Don't give me an attitude cuz I'll make it very difficult for you. Am I being detained? Yes, now you are. Where's the firearm? It's in my waistband. They kept reaching for it. I wasn't reaching for anything. Is he wearing it? I'll go with you on the Constitution. I know it very very well. All you would have had to do is give me your driver's license. How simple that could have been. YouTube is not always right. You ask me how you got here, I'll tell you how you got here. I got here by telling you. Exactly. told me no. Tyrannical, dude. Welcome back to the Lackluster channel. In March of 2025, a viewer named Trevor was riding his bike when officer Daniel Neaggermith pulled out from a side street without coming to a complete stop. Fearing that he wouldn't be seen by the officer, he yelled out to ensure he wouldn't be struck by the vehicle. Sergeant Neggermith appears to have taken the insult personally as he immediately activates his emergency lights and [Music] tones. Trevor stops and waits for the officer. Why are you riding with those things on your head? Sorry. Not allowed to ride with those things on your head. It's not a law. Yes. You want me to give you a ticket to show you? Florida statute 316304 prohibits operating any vehicle, including bicycles, while wearing headphones. However, an exception allows cyclists to use them when connected to a cell phone, provided that one ear remains unobstructed and allows pass through audio. But once Trevor appears in frame, it's obvious the headphones aren't even covering his ears. But that doesn't stop officer Neggermith from invoking the statute to enforce his ego. And now, seven officers raced through city streets, lights and sirens blazing to respond to the highstakes emergency of someone wearing headphones on their head. Don't give me an attitude cuz I'll make it very difficult for you. Take your hands out of your pockets. Why are you all over the street? Am I being detained? Yes, now you are. Can I see some ID, please? under. Put the bicycle down. What? What did I What crime did I commit? I will explain it to you once you give me your identification, please. What crime did I commit? Put the bicycle down and then stand over. Do you have reasonable and articulable suspicion? Yes. Probable cause? No probable cause. What is your reasonable suspicion? Stand over the bicycle. What do you mean stand over it? Stand over the way you were. Why? Because I'm asking you to do so. What is your reasonable suspicion, sir? Don't pick the bicycle up. You just said stand. Can I see your driver's license again? Confused. Are you filming? Registration. What is your reasonable suspicion? Can I have your sergeant? I am the sergeant. What is your reasonable suspicion? I'm going to ask for your driver's license one more time. And then what? And then we'll discuss it cuz I wonder who you are, sir. No. Under what law did I break? Cuz I had headphones on while I was riding a bike. That's a law. Can you cite the the I will once you give me your ID. No, sir. Okay. I'm not going to give you ID if you don't tell me what law I broke. Are you recording on your camera? Yeah. Don't take the bite off the camera. I'm going to ask for your ID one more time. No, sir. No. Under what law? Grab a seat on the ground, please. Under what law? Is that a lawful order? Yes. Under the intention of arrest, sir. Under Is that a lawful order? 423. Copy. 1050 on a bicycle. It's going to be Cleveland and Betty. It's going to be white male, brown shorts, gray shirt, red hat, black bike. If you could send me another unit as well, please. So, I'm going to ask for your ID one more time. No. Okay. I I don't believe I committed a crime. And you can't crime. Okay. Then why am I being civil right now? Civil violation. Then why am I being detained right now? Right now it's going to be obstruction. Obstruction for what? Because I've asked for your identification. Are you filming? Can you turn your body camera on, please? 100%. It's I don't see a light or anything on there, sir. It's recording you. So is that. Can we have another officer here? We're coming with another one. Sir, you can have him. I don't feel safe right now, man. I didn't commit a crime. You're detaining me for no reason. You almost pulled out in front of me over there and I said something. So now you're abusing your authority. No, I'm not really doing that at all. I've asked for a driver's license and I said no. Under what? Under what what crime did I commit? I've explained to you wearing headphones on your bicycle. Okay, then then that's enough. You said it was a citation and not a crime. It's not a crime, is it? Oh, then then you have no lawful reason to to ask me for my