Two male subjects physically fighting. So you don't understand. Okay. The us talking to them, that's not a decision you get to make. She needs to get out of the shower and come talk to us. We have a second caller advised far lefthand corner by the trash can for large males. I'm not asking. If you want to go to jail, cool. You can go to jail for not assisting with that. Well, why do you have to talk? Because we got a call. They were slamming each other's heads in the car. On February 1st of 2025, a fight was alleged to have occurred in the parking lot of an apartment complex in early Texas. First reports claimed there was an active fight. Call notes also alleged that someone was quote slamming each other's heads into cars, adding that four large males were involved, two of which were fighting, with one attempting to break up the altercation. 204 204 making me aware of a disorderly apartment and two male subjects physically fighting in the grass area in front of us. They were slamming each other's heads into cars. 10. They're going to be on the side of the building near the shed. Brown County Sheriff dispatchers assigned Sergeant Contrarus and Officer Fletcher to the scene as more information about the suspects was sent to the officers. We have a second caller advised far lefthand corner by the trash can. Four large males. Two are going into a bottom apartment. One is running towards the tank. Subject two ran off. He's going to be in a brown jacket and camo colored clothing running towards the tank. The other two possibly went into Upon their arrival, Sergeant Contrarus parked at the rear of the complex, making his way towards the dumpsters. None of the described suspects were in view. I'm going to be out on foot. I don't see or hear anything. Received. After joining Officer Fletcher, the officers noticed a woman on her porch and approached her to ask questions. Hold up for a second. Y'all okay? Yeah. We had gotten a call that there was some sort of fight going on over here. We think in this corner. So, y'all were the only people we saw out and about. Just want to check with you and make sure everything's okay. I can hear. Okay. It's not me. Okay. Okay. Did you hear who it might have been or where it was? Come on. We're going to have to find out who is and at least talk to them. Make sure everything's okay. Whether it's y'all or somebody else. It's just yelling. She's drunk. He's drunk. That's all it was. He took a walk. Okay. Hello. That's it. Hi. How are y'all? Good. How are you? What up? Hey. Just coming to check on everybody. Same different day, bro. Yeah, seems like it. But are is everybody good? Oh, yeah. No jail for me today. I hope not. I hope not. You took a walk. She's in there. Everybody's chilling. So, is it not not you guys? It was somebody else that's hanging out with you. All right. Okay. The people that we had over them separated and we still got to talk to her and still got to talk to him. Oh, well, he took a walk, so I don't know where he went. Okay. Like, he took a walk. Okay. What's his What's his name? I think she's in the street. He's y'all's friend. We got He's my friend, but I can't do that. We got to talk to him one way or the other. Doesn't mean he's going I can't tell you. It doesn't mean he's going to jail or go figure it out. I can't tell you where he went. He literally took a walk to pull off. Okay. That's all I can tell you. Okay. What's his name? Just so we know who we're dealing with. His name is his name. Um, but I think she's in the shower. So, they both needed to cool off. There was too much drinking involved. So, you don't understand. Okay. The us talking to them. That's not a decision you get to make. You sassy So, he's out taking a walk. She's not. I need to talk to her. Yeah. Well, I don't know where the guy is, though. You need to go talk to her and tell her she needs to come talk to us. I'm pretty sure she's in the shower. I don't care. She needs to get out of the shower and come talk to us. I'm not asking. If you want to go to jail, cool. You can go to jail for not assisting with that. This was Officer Fletcher's first mistake. None of the parties present are detained and can simply walk away at any time. A citizen generally has no legal obligation to assist police in their investigation or compel others to speak with them. And the courts could find that threatening an arrest for failing to assist them may constitute retaliation for exercising the fifth amendment right to remain silent or the first amendment right to not engage. However, the officer's next actions may cause them bigger issues. Well, why do you have to talk to her? Because we got to call aid. Yeah, we got to call domestic. I don't understand. No one's hurt. We need to talk to her. I'm just trying to talk. Okay, that's cool. Whoa. Whoa. What are you doing? Pushing the door open. Chill out. I'm not pushing the door open. God