I'm a former police officer myself. I was a federal agent. I have some significant hearing damage from shooting bullets and rounds near my head for years. You have my address. Come get me. And they came to my son. They put his fingers up here poking him. Thanks for being so loud. Do not interrupt me, sir. Unless you have a warrant. How about you? Put a lot of people in jail. And if I got to go to jail, I'll go to jail. But I'll do it with his teeth coming out. I am just like the Hell's Angels and just like that was. I don't care. Welcome back to the Lackluster channel. In early January of 2025, the Benton Police in Arkansas received a 911 call. Yes, ma'am. I need the police over here to the Bentonville. Okay. So, what exactly happened? It was our meal. We were We were eating our meal at the grill. These people, this man and his wife were sitting next to us. They got up. He, a grown man, put his hands on my little boy who is 7 years old, a little boy that weighs 60 lb. He's autistic. And he's poking him up in his collarbone with his fingers. He's got no right to touch my kids. I didn't realize it. I was sitting over here eating my meal. Eating a meal. A succulent Chinese meal. And I had my glasses on. I didn't realize my wife would never have saw it. He walked out of here. Okay. And tell my son, "Oh, thanks a lot for being so loud. Put his hands on my kids." You know, it's actually a felony in Arkansas for people to be putting their hands on other people's children. That's a felony. I will not have no I won't stand for it. The only reason right now he's not picking up his teeth in here is I didn't realize if I had realized he put his hands on my son, you could give me a call right now beating the out of him. I want this some found and I want charges filed. I want nobody touching my kids, man. Okay. Okay. I do have an officer that's been on the call. We'll try to get somebody to you as soon as we can. Officers Thompson and Williams were dispatched to the scene. When they arrived, they met with the caller. We're in the back. My little boy is my smallest one is partially deaf. Okay. He's only seven. He's a little boy. He's autistic. Okay. And he's half dead, halfway deaf. And you talk to him. It sounds like a 2-year-old. Okay. We were eating dinner. He had his little phone. He could barely even hear it. These people were sitting next to us at the grill. They never said anything to us. They get up. Hold my stuff in my diabetic. Oh, they rush out there. They rushed out. They come up over there. I didn't realize it till she pointed it out. And they came to my son. Okay. Okay. They put his fingers up here poking him. Why? Thanks for being so loud. Oh, that's But he was very quiet. I don't want somebody put their hand I'm telling you right now. I'm a former police officer myself. I was a federal agent, okay? My 20s. I'm going to tell you right now, I didn't realize I had my glasses on. I'm eating my food. I didn't realize it. If I seen that son of a [ __ ] put his hands on my kid, I would be in there right now tailgrabing his ass, knocking his [ __ ] teeth out. I don't give a [ __ ] about jail. I put a lot of people in jail. And if I got to go to jail, I'll go to jail. But I'll do it with his teeth coming out. Hold on. In jail or anywhere else, the lowest suck scumbag son of a [ __ ] to touch his kid. No one's got the right to touch my kids. Do you Did you see what it look like or anything like that? The name's in there. The manager Well, they're to have a warrant. I want this to go to detective. I won't go into the DA tomorrowing morning. I want their names. They paid their bill. I'm filing charges. No one's going to touch my kids. All the time. All the time. No one's going to touch a little boy like that. I guarantee if I was in Ben Canyon jail over there, I went in there for touching my hands like a little kid, they'd be beating the [ __ ] out of me in there. You know that. I don't know that. Yeah, they would. They would. Okay. Yeah. I need a ID from both of y'all and then his information, too. Officer Williams goes inside to speak with the staff as Thompson gathers information from Philillip. I didn't see I seen hands but your mom, right? Yes. I seen hands like this and then little man told me that he was doing this. Okay. So, um I will not have nobody put their hands on my boy. Yeah. Nobody. Can I feel that? I have a lawful duty in Arkansas to protect my children. You know that? Yeah. They're your kids. So, I have a responsibility under the law to protect these kids. Um, so what happened or I had a host come up to me saying that a man was upset and then the server I guess it was also related to the server that our girls are community feeding so we put several different people together sometimes and that's what happened in this case. So this family who called you I will not have nobody put their hands on my kids or do inappropriate with my kids if they got a problem they can do it me. Uh, in another family, the man apparently tapped him on the shoulder from what I hear. I didn't see it. I don't know. They touched my kids, we're going to have problems. And I'll tell you right now, if I had seen that son of a [ __ ] doing that, if I had realized, yeah, he left plates full of food. They rushed out of there real fast. He used to live on, but he didn't agree with it. Maybe he felt it was aggressive. He said his kid is autistic and maybe