okay guys we are back in zumkot for something of a unique sentencing hearing with judge michael olsen in michigan in which the sovereign citizen has already pled guilty and accepted a plea deal yet still goes on to vomit his word salad and waste the court's time oh and then ghost the judge during the reading of the sentence let's get into the video now so we are on the record in the matter of the people of state of michigan uh versus robert joseph matson file number 21-20513-fh today's date set for sentencing this matter we are proceeding today uh partially by video conference uh and partially in person uh mr daley is here in person mr daley would you like to place your appearance on the record james daley appearing on behalf of mr mansion and we also have uh mr stevenson with us from uh mission department corrections and sir you are robert joseph matson correct hello hey uh i'm a living flesh blood man attorney for uh public officer or statutory citizen judge i'm a living flesh blood man all right you are the living flesh and blood man who's known as robert matson correct uh tree for uh robert joseph matson would you be all cap's name there was uh something um that i tried to talk to my attorney about that uh before you let me out of the hospital i was in in the hospital or the jail i was uh i was experiencing a lot of pain trouble the jail was not treating me properly uh after i got out of the jail i went um to the hospital and there they hurried and rushed me to toledo hospital where um i almost died had i not been released in jail when i did i would be dead in that county jail that's all very sad and all but what do you expect the judge to do about this you're here to be sentenced um all right we're here for your sentencing hearing today um i'm not really able to address issues of medical treatment well at the jail well i was just saying that there's something mr manson don't interrupt me please uh the the medical treatment that people receive at the jail is not within my purview and i'm not going to address that today so well i just said i'm going to correct my do not interrupt me please have you had an opportunity to read and review your pre-sentence report i did with the secretary for mr daly have you had an opportunity to discuss your pre-sentence report with mr david i haven't had an opportunity to discuss it with him um i did with the secretary secretary my secretary got to hold it just let me allow him to finish his answer what were you saying mr man i did with the secretary she uh i talked to her over the phone and told her everything looked good and um i believe mr david was supposed to get back ahold of me i don't know if he got too busy or something else happened all right thank you mr madsen mr daley you wanted to say something on that issue yes my secretary contacted regards to the psi he said everything was right he had no complaints about anything i still tried to contact the bank to get an answer yeah that sounds more like it and i would usually be surprised by us offset having an attorney but seeing how disrespectful he is and with him continually interrupting the hearing i'm now not that surprised all right so what we'll do is have mr dale if you'd be willing to step out into the hallway we have an ipad out there um that we can log into the zoom session but i don't think he needs that he's ready to be sent yeah you have any other questions mr madsen uh yeah judge i think the court is making a big mistake here i've not um i appreciate that mr man discussing okay i've discussed all of these issues with you before okay i've muted mr matson's device because he won't stop interrupting me mr matson what i'm trying to tell you is that we have discussed these issues before you've raised those issues i've ruled against those issues and ultimately you pled guilty of your own choice uh to the uh controlled substance possession of uh narcotic less than 25 grams and so i'm going to sentence you on that charge today if you'd like i will have mr daly step into the halt and you can have a breakout session with him so you can speak with him about your um pre-sentence investigation report if you have questions or things that you want to talk with him about um regarding that report so i'm going to unmute your device now and i want you to tell me whether you want a breakout session with mr daley or not hello yes we can hear you now you want a breakout session with mr daley um well i've tried to talk to mr daley before i mean about this and answer my question do you deserve a breakout session with mr daley or not your honor i just i you're going to do what you're going to do i mean i try to talk to the courts and reason with the courts i mean you're going to sentence me today then i just filed for an appeal i'm an objection to anything that happens today i was under duress when i took the plea due to my life was at stake mr manson please answer my question do you want a breakout session with mr daley or not mr daley hasn't been much of help for me your honor so that's not an answer to my question mr matson please answer the question you want a breakout session with him or not judge old saver has one of the coolest heads of any judge i've seen but even he is starting to lose his call with this guy and i'm not surprised he cannot answer the simple question and then lambaste his attorney for not going along with his bs unbelievable sorry jana i i just ain't been doing any any help no justice at all other than the fact that he got you a plea deal which in turn got you released from jail isn't that the opposite of help and justice i mean i've already said what i had to say the sports is going to settle each day then that's what they're going to do i don't agree with anything that's going on today i'm sorry um i just my life was at stake when i had talked