You can't film people without the permission. I'm telling you. Stop me. Stop you. Yeah, I'll stop you. I don't really care about a federal law. It's called HIPPA. Back up. Lower your voice or I'm going to move forward. Yeah, go ahead and I'll call the cops. All right. I'm asking you please don't film. I said no. Why are you only talking to me and not her? Because you're the one that says no. Says no to what? To not filming. Please do not film. Really? Yes. Are you going to really do that? Uh, because someone is uncomfortable doesn't trump constitutional rights. What is wrong with you? I'm telling you, don't do that. It's not that we don't want to do our job. It's just we are limited and we can't. We can't. We can't. We can't. We can't. Welcome back to the Lackluster Channel. Today's story was submitted by Surveyor Raw, who was filming and taking pictures in the Fremont neighborhood of Seattle, Washington, when he noticed a small gathering around a pop-up tent at 36th in Dayton, and turned his lens towards the scene. While documenting it, he learned that the tent was set up by the Seattle Fire Department in conjunction with the Fremont Chamber of Commerce and noticed that one of the organizers of the event was taking pictures as [Music] well. Surveyor Raw continued to film the scene for about 5 minutes without issue until one of the men there found a problem with his camera. What's interesting is that the man had been on camera the entire time, including when the organizer was taking photos. Why you filming people, man? Who are you with? I don't want you filming me without permission. What's that? I don't want you filming me without permission. Who are you with? Are you with the Woodland Park Zoo? Who are you with? That's what I'm asking you. You can't film people without the permission. I'm telling you. Stop me. Stop you. Yeah, I'll stop you. Okay. Yeah, I'll stop you. the man goes to complain to the organizer who was taking pictures of him as well and it appears as though his quells are sorted out until just a few moments later. I told you don't film me, man. Why you got the camera angle me? Uh I just your driver's license and everything. You found my Oh, you're a live piece of you know that I just had out right there. Hey, what's your life, man? Go get your shot. The organizer, who was also taking pictures, now asks why surveyor RAW won't respect the man's wishes. So, the question here is, why are you why are you why are you not respecting people's wishes to not be videoed? Which people are you referring to? Obviously, yeah, he asked you not to video. But, I mean, just him. He was the only one who That's what I'm asking you. You're asking me why I didn't respect his wishes? Correct. because his wishes don't trump civil rights. Okay. Okay. Sounds great. 10:30. I'm telling you, don't do that. Surveyor Raw has now had his equipment taken and both he and his camera are thrown to the ground, causing damages to his device and decently sized abrasions to his elbow and hip. Shortly after the scuffle was broken up, surveyor Rob began recording again and three uniformed officers of the Seattle Police Department were called to respond. Oh, this guy's talking to the criminal. It's a 100 foot tender. It's a support. We'll get you a test. They're talking about getting this guy out of here before the cops arrive. No, we're talking about getting him his cuz that's why he's here. Oh, not here to attack people on the sidewalk. No, that's that's your job to aggregate to aggravate. A aggravate. What am I trying to say? Aggravate. Thank you, sir. That's that's the correct word. Aggravate. And when you get aggravated, you can commit crimes against others. Hi, Officer Sweden. Uh, were you involved in the dispute? Yeah, I'm the victim. Okay. Um, do you want to tell me what happened? Did you say dispute? Yeah, the fight. What? What do you want to call it? I was attacked and pushed down on the sidewalk. Okay. So, I'm I'm just trying to figure out what's going on, right? I was standing right here recording. Okay. And um the guy right there in the Africa thing on his shirt. Yeah. He came up to me and he said that he didn't want to be recorded. Okay. And then um it looked like he was going to come over here and he came over here a couple minutes passed and then he came up to me again and he grabbed the the the the camera and shoved it backwards and I fell down and here see that? Yeah. Um if you weren't happy to show you the video. Okay. Yeah. if if you want to do that. That sounds great. Okay. Two of the officers watched the video survey a raw captured of his attack. Uh okay. So I already explained to gentlemen that public recording public space. Yeah. You know your legal rights to record and take photographs which he did not understand. Uh so now he understands that. Um do you have any questions or anything you want to add? I mean what about the attacking me? Okay. Like pretty much everyone I've talked to here has told me about how public photography is all okay and that I don't have to worry about it, but no one's said anything about being attacked. I mean, I got injuries. I got property damage. Is there something you want to participate in these prosecution? Of course. You can't just attack people on the sidewalk, can you? So, uh, I'll document it. Um, I have this identification. It's It's been identified. You've been identified. Uh, do you give get