How do you want me to enter this building? >> I want you to go over there. >> Yeah. What else do you want me to do? Handstands, back flips. Out of here. I'm going the building. >> THEN MARK IT OFF. Can they trespass? Then I'm going to >> have fun. After Captain Keep Off the Grass was satisfied with the amount of threats he had made towards Josh, the captain directed him onto the driveway to access the front entrance. Eventually, a security guard met AFA at the door of the building. >> Nor shall any state deprive any person of >> I'm looking to get a records request form. I don't know if you guys have um a formal request form. Not looking to be here for a long time. and I'm just looking to fill out a records request form, hand it into an agent in the building, whether that's you or this this DHS police officer, and then I'm on my way. I'm just trying to fill out a records request. >> So, from what I understand is you have to request that online. >> Yeah. So, the problem is you guys are overloaded. As you can see, when you check out your records request system, it's refusing people. I think because of all the protests and everything that records is getting kicked. All I need is a piece of paper, a pen. I can submit my request and I can be on the way. You guys can get back to me in nine days. I'm not looking not looking for smoke. I just want to give a record. >> Go check to see if they have something that you can do. >> Even just a blank piece of paper and they can get back to me and then I'll be on my way. I'm just trying to do a request. Thanks, man. >> Captain security envelope now passes by to enter the facility. >> They took care of me, man. I'm all set. >> There's no need to be that unreasonable, man. Screaming in people's face. issue, but upon probable cause by oath or affirmation. >> Just waiting on them to get me a records request and I'll be out of here. There's some captain screaming at me. I'm not part of the protest. I'm not with them. I'm just coming to get a records request. I don't know what the problem is. >> After waiting a few minutes, a federal protective services officer approaches Josh. Ironically, in the background, the protesters read the First Amendment as the officer tells Josh he can enter but cannot record. >> Free exercise thereof or abridging the freedom of speech or of the press or the right of >> Hey, man. >> Not too bad. How are you? >> You got to come into the building >> and you got to talk to an agent, but you can't record. >> Josh explains that he is live streaming and cannot shut off the recording. So the officer tells him he can enter with his gear as long as it is aimed towards the side of the office. >> You can bring your stuff in, but you just that can be turned on while you're talking. >> So it's on. It's live. So what I'll just do is like I'll put it in a corner and >> we'll leave it off to the side. >> You're allowed to come in. >> I don't even need to go in. I just want a record form. Like I'll even stand in the lobby. No problem. >> What I'm saying is the agent's already waiting >> cuz he's behind the window. So we already talked to him. So he's >> Yeah. I'm not going to go into a facility that I'm not aware of without my recording device with me. I'm just trying to get a records request, man. So, if I can do that, great. If you could provide me a piece of paper, I'm not trying to be a hassle for you guys. >> I know. And >> I just want to get the form so I can so I can pass. >> I don't work for ICE. >> I work for photo protector service. But again, >> you're FPS. >> Yeah, >> so I talked to the agent and he's like, "You're more than what we can do exactly what you said. You >> go in. It's literally right over here to the left. >> Okay. if if he feels comfortable with me just bringing in my camera so I can document my records request and that's fine. If not, if you guys keep me give me a piece of paper, I'm trying to be I'm trying to be reasonable. I just I don't want to cause a problem. I'm not screaming at you guys, >> which which I 100% respect and I appreciate. So, we'll do this instead of having the phone like that while you're up there. Just put it in your pocket. You can still have it recording and then you can carry on. >> Okay. All right. No problem. >> Yeah. >> So, you can still have it documented. >> You know what I mean? >> I'm going to take it off this Um, you guys feel comfortable with me carrying this? You guys know? >> Thanks, bud. Appreciate it. >> So, just keep the stuff here. >> Nothing else in your pocket? >> Native. Is the watch going to pop? >> Uh, don't worry about the watch. >> That's it. After passing through security, Josh is brought to a window where he is greeted by George Capsolus of DHS. >> Hi. >> Hey, how are you? >> I'm good. >> I'm looking to do a records request. Um, simple records request for how many people are on staff here out of this field office. >> Okay. Josh explains that the online form for records is malfunctioning, which caused him to appear in person to submit the request. The employee acknowledges that the online system is broken, but then immediately directs Josh back to the broken system. >> So online, when you attempt to file and then um admit the records request, it's saying that it can't be done at this time. There's like a circle going, "Can't be done at this time. Please try again later." I've been doing that for hours. simply protected by the Freedom of Information Act. I can fill out something in person and give it to you. No, >> but we don't do that here. >> We don't do that here. So, it has to be online. Unfortunately, I understand that it's kind of circling around and kicking you out, but uh that's how we do the foyer request process. >> But you are a public installation. So, according to foyer law section 2B, I'm allowed to turn it into any public facing office. We're just here now. I understand accepting your referral request here. You have to do it all. >> You You're more than welcome to refuse it. So, I'm going to give you a verbal request that I would just like the names and salaries of all the agents. >> So, on video, you're denying my request. Fair enough. >> George Cops Solless notices the camera aimed at the lobby's wall and immediately flips out. >> That's a video of this. >> Yes, I am. Don't touch my camera. Don't let go, sir. >> Okay. I told you you don't Am I detained? >> Am I detained? Am I detained? Give me my [ __ ] back. Am I detained? Give me my phone. Am I detained? Sit down. I'm not detained. Am I detained? Am I detained? You're detained. Officer, am I detained? For what reason? Give me my phone back. You can't film anything. >> He gave me permission to film in here. I'm not I'm not detained. I'm not sitting. >> Am I free to go? No. >> What crime do you suspect me? >> What crime do you suspect me? >> I'll talk to this gentleman. So, did you turn the camera on when you came in here? >> I notified him of my activity. This is assault. >> No, it's not. >> I'm good, man. He's Don't Don't touch, sir. He's trying to touch my phone, sir. He's touching my phone. >> Hold on. Calm down. >> He's trying to delete my >> He took my property. I'm not detained. >> The live stream is then stopped by the agent that took the phone from Josh's hands. Shortly after the footage ends, AFA negotiates his release and obtains his property back from the government agents. He was asked not to show the man who came out from behind the window and pretended to assist him. and without being able to file the request that he appeared to submit in the first place. Josh was then forced to leave the facility. After exiting the doors, he turned his camera back on, filming a quick shot of the man's face to document who had denied him his right to a public service and refused to do his tax-funded job, unlawfully seized his property, and ended his live stream without consent or warrant and attempted to physically restrain him and force him to sit. >> That's your face. After the incident, AFA spoke with the deputy chief at the Burlington Police regarding his concerns with Captain Noame he first met at the parking lot entrance. The chief apologized for the confusion and his captain's behavior. Josh and his attorney are currently reviewing options on how to move forward after this incident, but for the most up-to-date information, be sure to visit Josh at Accountability for All.