damn. You just did, bro. Like, what the You hit my arm. you. I don't like you. We need to talk. You can suck a lot. Okay, we're done. He knows. He knows. I'm going to go see. I said I think she shower. So, let me go see. Aren't you? Hold on. Hold on. You're a sergeant, right? No idea who you are. You're a sergeant, right? Why are you blind? I'm asking a goddamn question. Are you blind? Are you stupid? No, we're done. We're done. We're done. Stop. Stop. You're detained. You're detained. Stop. You're underain. You're detained. Same Same Just relax. Just relax. We'll be good. We'll be good. Just relax. We'll be good. Let him let him let him relax. I want I want your Get your Okay, cool. Get your back. No. Yeah, you're crazy. I want your supervisor. He is the supervisor. There's someone. I've already called it and he didn't bring them. So, perfect. You're recording. Hell yeah. Yeah. Where is your supervisor? I am the supervisor. There's someone above you. I ain't going to call me out. Exactly. No, that's all you need to know. That's all you need. That's all you need to know. That is how it works. My boy Flusher knows. No, that's not how it works. We'll be good. We'll be good. I'm going to lock these so they don't tighten down on you. Okay. Here go, bro. I'm chilling. If I got to go, I got to go. I don't want anybody to have to go. Are you going to take me out so I can go talk to her or not? Is there any weapons here? Can you'all sit down? You want to sit down on the couch? Not at all. I'm chilling standing. Okay, just sit down. I mean, you done already enter the house. Just sit down. Why are you touching me? Can you Why are you touching me? Why are you just not sitting down in your own house? Because I've already had bad blood with you. Sit down. I ain't going to have bad blood. This ain't my house. So, I'm not going to sit down in my house. It's not our house. Well, can you understand? Okay, we're going out to the car. That's just weird. I mean, go on out to the car. Like, what the You get her. Get her. Come bring her out to the car. Didn't you say in the car? I'm not going to. No, I don't want to go to the car. I don't like closed faces. I don't want to go to the car. I don't want to go in a car. Put me in your car. I'm asking you a question. Making it more dramatic than it needs to be. Not at all, bro. I'm asking a simple question. Okay, there's the deal. It's called emergency aid. Yes. and I was going to go get her, but you're not going to push me when I'm going in. Under the Fourth Amendment, officers need a warrant, consent, or exigent circumstances to enter. If no occupant consents to their entry, and there were no clear exigent conditions, such as active violence or someone in immediate danger, their entry may violate the Fourth Amendment. The emergency aid exception to the fourth amendment warrant requirement allows police to enter a home without a warrant, but only if they have an objectively reasonable basis to believe that someone inside is in immediate need of aid. The entry is limited to addressing that emergency and the entry is not a pretext for investigating a crime. He pushed my arm out of the way when I went to go in. We're trying to go in. Okay. So, I'll go in the middle of the door and he was not letting us. I was going right past that. Yeah. argue this with us when we're trying to do and I asked for a supervisor. This is ridiculous. Man, I already told you I'm one. You're not getting another one. of you cuz you obviously aren't doing your job right. Which way do you want me to go? To the car with the lights on. I mean, there's plenty of cars with lights on it, dog. So, you're you're playing stupid games now. The neighbors and presumed callers can be heard yelling to the officers, attempting to tell them that they have the wrong people. I'm just getting you down here till we figure out what all I mean. Yeah, we've been figuring that out. All right. We haven't I mean, there's a seat in my way. What the are you on about? Sit down. Sit down. Right. Wrong people, right? Sit down. Thank you. Thank you. Keep going. Record it. [Music] They just keep asking us to do that we can't do. Hey guys, will you all go inside, please? Got me up. He knows it. No idea who you are. So the they said it's not their apartment. Whose apartment is this? It's that one. It's who? That one? No, it's not theirs. Okay. Is it yours? No, sir. Then who's is it? It's the girl you're wanting to talk to that won't come out. Okay. Hey, Fletcher. Yes. Can you come stay with them? Yeah. So, she said that the girl that doesn't want to come out is the owner of the apartment, right? Can you go with him and help him figure out what all's going on? I got to stay and supervise them. Right. Thank you. How would I be able to take a walk above mad? Yes, sir. What do you need? I need to talk to her. Can you stand right here? No, I don't have to. How do you not have to? I