phone number email? Yep. I'll get I'll get his email. You see what I was saying? You photographed. You see what I was saying earlier now? What about how you just let the criminal go? So, I mean, they're going to get it's going to get filed, but King County isn't going to take it right now. They don't they're not taking when crime is committed. Usually, you make an arrest, especially if the criminal's there and there's 20. Yeah. So at most this would be filed at a charge by officer and so it would refer be referred to prosecutors that would then be in contact with you. Yeah, I know. But that doesn't that doesn't um that's that's what you guys do when you don't want to do anything. The problem is not true. It is you've actually done it to me before. What do you do with So let me just ask you a question. If I just like walked up to that guy over there and just attacked him, knocked him down, grabbed his property, you wouldn't take me to jail. I charge my officer as a officer. you would let me just walk free after I do the exact same thing because So what we're telling you right if we did arrest him right now and we took him to King County he would be declined. They wouldn't take him. Why not? Because they're not accepting assault pole right now. Oh really? Yes. That's what we're trying to explain to you. It's not that we don't want to do our job. It's just we are limited and we can't as much as we would like. bookings that the King County Jail will accept are going to be felonies including property crime, domestic violence assaults, and some other order violations. Anything that's misdemeanor, gross misdemeanor, that's property crime or even lower assaults. Nobody's getting booked there because capacity, because of CO is what they say. So, what you're telling me is if I went over to that guy and just knocked him down and attacked him back, that would be you would be you would be charged. We would we're f we're going to file charges. I would be charged the same way he he would be charged. Yes. You would identify you explain explain exact same process. Good to know. If it's going to be ongoing though, like if it's going to escalate and you're not it's not going to go away like if this was not just like a temporary thing where you know people gathered here incidentally and it was like oh it's the guy's house and you're not leaving leaving him he can't you know get it out of there then maybe we we arrest you. You're still not going to get booked into jail. Yeah. The officers take pictures of the physical and property damages and leave the scene. But it wasn't the conclusion to this encounter. After the officers depart, Surveyor Ra takes a walk to speak with his live stream audience. Once he ends the stream, he notices a local ABC affiliate recording the site. Um, the police were just here and they said it's inappropriate to be this close. Oh, okay. Yeah, they said you couldn't get close at all. that you could be compromising people's private information. Oh, okay. Yeah. Also, you might want to be careful with the camera out here. I would come before. I'm I'm used to this. Oh, really? Yeah. You ever get assaulted for recording? She shook her head. No. Hey, you didn't give my permission to film me, but you turn that off, please. I didn't ask your permission. Yeah, you have to have his permission. What are you going to do with the video? Yeah, you do. What are you going to do with the video, sir? Are you Who are you with? I'm just a human being just to see you film. Stop filming me now. No, please stop filming. No. Why not? Why? You just came up in my room to her and then you're filming me. No, no. I was just telling her that the police advised me you could be in trouble if you stand. You pushed her back to get Did I push you back? Hey, sir. Am I on your way? Do you want me to move over? I'll be happy to move over if I'm blocking the car or something. Lieutenant Stone of the Seattle Fire Department now calls the supervisor because Surveyor Raw is recording again, ignoring the mainstream media camera crew. I have uh some requests from the people that are coming up to the table not to get too close because of personal information. So, I'm just asking you to respect that. Okay. Yes or no? Yes. Okay. Yes. No. Uh sir, they're giving personal information over here. So, it'd be really nice if you respected that. Who's the person who's supposed to protect that information? All of these people are giving personal information. So, I'd like you to stay back so you don't get any of that. I'd be more than happy to if you're willing to compensate me. How? Compensate you? Well, yeah. I mean, I just don't work for free. Yeah. Uh, actually, you're not working for anyone, right? But um this is not a job. Are you familiar with HIPPA law? Yeah, I'm very familiar. Sure. Do you know what it stands for? And sir, I'm asking you to respect the people that are coming to get. Okay. So, if you could move, please move back a little so these guys feel comfortable. I'm standing further back than she is, but you're talking to me. So, I know, but you're the one that keeps saying no. And I I'd really like to comp like compromise here. I'm I'm willing to um compromise. I'm I'm willing to not get too close, but I'm just trying to express to you that What are you trying to express to me that you want to film us doing? Why not just let me say it? Um, go ahead. What I'm