welcome back to the channel guys today
we are back in zumkot in michigan with a
sovereign citizen who has a slew of
charges ranging from possession of a
controlled substance to driving on a
suspended license
and he tries the old soft seat defense
the judge however is not having any of
it and doesn't allow him to continue
with arguments he has already ruled on
which really stumps him
right let's get into the video
all right we are on the record then in
the matter of the people of the state of
michigan versus robert joseph matson
file number 21-20513-fh
uh today's the date set for the ninth in
this map we are proceeding today
uh by video conference
uh first let me ask the attorneys to
place their appearances on the record
beginning with ms mir for the people

james daley on behalf of the defendant
all right
we do never ask for an attorney i said i
would be representing myself an
appropriate persona
um this is one way to railroad me that's
all give me in your jurisdiction
all right uh mr daley um
maybe you or or ms mir maybe you can
fill me in on the status of the yes your
honor i did i remember now we did have
an exam in this matter and mr matson did
represent himself at the preliminary
exam
and then mr matson then once it was
bound over did fail to appear here in
circuit court so now that he is
incarcerated whereas before he was not
um i guess if we just go through whether
or not he wants an attorney or still
wants to represent himself since we have
had an exam
in this matter um you know once he makes
his
intentions known on the record then we
can proceed with him still being proper
but i would like to go through and know
make sure he is knowingly making that
decision
yeah mr matson just let me sort this out
um a little bit mr daley
um
have you been appointed to stand by or
what exactly is your status i was
appointed to stand by your honor mr
manson and i would get along fine he's a
pleasant individual to talk to
but he wants absolutely no
none of my legal input
uh
basically he has a theory
that i don't believe is justified under
the laws of the state of michigan okay i
have indicated that too
all right
well he wants none of your legal input
now but let's see how he fares after
going toe to toe with this judge
all right uh we are uh back on the
record then in the matter of people
versus robert matson
uh sir you are robert joseph matson
correct
i am an attorney for
the all cap's name robert joseph madsen
i am living flesh and blood human
upper and lower case robert hyphen
joseph
cohen space madison
that is
my name
all right
as shown on my birth certificate
live birth
that would be me
has understood
that the
government has taken
that name and made allcat's name
and tried to be uh
to claim an account over that name which
to do business with
i am cringing for this guy right now you
know just because you've read something
online or wherever you heard this
nonsense that says all this crap about
the lcap's name doesn't make it true and
it's definitely not something you should
be blurting out in court because it
makes you look really dumb
all right sir do you understand that you
have a right to be represented by an
attorney in this matter
i do understand that
you also understand that uh
if you want an attorney and you can't
afford one that you can tell me that and
i would appoint one for you at public
expense

by me answering and speaking to you at
this time doesn't mean that i'm in any
way
being
giving any kind of
authority over my body to you at this

i will note sir your objection to
uh
my jurisdiction for you
uh and i will preserve that for the
record
um
as
your honor didn't as well disgusted
their hearing on monday i i
it is my position that this board does
have jurisdiction over you and i am
going to proceed as such
and sir again your objection is
preserved for the record and if you
would like to file an appeal if that
becomes uh necessary at a later date
you'll have the ability to do that
actually i think i can do something a
little quicker
i like to
exercise my rights to subrogation have
the prosecutor um
file
my right to segregation
or certify my right to segregation
at this time
it's an undeniable right segregation is
the removal of a third party
it's in
the laws black laws dictionary sixth
edition also the booth
um
dictionary second edition
that the removal of third party
would be the prosecutor in this case
i bet you would like to have the
prosecutor removed from the case
but unfortunately that's not how this
works because subrogation is a civil law
concept and is something an insurance
company might do to recover debt
even harvey denson from a few years back
was kicking around this idea until we
informed him of how dumb it would be to
use it in a criminal case
all right uh i'll note that request for
the record and find that there is
no right to subrogation in a criminal
matter and so i'm going to deny that
request
again your objection will be noted for
the record and if you
feel you need to appeal that decision at
a later date you will have the ability
to do that
um

please let me speak
do you understand as i asked earlier
that um
if you can't afford an attorney and you
want one that the court would appoint
one for you at public expense
do not want one
tells you
okay
then it's going to be a long hard slog
for you i can promise you that i'm not a
lawyer but i know there's a ton of work
involved in even the smallest of cases
it's not a matter of just turning up to
court on the day and spouting
pseudo-legal nonsense
i
am
not
a us citizen i am sovereign
separated myself from u.s government
we've covered that objection mr matson
and i've ruled on it again it's
preserved for the record and you can
appeal it to the michigan court of
appeals
um if you would like to do that
well definitely it's fraud american
jewish prudence guaranteed fraud
i studied it up and down i know it all
too well
so it will
go to the supreme court i promise you
okay
wow so without any knowledge of even the
basics of law you're going to take this
all the way to the supreme court
how many times have we heard this from
