Back up. >> You need to chill out. Just go over there. I'll talk to you. >> Don't you tell me what to do. >> Hey, what are you doing? >> What are you doing? >> I'm chasing. >> Why? >> Squishy constable versus corrupt cops at a ridiculous Arkansas traffic stop. >> You run 80 mph coming up Highway 15. >> I was scared. You're not in a police car. >> That is a police vehicle. >> You're not in a uniform. How do I know that? >> Don't haunt me. >> You are yelling at me. back up. >> You're in my town now. You're going to back up when I tell you to back up. Do you understand me? >> Don't start. >> We're going to go over this interesting interaction between Jefferson County, Arkansas Constable William Hamilton and the England and Lowenoke Police Department. And I've been letting this simmer for a little bit because a lot of people claim that what the police officers did was right. They actually protected a member of society from this halfcocked constable who was operating beyond his jurisdiction. Apparently what happened was this guy right here, this is William Hamilton. He's the Jefferson County, Arkansas constable. He saw this lady, he claims speeding and he decided to pull her over. The problem is he wasn't driving a regular marked police car. He was driving in a regular truck with blue lights on the top. She got confused, didn't think it was a police officer, freaked out, went into a parking lot, called 911, and then the cops show up. We're going to take a look at this, but I want to let you know up front, I don't have any kind words for the cops, who do initially look like they interceded for a member of the community. So, let's watch this, and we will make some comments along the way. 104. Be advised this truck is pursuing and they got blue lights on waving at me to follow. Hey Jump forward. Don't want to stay put. >> What are you doing? >> What are you doing? >> I'm chasing. >> Why? >> Cuz she come through. Sure. Running 50 mph. She's run 85 mph. I'm a constant. Jefferson County constant. >> Okay. >> She run a stop sign right down here. But there she is. >> Okay. That vehicle there. >> Yeah. Okay. >> Let me pull over. >> Yeah. You Let's all move over there. I'm the constable. I can park wherever I want. >> Whenever I want. >> Male driver of the truck is claiming to be Jefferson County constable. Okay. >> Hello. >> You just said that. >> I mean, look at this truck. Would you have pulled over? I don't think I would have pulled over. This just does not look legit. And I'm not saying a police officer's vehicle is legit by any means because the state is that great fiction by which everyone seeks to live at the expense of everyone else. The state and all their representatives are nothing but a great fiction. But this definitely doesn't look legit. >> Okay, you need to settle down. Okay. >> He's not settling down. >> All right. I've asked you for your driver's license, insurance, registration several times. You run 80 mph coming up Highway 15. You'd run this stop sign light right down here. >> I I was >> This guy looks like a farmer that looks like he just got off the back of a backhoe or a combine. What the heck? scared. You're not in a police car. >> That is a police vehicle. >> You're not in a uniform. How do I know that? >> I was in jail. >> There's so much going on out here. How do I know that? >> Don't harm me. >> You are yelling at me. >> Here. Give me a Just back. Back up. Back up. Back up. >> You're in my town now. You're going to back up when I tell you to back up. >> Don't start. >> Back up. >> I love it when authoritarians clash. It's my authorit. No, it's my authorit. It's my jurisdiction. I'm in control here. I'm conducting this. >> You need to chill out. >> Just go over there. I'll >> Don't you tell me what to do. >> I was going to give you a warning. >> Hey, do you know what jurisdiction you're in right now? >> Yes, I know. So, back up. >> It don't matter. I come into this jurisdiction with my lights on chasing her. >> I have every right. >> That does not look like a police vehicle. >> I don't care what you think. >> You understand me? Back up. >> Let me tell you something, buddy. >> 606. Give me a deputy out here. >> Yeah. Get a deputy. Get back. I'm not arguing. >> I am conducting this stop. >> Go over there. Don't tell me what to do. >> This guy is so old. He probably was part of Lincoln's brigade. >> She has been nothing but trouble. She pulled away from a traffic stop. >> Okay. And I'll figure that out in a second. Right now, you're in my town. Okay. So, you're going to chill out. You're not even in your jurisdiction anymore. You didn't call >> out of my jurisdiction. >> Did you let county know that you were coming? >> No. >> No. Exactly. So, I don't know any of this is true. So, you can sit back and you want to do you understand? >> No. I'm not arguing with you. Don't >> go to bar. I promise you. Don't you understand me? >> Just just