to the courts all right mr manson mr manson please stop stop so you refuse to answer my question about whether you want a breakout session with mr daley or not well i didn't i didn't i didn't want to stop pretty sure the record i place mr matson on mute again because he's continually interrupting mr madsen what i'm trying to explain to you is that you have the right to discuss your pre-sentence report with your attorney before the sentencing i've asked you four or five maybe six times now whether you want to have the opportunity for that breakout session and you won't give me a simple yes or no answer so what i'm going to do right now is ask you to ask mr daly to step into the hallway we'll set up that ipad i'm gonna put you in a breakout session with mr daily uh in order to uh make sure that i comply with the uh with your rights to have that breakout session um so at this point i'm gonna set that up whether you want it or not so that we have complied with that requirement a few minutes later judge i just had a repeat of him from conversation you ever had i'm prepared for sentencing all right mr madsen you've now uh had an opportunity to discuss the pre-sentence report with mr bailey is that correct no he didn't want to hear me on he just told me that he was here to give me sentence i tried to talk to you about things i tried to talk to him before we even went to court about things that was going on uh with um my life and me about dying and um as far as being incarcerated in jail which he didn't ever try to help me out because if he would have he would have did an investigation and knowing that i was in court and i was wrongfully put in in jail i told him i'm i'm not a statutory assistant i'm a constitutional uh citizen i mean he don't care to do anything to help me all he cares about is just helping you guys out and get you sucked into the system and it's wrong translation my attorney refuses to go along with my pseudo-legal ramblings all right for the record i did provide mr matson with an opportunity to with mr daly in a breakout session uh mr manson yes sir satisfied with mr daley and the advice that he's given i'm not satisfied with the way she's giving off sir do you wish to explain or challenge the accuracy or the relevancy of any of the information that's in your pre-sentence report um the the stuff that's in the preset report is uh directed to a statutory um citizen i'm not a statutory assistant i'm a constitutional citizen you cannot be a constitutional person and a statutory person at the same time your honor it has to be constitutional rights which the courts designed to protect rights so i was asking judge are you working as a banker or judge today um uh i mean there's no nothing to show that there's even a um is it i mean is there anything to show that there's even a contract between us i mean yeah what about that plea deal you've just signed which you should be thanking your attorney for by the way scissor this isn't a contract issue there must be an injured party is there a new party in the constitutional rights uh share vistas calling 4481 f-945 in order for it to be a crime that should there ought to be a major party there's no inter-party there's no crime all right i mean you're arguing the basis of your conviction again you pled guilty um to this charge what i meant but mr hanson we're asking you is whether uh you'd wish to explain or challenge the accuracy or the relevancy of any of the information that is in your pre-sentence report so is any of that information inaccurate inaccurate as far as the person that um reports they're trying a sentence all caps names it's not me i'm a living flesh and blood man you're after a fictional person yeah the only thing fictional here are your arguments buddy we however do wish you a fictional then we wouldn't have to sit here and listen to this clown act and we are all living flesh and blood beings but that doesn't mean you're not subject to the same laws as the rest of us right so with respect to that argument uh what the court will say is that i will leave the information that is in the pre-sentence report in the pre-sentence report and deny what seems to be some kind of a request to modify the pre-sentence report based on an argument that doesn't state any cognizable legal theory about a difference between mr matson as a human being and mr matson as something else uh so three cents report will stand well you never even explained to me i tried from the game i'm gonna mute mr matson again because he continues to interrupt me with uh a line of argument that i don't even know what to say about it it just is it's not a legal argument at all it is some kind of fanciful belief that there's a difference between mr madsen the human being and mr madsen as some other entity which is not recognized by the law and i'm not going to entertain it any further [Applause] uh mr daley does the pre-sense report disclose any prior convictions in which there exist any known constitutional defects no you're not uh the probation officers calculated the minimum sentencing guidelines in this case to be from zero to nine months do you agree with that computation guidelines uh before the court passes sentence mr daley is there anything you'd like to say on behalf of mr manson i've had the same uh with mr madison the courts have he's never wanted to talk about this case he's always wanted to talk about what he perceived our constitutional issues he pled guilty he knew what he was doing i do know that i'm prepared to to complete the sentencing now yeah mr daley the attorney just wants to get this done now but i can see why there is only so many times you can listen to the same guy repeat these same titles pseudolegal nonsense it must be so frustrating when you've trained to become a lawyer only for some youtube idiot to