us offset only to watch them crash and
burn in spectacular fashion at the first
hurdle
as of right now
for the record
unless the record reflects any
objections or denials that you keep
denying me
that i'm asking you to file a 1090 or an
oid 1099
for the prosecutor because the
prosecutors using my name to do business
and i will
i will prepare the 1096 and the 1099a
so this court proceeding is going to go
on and have
a jury trial is going to be sovereign
people
secure party creditors at my status
and also
you're going to be filing that oid 1099
for a prosecutor
wait so you want sovereign citizens as
jurors in your case
you do know you don't get to pick your
own jury right
surely you're not that dumb that's like
the mafia sitting in on the jury of one
of their own that's just stupid
all right sir you understand that you've
been charged with possession of a
controlled substance in this case and
that the maximum penalties
mr sir i'm going to ask you to let me
finish when i'm speaking i've i've done
the same for you and i'd ask you to do
the same
in your honor yes sir you understand
that you've been charged in this case
with possession of a controlled
substance cocaine heroin or another
narcotic is less than 25 grams
the maximum penalty for that offense is
up to four years in prison
i do not understand the nature and the
cause of the crime
yeah you definitely need a lawyer but at
the same time you are too dumb to
realize it
all right i'm advising you at this point
that you have been charged with
possession of a controlled substance
cocaine heroin or another narcotic of
less than 25 grams
and that the maximum penalty for that
offense is up to four years in prison
i'm also advising you that you've been
charged with operating on a suspended
license
uh
a license has been suspended revoked or
denied
that there is a uh second offense notice
with that and
therefore
uh the maximum penalty for that offense
is up to one year in jail and or one
thousand dollar fine i'm also advising
you that you have been charged in this
case with
uh alcohol open container in a vehicle
and the maximum penalty for that offense
is up to
90 days in jail
this also carries a habitual offender
second offense notice
which increases the potential penalty to
one and a half times the maximum
sentence
on the primary offense
uh as i've indicated you do have the
opportunity to consult with a lawyer if
you wanted one and if you can't afford
one i would appoint one for you at
public expense
yeah i think we all know what he means
by studying the law he's been on a
sovereign citizen website and bought one
of those expensive packages and from the
verbiage it's most likely from mark
stevens i could be wrong but that's who
it sounds like to me
uh
mr manson
or sir i uh
i believe you've referenced this already
but do you have any training in the law
yes i knew
uh
would you tell me just a little bit what
that training is
common law
okay and have you studied that yourself
yes i have along with a couple other
people
will it be fine when she chews you up
and spits you out though
i'm not really a betting man but i don't
fancy your chances here
okay you understand that the law in this
case consists of criminal statutes that
you're alleged to violate the michigan
court rules of criminal procedure
michigan court rules on evidence
and any number of decisions from the
michigan supreme court and court of
appeals within which interpret those
statutes and rules
i understand that the michigan supreme
court offers two different types of
courts
common law court
and a tribunal military maritime court
which
this court is operating under and
they're not operating properly
you don't have a clue what the judge is
talking about do you
because if you did you wouldn't be
repeating the same old debunked
sovereign nonsense
with me at this time
right you understand that the prosecutor
sorry go ahead
you understand that the prosecutor
that's going to try this case
uh has been to law school has had
significant education and the number of
years of experience and training in the
law
and that's perfectly fine
this is getting really painful to watch
all right do you understand that if you
do represent yourself you're going to be
required to follow the michigan court
rules and the rules of evidence
um
i'm going to be operating under
common law
laws
which
that's what i should be under as common
law this is not a common law of court
i don't belong here
all right you understand that i i
i know you've made that objection and
then made it several times
but i'm going to conduct a trial on this
matter that's going to require you to
follow the michigan court rules and the
michigan rules of evidence
do you understand that
yes sir
oh that sounds like his confidence is
going he has got to be thinking how
daunting this all sounds by now
you understand those rules are going to
determine whether you can do things like
ask certain questions of witnesses admit
documents photographs or any other
evidence that you might have
yes sir
you understand that you're going to be
responsible for the jury selection
process and that's also governed by
court rules which determine when you can
appropriately challenge a witness
yes sir
uh do you understand that in order to
become uh a licensed attorney to
practice in michigan it typically
requires at least three years of law
school and passing a bar exam to ex to
show that you have a sufficient
knowledge to work as an attorney
not a part of the state of the michigan
i am i am of
the republic of michigan michigan our
michigan republic
okay do you understand that in order if
you wanted to have a license to practice
law in michigan you would need to go to
law school
and
uh pass the bar exam
no incorrect
who needs to waste three plus years on
law school when you can just pay a guru
500 to download a shady pdf from a dodgy
sovereign citizen website
that makes so much sense
okay you understand that most that the
attorney's handling this your case the
prosecutor is going to have
uh
a licensed practice law in michigan that
meets the requirements that i've already
