welcome back to the lackluster Channel in August of 2023 a viewer who wishes to remain anonymous was driving with some friends through New York in the early morning hours when they noticed two unmarked units approaching in the opposite direction the officers made a u-turn that would have earned the average driver a traffic citation and pulled over the vehicle go back to the car okay the sergeant claims that they saw furtive movement in the vehicle prior to the stop to justify the pat Downs furtive movement describes a behavior of someone trying to avoid notice or being secretive and of course as the standard for furtive movements is purely subjective it is often abused by officers who wish to search a person or vehicle when they lack a legal basis for a Terry stop the cameraman who we will refer to as Jay records the officer as he bypasses the Fourth Amendment and tries to guess what mystery objects are contained in Jay's Pockets though Jay had been recording prior to the office of removing him from the vehicle and despite the fact that the officer stepped in to put his hands on Jay without his consent the officer now somehow feels violated because he put his own face too close to a camera thank you listen next the supervisor on scene Sergeant Krueger will unlawfully seize Jay's property instead of reprimanding his officer for assaulting a citizen over his First Amendment right to film the interaction you could put it in your pocket I'm gonna put it in your pocket you know you took my phone right the reason why the reason why I took your phone is because when we're standing face to face you're not going to be throwing your phone in people's faces everybody's being recorded that's the only thing all right no because as soon as I take my phone to my hand off your pocket you're going to take your phone out and you're going to start sticking in our faces that's why as of right now Sergeant Krueger eventually lets go of Jay and Jay removes his phone from his pocket once again this time the sergeant tries to frame filming the incident as a safety concern nobody else can I give it to your friends no I want it my that's my phone did I give you his phone I want my phone eventually Sergeant groover Returns the seized property like if you feel threatened get like back up bro if you feel thread back up back up back up literally literally he said I I but literally you're literally a less than a foot oh no reason I'll explain everything as soon as your friend here lets me explain explain though you're touching me stop touching me we know the officers aren't afraid of their own body cams they can turn them off and mute them at almost any time and in most cases are nearly impossible to obtain if you're relying on the police to be transparent and honest you're going to be let down as time and time again requests for records are ignored destroyed redacted or hidden behind an exorbitant paywall recording an interaction with your own equipment is not only your right but it is free freely available and free of censored or redacted information why you got a gun in your head bro you're not even a gun one two three four five what you talking about you you don't want that approaching you about safety issues I was cooling about my day I don't even know about the background it'll be knowing that because you're harassing I just came out of work and I'm going to vote I'm trying to go to sleep because we're all I think you said we're very close I'm tired but I'm trying to go to I'm trying to go home bro okay so as soon as we get through it all right you'll be on your way go you'll be on your way are you ready for an explanation now no you serious right now listen put the phone you can have it but put put you on top you think this is a joke I already made it to the driveway driver's plate all right guys as Jay's friends returned to the vehicle he gathers business cards from the officers the party was released without a citation and the only motive given for the Stop was that the passengers were moving around in the back seat lights on if you're approaching before you guys even pulled over everybody in the car started moving around especially your man right here he kept dipping down leaning to his left and it looked like he was placing something on the floor the officers continued with their unprofessionalism refusing to let go of their cards and pushing Jay into the car but one of the main reasons I featured this video is for this specific part this is YouTube YouTube not the first time being off too stupid look at her look at her yeah mentioning lackluster won't guarantee that you'll be featured but officers are often familiar with the channel and considering the amount of policy change internal affairs investigations and employment suspensions and terminations we've influenced it certainly doesn't hurt to put them on notice Jay's frustration with the officers caused his language to be a bit too much at the end for
