I also checked the cheese shop and you can show me clear those checks. >> Hi Joe, BTM Police Department. Can I see your license for insurance? >> I honestly think I left my license at the last place. >> What's what last place? >> The shell. >> The shell? >> Yeah. >> You don't have your license with you? >> You give me like 25 seconds. >> Okay. >> I may not. I Around 12:45 a.m. on May 31, 2024, Officer Sha Delaport with the Beach Haven Police Department observed a gray 2015 Jeep Wagon blow through a stop sign near Center Cry and Nay Avenue. He activated his emergency lights to initiate a traffic stop and the driver pulled over into a parking space in front of Buckaloo's restaurant and tavern. He exited his patrol car and made contact with the driver who was identified as 22-year-old Kale. How about your registration insurance? Do you have that on you? >> Yeah, I definitely have that. >> You lost it. All right. All right. Keep looking for your license. Once you find it, stick your hand out the window. I'll come back. Okay. >> What' you stop for? >> She flew right past the stop sign. >> Yeah, dude. I can >> see things in there. So, let me see the rich. That's her. Kaylee. That's her. Do me a favor. You're gonna start with the alphabet. We're going to see if we're going to take her out of the car, but I mean it. I smell alcohol emanating from the passenger side. >> Um, yeah. Reeks of alcohol from passenger side. So, >> okay. >> Start with the alphabet. See how she does on there. She fails that, we'll take her out. Okay. >> All right. And then you're going to have to run field. >> Okay. just want to double check with the alphabet test. She's just saying the alphabet backwards. >> No, no. You want to ask her what's your highest level education. All right. And she states whatever it is, whether it's high school or anything like that, be like, "Okay, now are you familiar with English alpha?" When she responds in there, she says yes. You're going to start with the letter D, ending with the letter L. Do you understand the instructions? Yes. Begin. You're looking for all signs. Put her alcohol cuz I already smell third speech. Anything along those lines. Um, and if she starts at a different point, ends at a different point. Regardless though, I'm smelling the alcohol emanating from her side. I think we're going to take her out regardless of that. But yeah. Okay. >> Don't care. She don't need it. Hi, Kayleie. Do you have any luck on your license? >> Yeah. No, no luck. >> All right. Can I ask you a question? >> Yeah. >> What's your highest level of education? >> Education? >> Yes. >> Uh, I have a diploma in speech pathology. >> Okay. So, you're familiar with the English alphabet? >> Yes. >> Okay. Can you recite the English alphabet to me starting at the letter D, ending at the letter O? Do you understand? >> Yes. >> Okay. You can do it. D E F G H I J A K L M N O P Q R N >> All right. You just had You go to O. That was okay. Like can we do it in front of here or no? >> What's that? >> Like just like everything like can we do in front of there or like in front of here? >> No, we're going to go over here. It's safe. You got the doors locked. This is like my job though. >> Yes. >> She told Hif that she was coming from a show earlier that evening. She denied consuming any alcohol earlier that evening, but he detected the odor of alcohol. The officer also noticed a wristband on her arm. After another officer arrived on scene to assist, Kale was asked to exit the vehicle for fulfilled sobriety exercises. >> Yeah, I understand. And you're going to do here. He's got a few instructions for you to follow. Okay. >> Okay. >> From this line. >> No, I'm just going to stand there. >> No. Just make sure you go this way and don't use that line. Okay. >> Okay. Which line? This line right here. >> Don't use that line. Okay. Don't go that one. >> All right. I'm going to explain a series of tests I would like you to perform. Do you have any issues with your back, ankles, knees, etc. that may alter you from any of these tests? No. >> No. All right. All right. >> All right. So, first we're going to do the walk and turn test. So, I'm going to explain to you. Don't start until I tell you to. Okay. >> All right. So, first you're going to put your left foot on the line and put your right foot in front of it with your right heel touching your left toe. >> The first exercise was the walk and turn test. During the walk and turn test, Kale failed to touch heel to toe on each step and turned improperly. The second exercise was the one leg stand test. During the one leg stand test, Kale failed to raise her foot in the proper fashion and put her foot down before the test was complete. What I want you to do from here, you're going to make a series of nine steps counting out loud. When you get to that ninth set step, you're going to make a series of small turns and make nine steps back. Okay? I'm going to demonstrate. Don't begin until I tell you to. All right? It's going to go one, two, three. Continues until you get to nine. From there, you're going to make a series of small steps pivoting on the ball of your one foot and then nine steps back. >> One, two, three, and so on to nine. Do you understand the instructions? >> Yes, I do, sir. >> Begin. four. >> It was to nine, right? >> And then nine back. >> All right. So, the next test is going to be the one leg stand. I'll take that into consideration. >> That'll that'll be a question for the next exam. >> But you don't have any issues with your ankles or anything? >> No ankles or knees. >> And you get to pick your leg of choice. >> Okay. >> All right. So, you're going to stand with your heels together and your arms at your side. Just like this. Yep. Just like that. >> I'm freezing. Bro, >> do not begin the test until I tell you to. Do you understand? >> Yes. Okay. When I tell you to, I want you to raise one leg, either leg approximately 6 in off the ground, foot pointed out, keep both legs straight, and keep your eyes on the elevated foot. While holding that position, count out loud 1,00 1,00 2 100 1 3 and so forth until told to stop. Do you understand? >> Yes. >> Okay, you may begin. >> You got to demonstrate teleport. >> You want to keep your hands to your side. >> So, you want to keep your hands out your side. The law the law requires you to submit samples of your breath for the purpose of testing to determine alcohol content >> which I do not. >> No hospital that. >> A record of the taking of the breath samples including the test results will be made upon your request. A copy of that record will be made available to you. >> For after you you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. >> Five, if you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. If you do not answer with anything other than yes, I will charge you with refusal. Now I ask you again when you submit breath test. >> What happens if I refuse? >> You get charged a refusal. >> And like what happens to a refusal if you don't mind me asking? >> So you're going to get charged with a DUI and a refusal. If you submit a breath test just based on your observations, you still get submitted you're still going to get charged with a DUI. Now if you have a submitted breath test and it's below the legal limit, the court will will make a determination after that. >> But did I try to drive? You're driving a motor vehicle. We have >> I I don't >> Okay, listen. He's repeat that last paragraph and if she gives anything other than yes or no, then we're just going to we're going to be done with this. >> Your answer is not acceptable. Um, I'll have that. I believe Southshore Towing is going to have it. Once they take the car, I'll get a card and she'll have that provided. She'll have all the information.