indicated to you
which
which makes
any
judge
or
prosecutor or attorney a part of great
britain foreigners
only operating under the
sovereign foreign sovereign unity
which actually i have myself
in
trump's over all years
all right
again i appreciate your objection to
uh this court's jurisdiction and i've
ruled on that and
um again
i'm not
not going to change the ruling
um you can appeal that to the court of
appeals in the supreme court if you wish
at the appropriate time
do you understand that at least at least
in my opinion i think you're going to be
at a significant disadvantage in this
case if you attempt to represent
yourself
uh without
there's no there's no fair trial in this
military maritime courts
can add sovereign citizen defense to
that list of disadvantages as well
because
not once offset has ever won a case on
the merits of their arguments not one
there's nothing fair about it
i mean you've already made your
determination the other day that i was
uh not guilty
last time i seen you in court
let the record reflect that i mean you
sit there
certainly and not guilty sir as
as i indicated to you uh at that hearing
i entered a not guilty plea for you that
is not my determination that you are not
guilty of what's been done
your honor it's not your job
to enter our please my or my attorneys
which this case is be mine
so the court has already made a
determination that i am not guilty
well you said it yourself it's your job
to enter a plea you obviously didn't do
that so the judge had to enter that not
guilty plea for you it's not a judgment
it's a plea
all right sir are you sure that you want
to represent yourself knowing uh all of
the disadvantages or at least what i
believe to be the disadvantages that you
face
yes and uh is that decision absolute and
unequivocal
absolute and unequivocal
you have any hesitation about this
my peers will be secure party creditors
you mean sovereign citizens like
yourself i'm sorry but that's not how
this works you don't get to pick your
own jury that's just dumb
you have any hesitation about the fact
that you want to represent yourself
no
no matter what you do to me
i will get out of it and there will be
lawsuits
at this point i'm going to determine
that
mr matson has made an unequivocal
request to represent himself
uh
the right has been asserted knowingly
and voluntarily
after discussion advising him
of the
disadvantages of self-representation
mr daley
uh and at this point i will i will uh
mr david be willing to come over talk to
me here after you're getting done with
this
video screen
all right conference
yeah i will appoint mr daley as a
standby counsel and sir you're asking
okay yeah can i speak with him about a
couple of things
i i can put you
i can put you in a breakout session so
that you can speak to him over video
conference privately
okay
so do you want a lawyer or not make up
your mind
all right uh mr madsen should be back
from the breakout session uh shortly
your i'm going to be going over and
talking to mr matson i still think
after my discussion with him there may
be some
ways to work this out
okay
let's hope he sees sense don't hold your
breath though
he should be back from the breakout
session
in
all right we do have uh
matson back from the breakout session
with mr daley at this point
um
mr daley you had indicated to me off the
record that you were going to have an
in-person meeting with mr matson at this
point is that correct
i will i can't get that done come monday
but i've already indicated to him i'll
do it on monday
okay and and sir is that something that
you want to do is have an in-person
meeting with mr daley
yeah i want to see if there's um
something that we can
work out here just to
save time and hassle and
a lot of grief between those
okay
well the hassle and grief will only stop
if you see sense and drop this
ridiculous sovereign citizen defense and
get yourself a real lawyer
i really would
would like to speak to mr david one last
time before
all right
okay so this is uh
an arraignment um
i i presume mr madsen that you'd like to
enter a not guilty plea
uh
until you've had an opportunity to speak
with mr daley is that correct
yeah i'm not entering anybody until i
speak with mr daily and
overseas with
prosecutor
uh based on that i'm going to find that
um mr manson stood mute to the charge
and he'll enter a not guilty plea on his
behalf
and uh i'll set this then for a
pre-trial
judge
you cannot enter that's working from the
bench you cannot enter not get guilty
on my behalf either me or my attorney
has to do that
he had his court again made a
determination that i'm not guilty right
as i've explained previously it's not a
determination that you're not guilty it
is an entry of a plea based upon you're
not entering a plea at the arraignment
the judge is obligated to protect your
rights in court he does this by entering
a not guilty plea the argument that he
is making a determination that you are
not guilty is just laughable it is to
protect your rights
i will
uh set a pre-trial for december 1st at 8
00 a.m
and that will give time for mr daly to
have an in-person meeting with you at
the jail
okay speak with mr daley
here again in private
i'll just go over to the jail and see
him on monday judge
okay he's going to come over to the jail
and see you in person on monday
uh so you can tell the officer that's
with you that you're done import for
today
okay um how about
next
time my bond
pierre bond next time i go to court
all right
with respect to the bond right now i'm
going to leave it as it's currently set
based on
prior failure to appear
i did appear you were you wasn't there
i went to the clerk's office
then i
went on
the television screen for anna marie's
court
and kept clicking me off for about 45
minutes
and after that i gave up
i did appear
i think it's a due process thing
well that just sounds like a cop out to
me
but you said it yourself you gave up and
if you're attempting the sovereign
citizen defense you've given up entirely
in my opinion either way it looks like
the judge isn't having any of your bs
next hearing should be interesting
