body cam okay I'm going to come over on your side around 11:06 p.m. on July 16th 2022 officer Kevin Pano of the Denville Township Police Department observed a 2019 Hyundai driving erratically on Route 10 West officer Pano proceeded to initiate a traffic stop by activating his lights the driver of the vehicle 26-year-old Stephanie agalar pulled into the parking lot of the Joyce Honda dealership he noticed that her daughter a minor was sitting in the passenger seat of the vehicle and proceeded to ask her where she was coming from and whether she had consumed any alcohol she admitted to consuming alcohol and officer Pano subsequently asked her to exit the vehicle officer Christopher orway arrived at the scene shortly afterwards to assist why are you driving so fast I'm sorry okay well got to get home safely right where are you coming from um North BG where northb okay what were you doing there there think okay how much did you drink tonight maybe just one I'm not okay well you were going pretty fast you're passing cars in the right lane you got to pass on the left and then you're changing lanes without properly signaling okay all this while I don't know how old your daughter is but you know you're driving a little bit crazy right where you going home I'm sorry over okay well I can't hear you so and your license says Clif in so I'm trying to figure out where you're going yeah I know I just move okay what did you drink tonight nothing well you said you had a beer earlier okay one what was it uh Cora that's it okay give me a couple minutes 82 is going to have one out testing in the Honda [Music] lot 71 can you respon [Applause] Stephanie can I have you step out of the car please I just want to talk to you with is that your daughter in there or just somebody else my daughter okay due to the fact that your driving was a little bit aggressive um you've admitted to having an alcoholic drink and I can smell it on you I want to just make sure you're okay to drive as long as I'm going to run you through a couple tests as long as the tests go well we'll get you out of here I have to cover my bases hold your potentially driving drunk after being in contact with me okay I hope you can understand that should take a couple minutes I'll get you on your way um I do have to wait for someone else to come here um are you in a rush or no dude if you want to let I know you were just on the phone or something if you want to call them and just if they're waiting that's my brother all right based on his suspicion of impairment officer Pano offered Stephanie the the opportunity to perform field sobriety exercises the first exercise involved the walk and turn test and Stephanie failed to walk Heel To Toe or turn as instructed the second exercise was the oneel leg stand test and Stephanie failed to raise her foot in the proper fashion the final exercise involved the horizontal Gaye nagus test and it was performed by Officer orway all right are you comfortable doing them in those shoes or do you want to do them Barefoot that's fine okay um so we can get these going actually um if you want and can step up here we'll use this line here you can uh put your Left Foot Right Here here right here here wait go like this you're going to stand on the I need to and walk down this line I'm okay look put your foot right here you're going to stand right where I am and you're going to put your left foot right there [Applause] okay you're going to put your left foot on the line and your right foot directly in front of it heal the toe you're going to put your arms down at your side and stand just just like how I am heal the toe you got to touch your feet together there you go stay there until I finish the rest of the instructions okay so just get back in it all right I'm going to go through the rest of the test I'm going to show you just one right here yeah I'm going to show you how to walk it okay but just get back we're in that position I told you all right arms down at your sides when I tell you to begin you're going to take nine Heel To Toe steps down this line keeping your arms down at your sides each step you're going to be looking at your feet and count out loud each step out loud yeah once you get to the your ninth step you're going to keep your front foot planted take a small series of steps like this and come back down the same line you just walked nine steps so it's going to look something like this wait but I'm wearing H I just I just said earlier you could take them off if you want you want to take them off and go barefoot yeah then go ahead whatever is going to be easiest for you I mean oh Jesus you're all right all right are you okay are you going to be able to do this yes all right I just want I don't want you to fall and hurt yourself here I'm going to move these all right here so get back in the position I told maybe back up a couple steps and get back how I told you all right you remember how to do it yes all right go ahead and do it no no no look you got to get back in the starting position look put your left foot on the line Right Foot In Front heel the toe arms down at your sides arms right down there you go stay like that no no no wait you you have to wait for me to finish all right so just get in this POS get like this in the starting position and just stay there and don't do anything else until I tell you okay so straight in line arms down your sides do you remember the instructions you're going to take nine down the line look down at your feet each step you count out loud arms down at your sides when you get to your nth step you keep your front foot planted small series of steps and back down the line it looks something like this one two no I can't do that when you get to your last step you keep your front foot planted couple steps one 2 three all the way back down the line until you get to nine one once you get once you start the test don't stop until you're completely done with the test do you understand the instructions yes I do I'll take in into consideration all right so get back in the starting position and then you can start the test Here Right Foot In Front all right now you can start whenever you want two just like I told you keep going okay the next test is called the one leg stand okay so you're going to put your feet together heels and Toes touching arms down at your sides just like this arms right down at your sides when I tell you to begin you're going to pick one foot either one you want you're going to pick it up about six inches keep your foot level with the ground you're going to look at your toe and count out loud 1,001 1,002 1,003 and so on and so forth until I tell you to stop if your foot goes down at any time pick it up and continue where you left off so if you put it down on six pick it up and continue at 7even all right so it's going to look like this 1,1 1,2,3,4,5 until I tell you to stop what no you're picking one foot up and that sit so you're going to keep your arms down at your sides you're going to pick one foot up just like this all right so do you have any questions with that test I'm sorry A1 yeah and keep going until I tell you to stop so let me get a let me get a uh timer going when you're ready you can begin1 yeah2 you got to pick your foot up3 45 7 six7 pick it up I don't have balance all right well do you think you you can okay okay put your feet right together on a line just like this your feet together try to put them together more good and your hands at your sides just like this stand just like that okay can patterns and her inability to perform the field sobriety exercises officer Pano placed Stephanie under arrest for driving Under the Influence after she was placed under arrest her vehicle was searched and impounded for a mandatory 12-hour period as required by John's law Stephanie was transported by Officer Pano to the Denville Township Police Headquarters once at police HQ he read hear Miranda writes as well as the standard statement for motor vehicle operators Stephanie agreed to provide breath samples walk back this way mhm just not front of the door I don't want to do it front your B processed she was released to her husband he signed the potential shared Lighty warning form on her behalf officer Pano wrote her the following sentences operating aot motor vehicle under the influence of alcohol with a minor passenger driving while intoxicated reckless driving careless driving improper passing on right and failure to maintain Lane thank you uh I'm going to go do some paperwork real quick I I need you to sign something it's um it says that we're turning her over to you um a sober adult and that you take responsibility for okay thank you so give me a couple minutes