relax. Okay. >> Yeah. So, like I said, we're just relax. Okay. Cuz I mean, if I was you, I wouldn't have believed it was you. >> So, you tell me what happened. Okay. >> Hold on, Eddie. Um, I'm coming from Pine Bluff. I'm, you know, going the back way or whatever. >> He going a little. So, I passed him and then I guess that's when he claimed he turned his lights on for me to uh pull over, but I'm like um not sure to pull over or not cuz he's not in the in his car. And so, >> and so you don't have to tell me how fast you were going or nothing, but um so from there, you passed him? >> Yeah, I passed him. >> Okay. And you didn't typically when I pass somebody, I don't look at their vehicle. You didn't look at his >> Uh-uh. >> Didn't see any badging, nothing. >> Uh-uh. Okay. And so what happened after you passed him? >> And it was >> That was such a leading question. Typically when I pass somebody, I don't really look at the vehicle. Did you look at the vehicle? >> Another uh truck. >> You can tell the cop is in her corner. But wait, it it gets tyrannical here in a second. >> Coming from the opposite side. >> I'm talking about the good cops. The good cops get tyrannical. >> I guess they are in groups with each other. I don't know. He literally blocked the street like forced me to stop and pull over. He let his uh window down and so I just I let mine down a little bit and then he was like, "You don't see who's behind you. That's the police. Pull over." And I'm like, "Whatever." So, but I I have no choice but to pull over because he's back in the uh the street. And then he gets out the car. >> Yeah. Hold on. Go ahead. 104. Right now, I've got him chilling out at his vehicle. Looks like he's about to come and talk to me again. I just sped this up. Just a tape. >> Okay. So, are we are we calmed down now? >> I've been calmed down. >> You You want >> You had nobody been putting your hands on me. >> Well, like I said, you're in my jurisdiction. Your >> come into your jurisdiction, but I left out of my jurisdiction. Chasing me >> and we're in the process of determining if you even called in a pursuit. >> No, I didn't. I didn't intend to even ride a ticket to nobody or even be on patrol. >> All right. But when I went to sheriff, she passed me doing 50 mph in a 30 mph zone. >> Okay. >> And I tried to stop her. She pulled over. I asked for a driver's license and insurance for registration. She refused, jumped in the car, or she was already in the car and took off. >> All right. >> She run 80 m an hour from Cheryl all the way to here. Run that stop sign light down here. >> You got a ticket booked? >> Yeah, I got a ticket book. I ain't out here for toys. >> Are you going to ride her ticket or? >> Well, I had planned on getting her warning cuz she's pulled all this crap. >> All right. So he was going to give her a warning until she pulled crap, which tells you that even the constable has the ability to exercise discretion until he gets his feelings hurt. Just like a cop. >> I asked her multiple times before she pulled off the first time to drive his license, insurance, and registration. I identified myself. I got my badge on. I got the decals on the truck. >> I'm as legal as you are. Well, our truck has got big giant police on it and blue lights all over it. Now, I see you got a blue light on there. Clearly, >> that means we're legaler. Our police vehicles look more legitimate than yours. >> Yep. No doubt. >> But >> I asked her, "Why didn't you pull over?" >> You got to You got to think about history in the state of Arkansas with people in unmarked vehicles pull over. >> Yeah. If I'd have done that, I wouldn't even had my badge on. I wouldn't have identified myself. I'd have pulled them decals off. >> I've got nothing to hide. >> So, would you write her a ticket? What port would you be out of town? >> Could you worn a Could you have worn a better shirt, sir? >> You can write her a ticket and then you can leave. Um, >> look at this guy running code three. >> Not going to jail. >> Putting lives in danger for no reason at all. on the cops are on the scene. Don't tell them, "Hey, it's not a code three." >> All right, >> that's a matter of opinion. Her leaving the scene >> she's going to leave the scene and ain't >> about it. >> All right, you can route her a ticket. >> Look at him roll in there like there's a mass shooting. I don't know if you saw this. I'm going to play it back. Watch this cruiser roll up. >> All right, you >> All right, you can route her a ticket if you want to. >> You going to let all this pass? >> Well, it happened in your jurisdiction. You write her a ticket. >> That's right. >> All right. >> That's what I tried to explain. >> A ticket book. You can go write a ticket, but then y'all are going to part ways and that's going to be the end of it. >> All right. >> All right. >> So, he was going to give her a warning and the cop says, "You got a ticket book? Go ahead and write her