So, check out the zoom features on this camera. Hey, hey sir. No, you can't video Absolutely, I can, sir. Hey. Hey, what Do not touch me. All right, from the top again. You can view anything you want and record anything you want from a public place if there is no barrier and nobody's got the right to keep you from recording in a public place. So, check out the zoom features on this camera. Hey, hey sir. No, you can't Absolutely, I can, sir. Hey. Hey, what Do not touch me. You cannot >> You cannot touch me. You cannot be Sir, it is available and viewable from public. You cannot interfere with me. Yes. >> You cannot interfere with me. We have a serious epidemic and addiction in this country and there are few who want to talk about it. ID addicts are running amok. >> Look, can I see your ID? >> No, you cannot. >> If you ever see these ID addicts and they're pretty easy to identify, be warned and be aware. They are dangerous and they will do anything to feed their addiction up to and including eliminating you. Do you really have to be so rude? When my rights were violated and I was assaulted by somebody who is sworn to uphold my constitutional rights, I get pretty upset, sir. I'm sorry to hear that. I'm sorry to hear that you don't know my rights or care about my rights and you want to try and use tools of intimidation to take my rights away from me. I'm not going to have it. >> I'm not sure who the original content creator and uploader of this video was cuz I got it from a third-party source. If you know, leave it in the comments section and I'll make sure that I post it in the description and a pinned comment. But, we're going to take a look at this interaction cuz this guy did a really, really good job handling these cops and let's make some comments along the way. Absolutely no markings on this squad car. Got ourselves a Pine County Sheriff's Deputy here. 405 W M So, this is Pine County, Minnesota. Z You see that in your rear view, definitely take caution and slow down. No, thank you, sir. All right. Can I get your name and badge number since you've made contact? Sure, my name is Deputy Atkinson, badge 554. Have a good day. Can I ask you why you're recording our vehicles and car numbers? >> [snorts] >> You can ask all you want, sir. >> [sighs] >> All right, we've got another dirty vehicle. Love it. All right. Let's take a look at something here. As we all know, you have to establish privacy. Let's check out the zoom features on this camera. Hey, hey, sir. No, you can't be recording >> Absolutely, I can, sir. Hey. Hey, whoa. Do not touch me. You cannot >> You cannot touch me. You cannot be Sir, it is available and viewable from public. >> you cannot be recording >> Sir, it is viewable from the public. You cannot interfere with me. Yes, absolutely >> You cannot interfere with me. >> recording inside of vehicles with the >> Okay, let's take it down a step. Let's take it down a step, you know. Now, at this point, I am going to ask for your identification. My ID, why? recording inside of vehicles with the Let's take it down a step. Let's take it down a step, you know. Okay, at this point, I am going to ask for your identification. My ID, why? Am I being detained? Do you want to start me a call >> Hold on, hold on. Am I being detained? trying to record inside squad Day two. And why am I being detained? First, you would think that enough cops have seen enough videos to understand that before you can ask for ID, there's got to be reasonable articulable suspicion that a crime has been committed. So, if they ask you for ID, they can say, "Hey, I have probable cause that you have committed this crime. Therefore, I need your ID." And besides that, if a public servant allows sensitive private information to be seen by the public at large, that public servant is betraying his obligation to the member of the public who wanted to keep their information private. I mean, does that even make any sense? This public servant was entrusted to keep information private. He claims it's supposed to be private, and yet he disseminates that private information so that anybody in the public can scalp that information, including driver's license numbers, social security numbers, names, addresses, birth dates. They have information on those screens that could literally ruin somebody's life if somebody else got a hold of that information. So, he betrayed the trust of a member of the public, and then he's going to turn around and request ID from a member of the public who exposed the fact that he betrayed that trust. Because like I just told you, you're recording at the time. Is that a crime? Data privacy laws? >> No, sir. You are required to create your own privacy. I am not required to do your privacy for you. How you doing, sir? What's your name and badge number? I'm Investigator Night Guard. Nice to meet you, sir. I really would like to take you downtown. >> Sir, can I see your ID? No, you cannot. Okay. Not unless you have reasonable articulable suspicion that I have committed, am committing, or am about to commit a crime, which is a statute or law. Not your feelings, not your policies, nothing about that. This is an unlawful detention. As a right to privacy >> This is an unlawful detention. >> Will you stop interrupting me? >> Sure. I'm sorry. Okay. So, basically he's walking around, he's recording inside [clears throat] all the squads, collecting plate numbers, everything else like that. He walked to my squad and then started zooming in on the computer and stuff, which it our computers is private information. But you need to create the privacy. Okay. Not me. I'm a private citizen. I don't care, but as right now, you have identification on you. I will be glad to provide it for you. In fact, it is in my Jeep. I'm sorry, but >> Okay. But in order for me to provide to you my identification, Okay. you need to be able to articulate reasonable, articulable suspicion that I have committed, am committing, or am about to commit an actual law. Man, you cannot get more clear than that. And the professional, the law enforcement professional on the scene should know all this. And I think he does know this, but sometimes the ego overrides your knowledge bank, and when your ego gets bruised, when somebody doesn't comply with your commands like you used to, then you step over that line of morality. You start putting your hands on people, you start demanding ID, you slap the cuffs on, you start kidnapping somebody who didn't even commit a crime. And therefore, they violate 18 USC 242, and they deprive people of their rights under the color of not even law, but under the color of fragile ego. I'd like to inform you, sir, that you are outside Okay, I'm just going to pull a piece of paper out here. You are officially outside of your authority. You're officially violating my constitutional rights. And it states He's got a spiral-bound binder. And it states right here, if you read line three >> [snorts] >> of the code of ethics of public services of the city of Hinckley. 