has sensory disorder or something like that. Okay. See, that's me. I was a federal law enforcement agent. I will not I will not tolerate it. This man, I will say, has been here a lot and every time has something to say negative. The lowest people on thising planet are people that hit kids and and put their kids on my put their hands on my kid. I don't give a [ __ ] about jail. He gets a little fired up. I don't care about jail. That's your kid. So, you know what I'm saying? What's your phone number? But this is what I'm hearing from servers because he's never directly asked for a manager. It's just the servers are like, I always have something to say. I don't give a [ __ ] This has got to go to the detective. I don't care what's got to be done, but we got to find out. His name, he paid the bill. I want I want to charge. I'm going to file charges. Going to touch my kid. I don't care. Why you couldn't just come up to us and be like, "The phone's a little loud." It wasn't even that loud. He was being an So, you guys were at the grill. Can you tell me where they were sitting? Yeah, they were at the grill. They were way over there. Oh, on the other side. Yeah, on the other side of the grill. Their little kids sitting on their laps being loud and all the other Everyone, you can hear people talking in there. Everyone's at the griller talking and shouting cuz they're, you know, I mean, come on. Yeah, this guy's got a problem. Lots of people. So, I mean, it it makes sense. Um, what's your name? You can see we have a camera system. Unfortunately, I don't have access to it. I We have a I'm not the general manager. I'm sorry, I get mad, but you know what I'm saying? Hey, you're fine. Nobody's got the right. No one's got the right to touch someone else's kids in any way aggressively threatening. I will have no one cuss my kids. I will have no one sexually touch my kids. I don't care who it is. I will them up if I catch them doing it. Yeah. Um birthday. Okay. Could you give them a call real quick? Does he have red marks on him at all from the folks? I don't because if he does, I mean, we've got to take a picture of it just for you. Nobody's got the right to touch anyone's kids. Yeah. So, there's a stipulation of I guess how he was tapping versus like a Yeah, like excuse me. Yeah. He is claiming that it was more of aggressive where he was kind of digging into the shoulder. Did you happen to look to see if there was a mark? When Officer Thompson inspects the child's shoulder, the tablet can be heard in the background. This was the noise that was endured during the meal. Officer Thompson took note that there were no red marks on the boy's shoulder. I don't see I don't see no marks, but let's real quick. I don't think there's any marks on him. So, was it on his back or was it on Where was it, honey? Right here. I'm going to take a picture of it anyway, just to document it. He is very animated right now. So, kind of trying to deescalate him until he calms down to look at the kid. Uh, let me get you the case report number really quick. Um, and I'll let you guys go just to get them home and I'll keep you updated with it. Okay. Actually, let me get your email, too. And then I just want to see the camera footage just so I can put in the notes what I've seen. Like he I guess I presume he paid with their credit card so his name and all that's going to be on there. Um that's just the thing with that is they don't have to give us that information. Um so it just depends. But but a detective can get they can they can get the they can get a a warrant and they get the information cuz it's easy to go off of what one person says and then it's like he say she say. But you know my thing is if this man is a grown man that's going to run like that then you know he's old enough to know better. Right. 64. I mean we're they're adults. Yeah. I mean I don't I don't I do not buy an adult who says oh I don't know any better. You know you're already 30 years old 40 years old. They know better. Go ahead. You're right. They know better. Yeah. Hi, Sam. Sorry to bother you. Um, I have a police officer here. And if they don't know better, they need to be in jail. Either way you shake it, they're wrong. Either they do know better and they're lying about it or they don't know better. Either way you cut it, they need to be charged. You know what I'm saying? But the way I look at it is that this is even though he didn't do any any injury, but he still assaulted a child. Yeah. He still assaulted a child. He had no right to put his hands on him. A customer called uh the police on another um family that was sitting at a girl with them. I have no right. I got no right to go watch a little girl put my hand on her. Yeah. Or anywhere else. Yeah. And I don't like nobody doing it to my kids. And when he does that Yeah. We're going to get we'll get all the information that we can. Um and I'll keep you updated on it. I'll see as far as we can get. Uh and I'll just let you know. Okay. claiming that the other family aggressively tapped their son on the shoulder. I I would ask, like I said, if it has to go to a detective, if it has to go to the prosecutor. So, what will happen is it'll go to a detective first. So, they're going to have to look at it first. Um, it's up to you if you want to contact your own people, but our our way is we do the first initial investigation and if we see fit for it