the ticket or is it it is something that

that I don't know how it happened or I
need to know that cuz I need to know um
because if I need to know because if the
ticket is defective then it's going to
be a problem to to is what

can tell me the origin
of in that document that you have that
does not uh reflect what you were given
a ticket for he cannot go forward on

complaint it doesn't track the citation

ticket says uh location 2261 FM 1092
Road the ticket says that yes okay and
what does the complaint
say cartright road at
fm92 okay so basically the address on
the ticket doesn't match the address on
the complaint so they can't go forward
with the trial today which means if they
choose not to refile the case our sset
friend did the right thing by not
accepting the deal offered by the
prosecution so before I swear anyone in
the state has a right to make a
motion
to

said it C at 1092 yes judge and that's
not the proper location the ticket you
were given says a some 100 block of 1092
too right yes judge and he has a copy of
the citation as well as I gave it to him
okay but the but that document that you
have is incorrect so I have to dismiss
this case based on that the state does
have an option under the law to refound
give notice that they will refile the
case when they if they refile they
cannot change the charge it has to be
what what you were given the ticket for
it cannot be something different so that
is why I was as in the state what does
the ticket say because whatever they
charge in that document like you have it
has to match the ticket can't be
something different so for today's
purposes this case is
dismissed now um but the state is saying
they're going to refile it so if they
refile it you're going to get something
either by email or mail make you have
your correct address everything on fall
should be correct
uh
and this this complaint was sworn uh
under oath the the was sworn to but the
state when it looks at if there is a
mistake the state can can dismiss I have
to dismiss I they can't prove that so
I'm going to dis miss it but if the
state determines that it wants to refile
it that is strictly the state's right
under the law to
do I don't know if they're actually
going to I don't know I'll have nothing
to do with that part all I can deal with
is what's in front of me today I just
want you to be clear on that if
there then you need to make sure that
it's not something new based on the
ticket you need to match it with the
ticket to be sure that whatever is in
the new document mates on the ticket
that you given because it cannot that
cannot be changed do you understand what
I'm saying so today will be dismissed
cuz the complaint was
invalid because a complaint is invalid
yes call it a def didn't
complain so I didn't make a finding on
guilt or innocence because the state
made the
motion so I'm just missing this you may
go to you may get a copy of the
dismissal for your reference and again
if you are notified that it is refiled
then you will have to start the process
uh to come in and then determine at that