come along and attempt to educate you all right uh mr matson in a moment i'm going to unmute your microphone and i'm going to give you an opportunity uh for allocution that's an opportunity to say anything that you'd like to say on your own behalf before the court passes sentenced yes sir can you hear me you'd like to say on your own behalf you said that i could say anything that i wish before sensing you can i'm sorry sir you can okay so this is where you will have the opportunity to express regret for your actions and maybe make an appeal to the judge in the hope of receiving a lighter sentence but if you're a sovereign citizen then this is your time to shine so get ready for one of the biggest servings of pseudo-legal words salad you have ever heard yeah yes sir your honor i mean before i took that plea i told i told mr daly that i wanted to sit there i wanted him to um sit there get the cameras for the um courts to prove that i was at the court date the day that um i was put in jail and said that that i wasn't in the court for um a contempt to court he said and i told me i wanted to fight my case but i hated to be out because i had medical issues mr daley said that's fine and all um but if you stay here and you fight this case they'll keep you in here for a year fight your case you will not be let out of um jail uh you're not i couldn't do that i was in major pain i would have died in that jail my proof is within the doctor's records in the hospital i have serious condition which would have left me dead within a week from the time that i took the plea the following day after i got up my wife was um killed in a car accident because everything's been going downhill for me ever since and now this with the courts i don't feel that i've had a fair chance with the porch ever since i even started with the court because reports has not proven jurisdiction to me i've not written any uh papers out agreeing in the contract saying that the courts can have any kind of jurisdiction over me i have not relinquished any sovereign communities that i have i just don't feel like there's uh i've been anything fair which is not going to be within your uh court system i mean i've tried to say i'm not a statutory person who is uh within your jurisdiction uh faith thing i'd be considered constitutional but i'm not even under constitutional laws but i will use them if i feel necessary as a constitutional living flesh and blood man there is no end to party going into the party would be the state's laws which the state cannot be the prosecutor the injured party and the judge as nothing's right the court case either had been dismissed or moved to higher court and i wasn't going to sit there and be put left in in jail to fight my case for a year i would have been dead i've been stupid enough to sit here and just agree with um a plea that i didn't even agree with in the first place just to save my life i don't think that's fair at all it's not right there's nothing but wrong here it's injustice not justice i mean the requirement for equal protection i mean okay there's a form zero uh five uh point zero three three three but terms are binding you and me together judge there's nothing even sitting there stating that i mean you can't you can't be a constitutional person and a statutory person at the same time either you're one or the other and as constitutional rights is known in form number 10 uh point zero zero two in any given context you have um your statutory approvals uh form would be 0.0503 to claim your uh privilege of statutory privileges you swear to constitutional rights which i'm not doing any of that the definition of a public jurist is therefore deception which is in form 05.014 i've not had time to get my own paperwork together due to the hospital when i logged into the system because my um wi-fi wasn't working properly on my computer i couldn't draw my own paperwork i've been in nothing but severe pain i've been able to move around and do much of anything for myself i mean i just don't feel that anything here as we don't see is right and it's not as it's not within the constitutional or the bill of rights if common law would uh permit and hey if i ask you if you're working under the osa office and or as a banker you don't answer that you don't tell me which jurisdiction you're under i mean these are all important things i mean for me to even provide intelligent argument for myself i have to know these things because guaranteed in the constitution i didn't even ask for this attorney you assumed that i didn't know the laws and that i needed an attorney the attorney has done nothing for me but they tried to treat me to the system uh the only system that i know is god in god's laws judge if i sit there and swear an oath because i'm not i'm not i've never took an oath to any governmental laws i'm not a public officer the only person that the only one i've ever taken an oath to is god almighty himself there's only one law giver one creator one judge that's god oh my god that's who i recognize for me to sit there and agree to anything more than that would be me sitting there violating my the laws of my god okay so with that meaningless word salad over and done with the judge moves straight to sentencing or at least he tries to all right in determining the appropriate sentence in this case the court has considered the seriousness of your offense your history the principal proportionality the statutory penalty the cost of confinement the report and recommendation probation department as well as what's been said on record here this morning the criterion reasons for the sentence or the nature and gravity of the offense the discipline appropriate to its commission returns against repetition by you and by others communication for the law and protection of society as indicated with