This is an off-duty police officer who gets pulled over by Arkansas State Troopers, and this off-duty officer is going in excess of 100 mph on icy roads in an inebriated state. And you would think if anybody knew not to take a field sobriety test, it would be a cop who issues field sobriety tests. And why don't you want to take a field sobriety test? Why do most, if not all of, you know, legal teams, lawyers, ex-cops tell you never to take a field sobriety test because it's very subjective. It is designed to make you fail. And yet, we're going to watch this yahoo cop putting other lives at risk encountering the very law enforcement agents that he's a part of, and he's going to take the very test that he knows that he shouldn't take. And that's that he's used to trip up other people in the past. Watch this. >> Roll down the back windows. >> Hey, how you doing? >> Hi. Can I see your license? Thank you. >> Now, I want you to listen to this very closely. Let me back up here. Just keep your eyes and your ears peeled, okay? Because while this off-duty officer claims that he doesn't want or and is not looking for a special preferential treatment, both he and the female Arkansas Trooper are saying things low-key, probably hoping that the body cam doesn't pick it up, and there is preferential treatment going on, whether he walks away in cuffs or not, whether they give him the field sobriety test or not, or the breath test, he is going to get extra special preferential treatment because all of this is done with apology. Uh believe it or not, the Arkansas State Troopers, who are the worst, they are notorious for being mean to people who aren't officers. Check this out. Listen real close. >> Thank you. Come on, man. Huh? 100. 102. >> He's thinking he's doing 80, which is stupid. Look at I don't know if you saw the the ice when she was walking up, but there's ice all over the side of the roadways. There's probably patches of ice that he can't see in the street. And to be doing 80 mph in those kind of conditions is just stupid. >> You have your registration? What's that? Thank you. Where are you coming from? Uh I just dropped your license. Can you grab that? >> I have some groceries. >> All right. >> Now this trooper is going to ask questions, a battery of questions that this cop does to people all the time. This cop should know not to answer any of these questions. >> Okay. All right. You got to take it easy, man. All right. I'll be right back. Just stay in the car. >> Look at the ice Look at the road. Look Look at the road conditions. There's snow all over the side of the streets. There's probably ice on the road. Okay, what's going to go on here? >> I didn't hear what you said. >> It's county. >> Oh. Why is he going to write you a plate on that van? >> Yeah. I don't know. I got a regular I got a regular plate on mine all the time, so. >> What was his excuse for driving like an idiot? >> he thought he was going 80. >> Yep. I saw you like get up behind him, and I'm like, "Damn, they're cooking." >> Yeah. >> So I stepped it up, and once she called it out, I was like, "Hey, I'm going to turn my cameras now." >> I don't think I smell anything. But just go talk to him, please. Just so I want to take my opinion. I don't think I smell anything. I don't want to read into it, but just Cuz he's coming from girlfriend's house, so Just Just Just go out there and be like, "Hey, sorry. She just got kind of Be like, 'Oh, she was kind of amped up cuz, you know, you are going 100. She She gets kind of irritated with that stuff, you know. She doesn't like the speeders and stuff.'" >> Got you. Just see what he says. >> Did you ask him anything? >> Do what? >> Did you ask him anything? >> I did not. No, I didn't want to overstep on yours, but I uh >> Did you smell it? >> I I'm almost positive I did, and his eyes are kind of bloodshot, too, and watery. >> I don't know if you noticed this, but they're being super careful how they speak knowing that they're on body cam. >> And he said that he was coming from uh He told you he was coming from his girlfriend's house, right? He told me that he was going to his girlfriend's house, and he's really nervous. Really [ __ ] nervous. >> 139 139 22. Can you start this way? This sucks. >> Did you hear that? There you go. This sucks. Did they even put it in text? Let's see. >> This sucks. >> This sucks. What sucks? Well, it doesn't suck when they're pulling you over. It doesn't suck when they're economically terrorizing you. It doesn't suck when they slap you at the DUI, but somehow it all of a sudden goes into the realm of it sucking if it's a fellow law enforcement agent because they do believe that badges and uniforms grant special rights. >> I recognized him, too, and he's like, "Oh, you don't recognize me?" And I was like, >> God damn it. I can't stand this. >> If he wasn't so nervous that >> God damn it. I can't stand it. I can't stand it that I have my body cam on. You know for a fact this would go completely different if they didn't have their body cams on. If there's no dash cam running, if they didn't have their body cams on, hey dude, I'll tell you what, I think you might be drunk. Can I just call a buddy, a cop buddy, and have them drive your vehicle home? They didn't pound your vehicle, they put you into a cage, slap you with a DUI even if you blew triple zeros, and we've seen that so many times before. But now that it's a cop now this sucks. Oh man. I have to do this cuz I'm going to get scrutinized. I don't want to get in trouble. I'm