civil violation. No, sir. I'm going to ask you to sit down one more time. No, sir. Is that a law? Are you under Is that under the threat of arrest? It could be because my next You do not give me your identification. If you identify yourself at this time, sir, I will arrest you for obstruction. So, I'm asking you now to sit down, please, because you're making me nervous. [Music] I'm asking you to sit down. Is that a lawful order? Yes. Under the threat of arrest? Yes. I want to let you know I do have a weapon on me. That's what I figured. Yeah. I'm a concealed weapons license holder. That woman you going to tell me that's had a firearm on you? I'm under the threat of arrest. Well, you look could be happening right now. I didn't commit a crime because I've asked you for your ID now seven times. I didn't commit a crime. Sir, you're riding your bicycle with those headphones on. Is that a crime? You said it was a citation. Is it a misdemeanor or a felony? It's a violation. Is it a misdemeanor? Enough for me to stop you to talk to you about recording this. Where's the firearm? It's in my waistband. Appendix K. You kept reaching for it. I wasn't reaching for anything. Got to put your hands in your pockets. It's loaded. There's one in the chamber. There's one in the chamber. It's loaded. Okay. Okay. Other than prior to Sergeant Negersmith telling Trevor to remove his hands from his pockets prior to being detained. Take your hands out of your pockets. Trevor never attempts to reach for a weapon or move his hands towards his pockets. But before we continue, have you ever seen two completely different headlines about the same event? We're currently drowning in information and most of it is filtered through biased lenses and clickbait. And if you're watching this channel, you already know how important it is to question the narrative. Which is why Ground News has been one of the longest sponsors of this channel, an ad-free platform that lets you see how stories are being reported across the political spectrum. You can compare headlines, check source bias, and even see what stories are being ignored by the side you usually read. Let me show you an example of a case I'm following. Ground News pulls in over a dozen different sources for this one incident. And look how differently they frame the same facts. The Boston Herald on the right focuses how the officers were frustrated when they fatally beat Tyrie Nichols, while News 1 on the left says that one of the ex cops regrets not stopping the Tyrie Nichols beating. With ground news, you'll see the bias rating of each source. Access the blind spot feed to find stories the mainstream is missing and even track your own reading habits with the my news bias dashboard. So if you want to break out of the echo chamber and make your own informed decisions, click the link in my description or head to groundnews.com/lackluster. And for a limited time only, you'll get 40% off the Vantage plan. That link supports the channel and get you unlimited access with no ads ever. The media has an agenda. Your job is to see through it. Ground News makes that easier. And now back to the story. Where's the firearm? It's in my waistband. They kept reaching for it. I wasn't reaching for anything. Put your hands in your pockets. It's loaded. There's one in the chamber. There's one in the chamber. It's loaded. Okay. Okay. Anything else? Uh, I have I also have a medical marijuana license and I have medication. He hasn't identified himself, so I'm going to charge him with obstruction. Obstruction for what crime? For not identifying yourself upon request. This is This is against my constitutional rights. No, it's not. This is against my fourth amendment right? It absolutely is. Absolutely not. What crime did I commit? I already explained to you you were riding your bicycle with those headphones on. Is that a misdemeanor or a felony? It's a traffic citation. Stand up. I have the right to detain you. [Music] What's going to happen to my bike? It's going to get impounded. Okay. Firearms going to get taken. Okay. Are you using any kind of medical marijuana today or? No, sir. No. But you have medical marijuana card. Yes, sir. All right. Are your eyes normally pin drops? What do you mean? Are they normally really tiny? Do you use any other medic? My right to remain silent. I'm sorry. I'm going to exercise my right to remain silent. Cuz what I'm going to do is I'm going to bring another officer over here too to come talk to you. 581. My wallet is in my bottom right hand pocket. 