respect to these uh sovereign citizen or whatever the other arguments uh you're making are we've dealt with the jurisdiction issue in the past i've ruled on that at least on at least one occasion uh probably multiple occasions and that ruling's not going to change um you will have appellate rights if you want to pursue those uh you're welcome to do that but uh you have pled guilty in this case okay so did you notice that that was the moment when the defendant drops out of the zone call or goes to the judge judge olserver doesn't notice for a while and continues on but his face is a picture when he does finally realize this is when the interesting excuse as to why he goes to the judge emerges um you indicated during your guilty plea that uh you were not under any threats or promises or anything like that and you indicated that it was your own choice to plead guilty so of course going to proceed with sentencing in this matter the recommendation from your probation officer is that you serve one year of probation with credit for 29 days that you've served on this case and that is i think under normal circumstances that would be an adequate recommendation with he's gone so now his attorney calls a defendant and gets through to a family member who doesn't know anything about why the call was dropped so his probation officer tries to contact him and well here comes the interesting excuse given for why the call was dropped oh robert matt's in there please okay who am i speaking with okay all right thank you this is mike stevenson probation okay he had he had sentencing this morning he just left the uh judge i just spoke with a female at the number that he gave me and she claims that he is at a heart doctor appointment at this time that's what she claims so he does appear to be in what looks like a hospital waiting room so that means he accepted this appointment not only on the same day of his trial but at the same time i mean the trial would have been over in minutes had he not started with the soft cbs but still having an appointment at the same time on the same day as his trial does sound like what a soft sit would do so i'm not that surprised by it but he does eventually log back into zoom to continue with the hearing but it doesn't start off well but we have everyone back with us now mr manson uh we are in a court proceeding right now and so i'm going to ask you not to not to eat anything and to move [Applause] all right i'm gonna ask you to remove your hood also mr matson thank you uh so we had uh been through the sentencing uh procedure i had uh given mr madsen an opportunity at allocution and was starting to announce uh the sentence and so i will continue with uh with where we left off uh in determining the uh appropriate sentence in this case court has considered the seriousness of the offense your history the principle of proportionality the the cost of confinement report and recommendation probation department as well as what's been said on the record here this morning the criterion reasons for the sentence are the nature and gravity of the offense the discipline appropriate to its commission it turns against repetition by you and by others uh vindication for the law and the protection of society uh mr manson uh pled guilty to one count of uh controlled substance attempted possession of cocaine heroin or another narcotic of less than 25 grams pursuant to a plea agreement which dismissed one count of possession of cocaine heroin another narcotic dismissed one count of driving the license suspended and one count of alcohol open container sounds like he had one hell of a party that day or maybe it's just an everyday occurrence for him who knows and he just happened to get caught that day either way he's a lucky man to have a decent attorney to get in that plea deal but he's too wrapped up in his ridiculous opposite beliefs to realize it or appreciate it which is sad i believe it am i correct mr daley there was a uh was there a killer agreement in this case to no upfront jail hey but so i hadn't believed there was a killer bruin in this agreement china i'm sorry mr david was that a yes or no no okay uh so the agreement was to uh uh one count of attempted possession of a controlled substance uh dismissal the remaining charges and that was apparently incorrect there was no sentencing agreement in this case uh this is mr madsen's first felony conviction he does have four prior misdemeanors uh those are uh all from 2015 or earlier he has two uh 2015 cases in 2002 and 2001. and so the recommendation in this case from the probation officers for uh a period of one-year probation and i think that uh well it also i should say includes restrictions on alcoholic beverages and substance use and i think that those provisions of terms of probation are appropriate given mr matson's compass needs assessment scores he did rate as highly probable in uh the categories of substance abuse family criminality residential instability and social environment uh he does have a substance abuse history of cocaine fentanyl painkillers since 2005. i think that it is appropriate to try to get mr madsen some help for his substance abuse problems the concern i have in this case is that is whether or not mr manson is going to be willing to comply with terms of his probation he has uh in numerous court hearings in this case uh made a number of uh stupid nonsensical moronic hilarious arguments that have absolutely no merit in law whatsoever uh the judge however is about to be a bit more reserved in his assessment of this sovereign citizen's arguments than how i've just described it but this is probably what the judge is really thinking what he believes are constitutional and jurisdictional arguments that have absolutely no legal merit whatsoever and he continued to challenge report addiction