You know what your problem is? You think you're free to ride your bike down the street without being harassed by cops. You're not. >> You guys aren't in trouble. I just need to talk to you real quick. >> You guys aren't in trouble. I just need to talk to you real quick. >> You ain't talking to me. >> Yeah, you. >> No, you ain't talking to me. >> All right. You got two options. You can either stop or I'm going to get my car and I'm going to arrest you. >> How about that? >> All right. All right. You're You want to be arrested for resisting? That's fine. >> Stop me. >> No reason to stop me. >> All right. Let's go. Today we are in East Molen, Illinois, and the inexplicable tyranny will come from the East Molen Police Department. Specifically at the hands of Jay Whittington, badge number 3163, and Sergeant Levi Moore, badge number 3157. To the left we have bicyclist Josh and his friend on the right riding with the flow of traffic in East Molen perfectly in line with Illinois biking laws. This is the rear of Josh's bike and was taken the night of the inflicted tyranny. And you can see clearly that he has a reflector fixed to the bike as well as a front white headlight. Illinois law states if you ride a bicycle at night, it must have a rear reflector that is visible from 100 to 600 feet to the rear. You also need a white front light visible from at least 500 ft. An additional red rear light visible from 500 ft can be used instead of the reflector or in addition to it. So there is no requirement that you have a backlit red reflector in the back of your bike. So once again, just to be clear, Josh and his friend are traveling with the flow of traffic. They both have a white headlight and they both have red reflectors affixed to the back of their bicycles. This is where the action and the tyranny begins. And we're going to make some comments along the way. You guys aren't in trouble. I just need to talk to you real quick. You guys aren't in trouble. I just need to talk to you real quick. You >> ain't talking to me? >> Yeah, you. >> No, you ain't talking to me. >> All right. You got two options. You either stop or I'm going to get in my car and I'm going to arrest you. >> [ __ ] off. How about that? >> All right. All right. You're You want to be arrested for resisting? That's fine. >> Stop me. >> No reason to stop me. >> All right. Let's go. >> You're not in trouble or anything. I just want to stop and talk to you. By the way, you are not required to talk to any cop unless they suspect that you've committed a crime, and they have to have probable cause for that. And this guy said, "You want to be arrested for resisting. You can't be arrested for resisting arrest. There has to be a primary cause for the initial stop first. And then if they try to arrest you because they suspect that you've committed a crime and you're resisting, then they can slap a resisting arrest charge on you. Oh, man. Subjects are refusing to stop. have ordinance violations. Stop when they don't have red reflectors on their bikes. >> That's a flatout lie. As you'll see clearly, they have red reflectors on their bikes. >> All right. You want to you want to stop? Last chance. >> Last chance. >> You need you need to have a you need to have a red reflector. And yours isn't >> I got a red reflector. >> It's not showing. You need the light to show. >> No, you don't. He's wearing 10 khakis, uh, hoodie. I'll be out the other male. >> He keeps going north. >> You want to stop? Got to go. T just went >> I got rid >> east second. Yeah. >> Okay. So, you're riding the bike at night. >> Yeah. >> Your reflector needs a show. >> Oh, there you >> have the reflector, but it needs to emit the light. >> Oh, >> at night. >> Okay. Again, here are the rear reflector requirements for the state of Illinois, and a rear light is optional. Besides, let's say they were actually breaking that law. If you're not free to ride your bike down the street without a rear reflector in America, then you're not free. >> So, you want to do him a favor and tell me his name? >> Josh. >> Josh. What? >> I don't I just want you guys know what I mean. >> Got an ID on you. >> Don't Don't ever talk to cops and especially don't ever squeal. Snitches get stitches. Don't ever do that, dude. >> He has a white bandana on around his head. >> Now the cop is violating >> this man's Fourth Amendment rights. He would have went that far east. Go south on 20th Street. Let's say Meredith David to Tom Henry for St. Harry spelling to Tom. You pulled me over just for that. >> What's that? You pulled me over just for that. >> Yep. >> All right. You're going to stop >> now. Notice you pulled me over just for that. Yep. So, the only thing this cop pulled him over for was the red reflector, which they were perfectly in line with the law on. Keep that in mind. >> I ain't I ain't stopping. What do you want to stop me for? >> Don't touch none of my [ __ ] >> First none of it. Okay. >> You don't have a light on the back of your >> I don't need a light on the back of it. No, I don't. Show me where it says I need to have a light on the back of it. Needs I had write a