officer lopez of the las vegas metropolitan police department narrates his response to a 9-1-1 call that reported yelling coming from a residence all right 417's and yelling coming from residence and you're screaming get out we're over get out give me my phone here has not seen subjects and can only hear them officer lopez responds code 2 non-emergency and upon arrival he met with officer wallers and could hear a verbal altercation coming from inside the residence hey hello metro police what's going on i don't need you guys here why are you even here we got a call from neighbors because they're hurt we're having a marital dispute police remington get in the house we just want to make sure everything's open it's fine can i talk to you we just want to talk to you real quick just because we just wanted my daughter is upstairs and she needs to be fed what do you mean as well i need to talk to you as well what okay let me talk to you for a while is it okay okay so anytime in the state of nevada anytime there is an allegation of domestic violence there is no way we need to come and investigate that right we need to come and know so that's why i will talk to you about domestic violence okay well then let me talk to you out here okay i can hear we're out with a female half mel half went back at the residence shut the door uh no evidence of any uh battery at this point in the video and in my opinion only this call should be ended the woman has been isolated and has denied several times that there was no domestic violence and that the couple was engaged in a marital dispute officer lopez radios in that there is no evidence of battery and the state's involvement in this couple's potential breakup should have ceased hey man sorry sorry dude i just need to talk to you real quick if you just need to know what's going on anything see any weapons on you i don't think i think i just want to grab my daughter okay no that's fine you guys married or dating oh that's my fiance okay okay and this is your child together over there yeah okay and i have another one she's sleeping that's also together with her yes okay if the dogs are violent i can go in and talk to you i'm cool with that you know whatever okay so so what happened today as far as what uh is there anything physical between you two or anything like that absolutely here i want to talk i want to keep you away from her sir well this is his private property are you guys good is there a crime no we have a rea right now you're an investor right now you're an investigative detention sir what's the crowd sir sir sir for me i don't work for you okay i pay my taxes i pay my taxes here let's just come over here here no sir sorry do you have a reason to be we have legal reason to be here let me talk to you over putting you in cuffs because you're being a douche according to the officer josh has now been detained for being a douche section 357.78 of the civil code of urban slang covers douchery and is defined as a person who thinks they are cool but is actually completely not cool the maximum penalty is nothing because it's not a crime regardless he is detained despite a lack of evidence of a domestic battery it is important to consider josh's demeanor he has been calm and has not even raised his voice during this encounter exactly because you're an investigative attention oh my god and you are trying to my arm you're going to break my arm you are trying to get away and i told you an investigative attention investigation for what for them for conversation okay i'm having a conversation with you and you think you can just leave you think you think this is how this is supposed to go right now listen dude please don't i want to be able to keep my daughter inside over here no you're going arguing of a man and woman arguing when we get calls like that they're possible domestic it's a domestic call okay doesn't mean anybody laid hands on anybody it could be just verbal as you're somewhat saying anytime there is an allegation of domestic violence there is no way to come and investigate that no evidence of any uh battery however we don't know and we have to investigate so when we get here we come into contact with you what we're doing is called an investigative detention you're detained until we understand whether or not a battery occurred if no battery occurred feel free you go on your way no evidence of any uh battery you would not be in cuffs right now if you would not have if you would have just listened you're trying to leave and if there's a battery occurred and you go back into that house i have to go in and get you no evidence of any uh battery i don't want to do that okay as it is right now from what i've seen it doesn't appear to be that one a battery has occurred however i need to do a thorough investigation before i can get my car and go on my way so you don't cooperate you go in cuffs that is why you're on cuffs she's not in cuffs you're in cuffs okay she could have even hit you and you could be the victim however you're in cuffs because of your actions okay so now let's start from the beginning what happened nothing strictly verbal okay that's all i needed to know dude that's it any time there is an allegation of domestic violence there is no way to come and investigate that no evidence of any uh battery nothing happened nobody laid hands on anybody and it's not against law argue however we want to hear what she has to say okay there is no way to come and investigate that and once we figure that out if it's just verbal i'm gonna let you out of those cuffs you can go back in your home you go back and argue or do whatever you want okay but i will advise you and tell you about how domestic violence calls happen okay or as far as what happens on what will go ahead and necessitate an arrest of you or her this is actually super painful on my shoulder okay okay you're not gonna act stupid right again are you i didn't say you're stupid i say act stupid okay so you know i will take you out of cuffs but you need to wait here with me until then do you understand okay that's it separate your feet separate your feet place your hand on top of your head 4 15. okay cool all right now you can put your hands down now okay thank you that's