here this morning i understand that that may be an honest belief that mr madsen has uh and i don't know where it comes from but i will say mr manson would be far better off taking legal advice from mr daly than from wherever it is that you're getting it to make you believe these arguments because as i've ruled repeatedly there's just there's just no merit to them they're not rational or coherent arguments under the law that that raises with me is that mr madsen if he does not believe this court has jurisdiction why then would he follow the terms of his probation and so if that's the question then the question i have to ask myself is why why would i put him on probation if there doesn't seem to be any indication that he would follow the terms of the probation the other side of that coin is that i think a lot of this stems from mr matson's substance abuse issues and the better way to get him help for his substance abuse issues is to uh put him on probation and get him into some kind of services to help him deal with that yeah it's bad enough having substance abuse issues but adding to the mix your sovereign beliefs and this changes everything it can make life way more complicated than it needs to be so sending him to jail might not help treatment is what he needs if he can stick to the judge's order that is so ultimately um mr madsen i'm going to give you a chance at probation and i hope that you are willing to comply with uh the requirements that are outlined in terms of your probation which i'll read to you word for word in a moment so that you're aware of them if you choose not to comply for the reasons you've stated or any other reasons um you can rest assured you're going to find yourself in violation of the terms of your probation and then i am going to be imposing other penalties meaning meaning for you jail time uh and i'm i'm i'll just tell you now it'll be a short leash because if we continue down this road uh i you know i'm already suspect of your ability to employ any violations are just going to confirm that for me and you're going to find that i'm going to lose my willingness to give you a chance so it will be the sentence of the court that you serve a period of probation for one year that you serve 29 days in the lenovo county jail with credit for 29 days served you must not use or possess alcoholic beverages or other intoxicants you must not enter bars or other places where the primary purpose is to serve alcoholic beverages for drinking on site unless the field agent has first given you written permission for your employment at a specific location you must comply with the requirements of drug and alcohol testing as directed by the field agent you must not attempt to submit any fraudulent or adulterated samples for testing you must not hinder obstruct tamper or otherwise interfere with the testing procedures and you must present proper identification at the time of testing you must pay the cost of your substance abuse testing you must not be in possession that you must not use or possess any controlled substances or drug paraphernalia unless prescribed to you by a licensed physician you must not be with anyone that you know to possess those items you must complete an outpatient or residential substance abuse treatment when you are referred by the field agent you must complete a substance abuse assessment when you are referred by the field agent you must pay a 30 uh per month supervision fee so long as there's no electronic monitoring if electronic monitoring becomes necessary that fee increases to sixty dollars per month uh you must also pay court costs of 750 an attorney fee of 450 a crime victims rights fee of 130 and 68 state costs you do mr manson have the ability to request an appeal of your sentence we're going to send to you three copies of a notice of right to appellate review and request for appointment of attorney form if you ask to sign one copy of that form and mail it back to the court that indicates to that you receive your copies of the form if you want to appeal your sentence you need to fill out the other copies of the forms and mail those to the address listed in those forms within 42 days you understand that mr matson yes you do so he understood all that apparently but just as the case is about to wrap up he decides to out of nowhere dredge up points and arguments the judge has previously ruled on hey judge i just had a couple questions before me from you concerning what you just said all right what what's your question um well if there's a crime victim's fee i'd i'd like to know where the um the victim is and also um your honor you said something about the jurisdiction if there's no problem with the jurisdiction i mean how come you couldn't tell me exactly which jurisdiction you're operating under so i would have to object that what you said i mean i it don't make no sense to me yeah i told you that before mr matson i'll tell you again i'm operating under uh the jurisdiction of the michigan constitution that sets forth uh the uh the fact that the state has various circuit courts i'm the judge of one of those circuit courts uh that one beat where you were pledged to have committed this crime and where you pled guilty to this crime your argument's that is assessed in every uh case where there is a guilty plea or verdict that is done pursuant to statute that was enacted by the michigan legislature and uh it is required to be imposed here so that is why i did it did any of that go in do you think well not according to the look on that face that is the face of confusion anyway thanks for watching guys please like share and subscribe to the channel and if you would like to support me and get early access to videos like this then please check out my patreon take care and i will catch you in the next one he's gone thank you
