Don't interrupt me. That's rude, man. Like, you just stopped us for a headlight. Listen to me very carefully. If you don't stop, I'm gonna rip you out of the car and you're going to have jail. What? Registration and insurance. He's reaching all over. He's looking for I'm trying to gather the vehicle documents. He got scissors, all sorts of junk in there. But next time you pull that crap me, you will go to jail. Welcome back to the Lackluster channel. In February of 2023, Officer Scott Davis of the Bonner Ferry Police Department initiated a traffic stop on a vehicle with a headlight out just as the family pulled into a gas station. Hello. Hi. My window is broken. Sorry. I'm Officer Davis, Police Department. Hello. Reason I stopped you is you have a headlight out. I do? Yep. Oh, it just comes loose, man. We can Can I jump out and fix it? Yeah, you can hop out in a minute here when I'm done. I'm finished doing my business here. Um, can I take your driver's license, registration, insurance, please? Yes, it's absolutely me. Rather than allowing the family to resolve the issue that led to the stop, Officer Davis immediately requests the driver's ID. While the driver is generally legally required to provide their driver's license, registration, and proof of insurance, passengers are not held to the same standard unless the officer has reasonable suspicion that they are involved in criminal activity. That said, courts have ruled that there's nothing unlawful about an officer asking for a passenger's identification. And Officer Davis doesn't hesitate to do just that. Do you got an ID on you too, sir? There, please. Uh, no, I don't actually. You don't have any ID at all? No, I don't have it on me now. Okay. I have my wallet. Sorry. Where are you guys guys coming from? Super one. Uh yeah, but we're out in San Point. Your place from Sanpoint? I live. No, I I live here. Um I'm from Sandp Point, though. So Okay. So you're coming from Super One tonight? Yes. Yeah. Yeah. And then what's your business here at Liberty? Here where? At the gas station. Oh, why are you asking us so many questions? I'm asking anything I can. Don't interrupt me. That's rude, man. Like, you just stopped us for a headlight. Why are you asking us all that? I'm allowed to answer questions that are pertaining to the traffic stop. How is what we're doing pertaining to registration and insurance? I asked you where you just came from. I know. How does that pertain to the headlight? There's Idaho case law that uh backs up what I'm saying. So, no answer as I expected. registration and insurance, please. Um, my baby is 6 weeks old about that. Officer Davis continues to escalate the stop as the passenger challenges his line of questioning. Idaho Code 1870 addresses resisting and obstructing officers, but notably fails to clearly define what constitutes obstruction. However, courts have long established legal standards for this charge. Simply speaking to, questioning, criticizing, or even cursing at law enforcement does not meet the threshold for an obstruction charge under this statute. On the contrary, threatening to arrest somebody solely based on their speech is a violation of their civil rights. To lawfully charge someone with obstruction, there must be physical interference, refusal to obey a lawful order, or depending on the jurisdiction, refusal to identify oneself when an officer has reasonable, articulable suspicion of criminal activity. If you don't stop, if you don't stop. Look, man, I'm not Hey, listen to me very carefully. If you don't stop, I'm going to rip you out of the car and you're going to object. What? For what? For you're obstructing my investigation at this point. He's looking for I'm trying to gather the vehicle documents. I'm asking you questions that pertain to the traffic stop. He's reaching all over. So, this is a registration. You asked where we're coming from when you stopped us for a headlight. Like, I'm not talking to you, dude. I'm not talking to you. Registration not in here or I can't reach for anything, babe. You're going to have to grab it. This guy thinks I'm He's already You're making this way worse than it is. Okay, you're not wearing a seat belt. Number one, that's why I asked for your name. Get off, man. You're not wearing a seatelt. The car is running. Is this I'm not going to argue with you looking for Dude, I was getting out to go into Hey, let's Hey, I I don't want to do this. Like, my baby's going to start crying. He probably needs to be breastfed. I want to go home. I don't want Okay, you need to calm down first of all. You need to calm down. This is the registration. Is this what you're looking for, sir? This is a routine traffic stop. I already I told you it's right here. It's right here. Okay. What's your first name, sir? This is What is your first name? I'm going to ask you one more time and then you're going to go to jail for what? You're not wearing your seat belt. Okay, get out. Though it appears that the passenger removed his seat belt only to open the glove box to obtain documents for the officer. Do you got an ID on you too, sir? Officer Davis now escalates the situation by threatening arrest over the seat belt violation, a $10 civil infraction that is not a jailable offense under Idaho law. But before he quote rips the passenger out of the vehicle, I'd like to take a moment to thank today's sponsor. Do you have credit card debt, medical or personal loan debt? Face away from me and put your hands on top of your head. Not searching you for weapons. You're making me nervous cuz I have no idea why you're acting so irrationally. I don't know why you're asking us where we're coming from. I'm allowed to ask those questions and we don't have to answer them. Like I don't know. Okay. Well, whatever. You don't Why would you ask them? I'm allowed to for the headlight. Yep. When Okay. I'm not going to go in and explain cuz I've already tried to explain things to you. Way past what I have to just You can either give me your name right now. Sure. My name is Brentton, man. Yeah, that's that's good for starters. You can run my name all you want. I'm