as we've seen from countless videos many traffic stops in the U.S are thinly veiled excuses to pin the automobile owner with additional charges and fractions and possibly crimes this action generates revenue for the local department and sometimes that local agency shares the plunder with federal agencies depending on the manufactured crime of the day this policing for profit method of conducting a roadside fishing Expedition by uniform Pirates always carries with it the justification of keeping Society safe on the roadways well a federal appellate court early November 2022 served up a legal victory for U.S Marine Corps veteran who sued the Hamilton County law enforcers who detained him on the side of the road without cause for nearly an hour in a fruitless search for marijuana the sixth circuit U.S court of appeals is refusing to Grant at former Hamilton County Sheriff's Office deputies Daniel Wilkie and Tyler McRae immunity from a civil rights lawsuit Saudi Daisy Tennessee resident William Eugene clabber filed against him in an April 2019 traffic stop and what's disturbing about this is that it took over three and a half years to resolve so much for the Injustice system clabber represented himself and relied heavily in the case on the officer's camera footage and his own according to court records a three-judge panel of the Appellate Court said in this week's opinion that clabber has presented ample evidence that the pair of law enforcers intentionally dragged out a stop for a window tint violation as a ruse to search clabber's vehicle for marijuana without legal cause the opinion stated when the historical facts are taken in the light most favorable to clabber we agree with U.S District Court Judge Travis McDowell that the deputies violated clearly established Fourth Amendment law so a jury must decide how to view these historical facts Deputy Daniel Wilkie by the way was arrested months after this encounter with Claver on charges including rape assault and official oppression crimes prosecutors say he committed while on duty and he used his police power to carry it out he resigned in December 2019. this shocking search by a Chattanooga area sheriff's deputy was caught on dash cam video last July in Hamilton County Tennessee two motorists were stopped by the deputy for an alleged traffic violation footage shows Daniel Wilkie and another deputy involved in the strip search of a man on the side of the road Wilkie allegedly performs an illegal body cavity search of James Myron Mitchell this is one of eight cases that I have um involving Mr Wilkie and then a variety of co-defendants common defendants and all those are Wilkie and Hamilton County government Daniel Wilkie has been hit with a 44-count indictment related to his actions against suspects he stopped for minor offenses deputies Wilkie and McRae are named as defendants in at least a half a dozen federal civil rights lawsuits alleging abuses of power and brutality and encounters with citizens and the most high profile of those cases involves the traffic stop of Shanda Riley in which the duo baptized her in a Creek in 2019. a former Hamilton County Deputy facing dozens of criminal charges and seven civil lawsuits is back in the spotlight again good evening and thank you for joining us tonight I'm Kim Chapman Latricia Thomas received the exclusive video of former deputy Daniel Wilkie baptizing a woman he pulled over through a records request to federal court she shows you what it reveals and brand new testimony from the sheriff saying the strange encounter should have been investigated it sooner what you are about to see in this cell phone video happened back in 2019 but you're seeing it with your own eyes for the first time right now [Music] a baptism is a pretty common sight in the South but this cell phone video entered as evidence in federal court shows a sheriff's deputy baptizing a woman he just pulled over that Deputy Daniel Wilkie seen stripped down to his boxer shorts chandel Riley one of the seven people suing him saying Wilkie violated her civil rights the suit says Wilkie told Riley he would only give her a citation instead of take her to jail for marijuana remnants in her car if she let him do this 42 year old Riley died of a drug overdose earlier this year after Wilkie's arrest McRae was transferred to work as a school resource officer at East Ridge High School he's since been accused of roughing up an East Ridge student without cause in video of the September encounter between McRae and the student went viral and guess where McRae ended up he's transferred back to patrol so deputies Wilkie McRae claimed that they had the right to be suspicious of Claver in April 2019 because he seemed nervous and shaky after being stopped for window tint that appeared too dark Mr clabber countered that he had caused to be nervous and shaky because he'd heard about rumors of police brutality and abuse of power by some wilies in the law enforcement department and has tremors as a sufferer of muscular dystrophy the sixth Circuit Court opinion recounted as clever reached for his dry driver's license Wiley encountered about where clabber was headed and clabber didn't answer not gonna talk to me while he asked clabber when Wilkie pressed with another question Claver handed Wilkie's license and asked am I being detained Wilkie replied yes because of the window tint violation as Wilkie and McRae headed back to Wilkie's Cruiser Wilkie said the words Sovereign citizen to McRae then the officers talked for a few minutes Wilkie observed that the van had an obstruction which was a Marine Corps sticker on its license plate and noted that clabber has been quote shaking like a leaf according to court documents to add insult to injury the pair of deputies decided to summon a drug sniffing dog to the scene but they didn't tell Claver about five minutes into the Stop the officers returned to clapper's van and requested his registration and insurance card Deputy Wilke expressed appreciation for clavers military service but added that Claver could not have an obstruction on his license plate then Wilkie began questioning Claver and asking if he'd ever been arrested or took medication clabber answered no to both questions Wilkie explained that the reason I'm asking is because you're shaken and the inquired whether clabber had Parkinson's or anything like that Claver indicated that he did not think that Wilkie could ask him these questions then Wilkie Justified his questioning on the grounds that Claver was shaking and that might suggest that he was hiding something or had drugs so Wilkie asks you don't have any of that do you clever responded no I don't but that didn't stop Wilkie according to the opinion of the Court he continued to press clabber on whether he had drugs or guns in his van Claver again answered no Wilkie then asked clabber for permission to search the van clabber refused he said quote Claver responded as anticipated I refuse permission for you to search my vehicle and there's nothing in there for a third time Wilkie asked clabber if he'd ever been arrested and Claver again replied no Wilkie reiterated is there any reason why you're shaking so bad clever responded sir I'm trying to be as respectful as I can but you've got me illegally pulled over Wilkie walked away from the van and McRae walked up by now Claver started videoing his interaction with a pair of deputies caught on clappers video McRae asked clabber if he had served in the Marines he would not answer any more questions Claver instead said that he'd like to be on his way if they were not arresting him Deputy McRae defended the continued Detention of Claver saying Wilkie penned two traffic citations against clabber for excessive window tint and obstructing his license plate with his Marine Corps sticker but gray eventually walked away nearly 30 minutes after Wilkie first stop clabber the drug sniffing dog finally arrived with this Handler Wilkie told this officer that collaber was likely a sovereign citizen who's being combative and trying to conceal himself according to the opinion of the Court Wilkie added that the canine Officer should let him finish with the ticket before deploying the dog in case clabber quote does something stupid the canine Handler waited another 10 minutes before taking the dog around clapper's Van McRae insisted the dog had alerted in the presence of drugs in the van and then he and Wilkie search clappers ban but found nothing illegal inside the sixth circuit panel wrote quote the U.S Supreme Court has adopted a bright line rule that officers may not detain a driver longer than necessary to complete a traffic stop simply because they want to investigate other crimes they said under clever's view of the facts here Wilkie and McRae did just that see guys the sad part about this whole thing is that it didn't have to happen in the first place this was clearly a fishing Expedition where cops waste taxpayer resources to harass and collect from honest people who are doing nothing wrong there's plenty of real crimes happening in towns and cities all across America instead these cops drive the people to fear and Desperation as they plunder more money from the already financially weakened people that these same cops claim to be protecting and serving leave your thoughts about this for the world and the global thought police in the comments section below if you haven't done so already subscribe to this
