constable luco of the rcmp in chestermere to provide a sample for a mandatory alcohol screening on september 6 how you doing 2020. why am i being pulled over uh this is a mandatory alcohol screening okay okay so you follow me to give me an alcohol screening yeah i'm pulling you over to give a mandatory i'll call screening have you ever had that done before why are you profiling me i'm not profiling you yeah you are why why are you following me okay so by law you need to provide me a sample okay bye bye don't tell me by law man i didn't do anything wrong you can't you just randomly pull i have no reason to okay hey guys as of december 18 2018 mandatory alcohol screenings became law in canada they allow police officers to demand a breath test from a driver in the absence of having reasonable suspicion that a driver has alcohol in their body however the law also states that anyone operating a motor vehicle who is lawfully stopped by police can be required to provide a breath sample the key words here are lawfully stopped and at this point and throughout the video the officer never claims to have probable cause to lawfully stop dwight's vehicle so why are you refusing to give a sample because what that's not it's my rights though why do i have to give you a sample of what you can it's called the mandatory alcohol screening it's to check that you don't have any alcohol in your system if you don't if you give me a sample and you pass you're fine you're good to go on your way but why why you just profile me you just can pull me over for no reason like you're supposed to be policing the neighborhood yeah i pulled you over to make sure you're not impaired was i driving was i swerving did you see me swerve once did you see me swerve once did you what gave you the reason what gave you reasonable suspicion that i was that i was driving i don't drunk it's called a mandatory i'll call you so just because you can and you know this is the problem with police just before okay well you ran my tags you followed me with your lights right in my [ __ ] mirrors okay well if you can blast in your mirrors right in my lights so i can't see so i pulled into the gas station see what maybe he'll pass no you follow me in there wait for me to leave and then come up behind me and now you're telling me now you want to give me a thing no i want to give you a mandatory alcohol screening i want you to get a sample okay my eyes ain't red i'm not slurring my words i don't feel like i need to do that you do you need to do it it's law okay if it's the law then take me to jail i'm agreeing to go to jail i haven't done anything wrong i'm not giving you an alcohol test for something for no reason it's interesting that the officer hasn't arrested dwight at this point he is either the most patient officer in the world or he is unsure of the legality of pulling someone over for a mandatory alcohol screening only it is likely that this is the officer's first experience with someone refusing the test either way the united states fought a revolution for much less than this in the u.s the supreme court has ruled that an officer can run a dog around the perimeter of your vehicle without reasonable suspicion as long as it does not prolong the duration of a legal traffic stop many including myself debate even that ruling as an egregious violation of the fourth amendment this situation takes unreasonable searches and seizures to a whole new level and it is terrifying that a law enforcement officer believes so little in personal liberty that he thinks he can and should be able to stop any random vehicle to obtain a breath sample in the absence of a traffic infraction or other probable cause i understand that canada is different and is losing their freedoms much quicker than the us but i predict that this is a glance at what we have in store for us in our country i'm not making it difficult you're you're supposed to be de-escalating situations by following me around is escalating a situation you're looking for trouble that's not how officers are supposed to act you're not acting you're acting like you're the big boss man so you know how how ras how civilians are supposed to act is this how they're supposed to act you're profiling me this happens every day with you guys every day i don't even know you i've never seen you in my life every day this happens with you guys i've never seen you in my life have you ever seen me before not specifically you i can't see you how am i profiling you and i've never even said you see the car in the rims and then you want to pull me over the car and rims me nothing to me tell that to all the other police that play in the morning you're driving around i'm giving you so is that is that is that illegal to drive around at three in the morning not but i'm asking you to give a sample okay but is that illegal i'm asking you a question is it illegal to drive around for me in the morning it is illegal to drive around with alcohol yeah so i just want to clear i absolutely agree with that it is absolutely illegal to drive around with alcohol okay i'll be right back a short period of time for profiling me and i'm not having it okay so all all the uh my partner here asked for is drive license registration insurance well i gave him max get him out of that mass he won't give me up sample he's refusing to give a sample i don't feel like he won't give me his idea okay okay have i done have i committed a crime in any way okay buddy i'm asking you have i committed a crime right now okay anything you say can be used as evidence do you understand this you're right you're reading me my rates well just like talking to me like you're talking about court and going so this is not a casual you understand refusing to provide a simple what is it what's the equivalence of that yeah you guys arrest me put me in jail and then i go to court and have 30 days to no we don't put you in jail can okay okay so when an officer pulls you over and then tells you this is a mandatory alcohol screening and then you refuse then he goes and read you the sd yeah so the sd when you read the chart on the sd it will tell you that if you refuse to provide a simple it's basically this similar to driving while impaired but i'm not the officer is half correct and just to reiterate directly from the rcmp website anyone operating a motor vehicle who is lawfully stopped by police can be required to provide a breath sample and again at this point there is still no lawful reason for the stop and any lawyer would easily be able to fight a charge stemming from this incident so if you're not give him a simple and then they're on your way so you guys can just violate me like that it's not a violation it's costing me from going on my way to where i'm going by following me putting your light straight in my ra right in my in my lights being an [ __ ] before you even pulled me over and now you're telling me that i have to do this or i get to go to jail brother i'm i didn't pull you over i'm trying to