to go further up, the detective will also see it as well. So, all the all the supervisors, our lieutenant will see it as well. He'll read over it and we'll go from there. You know, and keep in mind, we're talking about a child that's protected, not under the law as a child, but disabled, legally disabled. Yeah. We're not talking about just a normal child. Yeah. We're talking about a little kid who is protected under Americans with Disabilities Act and he's partially deaf. He had no right Yeah. to touch that kid. No right at all. You know what I'm saying? Yep. And I'm telling you, the only reason the only reason you're not showing up here with me tail grabbing his ass. Yeah. Anding him up is I did not realize cuz I don't care about jail. You would have showed up here and I would have been in there beating the dog out of him. Yeah, you're fine. Uh yeah, let me get in there and talk with You understand what I'm saying? Yeah, I I get you. I mean, I I'll I'll get in here with talk to the manager. I'll let you guys get those kids home and I I'll give you a call or email you one, okay? Let you know an update. Okay. Okay. Thank you. Yep. Thank you. Philip was sent on his way and officer Thompson went inside to meet with Officer Williams. Check. Yeah, they're didn't even react. I mean, I took a picture of his shoulder, but presume everything. I figured he was kind of over dramatic in the the poking. Yeah. And it was more fierce. Yeah. It may be one of those situations where he always comes in, but just want something to get something or something. Sorry about that. I'm sorry. Okay. While they waited for the manager to obtain footage of the alleged aggressive poking, the officers discussed possible charges. I don't think we have enough I got you, right? Uhhuh. Yes, I got it. I'm ting both reads intent with physical harm and battery is um intent with physical touch but I don't think like you said I don't think we have enough to even go off of a charge. I don't think we do either because guess we'll just have to really read the statue to see what it says. He wasn't upset. The kid was Yeah, the kid was fine. He was hanging out. Dad who was upset because that person. He kept alluding to contact. He even made while you were in here, he opened it up and he goes, "You got you guys would arrest me if I went up to like a 5-year-old girl and I said, "Well, that's a little different." Yeah. Well, my thing is this, too. The mom wasn't upset about it, and the kid was really wasn't upset. He was, you know, car. My thing is I think he's over dramatic in the situation. So I was reading the statues before I got here. It doesn't fit. I don't think there is a statue under that. What's it me walking by saying thanks for being loud and walk away? You can say that, right? There's no criminal thing against him. Even if he taps the kid just to make him look at him, thanks for being loud, right? there's no physical harm to him, which that what that's what battery says, right? And then assault is to cause physically bothered harm. Here's what I'm saying or hear. I'm not saying hearing uh the server just told me as I'm trying to collect this stuff that the kid was being obnoxious, running around, being rambunctious, maybe just not contained. And I guess that the man had had like touched his shoulder, tapped his shoulder. I didn't see it from what I'm hearing. And it could just be from him to the server. Thank you for misbehaving. Something like that. Like that. Like he was disrupted. Eventually, a short video of the alleged incident was sent to the manager and then forwarded to the officers. It shows a man, his child, and wife. As they leave, the man dons a yellow jacket and as he walks by the table, his hand touches the back of a chair as he leans in. The entire incident was over in less than 2 seconds. In fact, the child doesn't appear to even react to the encounter. This suggests that every account that was described by Philillip and his wife was a lie. And after the encounter, Philip called the police again. Um, I'm I called you a while ago. I'm a complainant. I was over at Shogun and I I left at my kids home, but the police were there still. Okay. When when that when that female officer gets clear and all that, would you please stop getting you a quick call? Okay. So, you wanted you wanted the female to call you back. Yeah. So, I was talking to her. So, Okay. And uh are you fill up? Yep. I sure am. All right. I will have her give you a call. Thank you. You're welcome. Despite having evidence that nothing happened, didn't even react and coming to that conclusion themselves. The officers still tracked down the man in the yellow jacket and the case was passed off to Detective Beer and the department gave the man in the yellow jacket a call. So I guess um the other party as in um I guess the kid that you touched on the shoulder. I didn't touch any kid on the shoulder, first of all. Okay, sir. Um, second of all, I walked I walked past I walked past a mother and father who had their their son sitting there with their phone blaring. I walked by with my wife and I said, "That was very loud. Thank you." And then we walked on. I touched nobody. So unless somebody has film of this, then I suggest you call my lawyer, Doug Norwood. Okay, sir. So I Nobody touched Do you have a witness that somebody touched? She's the one that came up to us and yelled, "Uh, you when we were