what were you doing to the bike i'm taking pictures to get the light out of my eyes man that's a government-owned vehicle what are you doing there what are you doing that's my vehicle where's your idea i'm not gonna show you anything what what's your problem what are you doing what are you doing on the government-owned vehicle we're gonna id you okay i'm gonna id you bro this is fixing to get real bad for you welcome back to the lackluster channel today's story is from coroner's news now be sure to check out his channel and let him know i sent you coroners was driving in laredo texas and noticed a border patrol helicopter scanning the area he decided to stop and record and noticed a border patrol atv as he began filming it officer lugo arrives on scene they can help you can help you hey they let them what's up get the lighter on my eyes can i help you huh can i help you with what what is that back go ahead and stand back can't you see what i'm doing or what get back over there what are you doing on the bike i'm taking pictures can't you see what you wouldn't step back over there no i'm not wait a step back no what you got to step back why it doesn't matter what are you doing on the bike i'm taking pictures can you see what what is that get the light out of my eyes officer lugo is immediately aggressive shining a high-powered flashlight into the eyes of corners it is important to note that corners is open carrying a pistol on his right hip and that it would be wise for anyone to illuminate a scene like this flashlights are often used as a way to determine whether or not a subject is under the influence they can also be used tactically to conceal your body and temporarily impair the vision of your opponent lately we've seen it done as a retaliatory move to block a camera or cause discomfort to an auditor there are recent arguments that because some of the newer high power led lights can cause permanent eye damage officers should refrain from shining them directly in someone's eye coroner's news now has been calm all while officer lugo escalated the encounter this would be one of the instances a flashlight should not have been shined directly into someone's eyes hey get back for me i gotta get back get back from me not gonna get back i'm not gonna get back you better get back you're not gonna i'm not gonna get back you better get back i'm not gonna get back yeah give us a community or get a subject subject's arm get back [Applause] you're gonna hurt my eyes all right what's suspicious about taking pictures you're up on the atv that's a government-owned vehicle what are you doing there what are you doing that's my vehicle that's not your vehicle i'm taking pictures of my vehicle i pay for that vehicle better get back from me man i'm not going to get back you better get back you better get back what's your problem stop right there i'm telling you to stop why i'm telling you to stop i'm detaining you because we're up on one of our atvs fixing to make the situation real bad okay you're fixing to make the situation real bad we're telling that i'm right now it doesn't i'm telling you to stop you're gonna okay i'm telling you to stop put your phone down i'm not gonna relax okay you are armed do you have a license to carry are you you have a license to texas the argument for whether this is a legal detention can be argued the officer did not observe anything illegal happening at this point all he knows is that an armed man is filming a government vehicle in the dark reasonable suspicion relies on specific reasonable inferences as was described in terry v ohio it is not incorrect an unparticularized suspicion or a mere hunch amir hunch's objective i.e the officer imagining that coroners could be stealing from or damaging the atv reasonable suspicion would be an objective fact requiring verifiable and quantifiable evidence such as observing corners holding items that should have been on the atv without reasonable articulable suspicion coroners wouldn't be lawfully detained and producing a license to carry wouldn't be required texas is also one of the few states that only requires the production of identification if you've been arrested all that said a court would have to decide on that and would likely rule in favor of the officer put your hands on the vehicle you better you better put your hands on the vehicle i'm investigating you you are up on one of our atvs okay then you need to relax you better move you better need to relax you need to relax and you need to listen to instructions okay i'm a federal agent and i'm investigating you and i'm detaining you do you understand what are you doing on the atv you can photos already put your phone down put your phone down and i'm gonna take that weapon off for you we're being detained until we investigate what you were doing on that atv i'm taking photos what are you doing on the government-owned vehicle on an atv and i'm asking you to relax we're gonna id you okay they're gonna id me i'm gonna id you bro all right bro fixing to get real bad bro this is fixing to get real bad for you why do you understand that fixing to get real bad for you why put your phone down you're gonna you're gonna get tased man why am i getting put your phone on the car relax and listen to instructions do you feel safer if you take my gun away i do actually i do put your hands on the vehicle get them again news now offers his weapon in hopes that officer lugo's aggression and pointless escalation would subside it does not and cornice is placed in handcuffs while the officers search through his pockets and remove his id one of the officers also uses the face id unlock feature on his phone to gain access to it if coroners hasn't been legally arrested and is only detained the search and identification and opening his phone are all major violations of his civil rights fortunately they seem unaware of corner's dash cam which shows the officers roughing him up during the search none of which had body cams he waited in cuffs for over 45 minutes until a supervisor ordered his release afterward coroners documented the damage to his vehicle and requested a complaint form from the supervisor and officer lugo continued his display of disdain for the public would i make the complaint for the world for this and you're the supervisor for everybody that's your name right here okay what's your name what's your name again what's your name again what's your name again what's your name for the complaint injury or death that's for the
