police department check this out just a little bit of digging there's this guy named was sis uh with sissel versus city of utica order granting defendant's motion for summary judgment this is a civil rights action filed pursuant 42 usc 1983 plaintiff kenneth allen with sissel alleges that defendant city of utica and four city police officers violated his civil rights during an arrest on the evening of december 9 2002 20 years ago guys moribito so he's been on the force for a while now the force he's been on the police force government is not eloquence or reason it's force and like fire it's a dangerous servant a fearful master before the court uh his defendant's motion for summary judgment and we'll skip the background on december 9th 2002 at approximately 10 41 pm defendant utica city police officer gregory moribito observes plaintiff's vehicle across and over the center line while making a wide turn after further observing that the plaintiff's brake lights did not function when he stopped at the sign because that's a horrible horrible crime moribito affected a traffic stop in response to questioning plaintiff admitted to having just left the bar where he had consumed a couple beers within a few hours mistake don't don't talk to police if there was ever time to not talk to police that would be it right there a check of the plaintiff's records revealed an outstanding warrant for resisting and obstructing a police officer that that could literally mean anything and i'm not trying to give this guy to the benefit of the doubt and the officer is not the benefit of the doubt but this is one of those instances where you can see how moribito let the power go to his head to such an extent where he would actually abuse somebody because we have it on we have it on film moribito and foreign plaintiff of the outstanding warrant moribito observed signs of intoxication and asked the plaintiff to exit his vehicle to perform a field sobriety test at this point the party's exchange account diverges according to plane if the driver's side door of his vehicle was broken requiring him to roll the window up before he could open the door when he did not exit as fast as morabito and his partner officer david fazekis wanted the officers became incensed morribido yelled at plaintiff through the driver's side window to exit the vehicle while fakie fazetas the zikas fazekis went around to the passenger side opened the door and pointed his gun at the plaintiff's head all for brake light being out suspecting of intoxication doing what morabito thought he shouldn't be doing with moore beto screaming at him to exit the vehicle and physicists instructing him to freeze the plaintiff put his hands in the air and attempted to explain the problem with his his door unwilling to listen the officers pushed a plaintiff out of his vehicle and onto the ground where he was punched kicked and maced by moribito and his partner as well as by other officers who had just arrived plaintiff was then taken to the police station where he was hosed down with cold water ridiculed and called a racial slur wouldn't doubt any of that stuff didn't really happen i don't know but
