welcome back to the lackluster Channel you may have seen a small clip of this video before but it's likely you haven't heard the whole story according to a lawsuit Jeremiah Nisbet was attempting to enter a Pace Bus in Harvey Illinois a security guard he had contact with before pushed Jeremiah to force him off the bus and keep him from entering Edward andritis continued to put hands on Jeremiah who then struck the guard in self-defense the guard reached for his weapon and Jeremiah ran away as the police were called to respond with nothing more than an allegation of battery and no reason to believe that Jeremiah was armed violent or potentially dangerous the three Harvey police officers who first arrived at the scene placed Jeremiah face down in the street and knelt on his legs and neck pinning him to the ground [Applause] possible the officers stood Jeremiah up and began to walk him to the Harvey police department vehicle when the security guard now standing near the officers and the police vehicle struck Jeremiah in the face with a closed fist while he was handcuffed say that again brother oh the Harvey police department arrested the security guard who was subsequently charged with misdemeanor battery as well as two counts of aggravated unlawful use of a weapon a felony under Illinois law for knowingly carrying a handgun without being issued a currently valid firearm owner's identification card at the time of the offense and for knowingly carrying a handgun while engaged in the commission or attempted Commission of a misdemeanor involving the use or threat of violence against a person or property of another Jeremiah filed a lawsuit against the city of Harvey the security company the Pace bus service two of the officers that pinned him to the ground for Fourth Amendment violations and the security guard Edward andritis for assault and battery the lawsuit goes on to allege that the Harvey police officers were trained regularly to employ neck restraints and chokeholds as defined under Illinois Law pointing to an order from the Harvey mayor in 2020 for officers to refrain from police restraint tactics including chokeholds strangleholds lateral vascular neck restraints carotid restraints chest compressions or other tactics that restrict oxygen or blood flow to the head unless an officer feels their life is in imminent danger it goes on to claim that the Harvey police did not properly train its officers to avoid the use of tactics or how to properly observe and attend to the medical needs of arrestees despite the fact that kneeling on someone's neck constitutes deadly force however after this incident the Harvey police chief Robert Collins stated that the officer who knelt on Jeremiah's neck during his arrest did not violate Harvey police department policy but the officer who handled that situation did exactly what he was supposed to do Pace Bus Service eventually filed a motion to dismiss which was granted the security guard however is not protected by qualified immunity and asked for a quarter-pointed lawyer to represent him in defense of the civil suit it appears he has finally found representation but may be the only defendant that would not pay a judgment with X dollars the case has currently moved to discovery which is due in April it also appears that the parties intend to meet with a Magistrate Judge to discuss settlement options so be sure to subscribe as I will post new information on my Community page when this case is finally over in the end it was nice to see an officer arrest another uniform after observing an obvious Injustice let me know what you think should officers be allowed to kneel on the back of a person's neck absent the immediate threat of serious bodily injury or death thanks for watching if you have a video use the submit Link in the description or pinned comment if you enjoyed this one subscribe and hit the bell for future content and check out our other channels lady lackluster and the odd side remember to like share and leave a comment about what you think of this interaction it's the easiest way for you to help expose corruption and misconduct merchandise is available using the links below join the lackluster family for just a buck if you'd like to further support the channel get a Lac logo next to your name custom emotes and early access to videos I look forward to seeing you in the next one all links are down below foreign