clean. I have nothing on me. Then why do you why do you got to give me the attitude and give me the runaround? Cuz I think it's really ridiculous you're going Well, that's cool. If you don't like that, go move to Washington then. I don't care. I'm not going to move to Washington. Why you treat me like that? You're a public servant, man. Thank you. Middle name. Peter. Last name? Andere. A N D E R E G. What's your name? Slow down. And badge number? Slow down. You do have to give me that. Tell me your last name. A N D. Slow down. A N. Okay. D E R E G. Okay. Date of birth. Now, sir, please. What is your name and badge number? ID out of Idaho. Yes. Okay. Name is Scott Davis. Badge number 67. Are you familiar with US Code Title 18 section 240? Nope. Face away from me. The officer runs the vehicle and the family through dispatch. Blonde hair, blue eyes 601 195. Copy. Code for and a backup officer arrives on scene. So, it's time for a headlight out. I'm just ask where they came from and stuff like that cuz it's Idaho plate or Bonner County plates and then he starts challenging. Oh, you can't ask those questions. All sorts of stuff like that. And so starts reaching for a whole bunch of stuff. They got scissors, all sorts of junk in there. And I told him to get out of the car. He wouldn't give me his name originally. So I'm going to kid you. Yeah. But so I got to do some warning tickets here and I'll be a minute or two. A short time later, officer Davis returns to the driver's window. Wasn't it won't open even if you roll your window down? The window won't roll down. Okay. So, hey, so what's his deal? Is he normally like this with law enforcement? Um, I couldn't really say. I mean, not generally. Usually, um I I we haven't encountered much law enforcement. Okay. So, I haven't um noticed any issue in the past. whenever we have. He's generally pretty respectful. Um, yeah, I don't know if he was just off by the questions or I don't know. I do apologize though. I mean, obviously, you know, I just got out of the shower. My hair is still wet. Just grab some groceries heading home. Like, definitely didn't intend for this. Um, well, no. It's just a headlight stop. Your headlight your headlights out. Are either of you on probation or parole? No. No. Have you ever been arrested? Anything like that? Never in my life. Is there any reason why he is so nervous like that? Do you have anything inside your vehicle maybe you don't want me to be concerned about? No. Absolutely. Okay. Why did you pull into Liberty here here? Uh tobacco cigarettes for him or you? For me. Okay. Cuz it looked for a second you're going to roll up to the pump and then you kind of forward a little bit for them. I was like I didn't want to block the front of their business if we were like going to be here for, you know. Okay. I just I don't know. I forget that Bonner's Ferry isn't like Sandp Point. It's a lot smaller here. So, like nobody's even coming here since we've been here really. I just didn't want to block up the front of their business. Got to understand where I'm coming from. I go to pull a car over, they turn into the first gas or the first gas station and then they pull around and then they slowly come to a stop. So, that can make me my my sentence is a little heightened behind me until I was pulling in. And it's not a crime, but it just sometimes people normally and then No, I understand. I'm in I'm asking questions about a license plate that's out of Sandp Point and where you're coming from. Then he said super one. I was like, normally people in their license plate are from Sandpoint. They're normally from standpoint. Yeah. You know, nine times out of 10. And then um getting um and then the vehicle doesn't even come back to you. It comes back to a Sherry. Who's Sherry? My mom. Oh, okay. Cuz your driver's license is Kayla. And so, but the vehicle is registered in my name. You mean the Oh, the entrance. Yes. Yeah. At first, that's all I had as well though, too. When I originally because that's the only thing I got at first. So, any questions? Me? Um, no. I'm all set. Um, is everything. Yeah, he's good. He's not going to jail. He's close, but he's not as long as we have a conversation and he wants to leave here tonight. Yeah. So, Okay. Yeah. Yeah. We would love to go home and I apologize for any inconvenience. Um, it happens all the time. Thank you. Um, future reference, when I ask for your name, I have a legal reason to ask for your name. Unless you do want to get booked into jail for a misdemeanor offense, you will give me your name. Does that make sense to you? Okay. I'm not trying to pick on you, your wife, but when I'm asking questions that pertain to the traffic stop, there's Kate Flaw. My substant over, she's the driver. Like, that's beyond the scope of the traffic stop to ask me for ID. I have nothing to do with parad driving. I literally just explained that to you. Per Idaho law, you can look up I don't have the code on hand. It's a traffic code. You have to have a seat belt on per Idaho state law. I could have wrote you a $10 ticket for I didn't, you know, but whatever. If but if you want to if you think you have legal, if you think you have some legal knowledge, go for it. I don't care. But next time you pull that crap on me, you will go to jail for what? Resist obstruct. I literally just told you that twice. Okay. Okay. So, have a good night. You too. Good night. He said he's recording everything. He's going to file a complaint. The stop concludes with Officer Davis threatening to arrest Brenton over his hypothetical future non-compliance. But the officer's constant misrepresentations or his misunderstandings of the law in this way appears retaliatory and serves only to intimidate somebody for exercising their constitutional rights. Let me know what you think in the comments down below. If you like this video, you can find it and others featuring the same officer on the Boundary County Watchman channel. That will also be linked in the description and pinned comment. And if you'd like to check out another one of my videos, just click on one of the episodes linked on the screen.