walking out the door?" Yeah. So I I don't know what this is this this insanity. So I'm just calling to get everybody's side. So I'm not accusing you of anything. No, this is insanity. This is insanity. Sir, do not interrupt me. Do not interrupt me, sir. Unless you have a warrant. How about you piss off? Sir, I gave you time to talk. Do you have evidence of this or are you just calling and harassing me? I actually do have evidence of What evidence of of of me touching a kid do you have? Because I touched no kid, sir. So unless you have video evidence of that, you need to leave me alone. I do. You do not. I do. No, you don't, sir. Evidence of what? He's trying to say he has evidence of then Paul. No. How dare you call and lie about my husband. He leaned over towards the husband and said that was loud or something. Thank you. Nobody touched anybody. Nobody cussed anybody until the lady came up and cussed at us. No. Then I told her to piss off and I walked out. Yes, he did say piss off. But no after she said [ __ ] you. No foul words were said. I stood there and watched. And if she's lying and saying that we touched her, then pull the security cameras. I am appalled. Otherwise, you have my address. Come get me. I'm speaking to you both calmly. I need I'm not calm when somebody I don't give a [ __ ] if you're calm. You're calling me at my house after on something that didn't happen. Add to my lawsuits against you. pull the security footage that will prove she is lying. That's simple. Ma'am, what? Hey, this is this is Sergeant Caster with the Benville Police Department. I'm actually the officer supervisor. Okay. Kind of looking into the whole uh instinct. Okay. Um so, first and foremost, you know, the profanity is unnecessary. We're all adults. I don't care. I'm at my house. I can say whatever the [ __ ] I want to at my [ __ ] house. Well, I'm just trying to explain. I don't give a what you're trying to explain. I didn't do anything. So, you know where the I am. You can come get me. My lawyer is Doug Norwood. Or talk to him. Go [ __ ] yourselves. Good night. You have a Some of you may think this man looks familiar. This is Chris. Chris had a dispute with his neighbor over trimming trees on their property line. Officers eventually arrived at Chris's house and attempted to issue a trespassing citation. With the situation and how it all played out, there wasn't a crime committed. However, what we are going to do to try and give you a little bit of peace of mind is we're going to trespass them from your property. Though he hadn't been on the neighbor's property, and neither neighbor had requested that the other be trespassed. Can I help you? Yeah. What's going on, man? Not a thing. What's going on with you? Hey, so uh we got called for a disturbance between you and your neighbors behind you. There was no disturbance. I was on my back porch. She decided to let me know she was unhappy and I basically told her to go herself. When asked for his ID, Chris refused, and he was arrested. Could you get your ID for me? Why? Cuz we're trespassing you guys from their property and we're trespassing them from your property. If you fail to ID identify yourself, we're just going to take you to jail. Okay, I'll go get my stuff. Hold on. Okay. You're threatening me that you're going to arrest me if I don't give you my ID. You don't identify yourself? Yeah. You're on my property, sir. Get off my property. I'm not identifying myself when I did nothing wrong. He was set free shortly after, but took his complaints to the city council. The ignorance and I dare say even nepotism displayed by the Center Police Department on Saturday was unprofessional to say the least and at the worst it was criminal. He then spoke with the chief of police and not long after the incident, the officer that arrested Chris was fired. Wills. Okay. He is he is no longer an officer with the police department. Oh, okay. That's wonderful. Okay. So, I'm just letting you know that you know that he is no longer here. May I ask it? Was it because of this particular reason or was there another reason that he was he was let go? No, it was all to do with this. Okay. But this is his most recent experience. You have my address, come get me. Despite Philip's request, when that when that female officer gets clear and all that, would you please have you a quick call? Officer Thompson never called him back, but Sergeant Castro did. Hello. Yes. Hi, nice to meet you. Philip Martinez. Yes, sir. This is him. Hi, this is Sergeant Ar with the Ben Police Department. Just want to let you know that I'm calling you on a recorded line. That's fine. I hope you do record it. I don't care. Let me tell you something. Okay. We were sitting in there eating dinner. My son is 7 years old. He's disabled. Mhm. Okay. He is deaf. He's autism. That man is sat over there and he came over there and he poked his fingers into my son's body. They were scared. Let me tell you, we were sitting there. It's very noisy in there. They're in there doing chops through those utensils. Top chop cuping ding ding. You know, if you've ever eaten at a Japanese grill, you know it's noisy in there. Yeah. And everyone's talking and you know, you hear cups. It's a It's a busy restaurant. My kid is sitting there 7 years old. That phone he had, he s you can barely even hear. I mean, people were yelling across their even their tables around us was