15. [Music] I'm good. Thank you. I'm sorry. So, where's your identification, sir? Cuz it would have been real easy just to give me the ID. Um, I can take you under that. Thank you. Are you guys body cams on? Yes, sir. Thank you. [Music] Trevor, how hard would have that been? Trevor, anything you might have missed, sir? No, sir. Okay. Just going to double check. Okay. Yeah, man. Thank you, man. made it there yet. Yeah, he hasn't made it. He almost pulled out in front of me and I yelled at him. So, he pulled me over. Probably didn't hear the white concerns cuz what? No, I pulled over right away. Okay. Right. Valid license 1054 1029. Buddy, are my headphones on my head still? Yeah, I'll take them off. Yeah, there's one. Trevor was placed in a cruiser to wait for a drug recognition expert to arrive on scene. Sergeant Nagger Smith then approaches to speak to him once more. All right, sir. So, so you just believe what I'm telling you. So, it's you don't think I am lying to you. It says right here, "Wearing headset, headphones, or another device when driving a bicycle. It's against the law." Is it a misdemeanor? No, it's a simple traffic citation. Okay. So that all you would have had to do is you would have been I would have probably given you a warning and none of this would have happened. But you decided to be obstinate and wouldn't give me any information. Just exercise my rights. What right do you have? I you have the right to be identified. But I I And then you're carrying a firearm. You're sticking your hands in your pockets. I told you. You were making me nervous. License holder, man. Whether you are or not, they're still a responsible gun holder. You're supposed to be responsible. What are the things they do tell you? I'm being responsible. I'm also a responsible American by exercising my rights. Sir, I'm gonna I'm gonna stop talking. Well, I'm not gonna argue about Constitution. You We I'll go to town with you on that. Arguing. I'll go I'll go with you on the Constitution. I know it very very well. You're playing with the wrong officer as far as that goes. Now, you're going to be charged today with the minimum obstruction, resisting without violence. I asked you for your identification multiple multiple times. you refuse to comply with my lawful order. You're going to be issued that citation and I have an officer coming over here to examine you for driving under the influence because I I suspect there might be some impairment in you as well. So, I'm going to have you talk to that officer and I'm going to remove myself from that part of the investigation. As they talk, the other officers joke about having to clear six calls for service to respond to the case of the decade. A man with headphones on his head on a bike six calls out. What's that? Did you clear offic? Moments later, Officer Hayes, a drug recognition expert, arrives on scene. Trevor. Yes, sir. Hey, I'm Officer Hayes. Hi. Um, I just got here, as you can see. Okay. Okay. What What's happening to you, man? Uh, I'm I'm I'm going to retain my right to remain silent. Okay. Well, you understand why you're being detained right now, right? Is he being around? Just hold on a second. Hold on a second. despite clearly and unambiguously requesting an attorney. [Music] Coupled with his previous statement that he would like to exercise his right to remain silent. I'm going to retain my right to remain silent. Officer Hayes leaves to obtain a Miranda card to read him his rights and continues questioning him. All right, Trevor, I'm going to read you something real quick. Is you are being detained for obstruction. Okay. You have the right to remain silent. Anything you say can be used against the court of law. You have the right to talk to a lawyer. Have him impressively with you while I be in question. If you cannot afford to hire a lawyer, one will be appointed to represent you 40 questions if you wish. Okay. You decide any time to exercise these rights and answer questions or make any statements. Do you understand each of these rights of explained to you? Yes. All right. So like I tell you I do not I I don't wish to answer any questions or anything. I'm not going to ask any questions but however I'm going to explain why I'm here. What I'm going to be asking of you. Okay. So, I got called here to make sure you're safe to be operating a bicycle. Okay. That being said, I'm not going to ask you any questions, but are you willing to do some filter writing exercises for me? No, sir. All right. So, let me explain. Okay. I had to make a decision based on my observations right now. Okay. And the officer's observations. Yeah. Why why I got called here. Okay. Okay. You failing to participate in these uh fail soy exercises that I'm asking you to perform can be used against you criminally. Okay. And I have to make an arrest decision. Do you