just told you it's called emergency aid. I need to make sure she is okay. She is okay. I need to see her. Your word is not enough. I don't know where she is. [Music] I haven't been in here. What is her name? She's in She's in the shower. You can hear it running. Yeah. Can you please come out? What? I'm Sergeant Contreras with the Early Police Department. I need to make sure you're okay. What? Hello? I'm Sergeant Conturus with the Early Police Department. I need to make sure you're okay. Okay, hold on one second. Let me get out of the shower. Okay. She was in the shower. Yeah, that's what they said. We don't want to go in there and bar in the shower, but we still have to talk to her before we can go. [Applause] Damn. See, that's the thing. I When we try to come inside, the big dude is still in the door. If we can just talk to people, we're cool. We can get out of here and leave everybody alone. But we have to at least talk to everybody. She's getting out of the shower. Oh, okay. Yeah. Well, he has to make sure that you're okay. He has to see your face. Oh, I'm okay. Okay. Uh, is she dressed? What's happen? We'll be out. She's in his house. What's happening? They have to make sure that you're okay before they We got several callers saying that you were fighting. Do you want me to go talk to some of the other talk to around there is not on. They have to have to hear from you before they Yeah. I just need to see you physically. Make sure you're not hurt. I'm not hurt. Okay. Just just put some clothes on and then come talk to me just real quick. Okay. Just real quick. Hello. Were you with the the other girl that was just out here? All right. So, do you know anything about what's going on in that? I have no idea. Okay. So, hang on one second. Have you been How long have you been out here? I didn't see you while ago. Maybe 2 minutes, maybe. I just walked up to my pick up to grab something. Okay. But I'm no part of this. I don't want to be no part of this. Okay. No offense. No, I understand. I understand. I know the girl here don't have No, she's not the one that starts anything. Hey, it's Fletcher. Can you hear me? All right. So, what was the last traffic you had? What's happening? Or shut the door. My underwear's in the top drawer. Underwear's in the top. from here. Okay. Was there a description or anything? Okay. Can you call back and ask, please? And I I'll stay on the line. Hi, ma'am. Hello. Uh, sorry. Okay. I do not care if you're intoxicated. I'm here to check make sure that you're okay. I'm fine. Okay. So let me just uh Okay. Go like this. Okay. Do you have any specifics on Okay. And what what exactly happened? Okay. Now you're just going to like go like this with your knee. The other one. Do you have your ID with you? I sure don't. Okay. I shouldn't be involved in this any bit. Okay. Well, we've got a witness that says you are, so I got to at least identify. I'm not a witness by any means. I just got here 2 minutes ago. How was that? My How am I witness, sir? Okay. We got several calls that you weren't physically fighting with somebody. Two male subjects physically fighting. I wasn't. Whatever happens outside this house, that's what I mean. There was And I was outside. There was no physical fighting. So, there was just verbal arguing. It was just verbal. Okay. Sir. Okay. So, nothing happened? No. Okay. I I don't want to be involved in this, please. Okay. I don't want you to have to be involved. We're getting reported that you're a witness or or a witness is reporting that you were involved with this. I ain't involved in nothing. So, I need I need your name, date of birth, ID, or something. Why am I being dragged into this? Honestly, I sat here by a pickup because I heard something going on. Okay. What's your first name? Christopher. I can see that you're fine. Yes. Uh, so nothing's going to happen to whoever you were arguing with. Who Who is that person, though? I don't know what you're talking about. I don't even know why y'all are here. I came inside, took a shower, got dropped off, came inside, took a shower, and then now y'all are here. Okay. I have no idea what's happening. Y'all got me on the Okay. The person Okay. The person that left is like, is that your boyfriend or anything? No. Who left? They the guys that are in handcuffs said that the guy left. He's not a boyfriend. No, I This is my apartment. What did you see specifically? I mean, throwing and everything else. That's why I come out here to make sure our pickups are okay. Which ones? Okay. Can you Okay. Can you describe them? I don't have anyone that lives here with me. I don't know. I have no idea. I got dropped off. Mhm. That I don't know what they're doing. Okay. Okay. Okay. Okay. Well, I'm glad you're okay. That's all we needed. Now, they're probably still going to go to jail for interfering. It's called emergency aid. Okay. What about the guy by the What about