this is this is Carrie Jarvis and this is his interaction with officers Mackenzie and Tucker from the Daytona Beach Police Department on October 29th 2020. Carrie's about to jump back into his SUV and drag both of these officers down the road before wrecking his vehicle but wait till you see how this story turns out [Applause] yeah [Applause] you might be asking how the heck did we get to this point right here 39 year old Carrie Jarvis made some bad choices in life some of his bad choices include aggravated assault armed robbery and Grand Theft so needless to say Carrie has served a lot of time Behind Bars he's probably not the kind of guy you want to see your daughter bring home and announce a serious relationship with but according to Carrie he's made some changes and he's trying to get his life back together then he got pulled over by Daytona's finest let's start from the beginning probably yeah yeah foreign [Music] [Music] that's awesome was it 208 yes sir yes sir foreign yeah that's fine rule number one when talking to police you're under no obligation to answer any of their questions the first thing even they will tell you when they're reading your Miranda Rights is that you have the right to remain silent in most cases unless you're the one asking the questions and Gathering the information it's best to use that right last time you got in trouble oh that first got out of prison and then but he got to charge because it wouldn't mind anyway when did you get out of when did you get out of prison yeah nine months ago would you serve time for it it's on drugs what kind of drugs crack that's what I was going though okay how long did you do six years six years for crack I got you before that you're 13 years ago so you've done what total at 19 years all for narcotics about to roll everything stepping out we're good consultation you work at bubble gums what'd you do there saltation very nice I got two kids I'm 40 years old now I'm over there I just hate that I still gotta wear all this [ __ ] here I look like I get [ __ ] stereotyped man just you know that's all it is you're not on probation or anything from the last time you went to the county no what was that arrest for that they dropped you said possession it was like three people went to jail oh so it was Mutual possession because nobody admitted to it so it's like what someone in the center console or cup holder I just good I paid all my phone calls I paid I've been working saved my money okay just bought the car from the car lot and again there's no weapons nothing less than the vehicle man okay I got you [Applause] but I did something wrong with him did he tell you why he pulled you over yeah somebody uh adopted a little thing right there coming out of the thing oh yeah when you're exiting private property crossing a state sidewalk or city sidewalk onto City roadway you must treat it like an actual stop sign coming to a complete stop and then proceeding against the intersection if it's true that that's the only reason they pulled Carrie over then they should just write him a ticket for it and let him be on his way but what do you think the odds are that that's not all they're gonna do they wouldn't try to escalate anything would they also you can't have this stuff hanging from your rear view because I mean per statue it it is illegal because it it's technically obstructed driver's view because you can't have anything that didn't come with the vehicle etc etc hanging from the rear view mirror on that nah you good man it's a minor petty little thing yeah I didn't know that I have to have diesel right yeah you can have like your fresheners and stuff yeah you just can't have like excessive bulky stuff hanging anything like um mind if I search your car is like asking mind if I dishonor and violate my Oath by making you insecure in your property as I rifle through your belongings okay so you said we can't search the car okay okay well here's the thing well my partner is behind you and prior to activating his lights and Sirens he observed heard of movements which is movements into certain areas so we're gonna check where those movements were and only where those movements were okay you step out of the vehicle please this ridiculously subjective furtive movement idea was conceived in the case Dewberry versus state in 2005. going hand in hand with Terry V Ohio Dewberry versus state says that quote furtive movements may be sufficient to establish reasonable suspicion that an individual has a weapon and thus justify a pat down search end quote not probable cause or objective articulable fact from the Fourth Amendment but reasonable suspicion from Terry V Ohio Dewberry also quotes Brown versus state which says quote furtive movements may give rise to to a reasonable suspicion that someone is armed and dangerous either way you look at it these two cases plus Terry V Ohio violates the Fourth Amendment and places officer safety and their subjective arbitrary edicts above individual rights step out of the vehicle please undo your seatbelt because we don't know if you're hiding weapons guns grenades anything man we're doing our job so we're just doing our job search please step out of the vehicle I didn't do nothing wrong though man please step out of the vehicle we observe furtive movements so we are just doing our job what is it foreign weapons trying to access a weapon did you hear what the cop said case law backs it up case law backs it up where we can search where that was we don't know if you're hiding weapons this is where the inherent hypocrisy of their oath of office is exposed they swear to uphold the Constitution and the laws of the state so since most state laws and court cases violate the constitution this is an impossible oath to keep it's either one or the other it can't be both come on I don't have and if there's nothing there there's nothing there man then you go on your way that's it as simple as that no no get out of the car no don't grab me now you're about to go to jail don't grab me man get out of the car don't do me like that man get out of the car I want to talk to somebody get out of the car get out and I don't see this [ __ ] man man come on man don't do it man [ __ ] [ __ ] [Applause] five seven Central car went 12 left we got act bad Elio that card signal four at the end of uh bro kill me bro nothing wrong man devil and Palmetto signal forward drive at gunpoint bro you did that bro go out cut out of the water now well you did that man all right okay crazy man no you did it to yourself you did that [ __ ] to me man get up no I want somebody here man you're trying to kill me bro yeah yeah you trying to kill me man no you're trying to kill me bro you gotta kill me bro hey everybody look at this [ __ ] everybody's looking at [ __ ] it's not resisting look at everybody [Applause] [Music] [Applause] and it's true according to the video evidence Carrie Jarvis did nothing wrong he was fleeing from a scene where badge thugs were trying to violate his consent and that's not just my opinion even though Jarvis was charged with two counts of aggravated battery on a law enforcement officer and aggravated fleeing and eluding and even though according to news reports officers also found heroin and knives in his car and even though Jarvis was also charged with trafficking and a controlled substance heroin and Fentanyl possession of THC oil resisting arrest with violence possession of drug paraphernalia and unlicensed caring of concealed weapons all the charges were unbelievably dropped when judge Sandra Upchurch saw the video she wrote quote the videos are the best evidence of what heard that day Mr Jarvis was unlawfully detained after his first denial of consent Upchurch wrote in a ruling quote had officers allowed Mr Jarvis to leave as he was entitled to no one would have gotten hurt the injuries resulted from the officer's own illegal activity end quote to which I say Amen but how many times does this happen every day in America cops initiate illegal activity onto members of the public and they get to walk away scot-free the state later dropped the charges but Jarvis had already spent 369 days behind bars without a bond Jarvis said quote it just disturbs me because if they do it to me they'll do it to someone else and this is true the Daytona Beach Police Department's internal investigation found officer McKenzie violated three departmental standard directives and was given a written record according to a department spokesperson officer Tucker was terminated for another incident not involving Carrie Jarvis Jarvis by the way is suing the department both officers individually and in their official capacity if I hear more on this I'll offer an update if you hear more leave a comment but I want to hear your thoughts in the comments section below do you think what the officers did was
