all right welcome back to the youtube channel here's the deal i appreciate you joining me on this live stream i wanted to share this with you because you know it's always a good day for learning it's always a good day for learning and it's easy to intimidate somebody when you haven't learned things and you're ignorant that's why jefferson said if you desire to be ignorant and free you desire what never was and would never shall be so we don't want to be ignorant these days we're going to be talking about hipaa laws because one things that the cop likes to do or cops in general they like to walk up to you and they like to intimidate you and take advantage of your lack of knowledge and they'll use their lack of knowledge to do it because a lot of times the cops will walk up to you and they don't even know their own laws their own codes and ordinances and regulations and policies but they'll come up and they'll try to intimidate you anyway that's not gonna stop them from trying to intimidate you so we're gonna go over this real quick this comes from the youtube channel trot golfer trot golfer did a really well you tell me what kind of job you think he did right here he's outside of the dispensary right here right off a public sidewalk he's actually standing there with his bike on the public sidewalk recording in public which every american should know that you got a right to do every cop should know that you have a right to do as a matter of fact every cop should actually be protecting your right to do this but for the most part they don't so let's go ahead and get into this video i will be skipping around this is an 18 minute and 32 second video if you want to see the whole thing i've already posted the link in the description if you want to watch it without interruption but let's go through this because there's some important little facets right here about how the cop walks up to you and as cops often do they want to engage in a non-consensual encounter with you you know usually people want you know a consensual encounter they want uh the person that you're walking up to you want a person you want to walk up to to desire to communicate with you but cops they force themselves on you and then they start issuing directives that they say you have to follow or there's this implied threat of force that's always hanging and hanging over the the cloud as they walk up so watch this let me know if you guys just kind of ran into this place let me if let me know if you can hear me and system audio just so i'm not continuing for minutes with no uh no sound let's just write on the road see if they respect uh filming on a public space so he's at this dispensary and he's filming out in public and we're gonna have an interaction with the dispensary workers here in a moment let's go and rush this up there it is right here hi how are you how are you some of our patients that they felt a little uncomfortable that there was someone outside recording them okay sorry if you wouldn't mind not recording the patience we'd appreciate it one minute i'm gonna be right here okay just don't record okay i'm gonna report why what's what's the problem oh there's no problems at all so they just the people that are being recorded don't want to be so if you just move down a little bit that would be fine we just want license plates and things being i mean from from the perspective of being ignorant and by the way when i call somebody ignorant that's not an ad hominem attack against them i'm not calling them stupid you know there's a difference between stupidity and ignorance we're all ignorant of a lot of things that doesn't mean we're stupid we just haven't got around to researching it there's so much to know in this world and there's so much to be ignorant about so when i'm saying ignorant i'm not slamming this woman but i can kind of understand from her ignorant perspective that hey we want to protect our patients and all that but they don't ever give it thought that hey isn't it your responsibility to protect patients why would you come out to a member of the public who's just filming on a public sidewalk and put the burden of protecting your patients on them isn't that your responsibility and that's going to lead us into this hipaa thing because i've seen a lot of videos where cops or the person behind the desk that doesn't want you filming is going to appeal to a hipaa law and they think that's the gotcha moment but it truly isn't a gotcha moment i'll be right here probably something along the lines of okay fine you'll be sorry we're about to call men with guns and they'll take care of you and they'll tell you to move you wouldn't listen to us but you'll listen to them looks like she appears again we have three complaints now and the owner has asked me to ask you to move down a bit or she's gonna call her trespassing or my trespassing because you're recording our patients and they don't want to be recorded they've asked how's that trespassing well because you're you're in front of the building and you're staying in front of our business you know where i'm at yeah you're on the sidewalk so what is the sidewalk but you're recording the building they don't want to be recorded if you're not going to move on they're going to make fun of are you a manager here i am you should probably learn the law before you call resources people do not want to be recorded that's not my issue that build a wall but why do you want to stand here record it because i can are you calling the cops yeah that's actually a good point uh window window says you didn't have to get my permission to record in public ignorance goddess and this mess were in yeah i agree so basically this person right here is saying you don't have our permission to do something that you have a right to do in the first place not only you