ticket then. >> Okay. >> I got a reflector. That's all I need. >> Yeah. But if you want to harass me, go ahead. Tell me to stop in the middle of the [ __ ] road. You ain't got no reason to stop me. >> Stand here with him real quick. >> Stand here. Am I being detained? Yes. >> For what? >> I just told you. >> I'm being detained? >> Yes. >> For what? >> So get I just [ __ ] told you. >> [ __ ] you. >> All right. So you're going to [ __ ] stand here and >> I'm going to stand here. Yeah, you are. >> What am I being detained for? >> I already told you your reflector at night needs to have a red light. Your doesn't have a light. >> Oh, [ __ ] me. >> Show me where. >> Not allowed to go anywhere. Anywhere I'm being detained against my will, correct? >> You're detained. >> All right. >> He's the same one that always cuss me when I drive by. I don't know who he is, though. >> I stopped him cuz uh his reflector didn't see it and it wasn't a light at all. Okay. >> He does have the red one, but at night >> you need to have a light on. [ __ ] 6 weeks of law school. No [ __ ] [ __ ] Tractor caddy. What the [ __ ] is this? >> That and he didn't use a hand when he took a turn there and throw ass. >> Anyways, I'm going to double check the ordinance. >> Yeah, >> I'm fairly certain that's what it is. >> I'm going to talk to you. The sergeant instructed him to turn his body cam off. And for the next almost five minutes, this body cam is muted while they have a conversation about Josh. Here's where they unmute the body cam. >> No. >> What? >> All right. So, listen. >> I want you. >> You're He's right here. Okay. >> Two problem. Yep. Two problems. One, your reflector. There's the reflector on Josh's bike right before he gets arrested for not having a backlit reflector, which he's not required to have. >> It was not visible at all. Your reflector needs to be visible. Yours wasn't. >> How's it not visible? You were in front of me. It's >> dark. >> You were in front of me >> and behind you. How do you think I turned around on? >> What's the reflector do? >> Second, you were driving northbound in a southbound lane. If you're on a bike, you need to ride with traffic, not against it. >> Okay. >> I was on the other side. No, you weren't. You you stepped out of your car and come across the street. >> Okay. Here, let's all you saw my car. You saw my car turn around and then you're drive. You're riding your bike. What? This way, right? >> Yeah. This way. >> This lane. In the left lane. >> This way. I wasn't >> in the left lane. Yes, you were. >> No. >> Okay. >> Well, then show me the footage, sir. >> I'm not going to do that. >> Oh, I figured he couldn't. >> Okay, but you did the violation. You were in the wrong lane. You're supposed to ride with traffic. You should have been in the right lane. >> You just told me you were stopping for a reflector for it. >> Still applies. Okay. What's your ID? >> No, you're writing a ticket. >> Sure, if you want. >> Well, you ain't going to ID me unless I'm determined to take me to jail. >> Now you're under arrest. >> You're getting ID. >> What? >> Now you're under arrest. >> He said you're not going to get my ID unless you threaten me with arrest. Now they're going to arrest him. >> What? >> Don't Don't touch my phone. >> I said a minor threat of arrest. >> He intentionally turned that phone off. >> Now you're being detained. >> Hold on. I was already being >> I'm not resisting. I'm trying to I'm trying to figure out what the hell's going on here. >> You aren't listening. >> What are you getting so damn aggressive for? >> Huh? >> All right, >> you [ __ ] punk. >> Yeah, you're the supervisor. >> Yeah. >> Yeah. What's your name and badge number? >> Sergeant 315. >> Okay. And you're going through this for what? >> Because you're not >> for a traffic offense. >> Cooperating. That's the big >> How am I not cooperating? >> You didn't stop me. >> I'm here. >> Hold on. You Hold on. Hold on. Hold on. Hold on. Right now you're under you're under arrest obstructing and and re ID. Yeah. >> Obstructing how >> for what? >> Earlier when I told you to stop and you continue to go. You matter of fact said [ __ ] you. I ain't stopping. >> Oh. >> Oh yeah. Now you remember that. >> No, I don't remember that. I'm saying now you just keep making [ __ ] up. >> No, it's not. >> Yeah. >> [ __ ] up. >> I should be >> You're not going to sit here and press me and search me unless you're taking me to jail. >> If that's what you want to do, take me to jail. >> That's fine. It's me. I don't have a problem charging you. >> Yeah, you charging me. >> Yeah, that's the problem. Cops don't have a problem charging you. They don't have a problem being petty and laying on the charges while real crimes go unsolved. While real criminals are out there hurting real people. >> I want all your badge numbers and [ __ ] They'll be on reportable along with the body. >> I can't believe you're letting do this. I'm going to have everyone your job. >> I've heard that so many times. >> I bet you have. >> And yet no one's concrete. >> Okay. >> It's pretty simple. have done as you were doing. Stop. Do >> you hear what the cops said? I've heard that so many times. Josh said, "I'm gonna have your badge. I'm going to have your job." I've heard that so many times. Maybe it's because you're out there earning the hate as a profession. >> You wouldn't even be here right now. >> Listen, it's that simple. >> I'm not going to argue. You weren't here. >> You know it's true. >> You weren't here. I did everything I was supposed to. >> I'm here. >> You failed to stop identify yourself. Not. You didn't ask me to ID myself. >> He just did. And you said I said unless you're taking me to jail. >> I said not unless I'm under threat of dess. >> Okay. We're not going down the threat of arrest, >> right? Yeah, I know. Yeah, you're stupid. >> You're um tier six. >> [ __ ] violating our goddamn right. You can say Martin for saying Joshua. >> I don't have footage. I wasn't here. And they quit saying I did it. >> I saw you do it. >> Right. Okay. >> You're driving in the left hand lane. >> You saw me approach and then you went in the other lane. >> Show me the footage. >> Which should have been the lane you're driving in in the first place. >> Show me the footage. >> You stopped in the middle of the street and said, "Here, I need If you guys aren't in trouble, I need to talk to you. I I don't know who the [ __ ] you are." Oh, you weren't in trouble until uh you right. >> Until I told you I told you stop and you continued. Then that's when you said [ __ ] >> What am I going to stop for? How do I know you're a [ __ ] cop? >> The uniform in the car. >> I don't mean nothing. How many [ __ ] people in post? >> Okay, I see. I see where we're going. >> No, I see where you're going. You're trying to find out who the [ __ ] I am. Now you know. >> We were. Actually, the better route to go here would be, where am I required to talk to a cop if I haven't been suspected of committing a crime? And where do you legitimately have the right to stop me when I'm biking in accordance with the law? >> You need to quit the YouTube, dude. >> What? >> You need to quit the YouTube. >> I'm not on YouTube. >> No, you need watching it. >> What are you looking for? >> Well, you're not. I'm searching your person. >> Yeah. >> Yeah. He's searching his person. I'm violating your Fourth Amendment rights based on an illegal stop. >> Against my will. You're detaining me against my will. >> You don't have to be local. >> Arrest me. Arresting me for what? What are you arresting me for? >> Obstructing and resisting. >> Resisting. >> And obstructing ID. That's three charges there. >> Did you hear what the cop said? I'm arresting you for obstructing and resisting. You got to have a lawful reason to stop me first. >> He did. We told you that. You don't accept. >> There's no we. You weren't here. >> Accept it. And I don't have to be here. >> You're right. You don't. >> I worked this guy long enough. >> I don't give a [ __ ] >> I know you don't give a [ __ ] That doesn't matter. Just cuz you guys are on the same [ __ ] team don't mean I I got to be honest. >> I'm not asking to be honest, though. >> There's some copyrighted music here. So, I'm just going to show you. They arrest him, put the cuffs on him, put him in the back of the patrol cruiser. I got a notepad with it. >> What do you want me to do? Sit down? >> Yeah, that's fine. [Music] Yeah. >> And right here, Officer Whittington mutes his body camera for almost 4 minutes. >> So again, the one thing I was wrong, the reflector did not need to be lit. >> So I'll give you that. But it still needs to be visible. Okay. >> It is visible. >> It wasn't. >> Okay. >> Okay. I didn't see it. There was no reflection. All right. >> That's what that's actually what brought my attention to you guys was there's no lights that I could see. >> They're not supposed to be lights you can see. Supposed to be a reflector, >> which is a reflection of a light, >> which I got what >> which is a reflection of a light. So when I'm driving towards you guys, I don't see reflector. Well, >> right. It needs to be visible. >> I mean, I got two on both my side fenders and then one. >> And if you want to argue it, that's fine. >> I'm not arguing. I got pictures of it. >> Okay. But the problem is, right, you're also driving the in the wrong lane of traffic. You need to go with traffic, not against traffic. And we both know you're going the wrong way. Traffic. >> I was >> Okay. >> I'm not even asking, but >> that's fine. >> Whatever. >> Who's going to be? >> Okay. [Music] >> Uh, let's get phone number for you. >> This is You just IDed me. I mean, why do you need a phone number? >> You don't. >> Well, cuz let's say there's something that comes up with your court date or something. Then they need a way to contact you. >> Court will contact me. >> How are they going to contact you without a phone number? This is the piece of paper that goes to them. >> How are they going to contact you without a phone number? >> They got my address. What's your current address? >> You got it on my ID. >> I didn't look at it. >> What'd you take it for? >> To identify you. I don't know why you're being difficult. >> I'm not being