[Music] Yo, what's going on? So, today we got a video from Body Cam Files, and the title of the video is, "Lady refuses to get out of her car ends badly." Let's get into the video. Let's see what they actually talking about here. >> On April 20th, 2023, police respond to a vehicle crash involving a suspected intoxicated driver. [Applause] What's going on, ma'am? What happened? [Applause] >> What's going on? >> I'm calling my bar. >> Where are you coming from? >> Where are you coming from? >> Literally like right now. your life insurance on you. >> But this >> uh she did get out. >> Yeah, I know. And she did get out and uh >> she she was like she basically was like standing up holding on to me. >> What happened? >> You got her driver's license. >> Did you get or >> not yet? I'm still waiting on her. >> Yeah, but in a minute. Let's deal with the >> What happened here? >> Hey, Lindsay, just stay with her. >> Do you speak English back? >> No. >> Hey, do any of you guys speak Spanish? Do I speak Spanish? [Applause] Um, so I'm guessing >> was the Ask them if the bus was stopped and they were stopped behind it. >> You guys speak Spanish or Portuguese? >> Portuguese. >> Portuguese. >> But you can speak Spanish. Okay. >> So ask them what happened. The Was the bus stop? So she hit rear end and them and they pushed her then. >> Was the bus stopped? >> Was that the bus stopped or was the bus moving? >> Okay. He was going slow. So maybe he had just pulled off. >> So the bus was slow. How fast were they going? >> How fast were [Applause] like 25 >> only like 25 >> and they're in the right land. >> Yes. >> So they thought that the bus was going to stop. Yeah. >> So then they slowed down and that's when the car slammed into them and they slammed into the bus. >> All right. Okay. And she hasn't gotten out of the car yet. >> She got out while I was there cuz I told her to get out and she like >> Yeah. >> Asked them if anyone else in the car with her. >> They didn't see anybody out there. >> No license. >> She has no license. Huh? >> She doesn't have a driver's license. She smashing this and then the guard off. Well, damn. >> No driver's license. You definitely cooked. I mean, you This is a tricky one just because I mean, obviously, hold on. Obviously, she's drunk, right? So, she's definitely going to be in trouble for that. But I mean it being three cars like that. I mean I know you the one that hits the person from behind is the one that's always in the in the trouble. You know what I mean? It's just it it's just the nature of the beast cuz they're going to say you you shouldn't have been tailing too close or whatever. But if this bus was going at a normal speed and then he he's goes to a, you know, pretty much to a halt and then the that car in front of them all of a sudden slows down and now you kind of like it's it's come on. Like that's it's it's crazy. It's crazy. It's not fair. And they always going to blame the person that hit them from behind. You know what I'm saying? I've been in a couple of accidents, so trust me, I know. All right. Something very similar to that happened to me years ago when um I was I was driving on the highway or whatever. A car two cars ahead like I was the last one. There was a car in the middle and then there was a car in front of them. And we we all are going like traffic is like 70. You know what I'm saying? seven like everybody going right and the car two cars ahead of me all of a sudden comes to like a stop like like just like type stuff like in the car in front of me he pumps the brakes boom and then me I pump the brakes but back then I ain't you know it was hey I was a young buck man my car was not great you feel me the them brakes was rough You listen, y'all know about them them days when you in college or something them when you just want to come up, your car isn't up to par. You feel me? So, I tried to make a stop, but my car was my brakes wasn't nah. So, I slammed right in the back of him. Boom. And I actually ended up hitting a lawyer, which is the crazy part. I ended up hitting a lawyer. And when the cops showed up and everything, the c the lawyer explained what happened cuz that one car the car that was two cars ahead, he just took off. Like once we hit each other, he kind of just took off and you know, so it was it was just an accident with us two, but really it was caused by the the first person, but obviously I get blamed because I shouldn't have been traveling that close and yada yada yada what you know what I'm saying. episode. Of course, it's my fault. But that lawyer, man, he was cool as heck, man. And he know Listen, it it he almost hit the car, you the the car that was in front of him. So, it was like it was just crazy. Um but yeah, so um but yeah, she she's bombed, man. She's bomb. She ain't got no license, nothing. She she's hooked. It's over with. >> How you doing? [Applause] Y give me a license. Can you tell me what happened? [Applause] What? What happened? >> Ma'am, Ma'am, we're over here. >> No worries. [ __ ] me. All right. >> No, I'm I'm That's fine. She stepped away. What's your name again? Excuse me. What's your name? Ma'am. Well, you need some help. Of >> course. Here. Come outside real quick. >> No. Step out of our car. Listen. >> No. >> We're done with traffic. >> No. >> I'm conducting a new investigation. >> That's fine. That's fine. >> Can you cooperate with my