if we're learning more about the arrest of a Republican state representative Ryan Martinez he's from Edmond he was arrested for DUI last week we've all heard of qualified immunity for police officers that magical parallel reality that allows a regular human being who wears a special costume and a badge to somehow be exempt from the consequences of criminal activity initiated on his fellow man it's better than a get out of jail free card it's a don't go to jail or be penalized in any way card qualified immunity somehow with the Court's blessings allows a cop to do nasty things to others without ever having to pay the negative consequences that you or I would have to pay if we did the same thing well just like there's qualified immunity for cops there's a case of legislative immunity as well and diplomatic immunity and judicial immunity what we've got here is Oklahoma State Representative Ryan Martinez from Edmond Oklahoma who like his Democrat counterpart Paul Pelosi thought it was a good idea to get behind the wheel of his car and drive drunk but because he's viewed as a very special person in our society and due to an Oklahoma constitutional statute he thought he was exempt from these penalties because the politicians in Oklahoma happen to be in the middle of a special legislative session at least that's what Martinez was trying to say let's take a listen foreign just there yeah okay what was your plan right now oh I was gonna head from the house right real fast I do what time do you start drinking what about 10 o'clock what time do you think it is now [Music] okay who do you work for yourself [Music] the last name Martino yes sir I'm sorry how many alcoholic beverages did you have tonight uh three or four yes sir you said you started at 10 o'clock yeah okay and you think it's one o'clock in the morning now yeah so three to four alcoholic beverages starting at 10 o'clock so it's only about 11 47 now it is okay okay [Applause] um what kind of drinks were there uh keep your hands out of your pocket were they single doubles how big were they were eight ounces okay so two eight ounces vodka tonic anything else so just two drinks um my concern is you're you're not being truthful just because you had trouble getting out of your car we got a call actually from someone here stating that you'd already showed up intoxicated I don't I don't think so though you don't think you don't think what part where did you have drinks before you came here I had dinner I didn't actually you what I didn't have anything to do the drink [Music] okay so why do you think they they believe that you showed up intoxicated man where'd you have dinner at I am mahogany mahogany I need to have anything to drink there nothing at all so two vodka tonics that made intoxicated or okay okay do you feel like you're too intoxicated right now no okay what about do you feel safe to drive you do yeah my house okay all right um so yours my concern like I said they were the ones who called us stating that you had showed us and they believed that you were already intoxicated before you got here nice to review some drinks you had trouble getting out of the car I thought you were having trouble even even standing standing still they actually set it up when they were close enough okay okay right well what I'd like to do is to take you through a couple of series of testing or I suppose I've already tested to see whether you're going to be safety driver okay are you okay with that have you done that before are you familiar with them okay that's fine because I can um I'm gonna walk you through them or I'm going to tell you exactly what to do okay so what I'll have you do actually can just stand right there for the first one with your feet together hands to the side yep all right do you wear any glasses any contacts anything like that you know all right any head injuries recent head injuries or anything like that I should know not recently how long ago a couple years ago a couple years ago would you have oh confessions I wrestler played football okay but nothing tonight no no nothing tonight okay all right so what I'm gonna have you do you see the the top of my I found the students okay so what I'm gonna have you do is you're going to follow the tip of my pen with just your eyes your eyes only don't move your head okay okay all right so I'm gonna start now okay [Applause] all right the next test we're going to do is going to be the walking current test I'll explain it to you um do you have any physical injuries I need to know about anything with your legs how so oh and which one how long do you have to use how long yeah until we determine whether or not you're safe to drive I mean you can you can deny doing any test if you want but what we want to do please keep your hands out of your pockets always make sure that you're the same but you're sober to dry that that's our main goal here to make sure that you're safe to drive we're gonna call my returning and you know I mean we don't need your attorney right now so like I said it's up to you these are voluntary okay these are an effort for us to determine if you're safe okay next thing okay what's next okay put your left foot on the line your right foot in front touching line Heel To Toe just like that yep and then you'll keep your hands to the side so make sure your your heel to toe I I don't start until I tell you to yep go back and then put your hands to the side so hands to the side like this nope just like this to the side and make sure your left foot is on that line as well your left foot and your right foot so okay I'm gonna start the instructions over so left foot is