not going to put my life and livelihood on the chopping block. No siree, Bob. >> I wouldn't have gave it away as much. >> His eyes were a little watery from what I saw. It's just like >> Oh my god. >> concerns. Do you want me to ask him? >> No, we'll get him out of the car on this one. He's going to know though. He's going to understand that. >> He already knows. By how nervous he is right now. >> I thought he would be Yeah, I thought he would be nervous. >> What's the plan of attack? >> God, it's so crazy. Of course I don't care who you are, I don't care if you're a former cop, I don't care if you're a current cop. If a cop pulls you over, you're going to be nervous. That's going to be a natural human reaction, but all of a sudden it's a standard for guilt. You know, oh he's looking nervous, he's awfully Yeah, it's cuz you guys are notorious for killing people, for tasing people, for dragging them out of the car, dragging them through the mud, economically terrorizing them, stealing their vehicle. Even if you don't die, you're going to a cage. Of course you're nervous. >> back on this one. >> We'll be honest with them, be up front with them and so >> Be honest. >> It just depends on how I'm in You've done it, I've done it, and it just depends on how um I suppose compliant he's going to want to be with everything to be honest is what it's going to be coming down to. So I would just I just like my radio's been all messed up tonight. I'm just Like I was kind of hoping to knock out the other one or else I already had, so I was like, well. >> Yeah, somebody said if you're relaxed, they'll use that against you. Anything. He was driving too fast. He was driving too slow. He didn't activate his turn signals. Everything looked too perfect. Hey, we knew you were guilty. You know how we knew you were guilty? Cuz you were going exactly the speed limit. It doesn't You're damned if you do, damned if you don't around these cops, man. >> So, did you set him up there? >> I'm going to go be honest with you. I'm going to bring him out of the car real quick. >> I told her I would leave cuz it's probably a bad idea. >> Yeah, I didn't know if he knew and I was like, what is this? >> Yeah, I just told her >> You got your side arm on you? Leave it in the car, okay? I'll just >> You got your side arm on you? Just leave it in the car. So calm. If you told them you had a gun, as a matter of fact, if she said, I got a CCW, man. I'm completely approved. I'm legit. I've got the permission slip from the government. And they're like, okay, let's go ahead and see that. And you reach back and you grab it like Philando Castile did, you will be filled full of holes like you're Swiss cheese. They will mag dump on you. If they'll mag dump on you for an acorn dropping on the hood or the top of a patrol cruiser, they'll mag dump on you cuz they think that you're reaching for that side arm. But look how cool she is because it's a fellow officer. She knows, well, there's probably not going to be any repercussions. He's got a side arm. I'm not too freaked out about it because he is me. Just for the rest of this track is traffic stop, ask yourself, would she treat me like this? He's all reaching in his pockets and they're not freaking out. Man, get your hands out of your pockets. Keep your hands where I can see them is what they tell you and me. Sir, sir, those are furtive movements. He's got his hands all in his pockets, man. This would You would not be allowed to do this. You would be face down on that cold, cold asphalt. She doesn't say that to you. I don't like that we're here, man. I hate that what I'm about to do right here. I'm I'm really sorry, man. He just admitted that he had a drink earlier. What a dumbass. I I PTSD's. I got some serious mental problems and uh well, I guess that's why my county hired me to be a road pirate law enforcer. Yeah, makes a lot of sense. If you've got mental issues, if you got PTSD's, the last thing they need to give you is a badge, a uniform, a gun, and the authority to state. Give me a break. >> Um any prescription medications you're on? Anything that affects your eyes? >> No. >> Um can you just bring your feet together hands at your sides for me? Can you see the tip of my finger? >> Yes. >> Okay. You're a little bit taller than me. Bring your chin down a little bit. Follow my finger with your eyes. Now watch the tip of my finger with your eyes and your eyes only. Keep your head still. Follow the tip of my finger. Do you understand? >> Yes. >> Perfect. >> Look at this guy. He's actually going to take an FST. I don't even know what to think about that. You and I know and he knows that it's completely subjective. You and I and he knows and they know that you should never submit to a field sobriety test because it's designed to make you fail. It's just mind-blowing. It's as mind-blowing as the guy who just let a cop in to inspect his house for no reason. >> I'm just going to fast forward through this. He only does the nystagmus test with or she only does the nystagmus test with him. And then because the icy conditions, she doesn't have him do the other toe-to-heel thing and the other deal. Let's see. Let's go Let's just fast forward this. Now, listen to him make an excuse about mouthwash and cough syrup. >> Um It's too cold and icy to do walk and turn one leg stand. I just want to do PBT. >> Okay. Okay. >> Is there anything in your mouth right now? When's the last time you did drink anything? Anything? >> I mean, I did some mouthwash before I I got