don't just have a right because it's in the first amendment you have a human right to record anything that you can see in public nobody has a right to trespass your eyes when you're in a public place if a person wants to maintain privacy then don't step out into the public arena is the bottom line it's very it's very fundamental it's very elementary but it's amazing how many people miss this don't understand it or ignorant of it and after they're informed of it they stay ignorant which to me when you cross into the line of okay i was ignorant on this thing before somebody just educated me and now i'm going to continue with my ignorance that's where you cross over into stupidity [Music] now when he gets confronted by the cops here you're gonna see that the fitness requirements in this department are a top priority just skipping around to the good stuff here guys i don't want to bore you here we go and now straight from planet fitness sergeant wolfie keeler good morning how are you doing uh can you hear me okay with your headphones in okay my name is deputy simonson with the maricopa county sheriff's office so if you're just joining us we're watching the trot golfer youtube channel this is trot golfer trot golfer and he's going to employ a little bit of silence he's going to exercise his right to be silent his right his freedom to ignore i got called out here um the dispensary here and the managers inside they're having an issue with you filming due to hipaa laws because some of the patients that come here are protected by hipaa and the customers of the dispensary are really uncomfortable with being filmed as they go through the parking lot here i understand you're on public property it's not private property you're not on their property or anything like that but due to the issue with the hipaa violation and stuff like that they're asking that you move along and stop filming their customers at the dispensary okay do you have any questions on that okay is there any issue you have with that or any reason in particular you're out here are you threatened by anybody or is there any other issue like that you know he's playing mr nice guy no were you yelling and screaming at any customers or anything like that where'd he go with that sir were you yelling and screaming at anybody today doesn't have anything to sink his teeth into let's see what do i do here can you still hear me i don't know if you turned your headphones on or off sir now check this out he's about to pull something out of his rotund derriere check it out the issue that they're having with you filming here is because some of these people are medical patients so it's a hipaa violation for you to be filming them as they're getting their medication did you catch it he just laid that phrase down as a fact he says quote it's a hipaa violation for you to be filming them as they're getting their medication and this would be the very cop who with his body cam would kidnap you throw him in throw you in the back of the police car throw you into a rape cage because you chose to possess medication that wasn't sanctioned by the government so now all of a sudden he's concerned with people who are getting medication at a dispensary and then he uses a lie he issued that as a statement of fact first of all he's he's gonna admit later on in this video a little spoiler alert for you that he is ignorant on hipaa laws number two in his ignorance on hipaa laws he he literally said that you you man on the street with a camera trot golfer are engaged in violating hipaa rules let's just look at something real quick before we get back to this video again this is trot golfer's video i just want to show you about hipaa because a lot of people are unin uninformed on what hipaa actually is hipaa stands for the health insurance portability and accountability act it was signed into law whatever by the then president of the united states slick willie bill clinton back in 1996 and what it says is the health insurance portability accountability act of 1996 is a federal law that required the creation of national standards to protect sensitive patient health information from being disclosed without the patient's consent or knowledge now i'm going to read you another little bit of tidbit here and give you an example of how this does not and cannot apply to journalists or people with a camera out on the street which i would call them a journalist because why you're journaling history if you have a camera and you're recording things that are going on before you you're recording a little snapshot of history where you are so you are a journalist you're digitally journaling so in summary what is the purpose of hipaa to improve efficiency in the healthcare industry to improve the portability of healthcare insurance to provide the privacy of patients and health plan members and to ensure health health information is kept secure and patients are notified of breaches of their health data so whose responsibility is it under hipaa to keep those medical health records secure it is the requirement and it only applies to custodians of medical records not to men with cameras and i like under this video somebody made a really really good observation let me see if i can find it for you if i can't find it i'll read it because i got it i got it for you on my other screen matter of fact i'll just bring this over right here because i want you to see it with your own eyes it was it's pretty interesting because he quoted this this comes from finbarr martin so finbarr thanks for thanks for lending us this uh this knowledge none of us this is another example if none of us is greater than all of us hipaa does not apply to photojournalist it applies to custodians of medical records those having legal access to medical information of citizens are custodians