Do I seem like a danger to myself or others? Yeah, you actually do. Your posture. You're intimidating me. I'm trying to move around the sidewalk. That's against policy right there. What he Hey, I'm talking to you, sergeant. Look at what he's doing. I don't know what he's doing. Uh one of the other officers like flashes shut hit his flashlight up into the the cameraman's face and he couldn't see anything. They should definitely make that a memo like if you if some jerk with a camera shows up, they should just shine the flashlight at them, right? We do it all the time. You do? Oh, that's a good one. Welcome back to the Lackluster channel. Today's story is a double feature originally submitted by Cream City News. However, the video was filmed by Horizon City News Service on August 28th. Horizon City was documenting police activity in El Paso and approached the scene to get a better view. The sergeant on scene allowed him through. Hold on. Hold on. For now. For now. I just hold on. Hold on. Hold on. Hold on. Hold on. Let him go around. Unless he says stay away from the car. Stay away from the car? What car? Okay. This looks like a sidewalk to me. Okay, well, you also seem intoxicated, so just stay away from our scene and once they leave, you can do whatever you a danger to myself or others? Yeah, you actually do. You're a liar. Okay, well, stay away from my scene. I'm standing on public sidewalk. Okay, stay away from my scene. I'm standing on public sidewalk. Okay, you can stand there. You're doing good, man. You're a sergeant. You're [ __ ] lying, dude. Okay. So we need to get you old dinosaurs out. You guys are too used to lying. That's a public intoxication is for us for people who are dangerous to themselves or others, not just people you don't like. No. You've been drinking. I'm not denying that. What I'm saying is I'm not a danger to myself or others. That's what the legislature in Austin intended. forward when I asked you to stop. So, but you're doing good now. let you go ahead and do what you need to do. I'm on a public sidewalk where I'm allowed to move. Unless it's a crime scene, where it is. It's a crime scene. There's no crime scene tape, dude. You have You have no idea what's going on. So, just relax. You're doing fine. Do whatever you want to do, man. As long as you just stay start threatening me with crimes I haven't committed. you're doing. That's fine. Just stay away from my friends. I'm not. See, that's why we need to get you old dinosaurs out. You okay? Horizon City admits that he had consumed an alcoholic beverage. Texas Penal Code 49.02 covers public intoxication and states that a person commits an offense if the person appears in a public place while intoxicated to the degree that a person may endanger the person or another. Horizon City has not displayed any behavior that would lead the cops to think that he is a danger to himself or others. While he is filming, he moves around the scene, and the sergeant seems to shadow him, blocking him from recording. See how See what you're doing? You're posturing. You're intimidating me. I'm trying to move around the sidewalk. Can I just freely move without you intimidating me? go that way if you'd like. And I can come back, right? Sure. It's an open sidewalk. Absolutely. Okay. Okay. So, don't be, you know, doing your thing. Okay. I'm just doing what I do. You do what you I don't want you like trying to like move in on me. Okay. All right. All right. Okay. You're still doing it. Okay. Just walking with you, brother. See what That's what I'm talking about. You're trying to make something out of nothing. I'm not making anything out of anything. You're trying to start something. No. And here's See, hey, you're the supervisor. You got to stop him. That's It's against policy right there. What he's Hey, I'm talking to you, Sergeant. Look at what he's doing. I don't know what HE'S DOING. THAT FLASHLIGHT THING. THAT MAN RIGHT THERE IS TALK TO HIM. He just did that [ __ ] on purpose. I have no idea what you're talking about. You're a [ __ ] liar. Okay. That's the second time you just lied to me. Okay. What's your name, Sergeant? Sergeant Davis. And your badge? 2303. All right. Not that you'll remember. No, my camera will. Okay. When do you retire? Who knows, man? Who knows? Hopefully soon enough. Okay. Are we up? All right. We're out. Let's do it. Sir, enjoy the rest of your day. I'm sure that was laughing at me, not with me. Shadowing and shining the flashlight into a camera is a form of prior restraint or censorship in First Amendment law. It is a government action that prohibits speech and other civil rights. The actions of the sergeant and the officer with the flashlight seem to be an example of an attempt to censor Horizon City's right to free press. Cream City News saw the video and felt compelled to call the department and submit a compliment. Okay. He didn't answer, and he's the only one on duty today. Can I take your name and your phone number and I can have him call you back? Um that's okay. I I I I'll try to give him a call back. I just wanted to give him a compliment. There