the guy by the white pickup? I have no part of any of this. I just showed up. How? I don't I have any idea. I'm just What What did he do? What did he do though? To our understanding, people were saying that you and somebody else were fighting outside. We have a second caller advised far lefthand corner by the trash can. Four large males. They were slamming each other's heads into cars. Okay. And uh when we got here, it looked like everybody was coming this direction from where the bicycles are right there. Right. Okay. We I was Yeah, I was inside. Yeah. And then I don't know whatever happens on the ground. Then they said they were only arguing. They were not fighting. I'm like, "Yeah, I understand that, but I can I just take your word for it." Okay, Christopher, if you would turn, put your hands on the back of your head. Turn around. What am I for? You're just being detained right now. Am I arrested? You're being detained. It doesn't I don't can't promise you you are or won't go to jail one way or the other. You are being detained. You may. I can't promise you. I s I talk to other people. I know you got this pocket knife on you. Are there any other weapons on you? That's all I have. Okay. Can I search your pockets and verify? Yeah, you sure can. All right. Okay. We need to physically see her to make sure that she's okay. Cuz that's what we worried about that that she's okay. Okay. You know, cuz let's say they don't want to get the other person in trouble, but before we left, you got stabbed and you ran inside and we're like, "Oh, oh, she's fine." I was like, "What? Oh, she's fine. Okay, I'm leaving." and then next day we find out, oh, there's a person inside that apartment. That's why it's called emergency aid. The emergency aid exception does not allow for an officer's imagination, no matter how vivid and creative, to create exigency without any reasonable connection to reality. But despite their inconsistent reasoning and vague witness claims, the pair that were arrested are not released. Okay. Now, so we tried to come inside so we could talk to you. So they got arrested, Trevor and Allison. They will block the door. They will not let us in. Yeah. So, and we tried to calm them down, too. If you need to sit down in the car, you can. It's up to you how So, can I be honest with you? So, I used to know that girl one time ago. I heard everything was going on. So, I'm staying with the girl right over there. And I walked over here cuz I heard some ruckus going on and that's all that happened. Yeah. So, two people guarded the door while y'all were trying to come in. Yes. Yes. We're trying to come inside and we told them we need to check on her. You know, you tell us come in here and do what we just did. Yes. That you and we told them this is the only thing we got to do. We got to see her talk to her and the people who brought me home. Okay. They are. Yeah. We all rode with each other home. Yeah. Yeah. Like I don't even live here. here. I live in Panka, Texas. I don't live here. You're just here for the weekend? Yes, sir. Okay. All right. Hang tight. Wherever y'all want to go, it's fine with me. And I'll be back in a second. Officer Fletcher returns to the apartment and the occupant realizes her dogs are now missing as the officers have left her front door open since forcibly entering her home. I hope they're still inside. I don't know. I was Thank you. We haven't seen any dogs either way. She's perfectly fine. Uh, she's saying she ain't got no dog. I don't see. So, even when we got here, there weren't any dogs in or out. So, if we had seen dogs, we would have left them. This one's about this big. So, you So, from what I'm hear, I got some other neighbors I need to talk to, but one of them I just talked to on the phone were fist fighting. Said that the guys were fist fighting. Oh, the guys. Okay. But they didn't say anything necessarily about her. Okay. So, I don't Let me go talk to some more neighbors. here. I shut the door. That's all I know. All right. Thank you. You can shut the door now. Are you What's your name? Okay. But Okay. Hopefully we don't bother you right now again. [Applause] The officers now talk to supposed witnesses. Did either one of y'all see how all this started? I just know it started like 12ish. Did y'all see anybody hitting each other? Um, I know there was two guys out there. I don't know who it was, but there fight back there, but I don't know. Okay. So, I I know there was a fight going on, but I need to know specifically, did you see anyone hitting one specific person hitting another specific person that I heard like like slapping and punching, but I didn't know who, but y'all didn't see anything? I don't know. With still no evidence of a physical encounter, the officers meet to share information and discuss their next steps. The closest thing we would have would be boing. So, this guy trapped this trying to say