explain to you how the process okay but i'm just i am not i haven't why do you pull people over for this reason i i explain to you it's a mass it's it's a mandatory office meaning that's why i pulled you off i am not the one that came up with the law for mandatory alcohol screening demand i'm not the one that came with the alcohol device screening device when we suspect suspect that's the driver is impaired i'm not i'm enforcing those laws okay do you understand brother okay no i'm understand what i'm trying to explain is basically there's i was i was profiled and now i have to provide a profile like how how are you profiled because i have a hoodie on and this guy's and i have a car and this guy's being a dick with his lights in my in my rear view hoping that i make a mistake i didn't make a mistake so then he follows me to a parking lot and then waits till i leave and then pulls me over over here where there's no cameras god knows what he was thinking that he wants to do okay i know that you guys like to shoot people he seems like he's never shot anybody in my life okay well i haven't done anything wrong so why am i being pulled over you guys make me look like a criminal and people drive by and see me and this car always being pulled over when i haven't done anything okay so give me your test so i can be on my way please okay so you'll give me a sample okay do you want him to give you a sample or you want me to do it i would like you to do it it's up to you so you had nothing to drink in the past two hours no i had probably like what eight beers today how long ago uh i was drinking them all day i was cooking and drinking them okay but you look to me like your your eyes well they didn't have alcohol in them okay it was not alcohol but how long ago you had your last uh your last drink was non-alcoholic beer how long ago was it's not alcohol not alcohol okay so so it's gonna give me a zero dip absolutely okay all right brother so i just have to read you what we uh instructed here to read to people so this is a mandatory alcohol screening you're required to immediately provide the bread sample do you understand you got it yeah so it's very simple brother you take a deep breath you put a tight seal around the corner and you just blow until i say stop it's just like this is how the white cops act they profile you out here i'm not white you're not but he calls you after the fact so that's what that is what it is he called because he because he knows he needed a brother on scene is this running live no usually we'll go you usually will go to calls to add two people you never know who you're renting wouldn't that be logical to you yeah okay so take a deep breath and then blow until it's just i'll hold it for you deep breath no watch i'm gonna pass and everything's gonna be okay unless this guy escalates it even more go ahead do you break breath go go go go go go go go go go go go go go go go go perfect zero not even a [ __ ] thing in there yeah it is so why did you have to be difficult so here because you pulled me up for no reason i'm thinking of it but for this reason i explained that to you i hold it over you use that for an excuse to pull me over no it's not an excuse it's a reason to pull you over was first you guys are bullies and you guys just keep with me that's not my opinion i just pulled over yesterday the day before for what not by me first guilty by association now can i get your id from you please no because i didn't commit a crime i did what you asked i'm not giving you mighty i haven't done anything i didn't commit a traffic infraction okay but i'm not giving you my id sure i'm not giving you my driver's license to be driving a vehicle i know i'm not giving you my id that's not that you can't pull someone over asking if they have an id that i would report with you then take me to jail then i will go in front of a judge and then like we'll argue this so we'll argue this in front of the judge then you know his last so it's all of you no i this is the first time i have not committed a crime or of traffic and violation i was nice enough to do your mandatory [ __ ] thing so now let me be on my way i should be on my way but you want to escalate it like i said the white man wants to escalate it okay you should let me go i haven't committed any crimes let me go there let me be on i need to be on my way i need to be on my way but right now i need to be on my way and i'm racially profiled okay well then let me on my way drop it and let me on my way because i haven't committed a crime i have not committed a crime let me be on my way let's let's calm things down i have not been on i've not committed a crime or a trafficking violation here's the thing i i think i know who you are yeah i met you over on my block that one day you're african you're from africa i'm from marissa i asked for a video and then you checked for it i did i did i haven't done anything uh hey um excuse me forget his name anybody brother so you pass the test which is good i know because i don't drink i don't do drugs this traffic stop should have never happened in the first place but what's really confusing is why the officers haven't ended it at this point there's no alcohol in your okay perfect so when he asked so let me again explain why what's what's under the traffic safety act is if a police officer asks someone for driver license or registration to make sure that the vehicle is insured which i'm sure he can run the plate and he can see that it is he can he can see that it's registered but he cannot see if it's insured but you can't register a car without it being insured oh yeah you can you trust me i i give tickets for no insurance for vehicles if they don't have it on them yeah well i'm pretty sure you're not going to be driving a vehicle like this and not insured so i'm i honestly personally i think i know it's it's insured not i know but i'm i know it is i confidence i'm clean but but the driver license if somebody if not just tonight if a police officer asks you for a drive license registration insurance and the traffic safety act you are you require to provide that otherwise here so if i don't commit a crime so if i don't commit a crime or if i don't commit a trafficking violation i'm allowed to just be accosted rather it's not about a crime or anything like that it's it's about okay so so basically i've done nothing wrong but i'm being this is happening and i agree with you that's not fair so this is an example of a traffic stop that turns into being not a good a good traffic stop we agree on that yes okay so so all of you obviously you guys uh minutes dwight is able to leave after officer luco retrieved dwight's name from running his plates dwight has not been able to find a lawyer that is willing to take on the case but he was offered an apology from a sergeant when he filed a complaint about the encounter it's unclear whether race had anything to do with the stop but it is very clear that the constables don't fully understand the law