on the line right foot in front of it touching Heel To Toe yeah so enhance to the side okay and then it's stay like that don't start the test until I've instructed you to do so because I'm going to explain it to you okay so what you're going to do you're going to take nine Heel To Toe steps on that line once you get to yeah nice okay once you get to that last one you're going to keep your front foot planted okay with the other foot you're gonna take a series of short choppy steps okay and turn around and take nine Heel To Toe stop suck I think um and I will do this okay for instructional purposes I'm gonna do three you're gonna do nine so stay in that position do what now that's asking a lot of something that's asking a lot how so I mean that's a that's very complicated okay any questions you want a primary Place expired um [Music] good okay all right you may begin until I tell you to stop yep you can start over that's okay to point it down toe pointed down point it down did you want me to demonstrate it again yes okay it's gonna look like this 1001 1002 1003 1004 1005. okay you may begin all right so it looks like that um is in session from February to may I don't see anything on the House of Representatives but I would imagine that's the same all right keep your hands out of your pocket you're saying uh yes sir you understand the legalities that cover state representatives as account as it relates to being arrested for offensive Sarah what is that understanding to you that you can't hold me you can't hold me and uh foreign [Applause] [Applause] right so that's kind of what I'm asking because as far as I know the regular session ended in May listen okay but you're saying right now you're in some kind of special session never who oversees your special session the governor and it's like me to call kids um [Applause] but do you understand the situation that we're investigating right now I agree what is it that you feel that we're not investigating right now I believe that uh you're worried about being intoxicated exactly so based on I'll walk on your well based on how you feel you conducted the sobriety attack how do you what do you think your observation is as far as the outcome of those studs I think I can move it off for two blocks no that's okay so you think you can make at home a lot of people can make it home do you think that you're not too intoxicated to drive home legally yes you do I do [Applause] what's the conundrum just uh you're asking if I could drive home safely I do think I could drive home safely do you understand that for my observation me I'm not talking about this office it's my observation of how you conducted the test that you failed to test I did one yes I I okay I believe you I'm nothing I'm nothing and that's not just the walk and turn test it's not just the one late stand test but it's also the nystagmus test for your eyes that's just one of the leading indications sure and that indicator is one that you don't have any conscious control over okay so the alcohol level in your body is going to dictate what your eyes are going to be as we're looking at them and as you're following the finger so based on that alone okay I trust a lot uh one of these Edmund cops accused Martinez of quote not being truthful ahead of his arrest on suspicion of driving Under the Influence outside a bar on October 27th according to the police report and body camera footage provided by The Edmond Police Department Martinez initially misled officers about where he had been and how many drinks he had consumed and he minimized the distance that he was planning to drive home and falsely claimed that the legislature was in quote like probably three special sessions my concern is that your judgment isn't fair foreign now officers made contact with Martinez at 11 41 pm and he was ultimately placed under arrest at 12 23 a.m after he had failed multiple field sobriety tests but before he was officially placed under arrest Martinez sat on a parking lot curb for about 20 minutes as officers attempted to verify his claim that the legislature was in special session he said quote my understanding is the constitution of Oklahoma says that I can't be detained on my way to go represent the people Article 5 Section 22 and that article States quote senators and representatives shall except for treason felony or breach of the peace be privileged from arrest during the session of the legislature and in going to and returning from the same place and for any speech or debate in either house shall not be questioned in any other place this constitutional provision is widely understood to prevent a legislator from being impeded while he's on his way to or from the state capitol to take action during a legislative session so the provision does not Grant legislators the equivalent of diplomatic immunity but Martinez wanted to believe that it did Edmond officers Sergeant Roger short and Maria Serafin as well as a third unidentified officer communicated with dispatch and the Oklahoma Department of Public Safety to determine whether the legislature was in session and whether the Constitutional Provisions prevented Martinez arrest to put it in another way they wanted to make sure that there was no presence of any magic pixie dust that would prevent them from arresting Martinez well and I mean I have respect for what you do which is why we're going to take everything [Applause] okay [Applause] you'll get phone calls once you get into the jail so they ended up placing him in cuffs and taking him to jail but one wonders what would have happened if Martinez met the requirements of Article 5 Section 22.
