can you just get this over give me a breathalyzer and we'll be on our way see you did better than me I had to cheat and put my heel on the ground and I explained it to you Deputy Ryan I don't have to give you my badge number okay welcome back to the lackluster channel on June 26 2022 if you were named Robert via was driving on wabana Road in Grand Rapids Minnesota following behind his friend as he led the way to their destination during the drive Deputy Mark Ryan of the Itasca County Sheriff's Office began tailing their Convoy the speed limit is 65 miles per hour and the two vehicles maintain their speeds at around 60. in fact only the deputy is seen exceeding the speed limit as he passes Robert's truck to initiate a traffic stop on his friend's vehicle more on the reason for the traffic stop later Robert was unfamiliar with the property they were headed to so he pulled over as well parking over 50 feet in front of where his friend was pulled over the officer calls in the truck's tags and speaks with the driver all of these marks indicate where the Sheriff's Office redacted the audio of the conversation which is why it's so important to record every interaction you have with State officials even if they tell you that they are recording the audio that they left is important early into the conversation the officer is inquiring about Robert's vehicle his friend tells the officer that they were convoying and the officer repeats Robert's last name yeah Zilla the audio is redacted again but they leave enough information in the video to corroborate Robert's Story the officer is looking for an older red truck anyway so I'm stopping you because I'm looking for an older the truck's owner is named Kirk and Kirk has warrants yeah there it I lost you everybody happens stance much uh 38 so I'm like well I'm gonna stop him because Kirk has got uh some warrants I'm looking after verifying that this was not the vehicle they were looking for the very lawfully questionable traffic stop should have ended instead the officer pretends he has no idea who Robert is or why he is also pulled over and approaches his vehicle yep [Music] level 34 station five second 28. David King Lincoln 587. hi we got you dry your dresser for what I'm illegal I want speeding on you pull me over you pulled him over I know you stopped in the middle of my traffic stop that's suspicious activity so I'm investigating your suspicious activity well I'm following him out to his out to his cousin's property driver's license [Music] driver's license all right once again I have not done anything illegal so I don't need to identify myself to you what's your opinion no it's the law no the losses when I'm uniformed officer asks for your identification if I've done anything you feel you're suspicious you pulled over in the middle of my traffic stop yeah because I'm following my buddy to his property so so then I come out here you start giving me attitude that just makes me want to ask more questions oh you can ask all the questions you want I'm I'm not going to answer any more of your questions go ahead and run my license and let me get on my way that's up to you I'll release you when I'm done okay been using any controlled substances are drinking today nope once you shut the vehicle out and I'll have you step back here we'll go through a few tests oh yeah I'm gonna go ahead and start recording just so you know well I have two cameras running right now Robert's my driver station when I run in please you have that back I'm gonna start recording for my own purposes not for yours during a lawful traffic stop you must present your identification to a law enforcement officer but there is no probable cause for a traffic infraction or reasonable suspicion that Robert is involved in criminal activity however Deputy Ryan appears to demonstrate a belief that you must identify yourself whenever an officer requests your identification regardless of circumstance this idea is even more ridiculous considering the deputy knows why Robert pulled over with his friend as the story has been corroborated by both men that alone should have expelled the deputy's alleged suspicions but he continues pressing Robert foreign the deputy has now admitted that the interaction continued because Robert gave him attitude so then I come out here you started giving me attitude that just makes me want to ask more questions and because Robert put him off the game is ordering Robert to exit his vehicle and to perform field sobriety tests despite lacking even a shred of probable cause to ask Robert to perform them he was not speeding or driving too slow nor was he swerving or alleged to smell like alcohol in fact he wasn't even pulled over and it's important to remember that field sobriety tests are a voluntary act and not required under Minnesota law have you been drinking or using any controlled substance no I'm not can I get your bait into your name okay I'm gonna run you through some field sobriety tests Robert you understand that yeah boy look at me go ahead so I'm gonna hold my finger up in front of your eyes do that I want you to follow my finger with just your eyes and not your head you understand what that means yep don't turn your head like this just follow it with your eyeballs okay yep so put your hands at your side while we perform this tip I'm gonna hold my phone up so well you can perform the test properly or that's going to be an improper test that's up to you well we can do this okay so keep your hands at your side and then when I put my finger in front of your eyes I just want you to follow it with your eyes