54 line, what is Dedicated service. All officials and employees pardon. Officials and employees shall not exceed their authority or breach the law or risk others to do so. May I ask you something, sir? If you do not have RAS to demand my identity and you continue to demand my identity is that violating the law? As of right now, like I explained to you. Going in The cop is putting his notebook back cuz he knows he's been had. This guy with the spiral bound binder is a freaking beast, man. Inside recording inside the computer and stuff, which is a law. >> You will You will find it is not. You're You're You're recording my computer and stuff and and I didn't like it and I want your ID. I am not in violation of any privacy laws. >> are. Sir, you need privacy, it is your obligation to create it. I told you not to be recording and you zoomed in on to my computer. >> Well, I actually zoomed in far far before you asked anything. You also contacted me. Did you touch me? So, I told you to stop. >> Did you make physical contact with me? I reached out. >> Are you aware that that's assault? Okay. That is simple battery. Well, then am I free to go? I love that. Now, on the record, officer, did you touch me? Had I committed a crime? Did I violate an ordinance? And yet you touched me anyway. Let the record show, judge. Let the record show, jury. Do you have an ID with you? I do. I always No, you may not. From this point forward, I will observe my right to remain silent. I have nothing further to say to you without a lawyer present. Now, if you ever say that, if you ever invoke your right to be silent, be silent. Shut the front door and don't open it back up for anything or anybody. That's fine. I'm just going to call my supervisor now and see what Maybe he'll educate you. Do you really have to be so rude? When my rights were violated and I was assaulted by somebody who was sworn to uphold my constitutional rights, I get pretty upset, sir. I'm so sorry to hear that. I'm sorry to hear that you don't know my rights or care about my rights and you want to try and use tools of intimidation to take my rights away from me. I'm not going to have it. >> any rights away from you. Are you demanding my ID? Uh I'm asking you for it. >> Am I free to go? Just hang on, all right. Am I free to go? I said hang on. >> Am I being detained? >> I already answered that question for you. >> And what crime do you suspect of me to be committing? Have committed or I'm about to commit? What law? You You're being very quiet here, Mr. Night Guard. You understand what I'm doing here, don't you? I'm trying to figure out what's going on. >> [sighs] >> Mind you, folks, this is day two and we've already got a cop who's addicted to identification. God, man, it's like crack to these people. Everybody was very polite. Oh, we got state po-po. LOOK AT THIS. Look at this. How you doing, man? Do a great day, folks. my This is Minnesota here for you, folks. You asked me a question. Went great. It went great. Nobody violated my rights. Nobody interfered. By the way, you are You guys are interfering with my process here. You are of interfering with my ability to collect news for public dissemination. It's a violation of federal law. I just told you I'm here to collect information for public dissemination. I'm exercising my constitutional rights. And I I wish you to be free to go. And besides, what's worse, interfering with the duties of a police officer or the police officer interfering with your unalienable rights? Shouldn't we err on the side of freedom? Would you mind giving me your name and badge number? You're 123? That's actually my former license number for my profession. From California, license 123 is funny. Irony and What's that? Yeah, tell me about it. Yeah. Do you mind I I don't have any weapons. I'm a little cold. Can I put my hand in my pocket? Let me Do you mind if I just check? I do. I do mind, but I will I know that I'm under a Terry stop here right now. I know I'm on a Terry stop and I know that gives you the right to pat me down, so No, Terry stop means that they need reasonable articulable suspicion that you've committed a crime or are about to commit a crime. There needs to be reasonable articulable suspicion though. They can't just put their hands on you and pat you down. >> [cough] [clears throat] >> By the way, it's an unlawful Terry stop. Just so you know. For the record. >> [sighs] >> And that's why you record because you want everything on the record. I'm going to speed this up a little bit here. No, he just keeps following me around with his phone all day. So. See Hawkinson, tyrant in charge. No, you want to come in here? Okay. All right. Yeah, if you want to talk with him and deal with it, that'll be great. I wish to be free to go. Well, if you want to leave I wish to be free from your detention, sir. Okay, well, then you can leave our parking And that's where the video ends, but I think this guy pulled an absolutely stellar move when he removed this spiral-bound binder with all these highlighted ordinances and rules and regulations and laws that the cop was not living up to. Knowledge is power, but somehow this knowledge and this power doesn't seem to phase people when they're jonesing for that ID and they want to exercise that power and control.