investigation? >> No. I'm not going out of the car. >> Step out of the car for me. Okay. >> No. >> All right. I'm going to pull you out of the car. Step out of the car. Understand? >> Should I Should I video this? >> I'm videoing it. Step out of the car. >> Ma'am, come out of the car. >> The vehicle has to get towed. Don't catch your car. >> Your airbags went off. Time to get you together. Better pay attention. Step out of the car. You >> already got smacked up by that airbag. They going to get you together. He's not. >> I'm going to let go of you, but you're going to come out. Is that good? >> Okay. >> All right. Step out. >> Come on, >> ma'am. Don't start reaching in your car. >> Let's go. Let's go. Or I'm going to pull you out. >> We're out of options now. >> Ma'am, step out of the vehicle like you were earlier. Come on. What? >> Get out of the vehicle like you were earlier. >> Listen. >> Step out of the car. >> Listen. Stop. Stop. Stop. >> Stop. Step out of your car. >> You get out on your own. You want to get out like the lady? She's distracted. >> Okay. >> You don't have any options, >> Lindsay. >> Okay. I'm >> not. >> Please step out of your car. >> No. >> The vehicle is going to be towed. You have to come out of the vehicle. >> I'm fine with that, but >> you can't be in the car when it's getting towed. >> Okay. I need to call someone. Okay. >> All right. You'll have an opportunity for that incident. No, >> but you have to come out. You don't have the option to stay in the car. >> No, officer. Nope. >> Stop. >> Stop. Relax. >> No. >> You were calm before. Relax. I spoke to you earlier. You were very calm. >> Yeah. >> Let's get back to that. Let's get back to that how we were before. I don't know why you're getting all hyper and some of that. All right. Can we pick it back up, please? Nice and calm. Right. Listen, like I explained, we're done with the crash. I'm investigating for possible driving under the influence. You understand that? Before I do that, I got to read you some things. Okay? I just need a yes or no. You understand? All right. I'm required to warn you before you make any statements. Listen to me. Can you pay attention? Give me a second. Ma'am, before you make any statements that you have the following constitutional rights. >> I know I have the right. >> All right. I just got to explain it to you. Okay. Ma'am, just listen to him. I I I want I want to I want >> Just listen to what he has to say. This is only to protect you. >> You have the right to remain silent and not answer any questions. Do you understand? >> You understand? >> Hey, go on the proper side. Make sure she's not reaching for nothing. You have the right to remain silent and not answer any questions. Do you understand that? >> No. >> What don't you understand about it? I would like to raise >> my friend. >> We have to get through this. Okay. >> Okay. I know. I know. >> Let's relax. Let's relax. We're just talking. >> We're just talking right now. >> No, we're not talking. >> We are talking. I'm trying to have a conversation with you. >> But I need to read this to you so you're protected. Do you understand that? >> And and and I know what I'm protecting. >> Without me reading your rights, you don't have these constitutional. If you don't do them, then I have to end my investigation based on the information that I have right now. With that in mind, would you want to do the field sobriety exercise? You don't want to do it. All right. You're going to be placed under risk for suspicion of driving under the come out of the car. Listen, you're out of the car now. Take them out. Stop. [Applause] >> She had a press in there. >> Pretty sure it ran off valid. >> Erica was charged with DUI and battery on law enforcement. She appeared in court the next morning in custody where a judge found probable cause, declared her indigent, and appointed a public defender. Her bond was set at $1,000, which she quickly posted, securing her release later that day under a no alcohol condition. But within weeks, prosecutors quietly dismantled the case. On May 4th, 2023, the state attorney's office declined to file the felony battery charge and instead downfiled the DUI to a misdemeanor, transferring it to county court. The move effectively killed the felony case and by August the $1,000 cash bond was refunded to her shity. Wow. Well, that's why people do what they do, man. Overall, they get no punishment. No punishment. Man, that car was smashed up. Smashed up. And it's like it's not like whatever. She was bombed, man. There's no excuse for that. I mean, honestly, no excuse, man. But whatever. Um, yeah. So, I think the officers, they could have did better, man. I would have, man, I would have got her up out that car fast, boy. They they sitting there pussyfooting around. She playing around. Oh, I don't know my Miranda and all that. Like, man, man, get her together, man. This I feel like this dragged on a little bit too long, my personal opinion. So, I'm giving maybe a three out of five. Um, it was all right, but it dragged on way too long, man. Anyway, uh, let me know in the comment section how well you think the officers did. And, um, if you enjoyed this video, there's going to be another video right on the screen. So, you know what I'm saying? Click on that one. You feel me? You know what I mean? Rock out with your boy. So, I'm going to catch you in the next