loud. And this man came up over there. I didn't recognize cuz I had my glasses on and I had I was looking at my food. You know, I've got diabetes. I was trying to get my sugar up. So, I'm in there eating my food. And I'm probably tattooed cuz I'm I'm also a veteran. I'm also a next cop and I have significant hearing damage from shooting bullets and rounds near my head for years. And this guy comes up to my son and pokes his fingers, puts his hand on a sevenyear-old boy on his up in his collarbone. Did you witness? I saw I saw the corner of my my sight and and my wife saw it. Okay. My son felt it. My son told us. I didn't recog I didn't really understand what's going on. I didn't you just see when someone's doing that that you know you're in you just there's a part of your mind that that that that gives I was giving credit thinking there's no way someone's going to do that in front of me. He's a grown man. He had a little boy there with his wife and you know he he's a grown man and it's very clear it's his decision to come over there and put his hand on my son. Absolutely. And I'm g tell you right now, I swear to God, I'm like the Bandidos or the Hell's Angels, okay? I've told the people, I put a lot of people in jail in prison even, and I never been to jail, but I if I got to go to jail, I'll go to [ __ ] jail. I don't care because I'm just like the Hell's Angels and just like the banditos. I don't care. And let me tell you something. The only reason there ain't shrimp and chicken and rice and vegetables all over that grill is I did not register. Cuz if I had understood what was going on, I would have left hook him and I would have beat that dog [ __ ] out of him right there and then. And I would not have stopped and I wouldn't have gave two rats asses. I would have been beating his ass until you all put me in handcuffs to just be in a police car. I don't care. I am just like the Hell's Angels and just like that was. I don't care. I won't stand for you. I remember what that son of a [ __ ] looks like. Yeah. Um, well, if I knew where he lived at, let me tell you something. If I knew where he where he lived at, I am just like the outlaws. If I knew where he lived, I would be at his house right now kicking his ass. Well, definitely wouldn't want that because obviously that that probably I don't care. You're right. I don't know where he lives, but like I told you, if I go to go to jail, I'll go to jail. But I will not have nobody catch my boys, right? And anybody my kids, I understand your frustration as a parent myself. I mean, I'd be a better Let me tell you something. You're a parent. You tell me what would you do to me if I put my thingies on your kid like that? Yeah, I mean I would I would definitely confront you and then try to figure out exactly what the reason is for you. Someone's got someone's got to go to jail. That's all. That's the only way out of this. I'm going to prosecute in the morning. I'm asking you all to do your job. He's such a disabled child and I want someone to jail. We'll definitely type it up. Um obviously at this point in time, we'll have to identify the party um because the person wasn't there whenever we arrived. Um, best course of action that we can do, we can review the camera footage. Um, we can send out an email. Um, if we do have cameras there to try to ascertain a person's identity. Um, and then from that point in time, we can type it up and we can send it over to the prosecutor. Now, um, so you you said that you were cop. What were you hoping affairs federally commissioned tribal police officer in New Mexico? That's a tribal police. Yep. Under US government. Okay. Um, so you're pretty familiar with also assault in the in the first degree and assault in third degree and so on and so forth. That's right. Okay. So, the closest thing that we would probably have at this point in time if the prosecutor were to pick up this um this case would be like assault. Um, that's my which is a classic misdemeanor. Um, but we have to establish the intent behind the contact. Um, now the intent is clear. Now, listening to listening to the the incident described by you, um it it seems like he tapped your son's shoulder. Obviously, physical contact was made, um whether his intentions were to just try to make a comment to your son or try to get him to calm down. Um obviously, the person doesn't know, your family, doesn't know your son, doesn't know you that your son is disabled. Um and so, we have to put that aside because he does not have that knowledge. Um, we can only present the black and white of what he knew at that point in time, which was he's a minor and he made contact with a minor. I don't think his intentions were to harm your son. Um, because obviously if you wanted and had ill intent, he probably would have just snatched up your kid and it would have been to the degree where he would have done that. I would have he would have done that. I would have stabbed that sort of his problem is he has no control over his emotions. He's a grown man. He should have. Yeah. As an adult, he should have probably either brought it to the attention of the business who can then approach you on a business standpoint. The right way to do things right. This phone call goes on for more than 40 minutes throughout which Philip continuously interrupts and often falsely suggests that the incident involving his son was of a sexual