[Music] the other vehicle did you have you kissing nail coloring have you no I haven't come on this I heard this uh person yell at his window like driving by and he's like very just two or four now and I just checked on him now I just checked in on now welcome back to the lackluster channel on October 17th of 2022 Deputy Terence Willie of the McKinley County Sheriff's Office pulled over a vehicle for speeding after the deputy returned to his vehicle to write a warning a car drove by the traffic stop and someone appears to have yelled something out the window Deputy Willie rushes back to the driver he had detained returns his license and rushes back to his Cruiser to chase down the man who exercised his First Amendment right to free speech and redressing his grievances with his government [Music] now driving well above the posted speed limit the Deputy weaves in and out of traffic without emergency tones or lights eventually he catches up with the suspected driver and camera two right here okay my name is okay what is it okay so you're young going [Music] yeah you just smile huh yeah I'm smiling at this point the officer has no valid reason to have pulled back in the accountability over as many courts have found that yelling in a car does not justify a community caretaker or emergency stop furthermore the officer claims that it was to conduct a welfare check but later admits that he had heard the exact phrase that was yelled McKinley didn't scream incoherently or ask for help he said [ __ ] cop any reasonable man would understand that the phrase was used while exercising his first amendment right of free speech and redress and it just so happens that hurt feelings are not reasonable suspicion the seizure of McKinley countability was made in retaliation for speech the officer didn't like which is the exact speech the first amendment is supposed to protect and now only after the unlawful stop and the Detention of his person papers and effects the officer runs McKinley's information and reveals that the vehicle's registration is expired okay I mean your registration because it's suspended okay you're not impaired that's my suspicion right now is because they're not impaired okay and that's why I'm checking on you because you're possibly appeared okay despite contradicting statements and claiming that the welfare check is because McKinley may be or is not impaired he never attempts to conduct field sobriety tests or asks any questions to dispel or confirm his quote suspicions instead Deputy Willy calls for a supervisor and writes a citation for the expired registration all the while McKinley accountability salutes the deputy who then tells the man that he is also receiving a citation for obstruction citation so I'll wait for him to come over okay so I'm gonna charge you for uh yes sir because of what you're doing sorry because of what you're doing because I'm talking to you okay no you you could be verbally telling me something you're not confined with it okay that's fine okay that's fine oh my God okay that's fine go to look at it where are you coming from don't worry about it okay then the deputy now speaks on the phone with his supervisor so I was doing a traffic stop and then uh the 26 on 118. and then I heard this this I heard this uh person yell at his window like driving by and he's like very just two or four now I just checked on him now I just checked in on now and just to make sure he wasn't intoxicated he got all mad cussing me out now all right he wanted to talk to you and he was like uh um I mean you wouldn't let me talk so I said okay I'll talk to him I'll call my supervisor for you yeah so he was yelling he was yelling at me when I was driving the car and I was like what the hell I said I went back and I I looked at him let's go check on him and then that's what he said to me here before but now he's saying like I'm gonna see you and all this stuff saying I know my rights and all this and well I wrote my Citation for a suspended to uh insurance but he's not giving me his driver's license either so so that I mean just with that being disorderly and me checking on him and for his uh yelling out the window and meeting us early right now he's flipping me off and he's like waving at people in the middle of the road so he's yelling illegal to take okay okay so he's right here he's coming not too far about three minutes later Sergeant Lee arrives on scene my own business um he drove by the old [ __ ] cop and with that being said you know I checked on him because he was if he was possibly impaired and that's why I stopped him um and his insurance is pretty sure she was suspending the most ironic part about this entire video is that during this interaction a woman screams at the officers from her car but neither of the officers jump into action and chase her down either for suspected DUI or to rescue the Damsel in Distress he came out asking him violate his rights and what else do you say okay you know his name clay come back to him uh someone uh someone else in the CCO one okay so I mean my welfare trick was just to be on him to see if he was intoxicated or not but instead of volunteers right now he was talking before he was talking about his stuff [Applause] how you doing I'll talk to you over here if that's okay with you yeah okay sure I got one right here too I got one right here I'm just telling you okay so what's the problem okay so what's the problem why are you out here causing a scene so to make a traffic stop you don't need probable cause you need Reasonable Suspicion okay okay listen to me listen to me listen to me listen to me okay you're screaming out the window okay that could be a number of things that could be a domestic it could be uh it could be okay it is but what a reasonable person believe that there's something going on in there in the car passing by is that a normal thing to do driving by in traffic okay that's not normal to me okay and he's saying that you're into your registration's expired for it okay where's your driver's license upon request McKinley now provides his license to officer Willie you're just making a fool out of yourself standing there with your finger out protest what are you protesting lying cops we should protest expired registration yeah that'd be a great idea well he's gonna write you a ticket if you want to make a complaint you can go to the Sheriff's office and do it great sounds good officer Willie now pleads his case for obstruction to his sergeant okay the officer's idea is that McKinley was obstructing by not providing his license at the beginning of the stop when the only reason for the detention was free speech however after it was pointed out that the registration had expired McKinley provided the requested documents even though the traffic stop was still unlawful sorry to come over sir there's information back uh do you take these uh documented MasterCard honor before the 17th yeah again dismissed for you I'm going to sign there so get them show them there put us on there all right cool thanks take care McKinley was issued two citations one for insurance and one for registration he has since provided the documents to the court and has pleaded not guilty his next court date is January of 2023 and when that's over he plans on taking civil action against the deputy and the department I've been working on this encounter for quite some time coordinating with James Freeman he along with multiple other channels are arriving in