he wasn't involved at all, that he just came out here cuz he heard all the yelling and hollering and he used to know this girl in this corner. Um the lady that was the witness over here is saying that yes he was specifically that him and she said the two guys that I have detained my car fist fighting she realizes the guy and a girl but she says that those three were fist fighting each other. The witness that first called now returns to the apartments. Now I called cuz they woke up my kids too. Yeah. So we we know that there was a there was a fight of some sort. We've got that. What we need to specifically is who was hitting who. Okay. So, the guy in the flannel shirt that's standing out there. He had a brown jacket on at the time. Okay. He had the other guy and was banging his head. Like the big tall Mexican guy. Okay. What about the other the lady that's with him? That's his wife. She was trying to stop it. So, she was trying to help. She was telling y'all stop this and they weren't she wasn't involved. Did she get She wasn't getting hit or hitting anybody. She was just trying to help. She was trying to stop it. My father and I tank, you know. Oh, are you going to jail? I am. Yes. We have a different colors identifying you as the other half that was fighting. I really hope you're joking cuz that is not true. They can pass it right there. That's what they said. No sir. Mhm. They said y'all were fighting over there, then you took off walking. No, sir. went and dropped the jacket. And I've got the person that was with me that dropped me off over here. They can vouch for it, too. He's right over there on the next street over. Okay. I mean, I can vouch for the person that brought me over here and that dropped me off to come pick somebody up to see if they were doing okay. Like, I'm not I didn't drive. I didn't do anything. And they could be for it, too. I came walking up. I didn't fight. I didn't do anything. All right. Was there anybody else that confirmed that? I I promise I I didn't do anything. They were saying I watched them walk up here. Yeah. Yeah. I swear I didn't I didn't fight. You check my hand. You can check anything. I didn't do anything. Well, they were saying that you were here. You were originally wearing a tan jacket that you were here for the first go around. Then you left and came back. No, sir. I've got a hotel in town. That's the truth. I swear on everything, sir. All right. I did not do anything. I promise. Okay. He's checking on me. Okay. Like you can check my hands. You can verify with him. Anybody else? [Music] [Applause] Hey, sorry. How do y'all know Mr. Who? That you speak bad. I'm not going to lie to you, man. You're not early warrants. Does he really? Yes. Does he? Yeah. I don't know about that. Hold it. Okay. I'mma go check on that. That way, by the time he clears you, I clear you, too. And you don't have any. Just a friend. A friend. He was going to come here and hang out before she got sideways. Okay. So, he has no idea about anything. So, he wasn't here when things got not at all. Like when y'all showed up, y'all were already here and then I saw him. I was like, "Dude, you need to go." At this point, only one caller claims to have seen a fight, while multiple others insist it never happened. After checking each individual for injuries and any sign of a physical altercation, the officers finally begin to realize the fight likely never occurred. But in a lastditch effort, Sergeant Contrarus leaves the scene, heading back to the station to run warrant checks. Meanwhile, Officer Fletcher roams the fields around the apartments, still searching for a jacket he hopes will tie the man standing next to the white truck to the call. He never finds a jacket. And after nearly an hour of detention, they let the man go. You know, it was not him. Yeah. So, there's him and another guy that were fired, but it's not this guy. Okay. All right. That's all I need to know. Thank you. Was released. He has a rod coming to pick him up. Uh, no signs that he was involved that we can confirm in the uh, disturbance. Take care, man. Keep making that money. Yes, sir. But the officers had other plans for the first couple they detained earlier that evening. There you go. My bad, man. Oh, just going to that guy over there. Okay. What's going on? You ready to step out? Where are we going? We're going to jail. Why interfering? I didn't interfere with anything. We got to come to this story so we can put it together. And he's been like calm and cool the whole time. Yeah. I'm If that guy would just like chill, we could have been done. Yes. We could have just walked in and go talk to her and but they decided to stay in front of us and not move. They start arguing. All right. Are we good? Yeah. In midApril 20125, the state motioned to dismiss the case, dropping the charges levied against Trevor and Allison because there was insufficient evidence.