of records anyone filming or photographing in public a public area would not be in violation of hipaa as he or she is not a records keeper that is very important and then they give an example that actually um it looks like it might have gone to court i'm not really sure because i haven't done any uh further research on it but it says generally if a reporter lawfully obtained it it would be the person who released the data to the reporter and not the reporter himself who would have the responsibility said this this guy at this law firm a tampa firm specializing in media law a lot of confusion was brought up when adam schafer tweeted a photo of giants defensive end jason pierre-paul's medical record which stated the player had his right index finger amputated the tweet started a huge debate on who was at fault for leaking the hipaa protected information however according to the reporters committee for freedom of the press quote espn is very much in the clear here hipaa does not apply to journalists it only applies to covered health entities said this this person at rcfp and then they say whoever released the medical information is the one who is under the gun so to speak and they're the ones who can be punished for that law theoretically so it can't be the guy with the camera it can't be trot golfer here no matter how this law enforcer tries to intimidate somebody and capitalize on on the potential existence of ignorance in that person's brain it doesn't make it so a person filming in public cannot be guilty of violating a hipaa a federal hipaa law so here we go back to the back to the video you have any questions on that or any issues with that i love the i love ignoring the ignoring is classic okay we gotta it's almost like he's looking at his phone okay gotta go to page three gotta contact the supervisor i'm not sure where to go with this usually people just open their mouths and incriminate themselves but i got nothing to go on maybe i should go order another donut can you get a donut with that can you get a little bit of cholesterol with that of course of course you can get a donut in cholesterol of course you can so he continues filming and the cops the sheriff's department goes to talk to the people at the dispensary who have called hired men with guns to try to harass a guy who's just filming in public let's make it clear what it is [Music] bye villain corp says that officer is misquoting he meant hippo laws hungry hungry hip hop [Music] [Music] okay the cop will be coming back his truck golfer has something to say now yeah yeah that's it that's another good point swamp lover says there are two cameras on that building so basically guys everybody has cameras if you have a cell phone you have a camera how are how how are the employees or the supervisor or the owner of this dispensary going to enforce everybody putting their cameras away their dash cams their front facing dash cams rear facing dash cams everybody's got a body cam i mean not everybody but everybody's got a camera in their pocket there are body cams you know cars come with cameras now there are cameras on light poles there are cameras everywhere but they're concerned and the cops that they're going to call to the dispensary have body cams and dash cams as they drive up and record the people that they say um they want to keep secure for hipaa hipaa violation's sake so now not only is it hilariously ironic that with all the cameras around they're going to harass a guy on the sidewalk with the camera now they're going to make things worse for themselves if that's truly what they cared about by bringing two more people with more cameras unbelievable the first amendment sucks doesn't it what a shitty amendment that is yeah that's a good point to window cops about to violate hippo with body cam going into the building and getting closer to the vehicle so he can record more license plates they're not concerned about hipaa they're concerned about somebody on the sidewalk doing something that they're not used to that's why it's a good idea to go out there and get people used to it and get them acclimated to the fact that hey we americans have freedoms we can do this kind of stuff you can do it too this would have been a non-video and tri golfer wouldn't have even posted it if nobody came out and hassled him isn't what part of this kind of thing that people don't understand do people not have access to youtube is the internet down in massive portions of america where people don't see that wow maybe i shouldn't step out of my business and give that guy with the camera a hard time because then it's going to go viral and the very thing that i don't want to happen is going to happen in spades is it zimmerman is that what it is what's the last name my last name yeah and just like i was telling them you get educated sorry you get educated did i get educated yeah so i'm gonna come over here and talk to you the same way i talked to them um obviously you're on problem you're on private public property like i told you the first time i came up you didn't as far as i know you didn't go inside their business or on their private property so you're just filming did you did you use the hipaa thing just for the hell of it or did i use the hypothetical that's what they told me inside yeah so you should study up on that before you start spouting what idiots say you know okay i i could not agree more so basically the cop made the threat in his words based on what they said inside he didn't know if it was legitimate or not he'd just go ahead and spew it this could be complete not nonsense it could be a fabrication it could be a complete lie but i'm still going to try to intimidate you with it because i want the people inside to think that i'm doing my job by getting rid of the evil cameraman unbelievable