Yeah. That's what I'm referring to. Right. You have any question for me about that? My question to you is this. How much have you had today? >> But that was like literally like 4 hours ago. Reason why I ask >> around 10:48 p.m. on November 2nd, 2024, Sergeant Spencer with the Santa Rosa County Sheriff's Office observed a red 2016 Nissan being driven erratically. He initiated a traffic stop and the driver pulled over in the vicinity of Byum Street and Park Avenue. He exited the vehicle and made contact with the driver of the Nissan who was identified as 27-year-old Destiny Hler. >> I smell the order of alcohol. >> Oh, no. >> Listen to me. >> I know. Listen. I'm going to tell you the truth. Listen. Listen. >> I switched vehicles. >> Listen to me. >> I smell the odor of alcohol coming from you or your dog. >> And I'm understanding that and I'm trying to tell you the truth. >> I'm not finished. >> I get that. I literally for 4 days now my car key fob has been lost. My car has been stuck at down the street for 4 days now. I finally got it. It just happened. I got in a fight with this guy that I've been talking to. So, I'm emotional right. So, I drove it home. That's it. Literally, it was like 2 and 1/2 hours, maybe 3 hours ago. two and a half three hours ago. I'm only irregular because the guy that because irrelevant that is my house right there. Yes. So I'm just guilt alcohol alone means nothing to me. What does mean something to me is a series of other indicators that I've seen put together make me believe that a crime is pushed. So, in other words, when I'm talking to you more, you have pupils that are pretty much huge. That's it. Literally, I swear I have not been drinking like that. It was I've been very upset. The last It's been like 45 minutes. I've been crying my eyes out over some stupid ass guy. That's it. Literally, that's it. I'm flying over some guy. That's it. No, I just want my ticket so I can go home and cry over this stupid ass guy. That's all I want. All right. You understand that? You're right. Just right. You understand what we got so far. [Music] >> So with that being said, what he's asking, are you willing to do field sobriety test? I just want to go full. I literally >> I understand that heartbroken tonight. >> Well, we have to get this out of the way first. >> Okay, I get that. I don't want to do anything. I just want to go full. >> Okay, so what he's saying, and let me explain this to you. What he's saying is you refusing the indicators we have right now, you will still go to jail. Okay. >> No, I can't go to jail. I'm a crime officer. Can I save my family? >> Not right now. No, not right now. >> So, and like you said, you have the right to >> What did I do though? What did I do actually wrong? I didn't do anything wrong. >> I understand my eyes red, but I've been crying. >> You also do smell like >> You also do smell like alcoh. >> Are you refusing? Yes or no? Listen, you go ask. You can go ask Paula. >> As he was speaking with Destiny, he detected the odor of alcohol and observed other indicators of impairment. Deputy Henry Hancock arrived on scene shortly afterwards and initiated his DUI investigation. Based on the officer's suspicion of impairment, Destiny was asked to perform field sobriety exercises. Around this time, she mentioned that she worked as a correctional officer. >> Ask her. >> I don't care about that right now. I've already heard that. Are you refusing? >> I'm crying. So, my eyes are red. >> Are you refusing Phil? >> I don't want to go to jail. No, I will do the [ __ ] check, but I don't want to go to jail. >> You will do So, you're willing to do a field sobriety task? >> Whatever you need me to do. >> Okay. >> But my house is right there. >> Step over here to the sidewalk >> for him, not you. He pulled me over. You didn't. >> He's relinquishing this to me now. >> No, he pulled me over. You did not. >> Okay. So, you're refusing? >> No, he pulled me over. You did not. I know that as much. Who are you? His sergeant? >> No, he's my sergeant. >> Why isn't he doing it? >> So, you're refusing? >> No, I'm asking a simple question. Why are you not doing my check instead of him? That's all I asked. >> I called him over here to do a DUI investigation. Okay, now I'm asking why are you not doing my check? >> Because he needs to stay available because you're a newer. >> I just explained to you asking. That's all I'm asking. >> And I just answered that question. >> What did you say? >> I said because he's a supervisor. He needs to stay available. So, I need to do this. >> So, you're newer. >> I don't know what that has to do with anything. Are you >> I can get in more trouble cuz you're newer and he's more uh sophisticated than you are. >> Okay, ma'am. I'm about to take this as a refusal. This one. >> It's not refusal. I said I would do it, but I want to know I'm not getting in more trouble cuz you're newer than he is. >> You don't you don't get an option on who does it or who. So, are you refusing to do it first? >> I'm not doing refusal. I'm just saying I don't want to get in more trouble cuz you don't know what you're doing than he does. You're new. >> This is my last time asking. Are you refusing to do >> refusing? I already said that. Are you sure that? >> Yeah, I'll let him do it. But are you going to watch to make sure he knows what he's doing? >> He knows what he's doing. I don't have to actually watch him do >> I don't I don't know that he's a new cop apparently. That's what he just said. >> I did not say that. But okay, so you're willing to do it? >> Sure. Let's go. >> Okay. Step over here to the sidewalk. Can >> I take these boots off? >> Yep, sure. if you want to. All right. First task I'm going to do, I'm just going to check your eyes. Okay. >> Deputy Hancock started with the horizontal gaze nestagmas HGN test. During the HGN test, Deputy Hancock observed the lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation and the onset of nestagmas prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Destiny did not touch heel to toe on each step and turned improperly. The final exercise was the one leg stand test. During the one leg stand test, Destiny failed to raise her foot in the proper fashion. >> All right. See the tip of the spin? >> Mhm. >> Okay.
