welcome back to the lackluster channel i often receive angry comments regarding the lack of updates on the videos i make well most settle and are often slapped with a gag order furthermore litigation can take years however today we get to look into a case involving the loveland colorado police department remember karen garner same department same lawyer which is why so many people laugh when the chief suggested it doesn't happen often the question is how often does this happen we do not believe this happens often we found out nearly eight months later that this had occurred we took swift actions at that point to contact the district attorney to implement the cert team and to find out why that happened but that is not a common practice in our organization these two high-profile cases within the same department in such a short span of time suggest otherwise both show a lack of basic understanding of the law as well as what seems to be a culture within the department that normalizes and even promotes the use of force over de-escalation tactics now the residents of loveland will be taxed to pay for these practices as the city is paying 290 000 to settle a lawsuit over the wrongful arrest of one of their own residents a man who noticed a motorcycle accident and had responded to offer to help pick up the bike officer paul ash asked the man for information regarding the crash and when he refused the officer arrested him for obstructing and resisting police officers cannot and should never be allowed to compel speech and it's terrifying that an officer thought that he had that power an internal investigation determined that the witness had not committed a crime and the officer was not justified in arresting and battering him officer ashe violated the limits of authority and exercise of discretion performed an unlawful search and seizure and went overkill on the use of force which injured the witness and led to a shoulder replacement all of this happened while the good officers benjamin de lima clint schnoor and brian bartness failed to intervene the department did not state what disciplinary or corrective action would be taken as a result of this internal investigation just that quote any disciplinary actions would be taken in accordance with the conclusion and outcome of the ia here is the video for reference let me know how you think internal affairs you are i didn't do anything i helped the guy get his bike up and that's why and i'm obstructing [ __ ] [ __ ] [ __ ] gotta have a seat now let me go i'll get in you don't have to force i'm at a double lucky customer you don't have to force me i'll get in your [ __ ] thing loosen these cuffs up please they're tight can we please loosen these cuffs up he's checking them they're not a finger [ __ ] with the way hey relax dude that's what happened to relax that's what happens when you go through my ass down that's what happens right now oh they're pretty [ __ ] tight so the bike has been moved over there yes sir over here yeah that's that blue one yeah i came out to help my friend okay and that's why you needed to sit there and talk to me well i didn't need to sit there yeah it did i didn't see what happened i didn't whistle witness what happened well you obviously did because you came out and helped him i yeah but i didn't know that what the hell happened i came down on my bike my buddy's bike's down that's part of the investigation and we need to know all about that and you're [ __ ] wrong okay have a seat please loosen these they are they are super loose no they're not have a seat in the car no my right my left wrist is okay do you want me to check them can i check these yes sir please they're [ __ ] tight as hell there's a lot of room in there you haven't seen in