all i didn't want to put you in cuffs okay but when you act that way then i have to i really don't okay most of these calls we go to we don't put anybody in cuffs unless we have reason to take them to jail okay and i get it you somewhat think you know your rights and honestly okay i'll give you the event number and you can help okay i probably actually need your supervisor's information as well because i do feel like oh you don't need his information because i mean well you want him right here right now okay i i you you are professional to an extent but uh okay i i do think you need to articulate a crime before you can okay well actually i know in the state of nevada and america okay okay what you just did was considered tyranny so i'm gonna go grab my phone no no no hold on you're still you're in detention you're still in your tent no that's not 415 you don't know that means i was asking her okay i need your information 415 hold on i need your information okay i'll get your information i'll give you my information and then you can go on your way but i at least need to identify you okay that's part of it uh you would have already identified me before you in custody no that's not it i told you if you stop acting up don't act up because you said you're saying hold on what's your first name real quick i which you're still under investigative attention you complained of your shoulders being hurt so i said are you articulating a crime that i've committed i have legal reasons yes that's all i need so what you could give it verbally what kind have you what crime there is no crime now from what you're saying okay but i still know i still have legal right right right to go ahead and get your identification on who you were i took you out of cuffs because you said your shoulders were sore because it was bothering you and i said if you don't have because i didn't commit to crying i told you if you don't act dumb i'm standing in the street i told you i told you if you don't no you are not i told you if you do not is there a crime that you're articulating i am i fiance was yelling at you when the baby was sleeping and your daughter was sleeping okay now do you guys argue a lot i'm just out of curiosity i wouldn't because i don't know maybe i ought to call cps to see how things go with if there's going to be violence in the house i may have to go that route to him do a welfare check on you if you can't articulate any crime committed right now i i doubt your cps call will go very good but there is absolutely nothing violent around my daughters okay i know there's weapons in the house we are very good parents we do we do have weapons in the house to protect our children we'd never that we would use in an incorrect way we know our laws um i'm a very understanding person i'm college educated i never want a confrontation like this with i don't want conversations like this with people either i don't know why why you're being so aggressive i i actually have surgery scheduled in two days and okay you know i i don't know well i definitely don't want problems with you sir i don't want problems can you give me can you give me your first name i just want to call you by my first name because i just my first name is joshua okay josh joshua's name okay well she has your information but i don't joshua look i'm not trying to create problems with you i'm not looking do you think you might but do you think okay joshua joshua do you think out of all the homes in las vegas i just randomly said hey let's go and pick this house and go over there and stop you think i roll through here listening for uh do you think but do you think but i'm not what i'm what i'm trying to say is why do you think i was here i i just i to articulate a crime and that's what i was asking no see hold on hold on there doesn't have to be in a crime i have to investigate a crime yes if a possible crime was a crime you asked if there was a crime there's a crime which is a disturbance disturbing the peace much like douchery clark county does not have an ordinance that covers disturbing the peace however 9.16.030 covers enumeration of prohibited noises which states that yelling shouting hooting whistling or singing on the public streets between the hours of 11pm and 7am are prohibited the couple is neither in public nor are they arguing between the stated hours at this point it doesn't seem as though there is a reason for further contact as the more josh speaks to the officer the more hostile he gets which should serve as a friendly reminder to utilize your 5th amendment rights and always remain silent i would again like to point out that josh has not raised his voice once during the entire encounter and that the loudest person on scene was officer lopez you guys are arguing yes you're allowed to how are you and have an argument between among you know between husband and wife boyfriend and girlfriend whatever okay well if there are people calling saying that you guys are arguing you guys are disturbing them that's the truth we are here to make sure that nothing else happened between you guys that there is no battery doesn't matter who called you asked about the articulating the crime there's your articulation so the crime is that we disturb the peace that's not why we're here you were asking about the crime okay see y'all i'ma let him go you want my information though right do you want to i'll give it to you i mean i don't care i'm not i'm trying to hide anything [Applause] is i don't know her p number she's the other officer there okay do you want medical attention why are you in pain i have surgery scheduled in a couple days for your shoulder uh my shoulder and i have her needed okay okay so so is that pain because you were in cuffs or what i i just feel pain i'm not accusing anybody i just want to know because that do you feel pain in your shoulder because of cuffs or because you always feel pain i don't always feel pain i have surgery scheduled in a few days okay you are free to go okay all right take care camera tucked apart it claws over calls over camera i gotta put notes in here though the officers turn off their cameras and wait for a supervisor when he arrives josh is able to file a complaint and receives
