell you to stop 23 take the was you're going to raise your foot approximately 6 in you're going to keep your body straight you're going to count out loud and you're not going to stop until I tell you to all right just give me one second I'll tell you to start all are you ready so any any foot you can raise just keep just keep your hands at your sides okay you could begin NOP no worries whichever foot you can 1000 no you the traffic accident her incoherent speech and her inability to adequately complete the field sobriety EX sizes Officer De Jesus placed Julia under arrest for driving Under the Influence her vehicle was surged by Officer Proto papida searched her vehicle and did not find any intoxicants but nonetheless stated that there was an odor of alcohol within the vehicle officers Bonilla and De Jesus transported Julia to the Hoboken Police Department for initial processing Sergeant Martinez from the Union City Police Department came to conduct a search which yielded negative results for Contraband First Responders from the Hoboken volunteer ambulance cores have subsequently evaluated Julia and she did not wish to go to the hospital huh 450 favor turn around yeah put your hands behind your back [Applause] who's uh transport uh across street okay you have all the information from I have that vehicle passenger driver got all their info I got their story all got a witness over here and then there's aant on that side of that car all so I'll grab this car is hours so we can no no I'm going to I'm going to check it but yeah I have intoxicant like the cups and stuff like that photos I'll Sergeant Luke zarski who is certified to administer the ALCO test machine read Julia the standard statement for motor vehicle operators and she agreed to provide breath samples she also waved Her right you have been arrested for driving while intoxicated that's our statute that's just the the um the violation statute do you do like um the like Breyer that's what this whole form is for oh okay okay so um we're go with number one right you understand number one okay number two the law requires you to submit samples of your breath for the purpose of testing to determine alcohol content number three a record of the taking of the breast samples including the test results will be made upon your request copy of that record will be made available to you after you have provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you'll be issued a separate summons for the refusal a court may find you guilty of both refusal and driving well intoxicated if the court finds you guilty of the refusal you will be subject to various penalties including licensed revocation of up to 20 years a fine of up to $2,000 installation of an ignition interlock uh and referral to an intoxicated driver Resource Center these penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty you have no legal right to have an attorney physician or anyone else present for the purpose of taking the breath samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit the breath testing even if you agree to take the test but then do not follow my instructions do not properly perform the test or do not provide sufficient breath samples I will charge you with refusal to submit the breath testing I repeat the law requires you to submit samples of your breath for testing will you submit the samples of your breath so that is what time you got there 156 okay 0 156 hours okay so I just need you to open your mouth do you have any Dentures um or retainers or anything like that Sergeant zot tarski administered the Alo test machine after a 20 minute observation Julia's Alco test results indicated a back of 0 point to 3% which has nearly triped the legal limit of 0.08% after Julia was fingerprinted and photographed by Officer Jesus she was released to her cousin after he signed the potential sh lady warning form on her behalf Julia was issued the following summonses operating Under the Influence reckless driving traffic on Mark lanes and assault by Auto court records indicate that on October 4th 2023 Julia was found guilty of operating Under the Influence based on her guilty findings she was subjected to a 3 Monon license revocation 12 hours at an intoxicated driver resource center and $640 in funds she was also found guilty of traffic on Mark lanes and find $200 to Dollars the citations for reckless driving and assaults by Auto were dismissed as part of the plea agreement so you have no implants or anything any piercings in your mouth or anything like that y okay um just open up real quick and I just have to inspect make sure there's no like gum or chewing in the backro lift your tongue up okay so your mouth is clear so let's see