understand that? I'm not sure why I'm being asked to perform a field sobriety test. All I was doing is riding my bike home from the beach. Most people don't realize that field sobriety tests are completely optional in most states. But participating in these tests can be used against you in court, even though they're highly subjective and notoriously unreliable. However, in some jurisdictions, if you refuse to take FSTs, your refusal can be used against you to suggest your hiding impairment. But while you're not legally required to submit to these tests, officers can still arrest you based on other observations while you're detained. What happens if I refuse? I've already told you I have to make an arrest decision based on my observations. And you're not dispelled my fear that you're not under the influence. Okay. I mean, I'm not under the influence. Okay. So, would you like to perform these filter to bright exercise? Uh, I I'm going to exercise my right to stay here and and remain silent. Okay. You don't have to answer the questions, but I That is a question, right? I'm not going to ask you any questions, but I'm going to ask you to perform the filter writing exercises. No. You don't want to perform them? No. Okay. So, at this point forward, I am going to be placing under also charging you arrest for what? Charging you a DUI. Okay. Do you understand? No, sir. I'll I'll fight this in court, I guess. Okay. Do you want to provide a breath sample? No, sir. I'll fight this in court. Okay. Do you want to provide a urine sample? No, sir. I'll fight this in court. I remain silent, I guess. All right. One more thing. He's got He's been arrested. Yeah. All right. Trevor was transported to jail where he was questioned even further and requested to perform field sobriety tests. All you would have had to do is give me your driver's license. How simple that could have been. I don't understand it. I really don't. YouTube is not always right. I didn't even know you were cough. I I thought you were going to pull out, so I just yelled. I yelled. I was thinking the fact, you know what it was? I saw the headphones and I'm like, "Oh, look at that. We need to have a talk cuz I don't need him getting killed." Here's the thing. I All I do on this in this agency is I do uh DUI and I do traffic homicides. That's all I do. And I write a lot of tickets and I know the traffic laws very, very well. And the last thing I want to do is see another bicyclist get hurt on these highways. You know what I'm saying? And all I was trying to do is educate you. And I just I I really didn't want it to go that way, you know? I'm not ones to put my hands on people. I don't I don't like to do that stuff. I like to educate people and send them send them on their way. You're driving on the highway and you had the headphones on, right? So, that's a conversation you and I need to have on the floor. Let me finish. They were on. My phone was dead. Nothing was even working. Were they even over my ears? Yes, they were over your ears. Otherwise, listen. I am not going to waste your and my time. You ask me how you got here, I'll tell you how you got here. I got here by telling you exactly. That's brutal. Tony, no. Tyrannical, dude. And I could make it a lot worse. And honestly, I would have debated with the constitutional law with you all day. I'd love to talk about the constitutional law. I'm sorry, dude. I'm very trying to ride my bike home. You know what? You would have been on your way. You would have been on your way. You wouldn't even You would You and I probably would have been saying you would have said, "Thank you very much, sir, and have a good day." Go find salt, officer. As long as you learn, that's all I want. I want education. I wasn't being disrespectful to you, though. No, I think what it is, you're you're misguided. You're misguided by whatever whoever instructed you. Nobody instructed me. But wherever you got that information from, that's totally incorrect. Like I said, it's one of those things that if you would have continued to be negative, then we probably would have complied with some more extra additional charges for that. We're not all bad guys. I I was just scared that you were going to pull out in front of me. That was it, man. So, I yelled. I saw you. That was the whole thing. Yeah. Well, yeah. I I don't know. I I I apologize for yelling at you. Grab a seat inside there. Is there a bathroom in there? Yes, sir. Trevor was charged with DUI, resist, obstruct, delay, and wearing headphones. He ended up paying the fine for the headphones, but fought the other charges, which were dismissed in May of 2025. As always, let me know what you think in the comments.
