out for a walk with his friend around midnight when they were pulled over and interrogated about their endeavors the original interaction was not captured on video but is referenced by the officers the second time they are detained for walking so we're just minding our own business walking down the road and uh getting some exercise in and i guess we're getting pulled over well it's 11 20 or 12 20 at night and you're out here walking up the road well yeah man you weren't around here yeah we're adults we're adults so where do we live at i'm not discussing my day huh i'm not discussing my day i'm not asking you to discuss your day i'm asking you where you live take hand out your for me thank you you can record all you want i'm recording as well cops will often use the time of day to suggest that they have reasonable suspicion to detain a person or persons and compel them to answer questions as previously covered on the show reasonable articulable suspicion is what an officer needs to perform an investigatory stop including this stop the officer has not stated that the men are detained but it is certainly implied by his use of emergency lights at the moment the men have no legal responsibility to answer any of the officer's questions walking up the road after midnight may be suspicious to some but without other indicators that a crime is afoot walking at night is just that walking at night and alone does not offer any reasonable inference of criminal wrongdoing as far as recording always ensure you record your own encounters do not leave it up to state officials remember that they were also recording jeffrey epstein's cell what do you guys live at it's not gonna happen in your business okay so we've had cars broken around broken into around here yeah and we don't have any we're just out here walking around and mounting our own business walking around exercising as you can see trying to use some weight where were we all stopped at we're stopped at um we suv yeah he's coming up here so who are you guys and what are you doing here we're walking man where are you walking to anywhere we're adults we're adults we're just walking and whenever we decide to turn around we'll turn around and walk back i'm about to be 21 july about to be 21. okay how old are you i'm not just discussing that with you i haven't committed a crime okay well you're not leaving until we without suspicion of criminal wrongdoing the sergeant tells the men twice that they are not free to go because they are curious about why they are walking this is a solid example of deputies interfering unduly with personal choice law enforcement is the most conspicuous form of government the police powers granted to them do not extend them extra rights detaining someone because of your curiosity without reasonable suspicion or probable cause is 100 tyranny and is a disgrace to the founding ideals a complete 180 from the concepts that birthed this nation so we got three police cars done pulled up we haven't committed a crime they haven't articulated any crimes that we have committed i'm not accusing you of the crime okay he says am i free to go walking no you're not someone who's gone we told you why you why we were walking okay the only thing that i ask is where do you guys live at well why do you need to know that well because if you don't live around here i'd like to know why you're here i live in clarksville and we both live in clarksville are these two that you dealt with earlier they are and were they smart assets just like they're being now a little bit yeah i apologize for yet another interruption but the only rude person involved in this interaction is the sergeant what appears to be the supervisor on scene is the only one using derogatory language his disrespect for his employers is embarrassing and the fact that he is in a leadership position is sickening well the second time we got stopped and now we're just walking and he's walking over you guys don't understand we have a job to that we don't recognize people that we don't see every day okay we've had vehicles broken into we've had businesses broken into am i accusing you that no i'm not i don't i'm just asking who you are where do you live and why are you out here walking because we can okay especially at 12 o'clock night because we can we're adults because we can't yeah i mean is it illegal yeah it's it's not illegal there you go but so why am i being detained i just told you why because trying to figure out what you're doing here we just told you yeah we told you multiple times we haven't committed a crime uh you can't really legally detain us unless we have committed a crime ah are you saying that i'm not being detained freely all right thank you thank you very much durango and his friend were eventually released from their unlawful detainment and the only outcome of this sergeant's interrogation was to further the divide between law enforcers and the public let me know