and your eyes alone you understand that yep okay Robert consents to the tests knowing that with the way Deputy Ryan was mishandling his emotions a refusal would have likely ended with his arrest and a chemical test to prove his innocence they begin the field sobriety tests with the horizontal gaze nystagmus which is performed flawlessly okay The Next Step Next Step well I'm explaining to you I'll just have you stand with your hands at your side yep and then when I ask you can you just get this over give me a breathalyzer and be on our way because I'm not on any drugs I've been sober for over six years well I'm glad to hear that so then when I tell you I want you to take a foot of your choice and lift it six inches above the ground and look down at your toe and count one thousand one one thousand two one thousand three one thousand four keep looking at your toe and holding it off the ground if you haven't put your foot down that's fine but pick it back up and continue Cal I'm gonna let you know right now that I've had two back surgeries so my balance isn't the greatest Robert again performs the test flawlessly despite his prior surgeries and the fact that the tests are stacked against you as you have probably never performed them before even Deputy Ryan would agree with that as he admits he couldn't even perform the test properly despite instructing the tests an unfathomable amount of times see you did better than me I had to cheat and put my heel on the ground when I explained it to you next test we're going to do a walk at the line here okay so we're going to use this edge of the road I don't want you to be right on the tire but I want you to kind of be beside it in the gravel again after being instructed to perform the walk and turn on an uneven surface Robert passes with flying colors hey perfect okay good don't forget your phone songs try and get that please for my records Deputy Ryan I don't have to give you my badge number okay do you have a business card I do can I have one please yes okay [Music] for what exactly because I did nothing legal nothing new times suspicious activity is not a crime and then when I come up and ask you a few friendly questions you give me attitude immediate it's not a crime you understand not identifying yourself when asked by a uniform officer for your identification you identifying Me by running my plates how do I know that you I don't know I have no idea the truck could have been sold 20 times [Music] we follow each other Mr Villa there's a villa or how am I saying her name yeah via Mr via do we understand each other yep and I'm going to be going in filing a complaint so just know that's fine that's fine the whole thing's recorded you can watch it together with everybody all right [Music] so why is such an attitude because I did nothing wrong I stopped because I'm following him off to his property and I pulled up far enough away from your track and traffic stop I didn't get out of my vehicle I didn't interfere with anything he could have simply said that while we were standing here talking I did say that for the record both men told Deputy Ryan that I'm following him out to his out to his cousin property driver's license you immediately refused to identify because I didn't do anything illegal suspicion is not a crime what is it I'm just wondering well personally why you have such a problem I did nothing wrong all I did was pull up ahead of your traffic stop sat here waiting for you to be done no it's not did I get off my vehicle how many cops are getting shot on the roadside right now because somebody pulls over jumps out and shoots me okay and I have my seatbelt on when you came up right did I take my seatbelt off did I get out of my truck no no I sat here I was waiting for my you understand my concerns yeah and I told you what I was doing and you still subjected me to a field sobriety test I'm sober not on any control stuff well there's people that usually go pipe off to the cops have something else wrong I didn't do anything wrong to be 100 clear piping off to the cops is protected under the First Amendment and the more Deputy Ryan talks the more his own speech may be used against him in a lawsuit for retaliating against Robert's lawful activities to run you through some testing that's that's fine okay he did he did in your words he did well because I'm not on anything I have no reason to lie you know I don't know you Mr via I don't know you that's fine and I don't know you so just doing my thing I don't have you know run-ins with law enforcement so wow in the future I'd simply asked that maybe you're something wrong do anything wrong so if you did something wrong then I'd really be having a problem right but I didn't do anything wrong I wasn't speeding I just yeah yeah I would if you did something wrong huh if I did something wrong but I didn't do anything wrong you have a good day sir no he's not the same type of fella you are but you're free to go yeah you have a good day [Music] yeah he was but I don't know why I don't either I tried to get to the bottom of that but moving on you have a good day thank you on scene Deputy Ryan claimed that he was looking for Kirk because Kirk had warrants but on the incident report he claimed that the traffic stop was to check on the truck's trailer lights though they were never discussed throughout the entire Stop Robert and his friend were finally set free after being stopped for driving a red truck Robert has filed a complaint with the department and is currently seeking counsel to file a lawsuit so we'll put that one in your memory bags rather be up