over here. >> You what? >> Mouthwash and some cough syrup. >> I did some mouthwash and cough syrup, Vic, before I came over here. You can just know that's a lie. You can smell that lie from 50 miles away. >> Okay. >> I'm I'm battling the flu. I don't know what else to do right now. >> I'm battling the flu. As a matter of fact, when you caught up with me, I was trying to outrun the field the flu. That's why I was doing 102 miles per hour. >> Okay. Look at your tongue up. I can see the mouthwash. Is that what the bluish tinge is? >> Yeah, that's what I downed when you went back to your vehicle, so you wouldn't smell the alcohol on my breath. My God. >> Okay. Nice deep breath. Take a Take a tongue depressor on your mouth. Fish blood taste like fish blood. I'll show you what it's got. Keep going. Keep going. >> [laughter] >> Guess what it is. Can anybody guess what it is? What's the reading for the breathalyzer test? The limit in most states is .08. What do you think he blew? How high do you think it went? Just take a stab at it before we proceed. Three, two, one. Send your cards and letters, folks. Here we go. >> Hi. I got to read you the I got to read you the [ __ ] sentence, okay? >> You got to read it right? >> I have to read you the [ __ ] sentence. >> What is it? What is it at? >> You're at a .084. >> .084. He's .004 over .08. Just barely over. And in my mind, that's not even drunk. >> I have probable cause to believe you operated a vehicle while intoxicated or refusal to submit to a chemical test. Informing you of your refusal to submit to a chemical test and your driving privileges If you have any questions regarding the operation of a vehicle while intoxicated or refusal to submit to a chemical test will result in a suspension for 2 years. Do you have any questions regarding the law? >> I don't know, man. Like I mean I >> Now, more importantly than what he blew is what do you think is going to happen to this cop? Let me ask you this. What would happen to you or I if Lyft or Uber found out that we were driving drunk? What would happen to you if you were a driver for FedEx, for some other delivery service like UPS, or if you were a truck driver and you had a CDL, what would happen to you? You lose your CDL. You would no longer live work for a Lyft or Uber. You would no longer work for UPS or FedEx because you'd be a liability to that free market company. But what do you think's going to happen to this guy when they just concluded that he's a 0.084? Now he's going to go into the breathalyzer test at the police station and get it double verified that he was driving, you know, legally over the limit. What do you think's going to happen to him? >> PBT is basically [ __ ] >> PBT's not certified, yeah. >> Yeah, I know, but How long was your last drink? Dude, it's been hours. It's been hours. I mean >> It's been an hour since you had your last >> It should be on the people. >> Obviously not if you refuse to blow. She's going to apply for a search warrant, dude. >> Yeah, yeah. >> Probably the higher cuz of the [ __ ] mouthwash. You rinsed your mouth >> Did you hear what the guy said? He said it's probably because of the freaking mouthwash. After admitting to having a couple drinks >> You said mouthwash in between >> Yeah, I mean I've only been on the road for like 5 minutes or 10 minutes. >> I've only been on the road for 5 minutes and I just live right down the street. It's always I'm just right down the street. God, I'm almost home. It's right around the corner. >> I mean >> Did you Did you rinse your mouth with mouthwash in between? And like in between you coming up? >> No. >> What a liar. Yes, you did. Your lips were still blue. Your gums and your in between your teeth were still blue. Of course you did. I was on the I was only on the road for like 5 minutes. He was probably on the road for like 50 minutes, maybe an hour. That stuff would all be gone from his mouth. He took a swig in the mouth mouth wash to mask the alcohol on his breath. Everybody knows it. >> Um It's up to you. Obviously, I hate that you're here, but that's why we're we're asking you like when's your when was your last drink? Have you blown on the breathalyzer? I do a certified breath test and if that's under That's that's the certified result. If you can see it on the certified test. >> Yeah. >> And I would I would like it to be under the result. >> Is that >> Is that clear enough for >> Is that clear enough for you on It is what it is. >> It is what it is. Here's my thought about drinking alcohol and driving. I think you're an absolute dumbass who is self-centered and inconsiderate. So self-centered and inconsiderate that you're going to get behind the wheel of a 3,000 to 4,500 lb machine going 60, 70, 80 mph putting my family's life in jeopardy, your family's life in jeopardy. I think that's a dumbass thing to do. On the other side of it, you can totally drink a couple drinks a couple hours before or even a beer right before and not even be inebriated. There shouldn't even be these laws. This is a violation of life, liberty, and the pursuit of happiness. This is a violation of human rights. I saw this I I think I played it uh it's probably in a video 2 weeks ago, but it was a it was a video of this farmer saying, "Man, we can't even drink a cold one on our way home from a 12 13 hour shift. Drinking a cold one is not a crime while you're driving. It doesn't mean you're going to be impaired when you've had one. I'm not advocating that anybody do this, but I don't have a problem