unbelievable well i mean this just in the future so they're telling me that they're yeah you're yelling and screaming at them so i'm getting all the information but even even honestly even if i was yelling and screaming at him like if i'm on this that's first i mean that's my freedom of speech man okay but if it causes somebody actually made a really good point that trot golfer liked let's see let's see he it was kind of it was a little bit of um there's a little bit of uh criticism for trot golfer it was something to the effect of hey you were doing really good until you until that part right there let me see i should have highlighted it oh yeah here we go chef phi says you did great and then you made a fundamental mistake at 14 at the 14 minute mark which i think is what we're on right now now when he said they accused you of yelling and screaming you should have asked what evidence did they provide to back their allocation allegations because without evidence it's hearsay and you have already just proven they lied about the hipaa violation instead you argued about your first amendment right and got taken off course remember you have video evidence you haven't committed any crimes the mistake auditors make is that they tell the police that um tell the police that and then when the police demand to see the evidence don't share that of evidence just let everybody dig their holes knowing that they're going to fail in it just because they said so they have to prove you're guilty not you have to prove you're innocent that is that is very well said and tru again trot golfer said hey thanks for the information i appreciate it so he appreciates this criticism as everyone does who is on the side of truth because truth fears no scrutiny it's like man we could all do a better job none of us is greater than all of us if you see an excuse me if you see an error in me that i can be corrected on i will take that correction do better in the future and that's what makes society better so this is a good criticism even though you can anytime you want which should give you all the confidence that you need to deal with them the silent treatment is a powerful tool more auditors should use it keep up the good work stay safe and stay free so i agree with this guy in that hey wait a second you said that they said now do you have any proof because if you don't have proof you're basically out on your own limb sawing off the branch as we speak i don't have to prove anything if you if you are alluding to the fact that i might be guilty of some kind of criminal activity or disturbing the peace or whatever the burden of proof is on you to back your assertion i love that posture that puts all the power in your hands and just watch them dig their own hole because they will the i like to hear cops talk because the more they talk the more they dig their hole and you got it all on video no need to hey you like this guy says you can walk in the confidence of knowing wow i am absolutely on the side of truth and these guys are on their own servants to their business that's the sort of condom yeah it's i mean yeah you could i mean you know what you you do if you're out here you're riding your bike you've got your shoes on you clipped in yeah you're good to go you're out here exercising doing fitness practicing your right finger whatever you want to film yeah their concern was they said that the customers were that's why i'm out here i'm not here to educate them how close they are to the the public property let's just say that how close they are to public public property okay you know what i mean yes sir and if they have issues with if patients have issues with all that they should you know invest in a wall or something or you know so i'm just just educating today like i told them it's no different than you sitting outside of a walgreens not everybody that goes in there is getting prescription medication yeah what's going on in there yeah you should you should really study up on that okay as far as hipaa i understand that's something that i'm terribly because the only one that can actually break the hipaa law is the provider people that are yes safeguarding that information you don't know who's a patient who's not yeah she'll fight somehow pick up something on their intercom or some paper paperwork that's on them not me i understand so just you're cool man okay i appreciate you talking to me i told them not to call you guys there was a there was a bit of a confusion when you didn't want to talk to me the first thing yeah no no you're doing your thing you don't have there's actually no confusion because when he came back the second time he said hey we all know you're on a public sidewalk we all know you can film from the public sidewalk you haven't done anything wrong so there was no confusion at all what he didn't like was the fact that when he walked up the guy would not trot golfer wouldn't communicate with him he just ignored him he just kept on doing what he was doing because he wasn't engaged in committing a crime golfer knew it this cop knew it and he reiterated the fact that he knew it so there's no confusion at all whatever confusion might be swimming around in anybody's minds is the confusion of these people who call themselves americans who thought it was a good idea to follow call armed badged agents to come and take care of somebody on public sidewalk when it was none of their business what golfer was doing on the public sidewalk talk to me yeah there's no reason for you to you're not just committing any crimes just i'm investigating what they told me yeah came out here try to get your side of the okay all right i appreciate it yes sir i appreciate you as well like i said it is it is private property so please refrain from yeah okay good good appreciate thank you very much all