trying to express to you is there's a there's a federal law that was passed in 1996. I don't really care about a federal law. It's called HIPPA. Yes. And that is information that they're giving right there. So, I'd like you to back up. What is information? Please back up. Lower your voice or I'm going to move forward. Yeah. Go ahead and I'll call the cops. All right. [Applause] Guess I should need to record this phone call. [Music] Can you Can you not film me here? Sure. No problem. Don't film me either. Oh, I'm going to film you. You said you're going to call 911. Hey, Seattle, please. Yeah, this is Penny Stone with Seattle Fire. Could you please talk about Lieutenant Stone now calls 911 to request a police response to stop someone other than the mainstream media from filming? Uh, if you're watching this, you'll probably notice that although I was standing further back than this person, when the fire fighter approached, she only spoke to me. And then she got in my face while she's adminating back. She stood one foot away from me. When I took a step back, she took a step toward me. Don't film me. Don't film me. Please. I'm asking you. Please don't film me. I already said no. Okay. Well, then we won't be doing any until you're done. Okay. You really want to do that? Do what? You really want to do that to the people here? They're not comfortable with you doing it. Why are you only talking to me and not her? Because you're the one that says no. Says no to what? To not filming. Please do not film. Please do not film. I asked I'm asking you and everyone's witnessing. Please do not film. And now I'm telling you, please do not film. No, I'm asking you very nicely. You're you're being belligerent. I'm saying please do not film. I said no. Okay. It's a civil right. What is wrong with you? These people aren't comfortable with you filming them. Feelings don't trump rights. Really? Yes. Are you going to really do that? Because someone is uncomfortable doesn't trump constitutional rights. What is wrong with you? Okay. This is a public servant. Yeah, it is a public servant and I'm asking you please don't film. I said no. Okay. Time to wrap it up. You said right. Are you okay? Look at the hypocrisy here. Hey, just so you guys know, the firefighter said that you need everyone's consent if you want to record them. Yeah, I've been asking. Yeah, but you you've been recording me. You didn't ask my consent. Oh, I don't think we're using any of you. I think we're just focusing on the event. She was recording pictures of pictures of him because he's been very confrontational. Yeah, but just so you know, I'm not um I'm not saying that you guys need my permission, but everyone here is saying that you need per that you need to get everyone's concern. I've been asking. Okay. Yeah, but you didn't ask me, right? Oh, yeah. I've been asking everyone here except for me. Excuse me. It's basic ethics. The video continues on without further incident and Surveyor Raw leaves the scene. The same morning I began editing this video, I received a message that told me I am worthless, that every word comes from the sewer, and that I just try to start something with law enforcement officers. But the most relevant part is where he writes, "Heaven help you if you ever need the police for something. I would not blame them not to show up." The irony is that this video presents a prime example of why your personal safety is your own responsibility. And other than traffic and jaywalking tickets, law enforcement officers are generally unusful to the taxpayers that fund their operations. Surveyor RAW was battered, resulting in physical injury and property damages with a dozen witnesses and video recording of the event. But the officers claimed that the county won't allow them to arrest and pursue charges against the asalent. What's worse is that cases like Warren VTC and Castle Rock v Gonzalez have held that police do not owe a specific duty to provide police services to specific citizens and have no duty to protect the citizens they serve from any violent actions against them. Reliance on another man that doesn't even know your name for protection is foolish and Surveyor Raw addresses his inaction to his battery in his video. Now, I want to admit to you guys that I feel pretty ashamed about this video. first because even though I know better, I cooperated with police under the temporary delusion that they might arrest someone who committed a violent crime against me in front of a dozen witnesses. And second, because I foolishly met the man's aggression towards me with passivity rather than self-defense. Now, I could offer several lines of rationale to defend my passivity during this encounter, but it's not a position I want to defend. That said, let me ask you, if I had defended myself with proportionate force, would the city workers who conspired with the criminal in this video see it justified as such? The takeaway from all of this is Americans don't understand your rights, state officials don't respect them, and your life is your responsibility. While self-defense will likely lead to prosecution, I would personally rather be tried by 12 than carried by six. A huge thanks to Surveyor Raw for submitting these videos. All three that were used in today's presentation can be found on his channel linked below. Be sure to check out his other work and let him know I sent you. [Music]