with those who would. The state does though cuz they want to pretend that they care about you, that they care about your family, and we got to get these dastardly criminals off the road. So, there's no there's no freedom, there's no leeway in this entire system right here. So, even What's that guy's name? Zach Galifianakis, that that kid that was a football player at that high school, and he got stopped by that that just this disaster of a police officer, totally flew through the field sobriety test, took three breathalyzer tests, blew triple zeros three times, and they still arrested him. If that cop has a hard on to put you into a cage, you are going into a cage whether you violated one of their one of their rules or ordinances or codes or not. >> I mean, it is what it is, right? I mean >> It's either It's either yes to the certified test, which is the the breath test, um or no. >> I mean, if I say no, you're taking it, right? >> Right. >> So, I mean, I might as well I might as well do the breath test, I >> Okay. All right. Um >> And I put my knives in my pocket. >> Yeah. I'd like to >> Wait a minute, you got a knife on you? Everybody If if that was you, wait, you got a knife on you? You got your hands in your pockets? Everybody pulls their weapons and fills you full of holes. No, not him, because he's part of the club, man. When you're in the big club, you've got special privileges. >> Take your car key. Can we just lock it up? >> Yeah, that's fine. >> Okay. Um is your key in there? >> Uh it's on my person. >> Okay. All right, let's go. All right, can I get my stuff? I have to detain you for the transportation. >> Okay. Well, can I put my stuff? I mean, you want to put your stuff in there? >> Can we get your stuff? Can I have one of you guys search him? Let's grab him. Where's your key at? >> I think it's on my left. >> She took a point. >> Now they're searching him. See, you and I would have already been searched, if not searched and handcuffed. >> .084 .084. He said this is what he read, he agreed. Turn back. Do the backs of your hands together. It'll go better. >> So they cuff him and they put him into the front of the patrol cruiser. Let's just go forward with this. >> I'm in a state you're on >> I don't know if you need to clean up here or something. >> Hey, you're on speaker phone. I'm in a state police squad car. >> So now he's either talking to his wife or his girlfriend and listen to her very interesting reaction. If I told my wife, "Hey, I'm in a state patrol cruiser." I I couldn't get the next word out without her just going, "You're what? What Wait, what happened? What's going on? Why are you there?" Listen to this. >> I'm on my way to the Lake Station Police Department. >> He's on He's on monotone and we still haven't heard it from his significant other yet. >> What? >> Yeah, so you're on speaker phone. >> She still hasn't said anything yet. >> I was on my way back to the house I should be okay. I PBT'd at like .05% under legal limit, so kind of ridiculous, but >> She still has He's been talking to her for like 20 25 seconds and she still hasn't said one word. >> It is what it is, so But worst case scenario, I'm going to you a call here in a little bit if I blow 0.001% over the legal limit. So >> She said yeah and he said okay. What what kind of relationship do these people have? What is going on here? It doesn't sound like this woman cares or is concerned about anything that's happening in this guy's life at all. >> I will keep you updated. >> What did she say? >> I will keep >> Do you have to do that? >> you updated. All right, I love you. >> He said I love you and she said yeah, okay. I mean I guess that's how somebody treats you if it's likely that there's domestic abuse involved in that relationship. I don't know. I don't know if there is or not. I'm just spitballing. That's all. All right, so now here's where he I'm just I'm going to go through all the boring details. There's not really anything that Oh, wait. Yeah, he she leads him through this test right here. Okay, he takes it it it it turns out to be a 0.081 with the certified machine. He's literally 0.001 over. And to me, you know, that may be legally intoxicated but I don't view that as impairment. >> So one was under the legal that one was >> Look, she's trying to keep it real DL, right on the down low. >> This is just a check. >> Okay. Honestly, I'm surprised she hasn't mute her muted her mic yet. >> I don't know if it's 103 or if it's almost 110. 101 10. 110. >> Yeah, I personally think if you're going to be that close, you know, be be a public servant. Get somebody out there and just have them drive drive people home. You're a public servant. I mean, the gas in your vehicle is paid for by us. The vehicle itself was paid for by us. Uh your entire salary and your pension is paid for by us. So, how about a little protection and service here? I don't care if this guy's a cop or not. So, now he talks to his girl again and here's what happens. So, I'm going to get to the to the end of this right here. >> Phone's on you? >> He got a 3-day suspension. I can almost bet it was paid. Back on duty within a week. Criminal case still open. Watch this. Reckless driving, unreasonable speed, operating a vehicle with an ACE of 0.08 or more, which is 0.081 back at the headquarters, and reckless driving, awaiting trial, awaiting trial, awaiting trial. This guy's name was Thaddeus Gerald Bilsky, and I guarantee you nothing's going to happen to him. He will probably be promoted. >> [bell]