nature. At the end of this video, I'll leave more of that phone call, but in the interest of time, we'll continue. The Bentonville police pursued this case for 7 weeks before closing it out. They refused to press charges on Crisp because of the restaurant's video. However, they also refused to press charges against Philillip despite the false police report made intentionally to punish Chris for something he didn't witness and allowed to be spun out of control. Not to mention, he threatened to stab Chris. If he would have done that, I would have stabbed. If he would have done that, I would have stabbed that son to show up at his home. If I knew where he where he lived at, I am just like the outlaws. If I knew where he lived, I would be at his house right now kicking his ass. Kick his teeth in. I put a lot of people in jail. And if I got to go to jail, I'll go to jail. But I'll do it with his teeth coming out. And made innumerable other physical threats while speaking to an officer. It shows a common reality in situations like this that no matter who was right or wrong, the police are most likely to take the side of the first person to dial 911, especially in high emotion disputes. This is common in domestic violence calls as in some jurisdictions, police are required to make an arrest and undoubtedly their perception of the incident is heavily influenced by the first caller's account. Even when they realize that their initial assessment was incorrect, the first caller's account has a lasting impact. Chris now plans to pursue a protection order. After hearing all the threats in the body cam and calls, it's also alleged that Philip and his family are now banned from the restaurant because of this incident. In fact, during the call, the restaurant made mention of Chris and his family. What's the guy's name? Which guy? Oh, on this. Mhm. Or did he pay in cash? No, he did pay here, but like he they are regulars and they're really good people, so I just Well, it's two sides to everyone. I know, but I just don't want him to think that we're like throwing him under the bus. You know what I mean? I mean, we still have to talk to him. That's the thing. No, I understand, but I really don't know like if like I don't know. I just feel bad. I feel bad about the whole thing, honestly. And said this about Philillip. This man, I will say, has been here a lot and every time has something to say negative. But this is what I'm hearing from servers because he's never directly asked for a manager. It's just the servers are like, I always have something to say. I'm curious now what you think of this interaction. How would you have reacted to Chris's actions? I personally believe he opted for the passive approach and should have been more assertive earlier in the dinner. Instead, Chris chose not to make the family feel uncomfortable before his departure to prevent causing a scene. And what about the actions of the police? Was their investigation good enough, or should Philip have faced charges for the various threats and falsified statements to law enforcement? Leave your answer in the comments. And if you have a story you want to share with me, you can do so, even anonymously, using the links in the description. Now, here's some more of that phone call. Um, and so I just have to be fully transparent with you. Oh, I get it. I understand. I'm just saying two things. You and I both know if I go out here anywhere, I go to school, hypothetically, and I put my fingers on someone's kid, I guarantee you n out of parents out here will either pull a gun on me or they'd be on top of my head. Right. I can tell you right now, you guys both know if a person goes to Benton County jail for a felony or a misdemeanor and inmates in there find out you're in here because you're putting your hands on a little kid, you and I both know what they'll do. You know how many times inmates have knocked their teeth out and told the jailers, "I'll take the charges." Yeah. I just You and I both know what I'm talking about here. Absolutely. Um but like I said, I wanted to at least make contact with you. I wanted to be at least kind of outline how this is going to be portrayed. Um, I don't want to speak on behalf of the of the prosecutor, you know, I just also want to give you like a good, you know, reasonable response that, you know, the likelihood that there will be criminal prosecution on a on this case. Um, it it's very low. Uh, but like I said, that's not my place to decide. Um, we're we're the responding parties and so a report, we'll type it up and we'll send it to the powers that be. So, I'll I'll go ahead and have um my responding officer um call you back and gather all the information, all the information for the report, and then I'll have them touch base with the business and see if they have any cameras. Um and then we can go ahead and review that footage. I submit this guy does know better, but he's got an attitude of he can do what he wants to do. That's what I submit. And I believe at his age, in this juncture in his life, if he feels the ability that he has the right to do that, and that's really what it boiled down to. He thought he had the right. And there's two dangerous things, the most dangerous things in my opinion you can do in America. And that is break into houses and messes people's kids. Either one of them are extremely dangerous. You know that, right? They