was a a stop that apparently some some idiot was was videotaping one of your gentlemen stops like last night or early this morning and and uh uh Sergeant Davis, you know, this this guy with the camera was just so annoying. He was like trying to look at everything that's going on, you know, like in public. And the sergeant the sergeant um like just kind of [ __ ] you know, like shadowed him where he couldn't get a good shot. It was great. And then uh one of the other officers like flashes shut his flashlight up into the the man's face and he couldn't see anything. Yeah. That was awesome. Oh, it was great. to call back again and call back maybe in 15 minutes or so? Yeah, I I will. It was so great. Do you get Do you guys um they should definitely make that a memo like if you if some jerk with a camera shows up, they should just shine the flashlight at them, am I right? We do it all the time. You do? Oh, that's a good one. Okay, uh It's hard when you're doing it on the day shift, but yeah. Oh, yeah, yeah. I suppose you can't use the flashlight to to shine a light in the camera in the daytime. Do what How do you How do you stop the camera during the daytime? It's hard. You just got to go with the flow sometimes. Oh, man. Boy, well, hey, you guys are true true heroes and um I don't think you guys should have to deal with members of the public that you're supposed to be helping showing up and just videotaping you. I mean, that's insane. Oh, yeah. Oh, yeah. And then they get upset when you tell them to put their phone away. If it's obstructing or if it's interfering with anything, then you can you have discretion to kind of remove it or tell them to turn it off or Oh, I got you. detain them or something like that for that. But if it's anything in reference anything other than that, yeah, you can't just take the phone away. Oh, shoot. I wish you guys could just walk up to them and just grab it just snatch that [ __ ] out of their hands, you know what I mean? Oh, me, too. I know. I know. I know. I know. Well, it was a good talking to you. You're a uh the not the receptionist, you're an officer? Yes. Oh, good. The desk officer. What What was your name? Was a fantastic conversation. Thank you. Officer Carroll, C A R O. Ooh, like almost like uh like Claro, like clear. But Carroll. Very very good. offensive. Yeah. Hey, let me ask you uh last question with these jerks with the cameras. Um like if they just start talking to you, can't you just say, "Hey, you're interfering." Um no, but you don't have to answer. You don't have to speak if it's anything that's not even in relation to what we're Got you. talking about or anything like that. We're just advised not to say anything cuz then it is Sometimes they just try to rile people's bones and then it gets you all Sure. and you say [ __ ] you shouldn't say and so forth and so on. So Yeah. Yeah, it's probably best just not to talk. But hey, boy, I wish you could just snatch that phone and and put them in handcuffs and and and and and give them some sort of ticket for Well, I was actually going to agree with that. Yeah, no. I No, most people don't agree with that. I don't think there should be I mean, you guys are doing a job. Why why why does the public need to see like what is going on with your personal you know business while you're in uniform. I I don't know. These people just have no lives. Oh, yeah. Oh, yeah, they don't. And when a crisis is going on, they quickly pull out their phones and to cover safety or take care of their children or anything like that. Yeah. So Yeah. Yeah, totally agree. Yeah. All right. Well, Officer Carl, thank you so much. We'll call back. Sergeant Davis, I loved it. He He You know what I mean? Like he kind of shadowed the like as the cameraman walked, he kind of walked so the cameraman couldn't get a good shot. It was great. Well, that's great. I'll make sure to let him know. Oh, yeah, it was great. And and and and even he's got his his his officers well trained because like as he was doing that, somebody that was like behind him like shined the flashlight up and he couldn't see anything in the camera. That that's a good crew you guys got going over there. That I like that crew. I like that crew. Well, thank you so much, sir. No problem. Have a good Have a great one. How about that? You too. Have a great Thanks. Bye-bye. Bye-bye. Whether it's lawful or legal for them to purposefully block someone's camera isn't the important conversation here. The most important part is that they simply don't care. Censorship of what you perceive to be your rights doesn't particularly matter to them and that is made obvious by the phone conversation we just heard. They have an understanding that they represent the ruling class and because of this they are protected. More and more we see substantial evidence that their oaths are nothing more than words memorized and blindly repeated to allow them to graduate. Let me know what you think of these interactions and be sure to head over to Horizon City news service and Cream City news and let them know that I sent you. Thanks for watching.
