What's wrong? >> I'm so sorry. >> Is this where you got to stay at? >> No. >> Okay. >> She was taking me home. >> Okay. Well, why you going to get behind the wheel if you've been drinking and take your friend home? [laughter] [clears throat] >> It's okay. So, you don't This is the reality check. I'm sorry. [laughter] >> It's okay. How old are you? It's okay. >> I'm 20. >> 20. Okay. Do you have your real ID on you? >> No. [laughter] >> Take some deep breaths. >> But it's it's not okay. >> What's your first name? >> Tristan. >> Tristan. [clears throat] Come up against just relax a little bit. Okay. Okay. So, how much have I had to do? >> I'm right here. [clears throat] You're okay. >> Like three, four drinks. >> Three, four drinks. Okay. >> Okay. Would you want to do some feel soy? >> Yeah. >> Yes. >> No. Just blow. >> Should I Can I blow? I don't know what I've never been in this. >> Just blow. Just blow. [gasps] >> It's up to you. >> Have to do the >> It's voluntary whether you want to do it or not. >> You have to do the filter. >> I can I can already smell the alcohol on you. >> I've never done this. I don't know. I really don't. >> Okay. Okay. Well, so SFST is just a standardized field soiety testing. It's just a series of tests to see if you're >> Oh, safe enough to drive. Um, clearly you're kind of not. You're going to the wrong side of the road. >> I'm terrified. I don't know what to do. I've never done this. I don't >> Okay. Well, you can um blow. >> Yeah. So, whether you want to do this test or not, or if you just want to blow, whatever you want to do. I don't know. >> Honey, you can do the field sobriety, but you're going to have a blow regardless. And they're going to take you downtown because you're drunk. >> I don't know what to do. I've never done this before. I really don't. >> And I have and I'm telling you. So, it's all voluntary. >> I don't know what to do. I really don't. >> It's not all voluntary. So, you can do the field sobriety and if you failed that >> Yeah. So, the field sobriety is is voluntary. Okay. If you want to do field sobriety, it's basically going to see your ability to be if you're safe to drive. Okay. >> Yeah. Um just like I told you, >> do you do you think you're safe to drive? >> I do. >> You think you're safe to drive? Okay. So, field sobriety is just going to it's going to test that. See what your levels of alcohol are. Okay. If doing that, if we determine you are under the influence of alcohol and driving a vehicle, then you will be placed under arrest. Okay. From there, we'll read you imply consent and it would be if you consent to a breath test or not. Okay. That's basically the whole how the process is works. But baby, you're drunk and you're gonna blow over the limit. So >> So what do I do? I really So I never I don't know what to do. I really don't. I've never I've never >> How old are you? >> I'm 20. >> You're 20. Okay. >> I don't know what to do. I really don't. >> So we could if you wanted if you want to do so, it's up to you. >> Why? I really I don't >> What's the point in doing the field sobriety test if y'all know and I've told you. >> Well, because she she thinks she's safe to drive. Okay. And if she believes she's safe to drive, then we can do the field. >> Now that she's in this predicament, she knows >> she's not. >> But I don't know what to do because >> honey, do the field sobriety test. >> It's up to you. >> We're not We can't make you do it. Nobody's Nobody's going to make you do anything. >> You're going to fail it and then they're going to make you blow. >> If you're going to make me blow, then just do it. I don't know what to do because regardless I've seen videos on Tik Tok. >> I got you. All the girls on there >> of all the people who have done videos and then regardless of how they do the videos, they just >> So, so cutting it from our perspective. Okay. You're leaving the downtown area. You've obviously been drinking. You were driving down the wrong side of the road. >> They got the wrong side of the [ __ ] road, [ __ ] >> Okay. So, that that's where that's that's why we're here. >> Yeah. Okay. Um, nobody's mad at you. Okay. >> Yeah, but this is my life. >> I know. >> As he was speaking with Trista, Officer Benedict detected a strong odor of alcohol and observed other indicators of impairment. Trista admitted to consuming alcohol earlier that evening, but told the officer that she felt that it would be safe to drive. However, her passenger told her that she should not have been driving. Based on her indicators of impairment, Trista was asked to perform field sobriety exercises. After some hesitation, Trista eventually agreed to perform the field sobriety exercises. >> But it's something that you have to deal with now. Okay. >> We're we're we're in this we're in this spot, >> right? We can both agree on that. This is something we I wasn't expecting on meeting you tonight. You were not expecting on meeting me tonight, right? It wasn't. >> But we're here. Um, so if you would like to do field sobriety, again, it's voluntary. If not, then if you want to do a breath test, we'll read that part. >> Do the breath test. >> Do the breath test? >> Yeah. Because if you build sobriety, it's just a waste of time. >> You're drunk. >> Nick, what did you do? Like, >> what do you mean? What did I do? >> I don't know what to do. I've never I've never >> I'm telling you to take the breath test. If you want to do the pill toy test, go for it. But I was 0.01 when I got my DUI and he's still >> What do you want to do? >> What is it? What does it do? >> Do the field. >> The field test. >> Do Yeah, he he can explain it to you. >> Okay. >> You want to do it? I guess so. >> So, well, do you want to know what the Phil Sparty test is? >> Yeah. >> Basic. So, the first test will check your eyes. Okay. Officer Benedict will check your eyes. He'll see if you have any resting estagmus or do you have