A cop gets on his loudspeaker and claims that he prefers not to write a bicyclist a petty ticket. >> There's a bike lane. >> Here you go. You're obstructing traffic. >> I prefer not to write a ticket for obstruction. And yet there's people riding in the bike lane. So why don't you get money out of those people? >> Gosh, I wonder what ends up happening. You're an adult. I've got a question for you. As you navigate through life, who is responsible for your safety and well-being? I'll give you a hint. It's not cops. According to the two cases, DeShaney versus Winnebago County and Gonzales versus Castle Rock, police officers have no constitutional duty to protect any American at any time, even if there's a restraining order, even if there's a history of abuse as in DeShaney. So when these guys claim they're pulling you over to keep you safe and then they proceed to try to cite you and fine you while they're harassing and detaining you, you can know for a fact that they're lying. Bicycle Gladiator was pedaling down the road minding his own business, obeying all the traffic laws, when he gets pulled over by a cop who makes the excuse that he doesn't want to see him get run over by a car. He wants to make sure that he's safe. Let's take a look at this from the top and maybe make some comments along the way. >> There's a bike lane. >> Here you go. You're obstructing traffic. I have a problem with bicyclists riding in the bike lane. Full of trash. Go over the sidewalk. Is this a lawful stop? No, it's not. What's the infraction? What's the infraction? By the way, this is IMPD and in the state of Indiana, there's no law code or statute requiring bikers bicyclists to use the bike lane. They can use the road, they can use the bike lane. There is no law prohibiting them from using the road when there is a bike lane. So, what happened here is the cop got his feelings hurt and this is a retaliation stop, pure plain and simple. What's the infraction? Before you go any further, is this a legal stop? What's the infraction? What's the What law did I break? I hurt your feelings. That's not a law. They haven't They haven't They haven't cleaned this since they put it in. Apparently, you don't. I understand that it's dirty. What you need to do is give me your ID or you can go to jail for physical identification. I'll take that charge, bro. This is This is illegal. I committed no infraction. This is crazy. What's your name? Bro, I don't have to identify. I don't. What's the infraction? Name and badge number. Now the cop is going gloves on. When that happens, it's highly likely that your rights are about to get trampled and another man is going to put his hands on your body. Because there is zero lawful reasons for the traffic stop, there is zero lawful reasons to identify yourself. No crime has been committed. This cop doesn't suspect that a crime has been committed. He's making everything up because his ego is bruised. Oh, and he's now blocking traffic. So I stopped reaching around in the back. You want my ID. You kept refusing to. Don't reach around in the back. Now you can give me your name. Okay. What's your last name? Last letter of my last name is T. What's your last name? I'm I'm telling you telling you what my last name is. The second letter of my last name is U. We're not We're not playing this game. Why aren't you writing this down? Is your body camera running? This is crazy. I'm requesting a sergeant. Can I get my ID? God, you [ __ ] [ __ ] God. All right. I hope you I hope you don't like your qualified immunity, bro. Figure it out, bro. >> And what you were placed under? Sit tight for me. >> Now, I kind of wish he'd made him say, "If I don't give you my ID, what is going to happen to me?" Make the cops say it. If you're going to relinquish your ID for an unlawful traffic stop, an unconstitutional stop, dig some pits for the cop and let him fall into them by himself. But don't just relinquish your ID. Get him to tell you what's going to happen if you don't give him ID. >> You know this is illegal. What's the infraction? You still haven't told me. Exactly. Got to be in the bike lane. [ __ ] It's a Fourth Amendment violation. Everything's been recorded. Do I have to tell you again? >> Yes, please. >> Legally? Law- Okay. Can you find out what the infraction is for me? >> Yeah, man. I'll be back here in a second here. You got lights? >> Yeah. >> Before we get back to the video, I just want to make something very clear about Indiana bicycle laws. Bicyclists may, but are not required to use usable bike lanes. They can choose to ride in the regular lane of travel instead. Bicyclists must generally ride as close as practicable to the right-hand edge of the roadway when moving slower than traffic with exceptions. They have the right to occupy a full travel lane when it's too narrow for safe side-by-side sharing with motor vehicles. Official sources like the Indiana Department of Transportation explicitly note, quote, "A bicyclist is not required to ride in a designated bike lane. Bicyclists have the right to use either the bike lane or the travel lane." And this comes straight from in.gov. So, the cop is operating 100% on ego as he deprives this guy of his rights under the color of feelings. >> I was in the I was in the uh I don't know. In the street, I guess. Cuz they haven't cleaned this since they put it in. >> Oh. I mean It's not too bad. I don't I don't know what uh you have against the police. >> Uh Fourth Amendment violations. That's what I have against you. >> I don't know what you could possibly have against police as I initiated an action against you that would legitimately give you a problem with police. This is insane. >> I want you to get hit by a car. >> You don't have to worry about it. The Supreme Court's ruled on that. >> There's a bike lane for that, okay? >> This is This is a This is more like a gutter. >> I think it's nice, dude. What do you mean? This is >> I don't I'm not trying to get a flat tire. >> There's There's leaves. >> What happens when I when I get flat tire and then I get robbed? >> What happens if a car Okay, that's what I'm >> That's what lights are for. We've been doing this 100 years in the street. What are you talking about? Quit copsplaining. The pig norance is is >> What has happened before for you to >> Fourth Amend- It's just you. Don't gaslight me. Don't gaslight me, okay? It's you right now. >> Whenever I first >> Fourth Amendment violation. >> It'd be like a rapist saying to his victim, "What have men done to you to give you such a bitter taste in your mouth somebody who wants to take advantage of you. Those blue lights may be on, but nobody's home. >> to the bike lane. >> You don't You don't get You don't You can You can ask. You can ask me. >> Okay. And then you still didn't move and I told you that I was going to pull you over if you didn't move in the bike lane. >> And what is the infraction? >> Bike lane. You're not in the bike lane. >> That's not a law. >> All right. You can start looking some stuff up. I'm sorry that I'm not even going to talk to you anymore. >> You should probably be looking up. Your qualified immunity's going to be tested, sir. Name and badge number. What happened to that? I didn't think so, [ __ ] Sorry. Whole thing's on video.