result in people getting shot. They result in people getting hurt. He should know at his age. If he was a 18year-old, I'd be like, "Okay, he's 18. He probably had been alive too long. He doesn't know too much. He's probably kind of stupid, you know, he's learning his way. This is a grown man, right? You said that he was there with his family as well. He had Yeah. his wife and his and his and his and his son. Yeah. Yeah. But, you know, I I I just I just don't I I did I didn't buy those stories when I was a cop. I don't buy them as a citizen now. Grown adults who tell me I didn't know any better. I I I call [ __ ] Yeah. No, I don't think that the the the the excuse of not knowing any better will come become a factor in this. I think it's going to be more so like his mindset and what his intentions were. Um, so I wasn't present. Um, all I I like can base my my judgment and and and my um kind of my interpretation is based off of your account. Um, and listening to what you're telling me as far as what you know you high out of there. He knew he had crossed the line because he hightel out of there. He was trying to get out of there as quick as he did. My wife confronted him and went over. I I didn't even realize what was going on. It took me a first a few minutes to realize what's going on. If your wife was agitated as as you uh initially were agitated whenever I called you, um it seems like he's kind of calmed down a little bit. Um but it looking probably out of there just to kind of diffuse the situation because he was like, "Oh, no, no, no. He he he they let the majority of their food there." After he did that, he realized he gone too far. She was very nice at first and said, "Hey." She's like, "What's going on? What's he say?" She said, "My son is, you know, she's she she doesn't have the temper I do." Oh, gotcha. Okay. Well, mom, but but you did say that your wife witnessed the incident, correct? That's right. And my son can tell you he felt it. Okay. Well, you said that your your son's aistic. Is he verbal or nonverbal? Um, when he talks, he sounds like a three-year-old. You have to really listen to him talk because, you know, if you listen to him say the same thing three or four times, then you can understand it. You understand? And did they describe it as like a tap on the shoulder? Did you describe it as like a No, it wasn't a tap. It was a poke. It was poking. Okay. And there was no no bruising, no marks or anything like that. There's no bruising and no marks. No, but you know, to me that to me that's hardly caught and I mean I'm calm down. I'll be fine. But I mean, you know, like I said, I lived life all these years. I don't go and do DWI. I don't have to get a DWI to know you drive. I don't have to go and and put my hands on the kid to have a judge tell me or a prosecutor tell me you're in trouble because you put your hands on the kid. Looking at the evidence, um it probably won't meet the criteria for criminal charges, but that's not going to be my place to make that determination. um I'll at least put, you know, pen to paper um and then submit it to to the detectives that will then present it over to the prosecutor um and and see if the prosecutor wants to pick it up for any criminal char. If I can live as long as I have lived without putting my hands or directing anger or frustration towards kids, then you know after being in the military and being a cop, I can tell you right now that clown can do it, too. Yeah. um we're going to type it up as anformational right now, which basically means that we're adding call notes and and and present it over to the prosecutor um and see what their determination is going to be based off of the evidence that we have. um if they feel that there's something there um then we'll generate a full um full case report um and at that point in time we'll submit it all the way through so that way they can go ahead and get started on um potentially getting a warrant you know for this individual for like I said at the most that we would probably have would be like an assault thrge I assume that the military that had half their skull missing they were shot in a wreck half their brain was gone half their head it looks like a deflated basketball and they managed to obey the rules out here and they have jobs and they don't hurt anybody. So, you know, I mean, when you have people out here that have have done these kind of jobs or been the police and had to deal with a lot of really crazy stuff and they don't go out and treat people's kids that way, right? But but like I said, looking at the footage, it it doesn't look like it's going to meet that criterion. So, I just really want you to like really listen to what I'm telling you just because I don't want to set the expectation that there will be criminal charges. I I get it. At the very least, even if they say no, I do think that somebody somebody should make contact with him. No, we'll definitely Yeah. Our end goal is to at least make contact with the individual and let them know that that police were contacted. We reviewed it and and obviously that you were we you were not pleased with the situation and that's the reason for our contact was because he never like even stopped remotely. It was like a He put his jacket on, he walked by, and you you could tell that he kind of leaned over, said something, and then just kept walking. Thanks for watching.