a ticket." Thanks, officer. But that ain't it. What is it? >> I can see physical fitness standards are topnotch over there in England County, Arkansas. >> Console Egyptian County pursuit this vehicle here without >> seemingly without calling it in. >> And she was fearful that he wasn't a real cop. >> I mean, I would be too. >> And so that's where we're at. I had to push him back away from her vehicle cuz he would not calm down. >> So what's he writing her ticket for? She was fearful that he wasn't a real cop. And there are people all over the United States every single day who are fearful that there are real cops. >> I guess speeding that she did through Cheryl. >> I don't know how he got it. That's what I'm wonder. >> But he can ride her for whatever happened in his jurisdiction, but >> So what did you stop? >> All right. That's the the easiest way to settle this. >> So, he's a constable in Jefferson County. >> Yeah. Can you hear him? >> And I can hear you. >> Can Can you hear me, sir? >> Hey, I hear you now. >> Hey, it's Officer Harper over at England. Uh, >> this a constable that pulled her over. Uh, we're verifying his identity, but the most that's going to happen is he's going to write her a citation. Uh before >> whatever happened she said she ran a stop sign or something. >> All right. So now listen, the citation is is to come to court and and fight it. Okay. >> Right. That's that's a summon to appear. Under no circumstances is anything else going to happen. I promise you. Okay. He will go to jail before you will. >> Okay. >> Uh protect her from the citation. How about that? If she's in your jurisdiction, then you protect her from any citation. Tell that constable to go ahead and kick rocks >> because he was causing a scene out here. >> That's right. >> Like I told you, I he he can technically say >> he can write you a citation. >> Yeah. >> And y'all can go to court on it, but that's going to be the end of it. And if anything else happens, then we'll deal with that. All right. Where you live at? >> Scott. Okay. So, real quick, can I just get your ID that way I can log who you are? >> Can I get your ID so I can log who you are? What is that? That's a violation of the Fourth Amendment. So, this cop who's supposed to be protecting this woman from the constable is making her insecure in her person. If there was anything a cop in that jurisdiction should protect, it's the identity of the people they're supposed to be protecting and serving. coming to our account pursuing his >> and and like I said technically he can sight >> that other cop is yelling at the constable but I wish we could get his body cam to see what was actually being said >> for whatever happened in his jurisdiction but him saying that you were fleeing into here and running a side sign >> if you were fleeing fleeing you wouldn't have Oh, >> but you told me it's cuz I pass. >> There you go. Now you're in our police database. >> Yeah, I just tweet that out in case you need it. >> What did he say he stopped you for? >> He said cuz I passed him. >> Cuz you passed him? >> Yeah. >> He didn't say it was about speeding. Nothing. And then he asked you for your driver's license multiple times. >> He didn't stop either. >> The only reason I stopped was because somebody else, whoever he was called or was with blocked the street and like I was forced to pull. >> Yeah. So apparently there was a second vehicle. She did stop and he came up and said, you know, whatever with Yeah. And what he's wearing in the vehicle. I don't I wouldn't have believed he was either. >> I wouldn't either. I left too. That's why when I saw him behind her when I was coming through here, I radio. It's like there's a vehicle with blue lights behind her, but it doesn't look like no police vehicle. >> I called into the police department and they told me to to stop here. It should be officer. >> Yeah. So, you're fine. He's going to write you a warning. Okay. And then you and your dad can talk to whatever authorities there are in Jefferson County about this. Okay. This is the most peaceful, quickest way to resolve this. All right. That warning doesn't require you to do anything except promise not to do it again. >> She's out of control. You just need to go on down the road. >> You going to Scott? Is that where you live? >> We got all your information for witnesses. >> I got her. >> We just need your phone number and all that. >> Yeah. I'll grab that from you real quick. I already got the last lady and not filmed >> getting all that information from her. Is that a good cop? No, it is not a good cop. A cop protects your identity. A cop protects your private information. A cop does not request it, doesn't put it in their police database. So the next time a cop looks into his database, oh, you had an interaction with the cop there. You must be a very bad person. >> Older England resident out here >> here. I I already scanned that with my