do you subscribe right now no my favorite goal no you're not here to go i got one officer saying that i'm not suspected of climbing and he said i was looking in buildings now now you're saying i'm looking at builders and that is a crime i'm not answering any questions you haven't answered any questions you haven't been any help whatsoever why are you getting rude why are you doing it because you're being i'm not i'm not the one surrounding people with guns you guys are just harassing me for no reason no this is what cops do welcome back to the lackluster channel today's story was submitted by jules scott who back in september of 2019 was out for a walk in the early morning when he noticed officers moody and o'brien of the amisbury police department and began recording [Music] 41. so what's going on you're just walking around you're looking in the buildings looking into the uh the ambulance and stuff is that legal oh we're just wondering what you're doing looking in the abandoned buildings and stuff am i suspected of a crime we're just wondering what you're doing do you subscribe right now am no free to go no you're not here to go what's your name do you suspect me to come in a calm i don't answer questions i'm i'm revoking my vitamin sound that problem no i'm just wondering what you're doing yeah yeah i heard two in the morning you're looking at a suspicion of a crime yeah that's why we're looking into it suspicion is a crime we're looking into it it's just being suspicious of calm being suspicious is not a crime okay so am i free to go no well if you're trying to figure out your information what happens if tomorrow if you are there and there's something wrong with that building what happens if if that if this we can do this what if game all you want i mean that's what you're saying this no you just keep going down this road this what if game what role all you got to do is give your ids with your friends is that required of me by law have i committed a crime wow why listen less than a minute in jules scott is told that he isn't suspected of a crime but that he isn't free to go the officer then brings up a what-if scenario and as jules repeats it the officer tries to turn it back on him this is a common interrogation technique utilized by officers across the country by using a logical fallacy to imply an accusation the subject becomes flustered the officer then continues to escalate by claiming that the subject is the one using the what is scenarios most people when faced with such foolish inquiries will become personally offended at the outrageous insinuation and act off the emotions they caused usually in the form of arguing which moves the subject away from their stance of remaining silent answering questions in an attempt to prove the officer wrong in this case it doesn't work and jules continues to refuse the officer's questions and asks if he can leave i free to go i think i'd be detained for what purpose activity is that a crime was that a misdemeanor or a felony enough to stop you it's another and check you out the supreme court has already decided um you're down here looking in businesses after they close is that a crime yeah it's called burglary right i so so i got one officer saying that i'm not suspected of crime and he said i was looking in buildings now now you're saying i'm looking at builders and that is a crime what's that what kind of try to prevent crimes what statute is that uh that's very weird 266. yeah uh google how you find your phone what who what evidence you have burglar [Music] excuse me excuse me i don't consent excuse me what are you doing what are you doing what's that right what are you doing why are you touching me i got this guy you got me in the armhole i got this guy why why are you why are you holding this illegal deception i want can i stop are you doing stop fidgeting what are you doing i'm not fidgeting yeah you are knock it off i'm not doing anything down for my safety i'm not doing anything i don't consent to any search and seizure i have not consented they violated my rights right now what's your name officer i'm all running what's your badge number what's your badge number 26. what do you guys think and away from my weapon are you kidding me no i'm not kidding you get it away i'm i'm not doing i'm hanging in my weapon like that again what are you doing you're trying to find a reason to patch it off a weapon no you want to use big items bulging in your pocket okay why would you suspect me in a weapon do you subject how what are you doing you're doing you're legally legally searching me right now okay well okay when you're done okay go ahead and search along your little phone and look up chapters 41 section 1998 okay what's that chapter 41 section 98 of the commonwealth of massachusetts covers powers and duties and says that officers may examine all persons abroad whom they have a reason to suspect of unlawful design it goes on to say that if an officer stops a person for questioning and reasonably suspects that he is in danger of life and limb he may search such a person for a dangerous weapon this is similar to the terry v ohio ruling that some have been rallying against because of its unconstitutional allowances for police officers in this situation the officers have clearly stated that jules is not suspected of committing a crime nor has he done or said anything to declare that he is a threat the detention and search is well beyond questionable figure it out for yourself what are you guys doing you guys are illegally searching yeah what's your name what are you doing out here late at night like this well is it illegal to be out later now no but when you're out looking in windows and checking out businesses we have a duty to check you out as police officers what we do what crime have do you suspect me of committing you're not gonna well you have to be committing a crime for us to suspect you with something it's called suspicious behavior inspirations is not two in the morning isn't it it's just fishing a crime so what time of day the time like how does that factor into any any and so what's the difference okay what's more normal answer this okay what's more normal if you're going to a business at three in the morning i'm not answering any questions you haven't answered any questions you haven't been any help whatsoever all you do is keep deep throwing that goddamn floss pick just tell us your first name this officer has been the only rude one on scene thus far remember that you owe officers nothing and do not have to answer their questions to assist them in their investigations why are you doing good why are you doing it cause you're being i'm not i'm not the one surrounding people with with guns you're the one who's rushing to close businesses and walking around at two in the morning that's not illegal it's suspicious that's why we're stopping you okay now you stop me where do you live i don't answer questions i'm not trying to be anything but free and on my way okay i haven't done anything wrong i haven't committed crime you guys don't suspect me at community crime so what's going on you guys are just harassing me for no reason no this is what cops do is her ass yeah no no we checked people out late at night yeah that's right look up 4198 i'm not stopping you asking you correct right well this is what we do for a living it's harassed no he called by the citizens okay it's called preventing crime okay that's what we do so you suspect me of being a criminal and committing crime we don't know that's what we had to find out okay you don't know okay so then why are you harassing me asking because it's two in the morning around walking around looking what does the time of day have to do you know whether somebody's committing a crime close and you're looking in their windows i'm not committed is that a crime no it's not a crime it's suspicious go on do what you're doing okay suspicious activity is not a crime um can i have your name number i already gave it to you exactly look at the little recording and okay and do your thing yeah that's how you treat people yeah that's how you guys should okay so go ahead and get out of here and we'll be watching you so am i free to leave yes you are so i'm free to stay tuned right right okay thank you have a nice night okay what's your name and badge number i already gave it to you yeah are you are you refusing to answer to identify yourself are you refusing to identify yourself bye have a nice night guys over at somebody else that don't know their rights [Music] at this point most of the officers leave and jules has a conversation with officer o'brien i