difficult because you're against my will. That's why. >> Yes, cuz you violated the law. >> Why didn't you pull me over then? >> I tried. I got the car and told you to stop. >> You did. >> Yeah. Okay. Why didn't your lights Why you running your lights on? >> It's always like the abuser to tell his victim, "Why you making it so hard on me? Why are you making my ability to abuse you so difficult? Can't you just roll over and just let me do what I want to do? Because I was trying to be courteous and have a have a normal search. >> Trying to be courteous by putting torture cups on you and arresting you for no reason. >> Above and beyond. >> No, you just you just told me. I got I got to find your wallet. >> I didn't tell you nothing. >> Yeah, I do. I got to find your wallet cuz you refuse to tell me your address. So now I got to dig through your pockets. Find your wallet again. >> Well, why don't you put it back where you got it then? >> You're searching me? >> Yeah. a block down the [ __ ] road. >> All right. >> I think this cop likes digging through other men's pockets. That's what I think. >> Okay. Need you to uh >> You need me to wet. You can't [ __ ] do nothing. Hey, can you show us trying to slide real quick off? What are they [ __ ] sticking in my bag? >> A key. >> [ __ ] Christ, man. >> Well, next time if you just cooperate. >> No, don't come. Next time you do your [ __ ] job. Protect and serve. Don't harass and extort. >> [ __ ] All right. So, what's >> Christ? Look at that [ __ ] >> Listen. >> What's your badge number? >> Three. It's It's right here. Okay. So, listen. >> I'm listening. >> Three Three charges. Okay. >> Three charges. >> Obstructing obstruct identification. >> Yeah. >> And resisting. >> Yeah. >> Okay. >> What did I resist? >> When I told you to stop >> when I told you to stop the bike. >> All right. Okay. >> Yeah. So, >> I hope you got your body cam on. It >> is. >> And I hope your dash cam was on, too. It wasn't. >> I sure hope it wasn't. >> Yeah. But we I mean we were >> you were on the wrong side of the road. >> I was not on the wrong side of the road. >> So when you >> you you didn't pull me over, sir. For one thing. >> I can still stop. >> But that's fine. You can't just stop anybody. You can't stop me. You got to have a reason to stop me. >> I did. >> You were in front of me. You stopped on the side of the dark road and you jumped. I'm just having a conversation here. >> Yeah. Just having a conversation. >> What lane of traffic were you in when you were driving that way? >> I was driving this way and this lane right here. Look at this. This car goes this way. >> Yep. And which >> What lane was you in? Well, >> you was going that way, wasn't you? >> Okay. >> Wasn't you? >> I was going I was in the right hand lane going north. You were in the lefth hand lane going north. >> You have to ride with traffic if you want to ride the bike on the roadway. >> I don't know what north is. I don't I don't know. I don't know what >> That's north. >> Okay, that's north. I was going north. >> And you're in the left lane, which is southbound traffic. You >> You was in the left lane. No, >> you did not jump out of this side. I >> You jumped out this side and walked across the street like this. >> Ah, thanks. You just proved my point. I parked my car at QC. >> Yeah. No, no, no, no. Not at QC Mark. You parked it on the side of the road and you jumped out going like this. You said you're not in trouble, but I need to talk to you guys. >> You're right. I did pull into TC and then I was facing you and then that's what you said. You cross the street. >> You cross the street >> cuz you're in the wrong me, sir. >> You're in the wrong lane of traffic. Do you have any other questions for me? >> I don't I didn't have any questions except for what the [ __ ] is your badge number? That's the only one I had. It's on the paper, >> right? >> Okay. >> I hope you [ __ ] enjoy your job for right now cuz I'm definitely stealing. >> Well, I tried explaining to you. >> I'm gonna go there. I'm going to go. Is there a sergeant there now? Cuz I want to make a complaint. What do I got to do to make a complaint? >> You either call up or go there now. >> Is he there or who do I got to call? >> Uh, if you just go to the front, they'll have a pay phone on the right hand side and you just pick up. >> It looks like a pay phone. >> You go to the dispatcher. >> Yeah. Yeah. And just say that you just want to file a complaint or whatever and then someone from command will be there. Okay. >> So Josh was in torture cuffs for about 20 minutes for no freaking reason. He says he went to the courthouse the next day and the cops hadn't even filed any paperwork. So there were no charges against him. Again, this is the city of East Molen, Illinois Police Department. I'll leave a link to their Facebook page in the description. I'll also leave a link for Josh's channel. If you visit him, let him know here's the deal sent you and let him know how you think he did. If there are any civil rights attorneys out there who'd like to take up this case, Josh would really appreciate hearing from you.