thing. So, what's your phone number? >> Okay. >> Mhm. >> And that license that was on your ID, is that your current one? >> Yeah. >> Okay. >> She'll be fine. >> Oh, she's free to go. >> Oh, you already got her info. >> I got it. >> Okay. >> Yeah, you're free to go. >> Yeah. No, she's good to go. We're not doing >> Oh, almost forgot. He almost drove over the ditch to turn it turning into the Dollar General when he was trying to follow her. >> Wow. >> I got out. I said, "What are you doing?" >> Doesn't sound like it's a good traffic stop. So, >> if we did what the constable did, especially the way he drove over that curve, we would be arrested, but the constable gets preferential treatment because he's in the thin blue line gang. >> Stick around. Make sure you don't follow her. And >> well, I was like, you got some backup now. >> Yeah. >> And that's the end of this police activity video. But it turns out that the Jefferson County constable, William Hamilton, retired after this incident, which led to this local news segment about the responsibilities and the requirements of being a constable. Last night, we showed you dash cam video of a shocking law enforcement interaction. a constable trying to pull over a woman miles away from the small town he's elected to serve. >> THV11's Katherine Rolley talked today with Jefferson County Sheriff Lafayette Woods about the incident and what constables are required to do. Catherine, what did you learn? >> Well, according to state law, constables have the same rights and privileges to an extent as an elected sheriff. But it's the rules that aren't followed that cause fear and confusion in this pursuit. And it raises the question, what are constables required and what can happen if they don't follow the laws that are set? >> Certainly, uh, we're always willing to sit down. If we know about it, we can type up a criminal case file for the prosecuting attorney for review. >> All this comes after Jefferson County Constable William Hamilton attempted to pull over a female driver of a black car in rural Jefferson County. The driver didn't know who the constable was, called 911 and met England police and Lonote County deputies, which led to this exchange. >> You run this stop sign like right down here. >> I I was scared. You're not in a police car. >> That is a police vehicle. >> You're not in a uniform. How do I know that? So there's a specific, you know, law that says and outlines, which there is about training requirements, uh, particular uniforms that have to be worn, uh, things that you have to have to be able to establish yourself as a constable or a law enforcement officer in this state. >> In the dash cam video, you can see the constable was not wearing the required uniform and his car was not marked clearly. And there's also the training that is required. Law enforcement told me that Hamilton had not completed this required trainings and the last documented one is from 2019. >> There training that the requirements have to be taken place uh particularly with firearms. >> Jefferson County has a little bit over 924 square miles. Woods says that there are benefits when it comes to constables with manpower, but those are benefits when a constipable goes through the required training. >> That is one squishy constable. Have you noticed that? I mean, he's pushing into him. He's like the Staypuff Marshmallow Man or something. and can help law enforcement. But when they don't and an incident like this happens, it could harm the trust between law enforcement and the public. >> Again, we have the power to determine whether or not somebody go home at the end of the night or goes to jail. We have a lot of discretion that we use as officers. >> We have a lot of discretion and we use it when we want to. Now, if we get our feelings hurt, you're going to jail. But if you cross your tees and dot your eyes and say, "Yes, sir. No, sir. I'll give you whatever you want, sir." and you bow down and lick our boots, well, we might keep you out of jail, might give you a warning, or we might economically terrorize you. But we do want you to know we have a lot of discretion >> and law enforcement professionals. And so, when one of us in that particular profession uh does something questionable, obviously, it's a black eye to all of us. >> I want to close this video with former Constable William Hamilton's resignation letter. He says, "I, William Hamilton, do hereby make the decision to retire to not be able to issue tickets or chase anyone to be involved in any kind of police involvement in the future that involves constables in Jefferson County." So, the squishy stay puff constable is no longer a constable in Jefferson County, Arkansas. But I want to ask you, how do you think the England and Lone Oak Police Department did? Do you think they were actually on the side of this woman? Do you think they supported liberty and defended her constitutional rights?