resting? Do you know rest? You know what nestagmus is? >> I don't voluntary jerk of your eyes. >> Okay. >> Which you can't control. And then they're going to make you walk. >> Well, if you don't have resting estagus, we'll check if your eyes are showing any any signs of impairment. >> I got you. Relax. >> After that, we'll do a walk and turn test. Okay. Basically, we only make you walk in a straight line. After that, we'll make you see how you're balancing. >> Sure, you can go ahead, >> Nichol. >> Would you like to come talk back here where he's >> Where's >> Hi, Lane. Or somebody keep Can you keep him away? She doesn't want him around her right now. >> So, just let him know she don't want him around. Hello. >> How you doing? >> Doing well. Everything that I explained to you, everything at everything. I know it's stressful right now. I understand you're scared. I understand you're scared and everything. But so your body testing like I was just telling you. Now I'm going to check your eyes and then you're going to do a walk and turn and then a a one leg stand. >> Okay. >> Um but it's completely up to you. I just want to blow. I can read you the implied consent and we can just go do your breath or if you want to do the SFST, the standard I feel testing, we can do that as well. >> Okay. >> So, which one? >> I want to do the test. >> You want to do the test? >> Okay. Well, we're kind of on a hill right here. >> Yeah. Yeah. Yeah. You want >> here? Just come stand right here. Yeah. Yeah. Just stand right there. >> Officer Benedict started with the horizontal gaze nestagmas HGN test and he observed the lack of smooth pursuit distinct and sustained nestagmas at maximum deviation and the onset of nestagmas prior to 45°. He also observed vertical nestagmas. The second exercise was the walk and turn test. During the walk and turn test, Trista did not touch heel to toe on each step and stepped off the starting position multiple times. The final exercise was the one leg stand test. During the one leg stand test, Trista failed to raise her foot in the proper fashion and put her foot down before the test was complete. >> Okay. Have [snorts] you had any recent head injuries? Do you wear contacts? No. >> Anything like that? Glasses? any problem why you would have uh would you have any problems following a fixed point on my fingerm walk in a straight line stand on one leg okay all right so I'm going to get my bearings with you I'm going to come real close to you but I'm not going to touch you okay light's kind of going to be in your eyes I just got to see your eyes okay just follow the tip of my point right there that tip right there can you see that just follow that with your Eyes and your eyes only. Okay. >> Okay. So, now we're done with the medical and now we're going to start the test. Okay. Just follow the fixed point on my pen and that pen only. Okay. Heat. Heat. Okay, now we're going to go up and down. Okay, just follow that point. One more time. >> All right. Now, we're going to do the walking turn. So, you see this white line right here? >> I do. >> What I want you to do is put your left foot on that line. Put your right heel in front of your left foot and keep your arms down by your side. And do not move from this position until you tell till I tell you to do so. Do you understand? Okay. So, what you're going to do is you're going to take nine heel to toe steps down this line and a series of small steps. And then you're going to go back nine heel totoe steps. It's going to look like this. Okay. In the ready position. One, two, three. and you will continue on to nine. You will take a series of small steps and you'll go back nine. One 2 3. I did three for the demonstration, but you will continue on to nine. Okay? Do you understand these instructions? >> I do. >> Okay. You may begin. That was nine. >> Okay. Yeah, you're done. Good job. All right. Now, look. Now, you're going to uh put your feet together, hands down by your side, and um you're going to raise one leg, whichever leg you want to. You're going to raise it approximately 6 in up in the air and you're going to point your toe parallel to the ground. And you're going to count your steps or your seconds out loud. 1 1,00 2 100 3 100 and so on until I tell you to stop. >> Okay? >> Okay. And once you start, do not stop. Do you understand? Let me get my watch ready. >> Whenever you're ready, you can begin. >> Okay. You ready? >> Go for it. something. >> I failed. I fell. >> It's okay. You can stop. >> Okay. So, really, how much do you have to drink tonight? >> Like five drinks. >> Five drinks? >> Yeah. >> Okay. >> All right. >> Do you have anything on you? >> I don't. >> Okay. Well, I'm going to have to place you under arrest. You are not safe to drive. Okay. >> Please. I can I can call someone. >> I can't I can't work past that point. I'm sorry. >> Please. >> I know. Why are you drinking and driving? >> What can I do? Please, >> there's nothing you do now. >> Following the field sobriety exercises, Trista admitted to consuming five drinks earlier that evening based on her erratic driving, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to adequately perform the field sobriety exercises. Trista was placed under arrest for DUI. After placing her under arrest, officer Benedict read her the George implied consent notice at the scene and she agreed to submit breath samples. Okay, just turn around on your back. They too tight on you. >> What do I do? I don't know what to do. >> Hold on. Hold on. I'll explain it to you. >> I don't know what to do. >> Okay. I just got to read you something. Okay. >> What do I do? I don't know what to do. I call my mom. I don't know what to do. >> I got you. Well, just listen. We'll take care of you. Okay. >> I don't know what to do. >> I got to find a spot to put that. >> Would you mind holding that? I can't. >> You said you're 20, right? [laughter] [gasps] >> Okay.
